Regulations on criteria for classification, conditions for establishment, merger, consolidation, and dissolution of public service units under the planning, investment, and statistics sectors

Pursuant to Decree No.Decision No. 1269/QĐ-TTgdated October 2, 2019 of the Prime Minister on the establishment of the National Innovation and Creativity Center;

Pursuant to Decree No.Decree No. 120/2020/NĐ-CPPursuant to Article 14 of the Government's Decree No. 117/2016/ND-CP dated July 21, 2016 amending and supplementing certain articles of the Government's Decree No. 14/2004/ND-CP dated December 14, 2004 on salary system for civil servants, public officials, and armed forces personnel;

Pursuant to Decree No.60/2021/ND-CPdated June 21, 2021, of the Government stipulating the financial autonomy mechanism of public service units;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Planning and Investment hereby promulgates this Circular to stipulate the criteria for classification, conditions for establishment, merger, consolidation, and dissolution of public service units under the planning, investment, and statistics sectors.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the criteria for classification, conditions for establishment, merger, consolidation, and dissolution of public service units within the scope of the planning, investment, and statistics sectors.

Article 2. Applicability

1. Public service units established by competent authorities in accordance with the law, which engage in public services activities within the scope of the planning, investment, and statistics sectors.

2. Agencies, organizations, and individuals related to the implementation of classification, establishment, merger, consolidation, and dissolution of public service units under the planning, investment, and statistics sectors.

3. This Circular does not apply to:

a) Public service units subordinate to the Ministry of Public Security and the Ministry of National Defense;

b) Public service units within the management scope of special administrative-economic units;

c) Public service units located abroad;

d) Public service units subordinate to the Ministry of Planning and Investment that operate in fields such as journalism, publishing, information and communication, science and technology, economy, higher education, vocational training, and other fields under the state management functions of other ministries and sectors.

Chapter II

CRITERIA FOR CLASSIFICATION; CONDITIONS FOR ESTABLISHMENT, MERGER, CONSOLIDATION, AND DISSOLUTION OF PUBLIC SERVICE UNITS UNDER THE PLANNING, INVESTMENT, AND STATISTICS SECTORS

Article 3. Criteria for classifying public service units based on functions and tasks

1. Public service units with functions to serve state administration:

a) Public service units performing the function of research to serve the drafting of legal normative documents, perfecting institutional frameworks, planning, programs, strategies, systems, policies, standards, regulations, economic-technical norms within the planning, investment, and statistics sectors;

b) Public service units undertaking the task of building, managing, operating, exploiting, and developing information systems to serve state administration in the planning, investment, and statistics sectors;

c) Public service units performing the function of supporting and serving inspection, supervision, and quality control of specialized services within the planning, investment, and statistics sectors;

d) Public service units performing other functions to serve state administration in the planning, investment, and statistics sectors.

2. Public service units providing public services within the planning, investment, and statistics sectors according to the approved list by competent authorities.

3. Public service units that both serve state administration and provide public services within the planning, investment, and statistics sectors are those public service units implementing one or more functions and tasks specified in Clause 1 and one or more functions and tasks specified in Clause 2 of this Article. The determination of the type of public service unit as prescribed in this Article shall be decided by the competent authority establishing the unit.

Article 4. Criteria for classifying public service units according to the level of financial autonomy

1. Public service units that self-finance regular expenses and investment costs.

2. Public service units that self-finance regular expenses.

3. Public service units that partially self-finance regular expenses, including:

a) Public service units that self-finance from 70% to less than 100% of regular expenses.

b) Public service units that self-finance from 30% to less than 70% of regular expenses.

c) Public service units that self-finance from 10% to less than 30% of regular expenses.

4. Public service units whose regular expenses are guaranteed by the State budget. The determination of the level of financial autonomy of public service units as stipulated in this Article shall be implemented in accordance with the provisions of the Government's regulations on the mechanism of financial autonomy for public service units.

Article 5. Conditions for establishing public service units

1. The establishment of public service units in the planning, investment, and statistics sectors must meet the conditions specified in points a, c, d, đ of Clause 1, Article 5 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, restructuring, and dissolution of public service units (hereinafter referred to as Decree No. 120/2020/NĐ-CP).

2. In addition to the general conditions stipulated in Clause 1 of this Article, the establishment of public service units in the planning, investment, and statistics sectors must also meet other conditions as prescribed by relevant laws.

Article 6. Conditions for merging or consolidating public service units

1. The merger or consolidation of public service units in the planning, investment, and statistics sectors shall be carried out when meeting the conditions specified in points a, b, c of Clause 2, Article 5 of Decree No. 120/2020/NĐ-CP.

2. Public service units formed after the merger or consolidation must satisfy all establishment conditions stipulated in Article 5 of this Circular and relevant laws.

Article 7. Conditions for dissolving public service units

1. The dissolution of public service units in the planning, investment, and statistics sectors shall be carried out when one of the conditions specified in points a, b, c, d of Clause 3, Article 5 of Decree No. 120/2020/NĐ-CP is met.

2. Public service units can only dissolve after completing their financial, property, land, loan, debt, and other obligations as prescribed by law and obtaining confirmation in writing from competent authorities.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effective Date

This Circular takes effect from August 10, 2024.

Article 9. Responsibility for implementation

1. Ministries, ministerial-level agencies, government agencies, organizations under the Government,

2. Public service units in the planning, investment, and statistics sectors, as well as related agencies, organizations, and individuals are responsible for implementing this Circular.

3. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, the provisions of those amended, supplemented, or replacing documents shall apply.

4. During the implementation of this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals are requested to report to the Ministry of Planning and Investment for guidance and resolution in accordance with the regulations.
