CIRCULAR

Regulations on confirming the designation of youth volunteer units that have been established and operated during various periods for units not yet confirmed with a designation.

 

Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs, concerning regulations on confirming the designation of youth volunteer units that have been established and operated during various periods for units not yet confirmed with a designation, shall take effect from January 15, 2015, and has been amended and supplemented by:

Circular No. 13/2024/TT-BNV dated December 9, 2024, issued by the Minister of Home Affairs, amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs, concerning regulations on confirming the designation of youth volunteer units that have been established and operated during various periods for units not yet confirmed with a designation, shall take effect from February 1, 2025.

Pursuant to the Youth Law 2005;

Pursuant to Decree No. 12/2011/NĐ-CP dated January 30, 2011, of the Government on the organization and policies for youth volunteers;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decision No. 40/2011/QĐ-TTg dated July 27, 2011, of the Prime Minister on the regime for youth volunteers who have completed their duties during the resistance war;

At the proposal of the Director of the Department of Youth Work;

The Minister of Home Affairs issues this Circular regulating the confirmation of the designation of youth volunteer units that have been established and operated during various periods for units not yet confirmed with a designation.[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular sets out criteria, authority, files, procedures, formalities, and responsibilities of organizations and individuals involved in confirming the designation of youth volunteer units that have been established and operated during various periods at central and local levels for units not yet confirmed with a designation.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals involved in establishing files and confirming the designation of youth volunteer units that have been established and operated during various periods for units not yet confirmed with a designation.

Article 3. Designation of youth volunteer units

1. The designation of youth volunteer units includes the name and code (if any):

a) The name of the youth volunteer unit during various periods is determined according to the criteria set forth in Chapter II of this Circular;

b) The code of the youth volunteer unit is determined according to letters attached to a series of numbers with historical significance or specific characteristics of the youth volunteer unit.

2. The designation of the youth volunteer unit serves as the basis for management officials and members of the youth volunteer unit to request competent authorities to:

a) Confirm participation in combat service, combat, construction, and defense of the country;

b) Request resolution of benefits and policies in accordance with the law.

3. Management officials and members of the youth volunteer unit referred to in Clause 2 of this Article include:

a) Young people under 18 years old who voluntarily join the youth volunteer movement and are approved by the organization;

b) Young people aged 18 to 30 years old who are mobilized by competent authorities to join the youth volunteer movement;

c) People over 30 years old who are mobilized to join the youth volunteer movement to perform management, professional, and technical tasks.

Chapter II. CRITERIA FOR CONFIRMING THE DESIGNATION OF YOUTH VOLUNTEER UNITS DURING VARIOUS PERIODS

Article 4. Criteria for Youth Volunteer Units Participating in Anti-French Resistance from 1950 to 1954

1. Establishment Policy

Based on the Directive of President Ho Chi Minh or the Resolution of one of the following organizations:

a) The Central Youth Mobilization Party Group;

b) The Vietnam Youth Salvation Association;

c) The Labor Youth Association.

2. Authority to Decide on Establishment

Established, managed, and utilized by one of the following agencies:

a) The Central Youth Volunteer Unit or the Central Vietnam Youth Salvation Association;

b) The State Supply General Department;

c)[2] Administrative Committee of region, inter-region, autonomous region; Provincial and District Administrative Committees.

3. Organizational Form

Youth Volunteer Units are organized in the following forms:

a) Central Youth Volunteer Teams, Model Youth Volunteer Teams, Youth Volunteer XP Teams;

b) Combined Teams, Combined Sub-units, Sub-units;

c) Youth Volunteer Teams organized into companies, battalions, and platoons.

4. Tasks of Youth Volunteer Units

Youth Volunteer Units perform one of the main tasks below:

a) Building and repairing roads, defusing bombs and mines, ensuring traffic;

b) Transporting logistics, serving combat operations, and directly participating in combat;

c) Conducting mass mobilization work, protecting and serving Party and State agencies, propagandizing Party and State policies, production, and study;

d) Participating in mitigating war consequences, constructing key projects, restoring and developing the economy in difficult areas;

đ) Supplementing forces for the military when necessary.

5. Duration of Operation of Youth Volunteer Units

The specific duration of operation of each Youth Volunteer Unit is carried out according to the requirements and tasks of the authority responsible for mobilizing, managing, and utilizing Youth Volunteers.

6. Living Conditions and Equipment[3] of Youth Volunteer Team members during their duty period are guaranteed by the mobilizing authority (without salary).

Article 5. Criteria for Youth Volunteer Units Engaged in Mitigating War Consequences and Building Socialism from 1955 to 1964

1. Establishment Policy

Based on Directive No. 01/CT.TNLĐ/TW dated February 25, 1959 of the Central Committee of the Labor Youth Association on recruiting Youth Volunteers for socialist construction or the policy of the Youth Organization or revolutionary government in the South.

2. Authority to Decide on Establishment

Established, managed, and utilized by one of the following agencies:

a) The Central Youth Association;

b) Other Ministries and Agencies at the Central Level;

c)[4] Administrative Committee of region, inter-region, autonomous region; Provincial and District Administrative Committees;

d) Provincial Youth Associations;

đ) Youth Organizations or revolutionary governments in the South.

3. Organizational Form

Youth Volunteer Units are organized in the following forms:

a) Youth Volunteer Teams building socialism;

b) Local Youth Volunteer Teams.

4. Main Tasks of Youth Volunteer Units

Youth Volunteer Units perform one of the main tasks below:

a) Participating in mitigating war consequences, opening up traffic routes;

b) Constructing and developing essential works in the Youth Volunteer movement with the task of consolidating peace;

c) Organizing study and training to improve the level of management cadres and Youth Volunteer team members; serving resistance in the South.

5. Duration of Operation of Youth Volunteer Units

The specific duration of operation of each Youth Volunteer Unit is carried out according to the requirements and tasks of the authority responsible for mobilizing, managing, and utilizing Youth Volunteers; for Youth Volunteer Units in the South, the specific duration of operation is carried out according to the resistance requirements and tasks of each locality.

6. Living Conditions and Equipment[5] of Youth Volunteer Team members during their duty period are guaranteed by the mobilizing authority (without salary); for localities in the South, living conditions and equipment are based on specific conditions or combining production with combat service.

Article 6. Criteria for Youth Volunteer Units in the Anti-American Resistance War to Save the Country from 1965 to 1975

1. Establishment Policy

Based on Directive No. 71/TTg-CN dated June 21, 1965 of the Prime Minister on organizing Youth Volunteer Teams against America to save the country serving transportation work, or according to the Resolution of the First Congress of the Communist Youth of South Vietnam on March 26, 1965.

2. Authority to Decide on Establishment

Established, managed, and utilized by one of the following agencies:

a) The Central Committee of the Vietnam Youth Labor Union;

b) Other Ministries and Agencies at the Central Level;

c)[6] Administrative Committee of region, inter-region, autonomous region; Provincial and District Administrative Committees;

d)[7] The Communist Youth of South Vietnam or revolutionary authorities at provincial, district, and commune levels in the South.

3. Organizational Form

Youth Volunteer Units are organized in the following forms:

a) General teams, youth volunteer teams organized into battalions, regiments, brigades, companies, platoons, squads for concentrated youth volunteers;

b) Regiments, battalions, companies, platoons, squads for grassroots youth volunteers in the South.

4. Tasks of Youth Volunteer Units

Youth Volunteer Units perform one of the main tasks below:

a) Building urgent defense works, serving the resistance war, and economic construction;

b) Opening roads, ensuring traffic, transporting logistics, evacuating the wounded, supplying ammunition, serving combat operations, directly participating in combat, defusing bombs, clearing battlefields, working in enemy-controlled areas;

c) Supplementing forces for the army when necessary.

5. Duration of Operation of Youth Volunteer Units

The specific operating period of each youth volunteer unit shall be carried out according to the requirements and tasks of the competent authority responsible for mobilizing, managing, and utilizing youth volunteers; for grassroots youth volunteer units in the South, the mobilization period shall be carried out according to the requirements and tasks of the resistance war of each locality.

6. Living Conditions and Equipment[8] of Youth Volunteer Team members during their duty period are guaranteed by the mobilizing authority (without salary); for localities in the South, living conditions and equipment are based on specific conditions or combining production with combat service.

Article 7. Criteria for Youth Volunteer Units in Economic Construction and Development, Participating in Wars to Defend the Homeland, and International Duties in Cambodia and Assisting Laos After April 30, 1975

1.[9] Policy on establishment

Based on Directive No. 460-TTg dated September 23, 1978 of the Prime Minister on organizing economic construction forces in southern provinces and cities, Decision No. 216-HĐBT dated November 13, 1987 of the Council of Ministers on organizing youth volunteers under current conditions, Directive No. 259-CT dated July 12, 1990 of the Chairman of the Council of Ministers on organizing youth volunteers for economic activities, Decision No. 770-TTg dated December 20, 1994 of the Prime Minister on organizing and policies for youth volunteers, or documents by competent authorities mobilizing participation in wars to defend the homeland and international duties in Cambodia and assisting Laos after April 30, 1975, or policies of provincial and municipal party committees, mobilization documents of provincial People's Committees, and documents of the Communist Youth League of Ho Chi Minh at the provincial level on gathering and mobilizing youth volunteers to overcome the consequences of war, build, and develop the economy.

2. Authority to Decide on Establishment

Established, managed, and utilized by one of the following agencies:

a) The Central Committee of the Ho Chi Minh Communist Youth League;

b) Other Ministries and Agencies at the Central Level;

c) Provincial and District People's Committees;

d)[10] Provincial and District Communist Youth Leagues.

3. Organizational Form

Youth Volunteer Units are organized in the following forms:

a)[11] Forces, divisions, regiments, battalions, general teams, teams, battalions, companies, platoons, squads of youth volunteers;

b) Battalions of youth volunteers named "Border Defense Pioneers";

c) Youth volunteer economic zones, construction sites, agricultural fields, forestry fields of youth volunteers;

d) Schools, education and vocational training centers of youth volunteers;

đ) Enterprises of youth volunteers;

e) Forces of youth volunteers mobilized to participate in wars to defend the homeland and international duties in Cambodia and assisting Laos after April 30, 1975.

4. Tasks of Youth Volunteer Units

Youth Volunteer Units perform one of the main tasks below:

a) Overcoming the consequences of war, opening roads, building and developing socio-economic regions after liberation;

b) Engaging in production, constructing material and technical infrastructure for new economic zones such as expanding cultivated land, planting forests, building irrigation systems, roads, and facilities serving production and daily life;

c) Serving border defense combat operations and international duties;

d) Taking the lead in implementing difficult and urgent tasks, building and developing socio-economic conditions in border areas, islands, and regions with particularly difficult socio-economic conditions as specified by the competent authority.

5. Duration of Operation of Youth Volunteer Units

The specific duration of operation of each Youth Volunteer Unit is carried out according to the requirements and tasks of the authority responsible for mobilizing, managing, and utilizing Youth Volunteers.

6.[12] The living arrangements and equipment of youth volunteer members during their service period shall be guaranteed by the competent authority responsible for mobilization (without salary). Management cadres and youth volunteer members of economic units shall enjoy salaries and other allowances as stipulated by law.

Chapter III. COMPETENT AUTHORITY, FILES, PROCEDURES, AND PROCEDURAL REQUIREMENTS FOR CONFIRMING THE BADGE OF YOUTH VOLUNTEER UNITS

Article 8. Competence to Confirm the Unit Nameplate of Volunteer Youth Units

1. For volunteer youth organizations established before March 26, 2011:

a) Ministries, ministerial-level agencies, government agencies, the Central Committee of the Ho Chi Minh Communist Youth Union confirm the unit nameplate of volunteer youth units for those units established or directly managed and utilized by their own level;

b)[13] The People's Committee at the provincial level confirms the unit nameplate of volunteer youth units for those units established or directly managed and utilized by the provincial, district, or commune levels.

2. For volunteer youth organizations established from March 26, 2011 onwards, they shall implement according to the provisions of Government Decree No. 12/2011/NĐ-CP dated January 30, 2011 on the organization and policies for volunteer youth.

Article 9. Documents for Requesting Confirmation of the Unit Nameplate of Volunteer Youth Units

The documents for requesting confirmation of the unit nameplate of volunteer youth units include:

1.[14] A request letter from the unit liaison board Form No. 01 or a request letter from individuals directly participating in tasks at the unit Form No. 02 or relevant documents from related agencies, units, or organizations Implementation Report of Production Projects of Supporting Industry Products Confirmed with Incentives requesting confirmation of the unit nameplate of volunteer youth units.

2. Necessary documents (originals or copies) according to the criteria specified in Chapter II of this Circular.

Article 10. Procedures and Formalities for Confirming the Unit Nameplate of Volunteer Youth Units Established, Managed, and Utilized by Central Agencies

1.[15] The unit liaison board or individuals directly participating in tasks at the unit or related agencies, units, or organizations requesting confirmation of the unit nameplate of volunteer youth units are responsible for submitting one set of documents as stipulated in Article 9 of this Circular either in person or through postal service to the Vietnam Association of Former Volunteer Youth.

2. The Vietnam Association of Former Volunteer Youth is responsible for receiving, guiding, supplementing to complete the documents and sending a document to the competent authority specified in Article 8 of this Circular to review and decide on confirming the unit nameplate of volunteer youth units.

3.[16] Within a maximum period of 45 working days from the date of receipt of complete valid documents as stipulated in Article 9 of this Circular, the personnel advisory agency of the competent authority specified in Article 8 of this Circular is responsible for reviewing the documents and presenting them to the competent authority for review and decision to confirm the unit nameplate of volunteer youth units if the unit meets the conditions for confirmation, or responding in writing if the unit does not meet the conditions for confirmation.

Article 11. Procedures and Formalities for Confirming the Unit Nameplate of Volunteer Youth Units Established, Managed, and Utilized by Provincial, District, or Commune Levels [17]

1. The unit liaison board or individuals directly participating in tasks at the unit or related agencies, units, or organizations requesting confirmation of the unit nameplate of volunteer youth units are responsible for submitting one set of documents as stipulated in Article 9 of this Circular either in person or through postal service to the Provincial Vietnam Association of Former Volunteer Youth or the Provincial Liaison Board of Former Volunteer Youth.

2. The Provincial Vietnam Association of Former Volunteer Youth or the Provincial Liaison Board of Former Volunteer Youth is responsible for receiving, guiding, supplementing to complete the documents and sending a document to the Department of Home Affairs for review and presenting to the People's Committee of the province or centrally governed city for decision on confirming the unit nameplate of volunteer youth units.

3. Within a maximum period of 45 working days from the date of receipt of complete valid documents as stipulated in Article 9 of this Circular, the Department of Home Affairs is responsible for reviewing the documents and presenting to the People's Committee of the province for review and decision to confirm the unit nameplate of volunteer youth units if the unit meets the conditions for confirmation, or responding in writing if the unit does not meet the conditions for confirmation.

Article 12. Correction and Revocation of Confirmation

1. In cases where errors are discovered in the decision confirming the unit name of the Volunteer Youth Force but such errors do not affect the authority or content of the confirmation, corrections shall be made.

2. In cases where the decision confirming the unit name of the Volunteer Youth Force is found to be untrue or beyond authority, the agency issuing the decision shall be responsible for revoking that decision.

Article 12a. Funding for Confirmation Work

The funding for verifying the confirmation file; the funding for organizing meetings to review and confirm the unit name (if applicable) shall be implemented according to Circular No. 40/2017/TT-BTC dated April 28, 2017, issued by the Minister of Finance on the regulations for travel expenses and conference costs; in cases where the regulations on travel expenses and conference costs are amended, supplemented, or replaced, they shall be implemented according to the new regulations that have been amended, supplemented, or replaced.

Chapter IV. IMPLEMENTATION

Article 13. Responsibilities of Ministries, Other Central Agencies, and Provincial People's Committees

1. Organize the confirmation of the unit name of the Volunteer Youth Force in accordance with Chapter III of this Circular.

2. Annually, compile the number of Volunteer Youth Force units that have been confirmed with their unit names by competent authorities and send the list to the Ministry of Home Affairs for monitoring.

Article 14. Request to the Communist Youth Union Central Committee

1. Organize the dissemination and popularization of the contents of this Circular to all levels of the Youth Union.

2. Guide all levels of the Youth Union to cooperate with the Association of Former Volunteer Youth Force at all levels in establishing files and verifying requests for confirmation of the unit name of the Volunteer Youth Force.

Article 15. Request to the Vietnam Association of Former Volunteer Youth Force

1. Organize the dissemination and popularization of the contents of this Circular to the Association of Former Volunteer Youth Force at all levels.

2. Review and tally the number of Volunteer Youth Force units from different periods that have not yet been confirmed with their unit names.

3. Guide the Association of Former Volunteer Youth Force at all levels to cooperate with all levels of the Youth Union in receiving, establishing files, and requesting confirmation of the unit name of the Volunteer Youth Force.

Article 16. Effective Date

1. This Circular takes effect from January 15, 2015.

2. During the implementation of this Circular, if there are any difficulties, please report them to the Ministry of Home Affairs for research and resolution by relevant ministries, agencies equivalent to ministries, agencies under the Government, provincial people's committees, and related organizations and individuals.

[1] Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing some provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs, stipulating the confirmation of the unit name of the Volunteer Youth Force established and operating during various periods for units not yet confirmed with their unit names, is based on the following grounds for issuance:

"Based on the Law on Youth dated June 16, 2020;

Based on Decree No. 112/2017/NĐ-CP dated October 6, 2017, issued by the Government on the system of policies and benefits for Volunteer Youth Force units in the South participating in the resistance war from 1965 to 1975;

Based on Decree No. 63/2022/NĐ-CP dated September 12, 2022, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Department of Youth Work;

The Minister of Home Affairs hereby issues the Circular amending and supplementing some provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs, stipulating the confirmation of the unit name of the Volunteer Youth Force established and operating during various periods for units not yet confirmed with their unit names."

[2] This provision has been amended and supplemented according to Clause 1 of Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing some provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs, stipulating the confirmation of the unit name of the Volunteer Youth Force established and operating during various periods for units not yet confirmed with their unit names, which will take effect from February 1, 2025.

[3] The term "management cadres" is abolished pursuant to Clause 10, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[12] This clause is amended and supplemented pursuant to Point d, Clause 4, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[13] This point is amended and supplemented pursuant to Clause 5, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[14] This clause is amended and supplemented pursuant to Clause 6, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[15] This clause is amended and supplemented pursuant to Point a, Clause 7, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[16] This clause is amended and supplemented pursuant to Point b, Clause 7, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024 amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014 of the Minister of Home Affairs on confirming the unit nameplate of volunteer youth units that have been established and operated during various periods for units not yet confirmed with a nameplate, which shall take effect from February 1, 2025.

[17] This provision has been amended and supplemented pursuant to Clause 8, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs regarding the confirmation of the unit nameplate of volunteer youth units established and operating during various periods for units that have not been assigned a nameplate, which shall take effect from February 1, 2025.

[18] This provision has been added pursuant to Clause 9, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs regarding the confirmation of the unit nameplate of volunteer youth units established and operating during various periods for units that have not been assigned a nameplate, which shall take effect from February 1, 2025.

[19] Article 2 of Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs regarding the confirmation of the unit nameplate of volunteer youth units established and operating during various periods for units that have not been assigned a nameplate, which shall take effect from February 1, 2025, provides as follows:

“Article 2. Effective Date

1. This Circular takes effect from February 1, 2025.

2. In the course of implementation, if there are any difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Home Affairs for study and resolution./.

[20] This Appendix has been added pursuant to Clause 6, Article 1 of Circular No. 13/2024/TT-BNV dated December 9, 2024, amending and supplementing certain provisions of Circular No. 18/2014/TT-BNV dated November 25, 2014, issued by the Minister of Home Affairs regarding the confirmation of the unit nameplate of volunteer youth units established and operating during various periods for units that have not been assigned a nameplate, which shall take effect from February 1, 2025.
