Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending point b Clause 1 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education;

1. Amending Point b Clause 1 Article 5 of Decree No. 204/2004/ND-CP as follows:
"b) Personnel working in confidential organizations shall be classified according to the officer rank pay scale of the Vietnam People's Army (Scale 6) with the highest salary level equivalent to that of the Major General rank (excluding officers of the Vietnam People's Army and Public Security officers who have been transferred or seconded) and the professional military personnel pay scale of the Vietnam People's Army (Scale 7)."
2. Amending and supplementing Clause 3 Article 7 of Decree No. 2004/2004/ND-CP as follows:
"3. Implementing promotions and demotions of ranks and salary increases:
a) The promotion and demotion of ranks and the increase of rank allowances for officers, non-commissioned officers, soldiers, professional military personnel, and technical staff in the armed forces shall be carried out in accordance with current laws governing the armed forces.
b) Officers of the Vietnam People's Army and Public Security officers who have held the highest rank of their current position, completed their tasks, met political criteria, moral standards, professional qualifications, and health requirements may be considered for salary increases.
The review period for salary increases for the rank of General, Colonel, and Major is four years; for Lieutenant Colonel, it is three years.
Authority to decide on salary increases:
For officers of the Vietnam People's Army, this shall be implemented in accordance with Clause 5, Article 1 of the Law amending and supplementing some articles of the Law on Officers of the Vietnam People's Army dated November 27, 2014;
For Public Security officers: The Prime Minister decides on the rank of General and Lieutenant General; the Minister of Public Security decides on the rank of Major General and below.”
3. Amending and supplementing Point d Clause 1 Article 11 of Decree No. 204/2004/ND-CP as follows:
"d) Guidelines for implementing the leadership position allowance (elected, appointed) as stipulated in Resolution No. 730/2004/NQ-UBTVQH11, Clause 3, Article 5 of this Decree, and newly established organizations in accordance with the law."
Article 2. Amending and supplementing the Professional and Vocational Pay Scale for cadres and public officials in state-run units (Table 3) and the Leadership Position Allowance Table (elected, appointed) in state agencies, state-run units; agencies and units under the Vietnam People's Army and Public Security (annexed to Decree No. 204/2004/ND-CP):
1. Supplementing the note on the application targets of the Professional and Vocational Pay Scale for cadres and public officials in state-run units (Table 3) annexed to Decree No. 204/2004/ND-CP:
"(4) For public officials currently classified at the senior lecturer position who are appointed to the professor position, the following classification shall apply:
a) If not yet at the final grade of the senior lecturer position, they shall be promoted to the next higher grade from the date of appointment to the professor position, with the time for the next salary grade increase calculated from the date of holding the previous grade.
b) If already at the final grade of the senior lecturer position, they shall be granted an additional three years (36 months) to enjoy the seniority allowance beyond the ceiling from the date of signing the appointment decision for the professor position."
2. Amending and supplementing Clause 4 Section I of the Leadership Position Allowance Table (elected, appointed) in state agencies, state-run units; agencies and units under the Vietnam People's Army and Public Security (annexed to Decree No. 204/2004/ND-CP) as follows:

c) In cases where individuals are currently receiving a leadership position allowance that exceeds the coefficient stipulated in Points a and b Clause 2 of this Article, the existing allowance shall be maintained until the end of the term of appointment. If the term of appointment is less than six months, the individual shall be entitled to maintain the existing allowance for a full six-month period.

1. This Decree takes effect from September 15, 2016.
Article 3. Effectiveness
2. Abolishing the salary grade scale for the professor position as stipulated in Clause 2, Article 8 of Decree No. 141/2013/ND-CP dated October 24, 2013 of the Government detailing and guiding the implementation of certain provisions of the Higher Education Law 2012.
1. The Minister of National Defense and the Minister of Public Security shall guide the procedures and processes for reviewing salary increases for officers within their jurisdiction.
Article 4. Responsibilities for Implementation
1. The Minister of National Defense and the Minister of Public Security shall guide the procedures and formalities for considering salary increases for officers under their jurisdiction.
2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
