RESOLUTION

ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATION OF THE CITIZEN PETITION BOARD

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13;

RESOLUTION:

Article 1. Position and functions of the Citizen Petition Board

The Citizen Petition Board is an agency under the Standing Committee of the National Assembly, with the function of advising and assisting the Standing Committee of the National Assembly on citizen petition work.

Article 2. Tasks and powers of the Citizen Petition Board

1. Assist the Standing Committee of the National Assembly in organizing the reception of citizens by agencies of the National Assembly and National Assembly deputies as prescribed by laws on receiving citizens.

2. Assist the Standing Committee of the National Assembly in organizing the receipt of petitions, complaints, proposals, and reflections from citizens sent to the National Assembly, the President of the National Assembly, Vice Presidents of the National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the National Assembly Office, and the Citizen Petition Board for study; when necessary, transfer the petitions and letters to competent authorities for resolution and follow up and urge the resolution and response to citizens. Summarize, classify, and transfer the opinions and proposals of voters to competent authorities for resolution.

3. Assist the Standing Committee of the National Assembly in coordinating with the Chairman's Board of the Vietnam Fatherland Front Central Committee in compiling comprehensive reports on voter opinions and proposals to be reported at the National Assembly session.

4. Assist the Standing Committee of the National Assembly in monitoring and urging competent authorities in resolving and responding to voter proposals. Assist the Standing Committee of the National Assembly in supervising the resolution of voter proposals, compiling reports on the results of resolving voter proposals, and building reports on the results of supervising the resolution of voter proposals to submit to the National Assembly.

5. Advise and assist the Standing Committee of the National Assembly in organizing and conducting supervision activities on the resolution of citizens' complaints and accusations according to the directives of the Standing Committee of the National Assembly; assist the Standing Committee of the National Assembly in building reports on the results of supervising the resolution of citizens' complaints and accusations to submit to the National Assembly.

6. Summarize the results of citizen reception, receipt and processing of petitions and letters, and the results of supervising the resolution of citizens' complaints and accusations by the Ethnic Council, various Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, Delegations of National Assembly members, and National Assembly deputies, regularly report to the Standing Committee of the National Assembly.

7. Advise and assist the Standing Committee of the National Assembly in guiding Delegations of National Assembly members, National Assembly deputies, Standing Committees of People's Councils, Committees of People's Councils, and People's Council deputies on citizen petition work.

8. Through the implementation of citizen petition work, research and propose to the Standing Committee of the National Assembly issues related to policies, laws, and guidelines.

9. Perform other tasks assigned by the Standing Committee of the National Assembly.

Article 3. Organization of the Citizen Petition Board

The Citizen Petition Board has a Director, Deputy Directors, and a supporting department called the Citizen Petition Department.

The Director and Deputy Directors of the Citizen Petition Board are appointed, relieved, or dismissed by the Standing Committee of the National Assembly.

The organization and tasks of the Citizen Petition Department are regulated by the Director of the Citizen Petition Board in coordination with the Head of the National Assembly Office.

Article 4. Tasks and Powers of the Director and Deputy Directors of the Citizen Petition Board

1. The Director of the Citizen Petition Board is responsible before the Standing Committee of the National Assembly for the organization and operation of the Citizen Petition Board. The Director of the Citizen Petition Board has the following tasks and powers:

a) Organize management and administration of the Citizen Petition Board's activities according to the tasks and powers stipulated in Article 2 of this Resolution;

b) Be subject to leadership and direction by the Standing Committee of the National Assembly, the President of the National Assembly, Vice Presidents of the National Assembly; maintain relations with the Standing Committee of the Ethnic Council, Standing Committees of the National Assembly, the Secretary-General of the National Assembly, agencies under the Standing Committee of the National Assembly, the National Assembly Office, Delegations of National Assembly members, National Assembly deputies, and relevant agencies and organizations in implementing the tasks and powers of the Citizen Petition Board;

c) Coordinate with the Head of the National Assembly Office in the recruitment, utilization, management, appointment, relief, transfer, and dismissal of civil servants of the Citizen Petition Department;

d) Organize the implementation of external affairs and international cooperation of the Citizen Petition Board;

đ) Decide on the use of allocated funds of the Citizen Petition Board.

2. Deputy Directors of the Citizen Petition Board assist the Director of the Citizen Petition Board in performing tasks according to the Director's assignment. When the Director of the Citizen Petition Board is absent, a Deputy Director of the Citizen Petition Board authorized by the Director of the Citizen Petition Board shall perform the Director's tasks and powers.

Article 5. Budget and Assurance Conditions

1. The Citizen Petition Board has a seal as prescribed by law.

2. The operating budget of the Citizen Petition Board is part of the National Assembly's operating budget. The material basis and operational conditions of the Citizen Petition Board are guaranteed by the National Assembly Office.

Article 6. Implementation Provisions

1. This Resolution takes effect from July 1, 2016.

2. Resolution No. 370/2003/NQ-UBTVQH11 dated March 17, 2003 of the Standing Committee of the National Assembly on the establishment of the Citizen Petition Board, which was amended and supplemented by Resolution No. 695/2008/NQ-UBTVQH12 dated October 15, 2008 of the Standing Committee of the National Assembly, ceases to be effective from the date this Resolution takes effect.
