PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the State Budget Law dated December 16, 2002;
Pursuant to the Action Program on Prevention and Control of Drugs for the period 2001-2005;
At the proposal of the Minister of Finance,
DECISION:
Article 1. Amending and supplementing Article 4 and Clause 1 of Article 5 of Decision No. 31/2000/QĐ-TTg dated March 2, 2000 of the Government Chairman on the establishment of the anti-drug fund as follows:
a) Amending and supplementing Point c Clause 2 as follows:
"Article 4
1. The local anti-drug fund shall be used for the following purposes:
a) Supporting units directly combating drug-related crimes; purchasing equipment for drug prevention and control work.
b) Supporting relatives of those who have been killed, injured, or fallen ill due to direct participation in combating drug-related crimes, eradicating and replacing poppy plants, and organizing drug rehabilitation.
c) Awarding units and individuals with outstanding achievements in drug prevention and control work.
d) Supporting other activities related to drug prevention and control.
2. The central anti-drug fund shall be used to support urgent and critical tasks related to drug prevention and control involving multiple provinces and centrally-administered cities."
2. Amend and supplement Clause 1, Article 5 as follows:
"1. The amount of money collected from cases of drug-related offenses adjudicated by the People's Court, as stipulated in Clause 1 of Article 2 of Decision No. 31/2000/QĐ-TTg dated March 2, 2000, shall be allocated as follows:
a) Allocating 30% to support and reward units and individuals directly involved in detecting and investigating the case;
b) Allocating 60% to the provincial or centrally-administered city anti-drug fund where the People's Court adjudicates the case;
c) Allocating 10% to the central anti-drug fund."
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 3. The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security and the Ministry of National Defense to guide the implementation of this Decision. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial and centrally-administered city People's Committees shall be responsible for enforcing this Decision. /.
