Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Ordinance on Protection of State Secrets No. 30/2000/PL-UBTVQH10 dated December 28, 2000 of the Standing Committee of the National Assembly, Term X;
At the proposal of the Minister of Fisheries and the Minister of Public Security,
DECISION:
Article 1. The list of state secrets of the highest confidentiality level in the Fisheries sector includes information within the following scope:
1. Plans of the Fisheries sector to participate in national defense and plans to mobilize forces of the Fisheries sector to cooperate with the Ministry of Defense to counteract war.
2. Content of preparation for negotiations related to delimitation of maritime zones and joint fishing areas at sea between Vietnam and neighboring countries.
Article 2. The list of state secrets of the top confidentiality level in the Fisheries sector includes information within the following scope:
1. Content of preparation for negotiation and signing cooperation agreements between the Fisheries sector and foreign countries or international organizations that have not been announced.
2. Documents and data on Vietnam's aquatic resources that have not been announced.
3. Documents to deal with trade disputes, copyright, and intellectual property cases.
4. Plans to dispatch vessels and boats to exploit in the East Sea and the Spratly Islands' waters in special situations to protect national sovereignty, serve security, and defense.
5. Opinions of Party and State leaders, Government directives guiding the Fisheries sector in activities serving security and defense.
6. Contents and minutes of meetings of the Party Cadre Management Board of the Ministry of Fisheries regarding policies, strategies for developing international cooperation and personnel preparation of the Fisheries sector that have not been announced.
Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 576/TTg dated November 29, 1993 of the Prime Minister on the List of State Secrets in the Fisheries sector.
Article 4. The Minister of Fisheries and the Minister of Public Security are responsible for supervising the implementation of this Decision.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
