Pursuant to the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH10 dated August 28, 2001;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Directive No. 13/2002/CT-TTg dated June 11, 2002, of the Prime Minister on the implementation of the Ordinance on Fees and Charges and Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government detailing the implementation of the Ordinance on Fees and Charges;
The Ministry of Finance hereby provides guidance as follows:
I. SUBJECTS AND SCOPE OF REGULATION
This Circular guides the collection, submission, management, and use of fees and charges in the banking, securities, and insurance sectors as specified in the Detailed List of Fees and Charges (hereinafter referred to as the Detailed List of Fees and Charges) issued together with Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government detailing the implementation of the Ordinance on Fees and Charges (hereinafter referred to as Decree No. 57/2002/NĐ-CP), which are carried out by organizations and individuals in the banking, securities, and insurance sectors.
II. AMOUNT OF COLLECTION AND ORGANIZATION OF COLLECTION
1. Amount of fee collection:
The amount of fees for services using securities equipment, infrastructure, and securities activities shall be implemented according to specific levels set forth in Appendix 1: Detailed List of Types of Fees.
2. Amount of charge collection:
The amount of charges for issuing licenses for professional activities in the banking, securities, and insurance sectors shall be implemented according to specific levels set forth in Appendix 2: Detailed List of Types of Charges.
3. Organization of collection:
- Charges in the insurance sector shall be collected and submitted to the State budget by the Ministry of Finance.
- Charges in the banking sector shall be collected and submitted to the State budget by the State Bank of Vietnam.
- Charges in the securities sector shall be collected and submitted to the State budget by the Securities Commission.
- Fees in the securities sector shall be collected and managed for use by the Securities Trading Center according to current regulations.
4. Deadline for payment of fees and charges:
Fees and charges in the banking, securities, and insurance sectors shall be collected and submitted in Vietnamese dong. Organizations and individuals, upon being granted permission to practice, have the responsibility to pay the entire amount of charges in one lump sum when obtaining the license.
III. MANAGEMENT AND USE OF FUNDS FROM FEES AND CHARGES
The system of collection, submission, management, and use of fees and charges in the banking, securities, and insurance sectors shall be implemented according to the provisions in Section C, Part III of Circular No. 63/2002/TT-BTC dated July 24, 2002, guiding the implementation of laws on fees and charges by the Ministry of Finance, and the following specific provisions:
1. Charges:
All funds collected from charges in the banking, securities, and insurance sectors are revenues of the State budget and must be fully submitted 100% to the State budget. Authorities responsible for collecting charges have the duty to organize timely and full submission of collected charges to the State budget according to this Circular.
2. Fees:
Retain 100% of the fees collected from services using securities equipment, infrastructure, and securities activities for the Securities Trading Center to supplement operating expenses.
IV. IMPLEMENTATION ORGANIZATION
1. This Circular takes effect from January 1, 2003. Any provisions regarding fees and charges in other guiding documents that conflict with the provisions of this Circular shall cease to be effective.
2. Within their assigned functions, tasks, and authorities, the State Bank of Vietnam and the Securities Commission are responsible for abolishing types of fees and charges that are inconsistent with the provisions of Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government detailing the implementation of the Ordinance on Fees and Charges.
3. In addition to the specific contents stipulated in this Circular, other issues related to fees and charges in the banking, securities, and insurance sectors shall be implemented according to the provisions of the Ordinance on Fees and Charges, Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government, and Circular No. 63/2002/TT-BTC dated July 24, 2002, of the Ministry of Finance.
4. Organizations and individuals subject to the collection, submission, management, and use of fees and charges in the banking, insurance, and securities sectors are responsible for implementing this Circular.
During the implementation process, if there are difficulties or obstacles, organizations and individuals are requested to promptly report them to the Ministry of Finance for consideration and resolution.
