Pursuant to Decree No. 73-CP dated November 1, 1995 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decision No. 78/2001/QĐ-TTg of the Prime Minister regarding the issuance of the Provision on standards and quotas for the use of official telephones at private residences and mobile phones for leaders in administrative agencies, public institutions, political organizations, and political-social organizations;
Pursuant to Circular No. 73/2001/TT-BTC dated September 30, 2001 of the Ministry of Finance regarding "Guidelines for the use of official telephones at private residences";
Based on the proposal of the Director of the Office and the Head of the Financial and Accounting Department;
DECISION:
Article 1. Issued herewith is the "Regulation on equipping, using, and settling telephone expenses for official use at private residences and mobile phones for leaders in the Ministry of Agriculture and Rural Development".
Article 2. This Decision shall take effect fifteen days from the date of signature. All previous regulations contrary to this Decision are hereby abolished.
Article 3. The Director of the Office, the Heads of the Financial and Accounting Department and the heads of units related to the Ministry of Agriculture and Rural Development are responsible for implementing this Decision.

REGULATIONS
REGULATION ON EQUIPPING, USING AND SETTLING TELEPHONE EXPENSES FOR OFFICIAL USE AT PRIVATE RESIDENCES AND MOBILE PHONES FOR LEADERS IN THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
(Issued pursuant to Decision No. 114/2001/QĐ-BNN-VP dated November 30, 2001 of the Minister of Agriculture and Rural Development)
I. EQUIPPING FIXED TELEPHONES :
1. The following subjects are equipped with one fixed telephone at their private residence for official activities, according to the provisions attached to Decision No. 78/2001/QĐ-TTg of the Government (hereinafter referred to as the Government's provisions):
a) The Minister
b) Deputy Ministers and equivalent positions, officials holding leadership positions with a coefficient of 1.1 or higher; senior experts.
c) Professors recognized by the State meeting one of the following criteria:
- Awarded the Ho Chi Minh Prize by the State.
- Honored as Hero of Labor or Hero of the People's Armed Forces by the State.
For retired professors who continue to serve as the head of national or ministry-level scientific projects and meet one of the above criteria, they also fall within the scope of application of this provision.
d) The Director of the Office, Department Heads, Bureau Chiefs, Chief Inspector of the Ministry, and equivalent positions with a leadership position coefficient from 0.8 to less than 1.1.
2. In addition to the aforementioned subjects, the following subjects are also equipped with one fixed telephone at their private residence for official activities:
a) Secretary of the Party Committee of the Ministry (if receiving salary from the Office fund)
b) Secretary of the Party Committee of the Agricultural and Rural Development Sector in Ho Chi Minh City (if receiving salary from the Office fund).
c) Director of the Party Cadre Affairs Board.
d) Chairman of the Trade Union of the Ministry (if receiving salary from the Office fund)
đ) Deputy Director in charge of synthesis, Deputy Director concurrently serving as Head of the Representative Office in Ho Chi Minh City.
e) Head of the Administrative Department, Team Leader of the Vehicle Team of the Ministry's Office, Team Leader of Team II of the Ministry's Office in Ho Chi Minh City.
g) Secretary of the Minister
h) Special cases due to work requirements will be considered and decided by the Ministry's leadership.
II. EQUIPPING MOBILE PHONES :
1. Subjects mentioned in point a, b, c, clause 1, section I, in addition to being equipped with one fixed telephone at their private residence, are also equipped with one mobile phone.
2. In addition to the aforementioned subjects, the following subjects are also equipped with one mobile phone for official activities:
a) Director of the Ministry's Office
b) Director of the Plant Protection and Animal Health Bureau
c) Director of the Forest Management and Nature Conservation Bureau
d) Director of the Forestry Inspection Bureau
đ) Director of the Plant Protection Bureau
e) Director of the Animal Health Bureau
III. METHODS OF EQUIPPING AND SETTLING TELEPHONE EXPENSES FOR FIXED TELEPHONES AT PRIVATE RESIDENCES AND MOBILE PHONES :
1. Methods of equipping:
All subjects under the aforementioned provisions who have not yet been equipped with fixed telephones at their private residences or mobile phones using public funds (budget or supported by units within the sector) will be provided with equipment according to the levels stipulated by the Government.
- The cost of purchasing a fixed telephone does not exceed 300,000 VND per unit and installation costs according to the contract signed with the Postal Authority (if already equipped, no re-equipment).
- The cost of purchasing a mobile phone does not exceed 3,000,000 VND per unit and installation costs according to the contract signed with the Postal Authority (if already equipped, no re-equipment).
2. Methods of settling telephone expenses:
a) Transfer the subscription contracts for fixed telephones at private residences and usage contracts for mobile phones for the subjects listed in sections I and II above to individuals for management, while the agency only signs subscription contracts for fixed telephones at private residences and mobile phones for the Minister.
b) Allocate monthly payments for telephone subscriptions and expenses for fixed telephones at private residences and mobile phones for subjects with the following standards:
- Subjects at point a, clause 1, section I are allocated 300,000 VND per unit per month for fixed telephones and 500,000 VND per unit per month for mobile phones.
- Subjects at points b, c, clause 1, section I are allocated 200,000 VND per unit per month for fixed telephones and 400,000 VND per unit per month for mobile phones.
- Subjects at point d, clause 1, section I and points a, b, c, d, clause 2, section I are allocated 100,000 VND per unit per month for fixed telephones.
- Subjects at points e, g, h, clause 2, section I are allocated 50,000 VND per unit per month for fixed telephones.
Specifically, subjects at points a, b, c, d, đ, e, clause 2, section II are allocated 250,000 VND per unit per month for mobile phones.
3. Officials who are provided with fixed-line telephones at their residences and mobile phones, if directly assigned by the Minister to participate in search and rescue operations, disaster prevention and mitigation activities (such as floods, storms, epidemics, forest fires, etc.), shall be reimbursed for the difference between actual telephone charges incurred and the allocated quota as follows:

The officials directly assigned by the Ministry's leadership to participate in such work shall be responsible for calculating and preparing a payment request form for approval by the Ministry's leadership (accompanied by the telephone bill for the month of assignment or other relevant documents).
IV. SITUATIONS IN WHICH THE REIMBURSEMENT OF TELEPHONE CHARGES SHALL BE TERMINATED OR NOT CONTINUED:
Officials who are provided with telephones at their residences and mobile phones, when they transfer to new positions that do not require telephone provision, or upon retirement or cessation of service, shall not be reimbursed for the telephone charge allocation in the following month from the month of the decision on job transfer, retirement decision, or decision to cease holding the position of head of a scientific research project at the ministerial or state level for retired professors.
However, for the subjects mentioned in points a, b, and c of Clause 1, Section I, they shall continue to be reimbursed for the fixed-line telephone usage charges according to the allocated quota for a period of three months from the date of the retirement or cessation of service decision.
