CIRCULAR

Regulations on economic and technical norms for services

preserving and developing traditional sports

Pursuant to the Law on Physical Culture and Sports dated November 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Law on Physical Culture and Sports dated June 14, 2018;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and public services using state budget funds from regular expenditure;

Pursuant to Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government stipulating the financial autonomy structure of public service units;

Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Sports Administration;

The Minister of Culture, Sports and Tourism promulgates this Circular stipulating economic and technical norms for services preserving and developing traditional sports using state budget funds (hereinafter referred to as public services).

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular stipulates economic and technical norms for services preserving and developing traditional sports using state budget funds (hereinafter referred to as public services).

a) Job titles in the labor cost component of the standard table shall be applied in accordance with Circular No. 07/2022/TT-BVHTTDL dated October 25, 2022 of the Minister of Culture, Sports and Tourism stipulating job code, job standards, and salary grading for sports professionals (hereinafter referred to as Circular No. 07/2022/TT-BVHTTDL).

b) Agencies, organizations, and other individuals related to the implementation of public services using state budget funds;

c) Encouraging non-public agencies and organizations implementing public services without using state budget funds to apply economic and technical standards as prescribed in this Circular.

Article 2. General Provisions on Economic and Technical Standards

1. The economic and technical norms stipulated in this Circular are the maximum levels, ensuring accurate and sufficient costs to complete the provision of public services according to quality criteria and standards.

2. The economic and technical norms stipulated in this Circular serve as the basis for:

a) To determine the job titles within the labor cost component for the implementation of public services using state budget funds, submit for approval by the competent authority, and allocate annual funding;

b) To determine unit prices and service prices for public services ordered using state budget funds in accordance with Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and public services using state budget funds from regular expenditure.

3. Determination of job titles:

a) Job titles within the labor cost component of the normative table shall be applied according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces; Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain provisions of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces, or equivalent conversion based on job positions approved by the competent authority; Circular No. 07/2022/TT-BVHTTDL dated October 25, 2022 of the Minister of Culture, Sports and Tourism on job title codes, qualification standards, and salary grades for physical education and sports professionals.

b) In cases where the rank of job titles working at agencies and organizations does not comply with the normative table, the competent authority shall consider and decide to apply the ranks specified in the norms, equivalent ranks, or the actual ranks of employees working and the corresponding labor costs. In these cases, labor costs must not exceed those calculated from the norms issued by the Minister of Culture, Sports and Tourism. Civil servants and officials participating in work and receiving salaries from the state budget shall not enjoy the benefits stipulated in this Circular.

Article 3. Content of economic and technical norms

1. The content of economic and technical norms includes:

a) Labor costs: The direct and indirect labor time required on average for various ranks of workers to complete the provision of a service. Direct labor costs are the time spent on implementing service stages according to the guidance for providing public services, measured in workdays (8 hours per day), as stipulated in Article 105 of the Labor Code; indirect labor costs are calculated at 15% of direct labor costs.

b) Machine and equipment usage costs: The time required to use machines and equipment to provide public services. Machine and equipment costs in the norms are calculated in shifts, each shift corresponding to one workday (8 hours) as stipulated in Article 105 of the Labor Code.

c) Material usage costs: The specific quantities of materials necessary and directly used to provide public services.

2. The structure of economic and technical norms includes the following contents:

a) Name of the norm.

b) Description of work components: It is the content of the main work stages to implement the provision of public services.

c) The economic and technical norm table includes:

- Labor costs: Job titles and ranks of workers, units of measurement for labor cost norms;

- Consumption of machinery and equipment used: Name of machinery or equipment, unit of consumption cost, consumption cost of use;

- Material usage costs: Names and specifications of materials, units of measurement for material costs, material cost levels;

- Normative cost value: The numerical value representing labor costs, material costs, machine and equipment costs, and material usage costs.

3. Economic and technical norms for public service activities are specified in the Appendix to this Circular.

Article 4. Organization of Implementation

1. Based on the economic and technical norms for public services attached to this Circular, ministries, sectors, and central agencies shall consider and decide on specific norms applicable to public service units under their management in accordance with the conditions of the service-providing units.

2. Agencies and organizations using state budget funds to implement public services shall study the actual conditions and propose specific norms to the competent authority for consideration and decision.

Article 5. Effective Date

1. This Circular shall take effect from January 1, 2025.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

4. During the implementation process, if any difficulties arise, agencies, organizations, and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Sports Administration) for consideration and resolution./.
