JOINT CIRCULAR
Regulations on Management and Use of Funds for Implementation of the Social Assistance and Functional Recovery Program and Functional Recovery
for Mentally Ill Persons and Persons with Mental Disorders Based on Community Support from 2011 to 2020.

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
Implementing Decision No. 1215/QĐ-TTg dated July 22, 2012 of the Prime Minister approving the Social Assistance and Functional Recovery Program for Mentally Ill Persons and Persons with Mental Disorders from 2011 to 2020.
The Minister of Finance and the Minister of Labor - Invalids and Social Affairs issue this Joint Circular regulating management and use of funds for implementation of the Social Assistance and Functional Recovery Program for Mentally Ill Persons and Persons with Mental Disorders based on community support from 2011 to 2020 (hereinafter referred to as the Program).
Article 1. Scope and Applicability
1. This Circular applies to agencies, units, organizations, and individuals using state budget funds for the execution of Program activities.
2. In cases where the Program uses development investment capital or non-reimbursable aid funds, it shall be implemented according to current State regulations and specific guidelines provided by the donor for these sources of funding.
Article 2. Sources of Funds

a) Central Budget:
- Ensuring funding for the implementation of activities under the Project that fall within the responsibilities of ministries and central agencies;
- Targeted support for some localities to upgrade, expand, increase capacity, and purchase necessary equipment and supplies for mental health care and functional recovery activities; building pilot models of facilities for prevention and treatment of persons with mental disorders according to the approved Project;
- Targeted support for localities receiving additional funds; balancing from the central budget to implement the following tasks:
+ Developing human resources for social assistance and functional recovery for persons with mental disorders based on community involvement.
+ Communication and raising awareness about the responsibility of families, communities, and society regarding care and functional recovery; enhancing knowledge, skills, social assistance, and functional recovery for persons with mental disorders based on community involvement.
b) Local budgets proactively allocate funds for local agencies and units to implement activities of the Project as stipulated in Decision No. 1215/QĐ-TTg in accordance with current laws on decentralization of state budget and Clause 3 of this Circular.
2. International organization aid funds (if any) for Project activities.
3. Contributions from families of persons with mental disorders. The objects, contents, and levels of collection are specified by the People's Committees of provinces and centrally-administered cities.
Article 3. Contents and expenditure levels for Project activities
1. Supporting material infrastructure and equipment for social welfare institutions providing care and functional recovery for persons with mental disorders from the social security program funds in the central budget:
a) Depending on specific requirements, conditions, and capabilities of the local budget, the Chairman of the People's Committee of the province or centrally-administered city (hereinafter referred to as provincial level) approves new construction or upgrading projects of social welfare institutions providing care and functional recovery for persons with mental disorders (after obtaining written agreement from the Ministry of Labor, Invalids and Social Affairs).
b) The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Health to establish standards for appropriate equipment suitable for the scale of social welfare institutions providing care and functional recovery for persons with mental disorders.
c) Ensuring funding in the budget estimate of the Ministry of Labor, Invalids and Social Affairs to purchase specialized equipment for care, treatment, and functional recovery activities for persons with mental disorders for completed new construction projects of social welfare institutions.
+ Up to 10,000 million VND per institution for upgrading, expanding, and increasing capacity projects of social welfare institutions providing care and functional recovery for persons with mental disorders from 300 to 500 beneficiaries.
+ Up to 5,000 million VND per institution for purchasing specialized equipment and initial supplies for newly constructed social welfare institutions providing care and functional recovery for persons with mental disorders that have been completed.
+ Up to 2,000 million VND per institution for purchasing specialized equipment for rotating social welfare institutions providing care and functional recovery for persons with mental disorders.
2. Funding for developing human resources for social assistance and functional recovery for persons with mental disorders based on community involvement:
2.1. Training and training costs for staff and volunteers in the field of mental health care; enhancing the capacity of lecturers at training institutions and family members of beneficiaries; skills and methods for caring and functional recovery for persons with mental disorders.
a) The content and level of training and training costs are implemented in accordance with Circular No. 139/2010/TT-BTC dated September 21, 2010, of the Ministry of Finance on the preparation of budget estimates, management, and use of state budget funds for training and capacity building for officials and civil servants and any subsequent amendments and supplements (if any).
b) Costs for compiling training materials. The cost is 70,000 VND per standard page.
c) Training institutions or agencies assigned to open training courses from Project funds may provide support to volunteers and family members of beneficiaries during concentrated training days. The support includes:
- Travel expenses from place of residence to the training location (one round trip);
- Accommodation rental support expenses (in cases where the training institution does not have the conditions to arrange accommodation for trainees and they must rent);
- Support for meals and refreshments during breaks.
The expenditure level shall be implemented in accordance with the provisions of Circular No. 97/2010/TT-BTC dated July 6, 2010, issued by the Ministry of Finance, regarding the regulations on travel expenses and expenditure for organizing conferences for state agencies and public service units (hereinafter referred to as Circular No. 97/2010/TT-BTC).
2.2. Expenditure to support training institutions in developing curricula and textbooks for social work training programs in the field of mental health care and functional recovery for people with mental disorders. The content and expenditure levels shall be applied according to the regulations on textbook development for university and college majors as stipulated in Circular No. 123/2009/TT-BTC dated June 17, 2009, issued by the Ministry of Finance, concerning the content and expenditure levels for developing curriculum frameworks and compiling textbooks for subjects in university, college, and vocational high school majors.
3. Expenditure to support the pilot construction of facilities for preventing and treating mental disorders from the social welfare budget under the central government's budget:
a) The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Health to issue standards for equipment suitable for the scale of facilities for preventing and treating mental disorders.
b) The Minister of Labor, Invalids, and Social Affairs shall approve the list of social welfare institutions directly under the Ministry and the list of local social welfare institutions that develop pilot projects for facilities for preventing and treating mental disorders. The number of pilot models for facilities for preventing and treating mental disorders to be supported during the period of 2011-2015 shall be at least ten models.
c) Allocate funds in the budget for expenditures of the Ministry of Labor, Invalids, and Social Affairs to implement the pilot construction of facilities for preventing and treating mental disorders:
- Expenditure for researching and issuing criteria and conditions for pilot model facilities for preventing and treating mental disorders. The content and expenditure levels shall be carried out in accordance with current State regulations.
- Support for repairs, renovations, and the purchase of necessary specialized equipment and supplies for the operation of facilities for preventing and treating mental disorders under the Ministry.
d) Provide targeted support to local budgets for repairs, renovations, and the purchase of necessary specialized equipment and supplies for the operation of pilot model facilities for preventing and treating mental disorders. The maximum support amount is 3 billion VND per facility.
đ) During the period of 2016-2020, support the expansion of the model to districts, counties, towns, and cities within provinces with a large number of beneficiaries to provide psychological therapy and functional recovery services for people with mental disorders based on the evaluation of the implementation of pilot facilities for preventing and treating mental disorders during the period of 2011-2015.
4. Communication to raise awareness about the responsibilities of families, communities, and society as a whole in caring for and restoring functions; enhancing knowledge and skills in social assistance and functional recovery for people with mental disorders based on community involvement:
a) Expenditure for propaganda through mass media (radio, television, press); building, producing, duplicating, and distributing various types of communication products according to the approved budget. The selection of propaganda forms, contents, programs, and products shall be decided by the head of the agency responsible for communication based on the authorized budget and in accordance with Decision No. 39/2008/QĐ-TTg dated March 14, 2008, issued by the Prime Minister, establishing the bidding, ordering, and assignment regulations for providing public services using state budget funds and related guiding documents.
b) Expenditure for organizing contests and disseminating laws on caring for and restoring functions for people with mental disorders based on community involvement, as approved by the competent authority. The content and expenditure levels shall be in accordance with Circular No. 73/2010/TTLT-BTC-BTP dated May 14, 2010, issued jointly by the Ministry of Finance and the Ministry of Justice, guiding the preparation, management, and use of funds to ensure legal education and dissemination activities.
c) Expenditure for building and operating websites. The content and expenditure levels shall be carried out in accordance with Circular No. 137/2007/TT-BTC dated November 28, 2007, issued by the Ministry of Finance, guiding the expenditure levels for creating electronic information; Circular Jointly Issued No. 19/2012/TTLT-BTC-BKH&ĐT-BTTTT dated February 15, 2012, issued jointly by the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Information and Communications, guiding the management and use of funds for implementing the National Program on the Application of Information Technology in Government Activities.
5. Expenditure for drafting and promulgating normative legal documents. The content and expenditure levels shall be carried out in accordance with Circular Jointly Issued No. 192/2010/TTLT-BTC-BTP-VPCP dated December 2, 2010, issued jointly by the Ministry of Finance, the Ministry of Justice, and the Office of the Government, guiding the preparation of budgets, management, use, and settlement of State budget funds to ensure legislative work and the completion of the legal system, and Circular Jointly Issued No. 47/2012/TTLT-BTC-BTP dated March 16, 2012, issued jointly by the Ministry of Finance and the Ministry of Justice, regulating the preparation of budgets, management, use, and settlement of State budget funds to ensure legislative work and the completion of normative legal documents by People's Councils and People's Committees.
6. Expenditure for scientific research in fields such as prevention, early detection, and intervention, psychological therapy, and functional recovery for people with mental disorders. The content and expenditure levels shall be carried out in accordance with Circular Jointly Issued No. 93/2006/TTLT/BTC-BKH&CN dated October 4, 2006, guiding the system of allocated funds for implementing scientific and technological projects using state budget funds, and Circular Jointly Issued No. 44/2007/TTLT-BTC-BKH&CN dated May 7, 2007, guiding the standardization of the establishment and allocation of budget funds for scientific and technological projects using state budget funds by the Ministry of Finance and the Ministry of Science and Technology, and any subsequent amendments and supplements (if any).
7. Expenditure for investigation, survey, establishment of databases to assist social welfare and functional recovery for individuals with mental disorders and community-based mental health patients as decided by the competent authority as stipulated in Clauses 2, 3, and 4 of Article 10 of Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics. The content and expenditure levels shall be implemented according to the provisions of Circular No. 58/2011/TT-BTC dated May 11, 2011 of the Ministry of Finance on the management, use, and settlement of funds for statistical surveys.
8. Expenditure for inspection, supervision, interim review, final summary, and evaluation of the implementation of the project's activities. The content and expenditure levels shall be implemented according to the provisions of Circular No. 97/2010/TT-BTC.
9. Expenditure for cooperation with foreign organizations and individuals in providing technical support, experience, and resources to develop social assistance and functional recovery for individuals with mental disorders and community-based mental health patients: The content and expenditure levels shall be implemented according to the provisions of Circular No. 102/2012/TT-BTC dated June 21, 2012 on the financial allowance system for state officials traveling abroad for short-term missions funded by the state budget; Circular No. 01/2010/TT-BTC dated January 6, 2010 on the expense regulations for receiving foreign guests visiting Vietnam, organizing international conferences and seminars in Vietnam, and hosting domestic guests; Circular No. 219/2009/TT-BTC dated November 19, 2009 on some expense standards applicable to projects/programs using Official Development Assistance (ODA) funds; and Circular No. 192/2011/TT-BTC dated December 26, 2011 amending and supplementing some articles of Circular No. 219/2009/TT-BTC dated November 19, 2009 of the Ministry of Finance and subsequent amendments and supplements (if any).
10. The state budget ensures regular operational expenditure for social welfare institutions caring for and rehabilitating mental health patients and facilities preventing and treating mental disorders according to the budget classification under the State Budget Law. The content and expenditure levels shall be implemented according to the current financial expenditure regulations of the state for administrative agencies and public service units and the following special expenditure items:
a) Expenditure for purchasing professional guidance materials on prevention and treatment of mental disorders; care and rehabilitation for mental health patients.
b) Expenditure for establishing files at a cost of VND 30,000 per file (including photos).
c) Management expenditure for each individual due to their special nature at a cost of VND 30,000 per individual per month.
d) Support expenditure for those directly counseling and treating psychological therapy, supporting rehabilitation for mental health patients and individuals with mental disorders when working in the community (in addition to the current travel allowance) at a cost of VND 100,000 per day.
đ) Expenditure for purchasing essential personal living items for individuals; medical examination and treatment expenses during the time individuals reside at the facility: The facility shall prepare an appropriate annual budget based on actual conditions and submit it to the competent authority for approval.
e) Transportation expenses for individuals when transferring to another treatment facility; support for transportation costs for poor households' members who have recovered and returned to the community after treatment. The level of expenditure shall be based on the public transport fare rates applicable in the locality or actual expenses (if the unit arranges its own means of transport) or rental contracts (if renting from outside).
g) Support expenditure for meals for homeless mental health patients during their stay at the facility. The meal support level shall be applied according to the local regulations for individuals being cared for at social welfare institutions.
Article 4. Preparation, Execution, and Settlement of State Budget
1. The preparation, allocation, execution, and settlement of funds for implementing the project shall be carried out in accordance with the State Budget Law, Accounting Law, and related guiding documents.
2. The Department of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant departments and sectors to develop a plan for implementing the project at the local level, submit it to the People's Committee Chairman of the province for approval, clearly defining the targets, activities of the project, and the responsibilities of each agency in organizing the implementation of the project; compile and report annually on the results of implementation to the Ministry of Labor, Invalids, and Social Affairs.
3. Social welfare institutions caring for and rehabilitating mental health patients and facilities preventing and treating mental disorders shall base on assigned tasks, content, and expenditure levels stipulated in this Circular, and the number of mental health patients and individuals with mental disorders cared for and treated at the institution, prepare an annual regular expenditure budget together with the main budget and submit it to the supervising agency for consolidation and submission to the finance agency for approval by the competent authority.
4. Annually, based on proposals from ministries, sectors, and localities, and taking into account the approved project implementation funding according to Decision No. 1215/QĐ-TTg, the Ministry of Labor, Invalids, and Social Affairs will review and propose a budget allocation for ministries, sectors, and localities (the portion of project implementation funding from the central budget), consolidate and submit to the Ministry of Finance for consideration and inclusion in the budget estimate, and report to the competent authority for consideration and decision in accordance with the State Budget Law and related implementation guidelines.
5. The management, use, and settlement of supplementary targeted funds from the central budget to the local budget shall be carried out in accordance with the provisions of Circular No. 86/2006/TT-BTC dated September 18, 2006 of the Ministry of Finance on the management of supplementary targeted funds from the central budget to the local budget.
6. The management and use of funds for repair, upgrading of infrastructure, and procurement of equipment shall comply with the current laws on bidding: Circular No. 86/2011/TT-BTC on the management and settlement of investment capital and public service capital with investment characteristics from state budget funds; Circular No. 68/2012/TT-BTC dated April 26, 2012 of the Ministry of Finance on bidding for the purchase of assets to maintain the regular operation of state agencies, political organizations, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations, and people's armed forces units.
Article 5. Implementation Provisions
1. This Circular takes effect from September 3, 2012, and is applicable from the 2012 fiscal year.
2. During the implementation process, if there are any difficulties, units are requested to promptly report to the Ministry of Finance for coordination with the Ministry of Labor, Invalids, and Social Affairs to study and resolve them./.
