PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Ordinance on Prevention and Control of Human Immunodeficiency Virus (HIV) Infection and Acquired Immunodeficiency Syndrome (AIDS) dated May 31, 1995;
Pursuant to the Government Decree No. 34/CP dated June 1, 1996 guiding the implementation of the Ordinance on Prevention and Control of Human Immunodeficiency Virus (HIV) Infection and Acquired Immunodeficiency Syndrome (AIDS);
Pursuant to Decision No. 358/CT dated October 6, 1990 of the Chairman of the Council of Ministers establishing the National Committee for SIDA Prevention and Control (now the National Committee for HIV/AIDS Prevention and Control);
Considering the proposal of the Chairman of the National Committee for HIV/AIDS Prevention and Control and the Minister, Head of the Civil Service Department of the Government,
DECISION:
Article 1. The National Committee for HIV/AIDS Prevention and Control assists the Prime Minister in directing and implementing HIV/AIDS prevention and control work, with the following tasks and powers:
1. Developing strategies, policies, and plans for HIV/AIDS prevention and control.
Taking the lead in coordinating with relevant ministries and sectors to develop legal documents on HIV/AIDS prevention and control.
2. Coordinating with the Ministry of Health, the Ministry of Planning and Investment, and the Ministry of Finance to prepare annual budget plans for HIV/AIDS prevention and control, submitting them to the Government for approval and allocating approved funds to relevant ministries, sectors, social organizations, and localities in accordance with assigned tasks.
3. Directing, inspecting, and urging the implementation of HIV/AIDS prevention and control work nationwide.
Managing and operating the "HIV/AIDS Prevention and Control Program" in accordance with the Prime Minister's regulations on managing national target programs.
Directing and coordinating the activities of relevant ministries and sectors, social organizations, and local People's Committees in the following matters:
a) Monitoring, supervising, and keeping abreast of the spread of HIV/AIDS in localities and throughout the country.
b) Organizing advisory networks for HIV/AIDS prevention and control.
c) Managing, treating, caring for, and advising people infected with HIV/AIDS.
d) Strengthening technical infrastructure in the health sector for HIV/AIDS prevention and control, ensuring absolute safety in healthcare services.
e) Organizing scientific research and training staff to enhance the effectiveness of HIV/AIDS prevention and control.
4. Serving as the focal point for international cooperation, coordinating and managing bilateral and multilateral cooperation on HIV/AIDS prevention and control at the national level and among sectors and localities.
5. Coordinating with relevant ministries and sectors to inspect, audit, resolve complaints and reports, and handle violations of laws related to HIV/AIDS prevention and control.
6. Summarizing, concluding, and evaluating the effectiveness of HIV/AIDS prevention and control annually and over different phases.
Article 2. The National Committee for HIV/AIDS Prevention and Control has an office to assist its operations. The Office of the Committee is headquartered in Hanoi. The organization and staffing of the Office shall be decided by the Chairman of the Committee after consultation with the Civil Service Department of the Government.
Article 3. The National Committee for HIV/AIDS Prevention and Control may use the state emblem seal and have accounts in both Vietnamese currency and foreign currencies at the State Bank of Vietnam.
Article 4. Organizations conducting HIV/AIDS prevention and control work at various sectors and levels shall operate as follows:
1. Ministries, agencies equivalent to ministries, government agencies, mass organizations, and social organizations with many activities related to HIV/AIDS prevention and control shall establish a steering committee for HIV/AIDS prevention and control chaired by a Deputy Minister (or equivalent), with dedicated staff within the ministry or sector's establishment.
2. Provinces and centrally-administered cities shall establish a Committee for HIV/AIDS Prevention and Control chaired by a Vice Chairman of the People's Committee, with the Director of the Health Department as Vice Chairman, and with some dedicated staff within the Health Department's or other departments' establishments that are members of the local HIV/AIDS Prevention and Control Committee.
3. Districts, counties, towns, and provincial-level cities shall establish a Steering Committee for HIV/AIDS Prevention and Control chaired by a Vice Chairman of the People's Committee, with some dedicated or concurrently appointed staff within the establishments of the steering committee's member agencies.
4. HIV/AIDS prevention and control work at communes and wards shall be handled by the Chairman or Vice Chairman of the People's Committee, assisted by staff from health stations who are concurrently appointed.
The functions, tasks, and powers of HIV/AIDS prevention and control organizations at various sectors and levels shall be defined by the heads of those sectors and the Chairmen of People's Committees at all levels according to guidelines provided by the National Committee for HIV/AIDS Prevention and Control.
Article 5. This Decision shall take effect fifteen days after its signing. All previous provisions contrary to this Decision shall be abolished.
The Chairman of the National Committee for HIV/AIDS Prevention and Control, the Ministers, Heads of agencies equivalent to ministries, Heads of government agencies, and Chairmen of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
