DECISION

Issuing temporarily the rates for Internet telephone services from PC to phone for international outgoing calls

THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and postal and telecommunications tariff management;

Pursuant to Circular No. 03/1999/TT-TCBD dated May 11, 1999 of the General Post Office guiding the implementation of Decree No. 109/1997/NĐ-CP dated November 12, 1997 of the Government on Posts and Telecommunications and Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and rate management for postal and telecommunications services;

At the proposal of the Director of the Planning and Finance Department,

DECISION:

Article 1. Issuing temporarily the rates for Internet telephone services from a personal computer (PC) located in Vietnam connecting to the Internet to a telephone in another country (hereinafter referred to as PC-to-Phone international outgoing calls) as follows:

1. Telephone call rates:

- The rates shall not be lower than 1,400 Vietnamese dong per minute as prescribed by enterprises providing such services.

- The unit of time for calculating rates is minutes. A call lasting less than one minute shall be counted as one minute. Any remaining time at the end of a call that is less than one minute shall also be counted as one minute.

- The above rates do not include value-added tax and do not include Internet access fees and other telecommunications service fees for Internet access.

2. Enterprises providing such services shall specify the rates for PC-to-Phone international outgoing calls to each country and territory based on compliance with Clause 1 of this Article and report to the Ministry of Posts and Telecommunications before officially implementing them.

Article 2.

1. Monthly, before the tenth day of the following month, enterprises shall report:

- Volume and revenue from rates for PC-to-Phone international outgoing calls;

- Collection status of rates from users of the service;

- Negotiation and payment status of rates with foreign partners.

2. In cases where enterprises providing PC-to-Phone international outgoing calls issue prepaid cards:

a) Enterprises shall establish specific and publicly announce the denominations of the cards, their validity periods, and corresponding telephone call rates, and report to the Ministry of Posts and Telecommunications before officially implementing them.

b) Monthly, before the tenth day of the following month, enterprises providing the service must report to the Ministry of Posts and Telecommunications the following information:

- Quantity and revenue from card sales by denomination in the month;

- Number of new activated cards in the month;

- Number of activated cards that have been fully used or sold but not activated within the validity period in the month;

- Volume and revenue from PC-to-Phone international outgoing calls made using the enterprise's cards in the month.

Article 3. This Decision takes effect from July 1, 2003.

Article 4. The Head of the Office, the Director of the Planning and Finance Department, Heads of units under the Ministry of Posts and Telecommunications, General Directors, Directors of telecommunications service enterprises, General Directors, Directors of PC-to-Phone international outgoing call service enterprises, and Heads of related units are responsible for implementing this Decision./.
