DIRECTIVE

ISSUED BY THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

on strengthening labor export activities

and experts during the period of 2001-2005.

 

Implementing Directive No. 41-CT/TW dated September 22, 1998 of the Politburo on labor export and experts; Decree No. 152/1999/NĐ-CP dated September 20, 1999 of the Government on Vietnamese workers and experts going abroad for a limited time; many units have done well in labor export and expert activities, contributing to economic and social development. However, some units have not achieved effectiveness due to lack of initiative in market research, waiting for partners, or committing violations... which negatively affect workers and the labor export and expert activities of the sector.

To continue effectively implementing Directive No. 41-CT/TW of the Politburo to address existing issues and improve the efficiency of labor export and expert activities of the sector, the Minister of Agriculture and Rural Development instructs: "Heads of agencies and units under the Ministry shall strengthen labor export and expert activities of the sector during the period of 2001-2005 as follows:

           

I. Grasp the guiding ideology and state regulations on labor export and experts during the period of 2001 to 2005:

1.Understand deeply the guidance opinions of Prime Minister Phan Van Khai and Deputy Prime Minister Pham Gia Khiem at the National Conference on Labor Export and Experts: Labor export and expert issues must be considered as one of the key political tasks, not only having economic significance but also significant social impact; not only short-term benefits but also long-term benefits... from which practical and effective plans and solutions can be developed.

2.Grasp the issued documents:

Of the Politburo and the Government:

Directive No. 41-CT/TW dated September 22, 1998 of the Politburo on labor export and experts.                     

Decree No. 152/1999/NĐ-CP dated September 20, 1999 of the Government on Vietnamese workers and experts going abroad for a limited time.

Of the Ministry of Labor, Invalids and Social Affairs:

Circular No. 28/1999/TT-BLĐTBXH dated November 15, 1999 guiding the implementation of Decree No. 152/1999/NĐ-CP.

II. For enterprises under the Ministry that have been granted permission by the Ministry of Labor, Invalids and Social Affairs to operate labor export:

1.Enterprises engaged in labor export work must clearly recognize that this is not purely a business activity aimed solely at profit, but also a large social responsibility. Therefore, they must create favorable conditions and pay attention to the legitimate interests of workers, protecting their rights.

2.Develop plans and measures to organize and implement the strengthening of labor export and expert activities during the period of 2001-2005 based on careful study of the above documents, market conditions, and the specific characteristics of the Agricultural and Rural Development sector's labor export.

3.Develop a proposal for organizing training activities according to the training and education orientation regime for workers going abroad for a limited time (issued with Decision No. 1635/1999/QĐ-BLĐTBXH dated December 13, 1999 of the Ministry of Labor, Invalids and Social Affairs), the regulation on issuing and managing training certificates and education orientation (Decision No. 179/2000/QĐ-BLĐTBXH dated February 22, 2000) and guidelines from the Department of Overseas Labor Management (document No. 131/QLLĐNN dated April 6, 2000).

4.Enterprises conducting household helper labor export must coordinate with Women's Unions in the place of residence of workers when recruiting to properly fulfill the requirements set out in Circular No. 1622/LĐTBXH-QLLDNN dated May 25, 2000 of the Ministry of Labor, Invalids and Social Affairs.

5.Enterprises exporting labor must regularly report to the Ministry of Agriculture and Rural Development and the Ministry of Labor, Invalids and Social Affairs on the results of implementing Directive No. 41-CT/TW of the Politburo, Decree No. 152/1999/NĐ-CP of the Government; the situation of labor export and expert activities of their unit, according to the contents stipulated in Circular No. 2424/LĐTBXH-QLLĐNN dated July 27, 2000 of the Ministry of Labor, Invalids and Social Affairs.

6.Units requiring activities or currently processing applications for permission to conduct labor export and expert activities must comply with the provisions of Decree No. 152/1999/NĐ-CP of the Government. During the process of handling procedures, if there are difficulties, they must report to the Ministry for consideration and resolution. After obtaining permission from the Ministry of Labor, Invalids and Social Affairs, units must study and implement according to the current directives and regulations.

7.Training institutions granted certificates for training and education orientation for workers going abroad in various sectors must develop plans and clearly define the content of the training program to enhance workforce training efforts, improve worker quality, and strictly adhere to the regulations of the Ministry of Labor, Invalids and Social Affairs.

III. Strengthen state management over labor export and experts:

1.Assign powers and responsibilities to the following management agencies:

1.1.The International Cooperation Department is responsible for advising the Ministry on researching partners and promoting market expansion;

1.2.The Policy Department for Agriculture and Rural Development, the Financial Accounting Department guide and monitor the implementation of systems, policies, and finance;

1.3.The Office and the Inspectorate assist the Ministry in strengthening inspections, supervision, and handling violations in labor export and expert activities of units according to Decree No. 61/1998/NĐ-CP dated August 15, 1998 of the Government;

1.4.The Cadre and Civil Servant Organization Department oversees the compilation, guides, and urges heads of labor export enterprises and related units under the Ministry to strictly implement this directive.

1.5. The Trade Union of the Agriculture and Rural Development sector and the information agencies of the sector shall publicize to ensure that workers fully understand the Party's and State's policies on labor export and expert dispatch in order to contribute to building workers' sense of responsibility and combating negative practices in labor export and expert dispatch activities.

2. Annually, the Ministry shall conduct inspections and audits of enterprises licensed for operation regarding labor export and expert dispatch based on the inspection and audit content specified in Circular No. 2424/LDTB-XHH-QLLDD dated July 27, 2000, issued by the Ministry of Labor, War Invalids and Social Affairs.

Labor export and expert dispatch are strategic socio-economic activities that significantly contribute to human resource development, job creation, income generation, skill enhancement for workers, increased revenue for the country, and strengthened international cooperation. The above are urgent requirements, which relevant agencies and units must thoroughly grasp and effectively implement according to this Directive. In case of any difficulties arising during implementation, related agencies and units shall promptly report to the Ministry of Agriculture and Rural Development for consideration and resolution./.
