Circular No. 11/2023/TT-BTTTT guiding the work of competition and reward in the Information and Communications sector

CIRCULAR

 GUIDELINES FOR COMPETITION AND RECOGNITION WORK

IN THE INFORMATION AND COMMUNICATION SECTOR

Pursuant to the Law on Encouragement and Reward No. 06/2022/QH15 dated June 15, 2022;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Personnel Department;

The Minister of Information and Communications issues this Circular guiding competition and recognition work in the Information and Communication sector.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed implementation of Clause 4, Article 24; Clause 3, Article 26; Clause 3, Article 27; Clause 3, Article 28; Clause 6, Article 74; Clause 2, Article 75; and Clause 6, Article 84 of the Law on Competition and Recognition 2022 in the Information and Communication sector.

Article 2. Applicability

This Circular applies to collectives, cadres, civil servants, public officials, workers at units under and directly subordinate to the Ministry and the Information and Communication sector; collectives and individuals with achievements contributing to the construction and development of the Information and Communication sector.

 Article 3. Responsibilities of agencies, organizations, units, and individuals in competition and recognition work

1. The Personnel Department is the permanent agency of the Competition and Recognition Council of the Ministry of Information and Communications, responsible for:

a) Taking the lead and coordinating with agencies, organizations, and units in the Information and Communication sector in advising and proposing to the Minister to issue Circulars, Directives, Decisions organizing and implementing competition and recognition work; programs, plans, measures to organize competition movements; guiding, urging, inspecting, summarizing, and concluding competition movements and recognition work; promoting exemplary models and good deeds in the Information and Communication sector.

b) Reviewing files submitted to the Minister for recognition within the authority or submitting to competent authorities for recognition of competition titles and forms of recognition according to the laws on competition and recognition.

c) Being responsible for the results of advising and organizing the implementation of competition and recognition work in the Information and Communication sector.

2. Heads of agencies, organizations, and units in the Information and Communication sector are responsible for leading and coordinating with Party committees at all levels, Trade Unions, Youth Union to concretize contents, targets, measures to organize competition movements, inspecting the implementation, summarizing, and concluding competition movements, promoting exemplary models, recognizing awards, and proposing higher-level recognition of competition titles and forms of recognition according to the laws on competition and recognition; being responsible for award decisions and proposing higher-level recognition; suggesting innovations in competition and recognition work; providing opinions when requested by the permanent office of the Competition and Recognition Council of the Ministry of Information and Communications.

3. News and communication agencies are responsible for regularly propagandizing the Party's policies and State laws on competition and recognition; propagandizing about competition and recognition work; propagandizing about exemplary models and good deeds; outstanding individuals and collectives in competition movements to set examples, promote, and disseminate learning; promptly reflecting and combating violations and negative behaviors in competition and recognition work.

4. Agencies, organizations, units, and related individuals strictly comply with the provisions of the laws on competition and recognition; bear responsibility before the law for reporting achievements and establishing recognition files.

Chapter II

OBJECTS, CRITERIA FOR CONSIDERING AWARDS OF COMPETITION TITLES

AND FORMS OF RECOGNITION

Article 4. Title "Advanced Worker"

1. The title "Advanced Worker" is awarded annually to individuals belonging to agencies, units, enterprises under the Ministry who meet the criteria specified in Clause 1, Article 24 of the Law on Competition and Recognition 2022.

2. Only individuals who are state civil servants, public officials; workers with fixed-term contracts of one year or more; these individuals must have worked for ten months or more during the recognition year.

3. Individuals sent to short-term training or enhancement courses under one year, completing the course and complying with the regulations of the training or enhancement institution, their study time will be counted towards their working time at the agency, organization, or unit for consideration of the "Advanced Worker" title. In cases where individuals are sent to training or enhancement courses of one year or more, comply with the regulations of the training or enhancement institution, and achieve satisfactory grades or better, they can be considered for the "Advanced Worker" title.

4. Female employees on maternity leave according to the State's regulations and those who bravely save people or property, or those serving in combat roles due to injuries requiring medical treatment or rehabilitation according to the conclusion of health authorities, their leave time will still be counted towards consideration for the "Advanced Worker" title.

5. For individuals transferred to new agencies, organizations, or units, the new agency, organization, or unit is responsible for considering and awarding the "Advanced Worker" title. If the individual has worked at the previous agency for six months or more, the opinion of the previous agency must be obtained.

6. In cases where individuals are transferred or seconded to other agencies, organizations, or units for a certain period, the decision to consider and award the "Advanced Worker" title shall be made by the agency, organization, or unit that transferred or seconded the individual, and confirmed by the receiving agency, organization, or unit regarding the proposed award achievements.

Article 5The title "Flag of Competition of the Ministry of Information and Communications"

1. The title "Flag of Excellence of the Ministry of Information and Communications" according to the annual regular competition movement shall be awarded to collectives leading the competition movement of clusters and groups organized by the Ministry of Information and Communications, meeting the standards prescribed in Clause 1 of Article 26 of the Law on Competition and Rewards 2022.

2. The title "Flag of Excellence of the Ministry of Information and Communications" shall be awarded to collectives leading the thematic competition movement launched by the Ministry of Information and Communications with a duration of implementation of three years or more when concluding the competition movement.

3. The subjects, criteria for awarding shall be specifically stipulated by the Ministry of Information and Communications according to each competition movement.

Article 6. The title "Outstanding Labor Collective"

1. The title "Outstanding Labor Collective" shall be awarded annually to agencies, units, enterprises under the Ministry; departments and equivalent units directly under agencies, units, and enterprises under the Ministry that meet the standards prescribed in Clause 1 of Article 27 of the Law on Competition and Rewards 2022.

2. The subject for awarding must have officially operated for ten months or more in the year of commendation.

Article 7. The title "Advanced Labor Collective"

1. The title "Advanced Labor Collective" shall be awarded annually to agencies, units, enterprises under the Ministry; departments and equivalent units directly under agencies, units, and enterprises under the Ministry that meet the standards prescribed in Clause 1 of Article 28 of the Law on Competition and Rewards 2022.

2. The subject for awarding must have officially operated for ten months or more in the year of commendation.

Article 8. Certificate of Merit of the Minister Ministry of Information and Communications

1. "Certificate of Merit of the Minister of Information and Communications" for outstanding achievements regularly every year:

a) Awarded or posthumously awarded to individuals belonging to agencies, units, enterprises under the Ministry who model themselves after good policies and laws of the Party and State, having been twice consecutively awarded the title "Model Worker at the Grassroots Level" or having been continuously recognized as excellently completing tasks for two years or more during which time two initiatives have been recognized and effectively applied within the grassroots level.or having two scientific topics, scientific projects, scientific works and technological applications that have been reviewed and effectively applied within the grassroots level.

b) Awarded to collective agencies, units, enterprises under the Ministry; departments and equivalent units directly under agencies, units, and enterprises under the Ministry that have excellently completed tasks for two consecutive years, maintaining internal unity, implementing well democratic regulations at the grassroots level, organizing well competition movements; caring for the material and spiritual life of the collective; practicing thrift and combating waste; fully implementing all systems and policies for all members of the collective.

2. "Certificate of Merit of the Minister of Information and Communications" for outstanding achievements in the regular annual competition movement, thematic competition movement launched by the Ministry of Information and Communications: shall be awarded when concluding the regular annual competition movement, thematic competition movement; the Ministry of Information and Communications will award Certificates of Merit to collectives and individuals with outstanding and exemplary achievements in the competition movement. Regarding the recipients, number of Certificates of Merit, criteria for awarding, the Ministry of Information and Communications will specify concretely according to each competition movement.

3. "Certificate of Merit of the Minister of Information and Communications" awarded or posthumously awarded to workers and employees who model themselves after good policies and laws of the Party and State, achieving many outstanding results in labor and production, having a wide influence within the agency, unit, organization, enterprise in the field of Information and Communications.

4. "Certificate of Merit of the Minister of Information and Communications" awarded to collectives and individuals who model themselves after good policies and laws of the Party and State, achieving outstanding and sudden results: awarded to collectives and individuals winning high awards at national and international competitions, festivals, exhibitions in the field of state management of the Ministry of Information and Communications; having inventions, innovations, patents, applications of advanced science and technology bringing high efficiency or collectives and individuals achieving outstanding results with a large impact, serving as role models for learning in the field of Information and Communications.

5. "Certificate of Merit of the Minister of Information and Communications" for long-term contributions to the construction and development of the Ministry and Information and Communications sector of Vietnam, awarded to collectives on the occasion of celebrating the anniversary of the traditional day of the agency, unit in even-numbered years.

6. "Certificate of Merit of the Minister of Information and Communications" awarded to Vietnamese collectives and individuals abroad and foreign collectives and individuals contributing to the development of the Ministry and Information and Communications sector of Vietnam.

          Article 9. Letter of Commendation  of the Head of the agency, unit with legal personality under the Ministry

1. "Letter of Commendation" to be awarded to individuals who model themselves after good policies of the Party, laws of the State, meeting one of the following criteria:

a) Completing assigned tasks well for one year or more; having good moral character; consistently studying to improve professional knowledge and skills;

b) Achieving outstanding results recognized in competitive campaigns initiated by the agency or unit;

c) Achieving many merits or outstanding and sudden achievements within the scope managed by the agency or unit.

2. "Letter of Commendation" to be awarded to collectives who model themselves after good policies of the Party, laws of the State, meeting one of the following criteria:

a) Completing assigned tasks well for one year or more; maintaining internal unity, implementing well democratic regulations at the grassroots level, organizing well competition movements; caring for the material and spiritual life of the collective, practicing thrift; fully implementing all systems and policies for all members of the collective;

b) Achieving outstanding results recognized in competitive movements;

c) Achieving many merits or outstanding and sudden achievements within the scope managed by the agency or unit.

Chapter III

AUTHORITY TO DECIDE AND AWARD COMPETITION TITLES AND REWARD FORMS

COMPETITION TITLES AND REWARD FORMS

Article 10. Authority to decide

1. The Minister of Information and Communications decides to award:

a) The title "Flag of Excellence of the Ministry of Information and Communications";

b) The title "Outstanding Labor Collective";

c) The title "Model Worker of the Ministry of Information and Communications";

d) Titles such as "Advanced Worker", "Model Worker at the Grassroots Level", "Advanced Labor Collective" for collectives and individuals of agencies, units under the Ministry without legal personality;

đ) The form "Certificate of Merit of the Minister".

2. Heads of agencies, units, organizations, enterprises with legal personality, separate accounts and seals decide to award:

a) The title "Advanced Worker";

b) The title "Model Worker at the Grassroots Level";

c) The title "Advanced Labor Collective";

d) The form "Letter of Commendation".

Article 11. Organization of awarding and receiving

1. Responsibility for organizing the award ceremony: Agencies, units, enterprises under the Ministry or the organizing bodies of specialized conferences shall organize the award ceremony for all commendation titles and forms of reward decided by the heads of grassroots units, the Minister of Information and Communications, the Prime Minister, the President, and other forms of rewards decided by other Ministries, sectors, localities, and central mass organizations. In special cases, this will be submitted to the Director of the Cadre and Civil Servant Organization Department for the Minister's decision.

2. Ceremony procedures for awarding commendation titles and forms of reward decided by the Minister of Information and Communications and the heads of grassroots units must be solemn and have motivational and educational effects.

3. Authority to award:

a) Commendation titles and forms of reward decided by the Minister of Information and Communications: The Minister shall present the awards or delegate others to present them.

b) Commendation titles and forms of reward decided by the heads of grassroots units: The head of the unit shall present the awards or delegate others to present them.

Chapter IV

PROCEDURES AND DOCUMENTS FOR PROPOSAL TO AWARDS

COMMENDATION TITLES AND REWARD FORMS

Article 12. Reward proposal process

1. The reward proposal process follows the principle that a higher-level authority only organizes the review and reward or proposes to a competent authority to grant rewards upon receiving the reward proposal dossier from the immediate lower-level authority. Overstepping levels in submitting proposals is not allowed.

2. The level responsible for managing organizational structure, civil servants, employees, and salary funds shall grant rewards or propose to a higher-level authority to grant rewards for objects within its management scope.

3. Rewards for achievements in competition movements: The level initiating the competition movement is responsible for summarizing, concluding, selecting outstanding individuals and groups to grant rewards or propose to a higher-level authority to grant rewards.

4. Rewards for outstanding and sudden achievements: The level where outstanding and sudden achievements are made is responsible for granting rewards or proposing to a higher-level authority to grant rewards.

5. Proposals for commendation titles and reward forms within the authority of the Prime Minister and the President shall be reviewed by the Minister of Information and Communications and proposed for rewards.

Article 13. Agreement on rewards

For agencies, organizations, and units located in provinces and centrally-administered cities when proposing rewards to the Ministry of Information and Communications for agencies, organizations, units, or their heads, they must obtain the agreement of the Provincial or City Department of Information and Communications.

Article 14. Dossier for proposal to award commendation titles and reward forms

The dossier for proposal to award commendation titles and reward forms shall comply with the following regulations:

1. Dossier for proposal to award commendation titles and reward forms at the Ministry level: The rewarding unit submits one set (original), including:

a) A report attached with the list of reward proposals;

b) Minutes of the appraisal meeting of the Competition and Reward Council at the level proposing rewards;

c) Report on achievements of the individuals and groups proposed for rewards;

d) Decisions, certificates, or confirmations by authorized agencies or organizations regarding scientific topics, projects, and technological works in cases of proposing the title "Outstanding Worker at the Grassroots Level", "Outstanding Worker of the Ministry of Information and Communications", and "Certificate of Merit from the Minister of Information and Communications" for annual achievements.

2. Dossier for rewarding foreign individuals and overseas Vietnamese includes: A report from the rewarding unit and a summary report on achievements confirmed by the level proposing rewards.

3. Dossier for rewarding individuals and groups with outstanding and sudden achievements in production and work discovered by the heads of agencies, organizations, and units includes: A report attached with the list of reward proposals and a summary report on achievements implemented by the rewarding agency, organization, or unit.

4. Dossier for rewarding individuals and groups winning high prizes in national and international competitions, festivals, and exhibitions in the field managed by the Ministry of Information and Communications, with inventions, innovations, and applications of advanced science and technology must include decisions, certificates, or confirmations in writing by the competent management agency.

5. Report on achievements of individuals proposed for the title "Outstanding Worker of the Ministry of Information and Communications" and the reward form "Certificate of Merit from the Minister of Information and Communications" for annual achievements must clearly state the content of topics, innovations, and solutions in work and management that have practical effectiveness and excerpts of confirmation opinions from the Science and Innovation Council at the level proposing rewards; if the innovation, solution, or topic has been recognized by the competent authority, send copies of decisions, certificates, or confirmations instead of the confirmation opinions of the Science and Innovation Council at the level proposing rewards.

6. When proposing to the Ministry of Information and Communications for rewards, electronic files of the proposal dossier must be sent simultaneously, except for classified documents (in .doc format for reports, lists, and achievement reports of proposed reward recipients; in .pdf format for other related dossiers).

Article 15. Deadline for submission of the dossier for proposal to award commendation titles and reward forms 1. Dossier for proposal to award the title "Excellent Labor Collective" and "Flag of the Ministry of Information and Communications": The deadline for submission is based on the annual guidance on summarizing competition and reward activities of the Ministry, but not later than April 30 of the following year of the proposed reward.

2. Dossier for proposal to award the title "Outstanding Worker of the Ministry of Information and Communications" and the reward form "Certificate of Merit from the Minister of Information and Communications" for annual achievements: The deadline for submission to the Ministry is before June 30 of the following year of the proposed reward.

2. Documents for proposing the commendation title "Outstanding Soldier of the Ministry of Information and Communications" and the form of commendation "Certificate of Merit from the Minister of Information and Communications" for annual achievements: the deadline for submitting the documents to the Ministry is before June 30 of the following year of the proposed commendation year.

3. Application dossier for commendation of achievements in thematic mass mobilization campaigns: the deadline for submitting the dossier shall be based on the guidance for summarizing the campaign.

4. Application dossier for commendation of outstanding and exceptional achievements: the dossier shall be submitted to the Ministry immediately after the individual or group achieves the outstanding and exceptional results.

Article 16Notification of commendation results

1. For collectives and individuals meeting the criteria for commendation, within ten working days from the date of the commendation decision, the agency responsible for mass mobilization and commendation work shall notify the agency that proposed the commendation.

2. For collectives and individuals not meeting the criteria for commendation, within ten working days from the date the competent authority notifies the commendation result, the agency responsible for mass mobilization and commendation work shall notify the agency that proposed the commendation. If the dossier does not follow the correct submission route, the agency responsible for mass mobilization and commendation work shall notify and return the dossier to the proposing agency.

Chapter V

IMPLEMENTING PROVISIONS

Article 17. Effective date

This Circular takes effect from January 1, 2024, and replaces Circular No. 09/2018/TT-BTTTT dated June 29, 2018, issued by the Minister of Information and Communications guiding the implementation of mass mobilization and commendation work in the Information and Communications sector.

Article 18. Implementation Organization

1. The heads of agencies, organizations, units, and enterprises under the Ministry and the Information and Communications sector are responsible for disseminating and implementing this Circular and the provisions of the Law on Mass Mobilization and Commendation 2022.

2. During the process of organizing and implementing mass mobilization and commendation work, if there are difficulties or issues arise that are not suitable, the heads of agencies, organizations, units, enterprises, and related individuals shall reflect these issues to the Ministry of Information and Communications (through the Cadre and Civil Servant Department) for consolidation and reporting to the Minister for consideration and decision./.
