Handling and reorganizing state-owned houses and lands in Ho Chi Minh City

 

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Land Law dated July 14, 1993 and the Law Amending and Supplementing Certain Articles of the Land Law dated December 2, 1998;

Pursuant to Resolution No. 02/1998/PL-UBTVQH10 dated February 26, 1998 of the Standing Committee of the National Assembly on thrift and anti-waste practices; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Pursuant to Decree No. 86/CP dated December 19, 1996 of the Government on the issuance of Auction Rules for Assets;

At the proposal of the Minister of Finance,

Based on Decree No. 14/1998/NĐ-CP dated March 6, 1998 of the Government on state asset management;

The Chairman of the People's Committee Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Amends and supplements certain articles of Decision No. 80/2001/QĐ-TTg dated May 24, 2001 of the Prime Minister on the handling and reorganization of state-owned houses and lands in Ho Chi Minh City as follows: City of Ho Chi Minh,

DECISION:

Article 1. 1. Clause 1 of Article 3 shall be amended and supplemented as follows: "1.Ministries, ministerial-level agencies, government agencies, central agencies of mass organizations, provincial people's committees under the direct jurisdiction of the Central Government, and total companies established by decision of the Prime Minister shall be responsible for inspecting, reviewing, and providing written opinions on proposals for handling and reorganizing offices and production and business premises of subordinate units located within the territory of Ho Chi Minh City and submitting them to the Ministry of Finance.

The Minister of Finance shall take the lead and coordinate with the Chairman of the Ho Chi Minh City People's Committee to decide on the handling and reorganization of offices and production and business premises of these units within the territory of Ho Chi Minh City." 2. Clause 3 of Article 4 shall be amended and supplemented as follows: "3.The sale of houses and the transfer of land use rights shall be carried out as follows:

a) The valuation of houses and land must be conducted through one of the following organizations: The Council for Valuation and Auction of State-Owned Factories and Warehouses of Ho Chi Minh City (referred to as the Council for Valuation and Auction of Ho Chi Minh City); Organizations with the function of state appraisal.

b) The auction must be conducted through the Council for Valuation and Auction of Ho Chi Minh City or according to the delegation of the Chairman of the Ho Chi Minh City People's Committee. In cases where only one organization or individual registers to purchase, there will be no auction. The Council for Valuation and Auction of Ho Chi Minh City shall decide to sell at the price determined by the organizations specified in point a above. In special cases, the Chairman of the Ho Chi Minh City People's Committee may decide to sell designated houses and transfer land use rights of units under the management of the Central Government and the city according to the price determined by the organizations specified in point a above."

The auction shall be carried out in accordance with the procedures stipulated in Decree No. 86/CP dated December 19, 1996 of the Government on the issuance of Auction Rules for Assets. Specifically, for the sale of houses and the transfer of land use rights pursuant to Decision No. 80/2001/QĐ-TTg dated May 24, 2001 of the Prime Minister, public notice shall be given at least 15 days before the auction takes place.

Article 2. All previous regulations that conflict with this Decision are hereby abolished. Ministers, heads of ministerial-level agencies, heads of government agencies, central agencies of mass organizations, and general directors of total companies established

Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

All previous provisions contrary to this Decision are abolished. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, central bodies of social organizations, and General Directors of State Corporations shall
