National Defense and Security Education
THE GOVERNMENT
Based on the Law on the Organization of the Government dated December 25, 2001;
Based on the Law on National Defense dated June 14, 2005;
Pursuant to the National Security Law dated December 3, 2004;
Based on the Law on Education dated June 14, 2005;
Considering the proposal of the Minister of National Defense, the Minister of Public Security, and the Minister of Education and Training,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. Scope of application
This Decree stipulates:
1. The content, time, methods of national defense and security education for students and trainees in secondary schools, vocational colleges, technical colleges, colleges, college-level vocational training institutions, and universities (hereinafter referred to as secondary school to university level), trainees in institutions under state agencies, political organizations, and socio-political organizations (hereinafter referred to as political, administrative, and mass organizations); and the training of national defense and security knowledge for party cadres, civil servants at all levels, and other subjects.
2. Advisory bodies, management personnel; support work; responsibilities of ministries, agencies, and provincial people's committees directly under the central government; systems, policies, rewards, and penalties for national defense and security education and training of national defense and security knowledge (hereinafter referred to as national defense and security education and training).
Article 2. Position, nature of national defense and security education and training
1. National defense and security education is part of the national education system, a basic component in building the whole-people national defense and social security; it is a compulsory subject in the curriculum of secondary school to university level and political, administrative, and mass organizations.
2. Studying and training in national defense and security knowledge is both a right and obligation of cadres, civil servants, and the entire population. National defense and security knowledge corresponding to cadre positions is one of the mandatory criteria and one of the standards for considering promotion and appointment to leadership and management positions in state agencies and organizations at all levels and sectors.
Article 3. Objectives, requirements, principles of national defense and security education and training
1. Objectives of national defense and security education and training
To contribute to the comprehensive development of human resources, understanding basic contents about national defense and security; the tradition of resisting foreign invaders, the responsibility and duty of citizens to protect the country; enhancing patriotism and love for socialism; being aware of the plots and tactics of hostile forces; having basic knowledge about the policy and administration of national defense and security; possessing necessary military and security skills to participate in the construction and consolidation of the whole-people national defense and social security, ready to defend the Socialist Republic of Vietnam.
2. Requirements of national defense and security education and training
Conducting comprehensively through various forms suitable for each target group; developing a unified program, textbook, and teaching plan ensuring fundamentality, comprehensiveness, practicality, and systematicness.
3. Principles of national defense and security education and training
Implementing the Party's educational guidelines and viewpoints, state policies and laws, with a focus on the masses, national characteristics, science, modernity, theory combined with practice; integrating school education with propaganda through mass media, organizations, and community residents.
Chapter II
REGULATIONS ON TARGET GROUPS, CURRICULA OF NATIONAL DEFENSE AND SECURITY EDUCATION,
TRAINING OF NATIONAL DEFENSE AND SECURITY KNOWLEDGE
Article 4. Students and trainees in secondary schools to universities; trainees in academies, political, administrative, and mass organizations at all levels, and part-time training classes organized by ministries, sectors, and localities
1. Students and trainees in secondary schools to universities
a) Content of national defense and security education
Tradition of resisting foreign invaders, patriotic spirit, pride, and self-respect of the nation; basic policies and viewpoints of the Party and State on national defense and security; the Party and State's work on national defense and security; legal documents on national defense and security; popularizing essential knowledge about the people's armed forces; Vietnamese military art; preventing and combating the "Peaceful Evolution" strategy and violent overthrow plots of hostile forces against the Vietnamese revolution; basic knowledge about military technology and tactics, civilian defense.
b) Duration of the national defense and security education course
- Secondary schools: 105 class hours;
- Vocational colleges, technical colleges, vocational training colleges: for programs from 12 to 24 months: 45 class hours; for programs from 24 to 36 months: 75 class hours; for programs of 36 months: 120 class hours;
- Colleges: 135 class hours;
- Universities: 165 class hours.
c) Curriculum of national defense and security education
The Ministry of Education and Training will coordinate with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of National Defense, the Ministry of Public Security, and relevant agencies to develop the curriculum of the national defense and security education course for the subjects mentioned in Clause 1 of this Article.
2. Trainees in academies, political, administrative, and mass organizations at all levels, and part-time training classes organized by ministries, sectors, and localities.
a) Content of national defense and security education
Policies and viewpoints of the Party and State on national defense and security; viewpoints and tasks of national defense and security education; state management of national defense and security; legal documents on national defense and security; the formation and development of Vietnamese military art; national defense and security strategies of some countries related to Vietnam's national defense and security; preventing and combating the "Peaceful Evolution" strategy and violent overthrow plots of hostile forces against the Vietnamese revolution; national defense and security work in ministries, sectors, and localities.
b) Duration of national defense and security education
- Advanced political theory training in concentrated and part-time programs at the National Academy of Politics and Administration and other political academies: 45 class hours;
- Intermediate political theory training in provincial political academies and management cadre training institutions of ministries, sectors, and mass organizations: 45 class hours;
- Political and administrative bachelor's degree training with a second diploma: 60 class hours;
- Training for intermediate vocational education in the administrative sector; training bachelor's degree in political science and administration with a national defense and security certificate according to the corresponding program for the level of training.
c) Curriculum of national defense and security education
The National Academy of Political Science and Administration Ho Chi Minh City shall coordinate with the Ministry of National Defense, the Ministry of Public Security, the Ministry of Education and Training, the Ministry of Home Affairs, the Central Propaganda Commission, and relevant agencies to establish the national defense and security education program for the subjects mentioned in Clause 2 of this Article.
Article 5. Cadres, party members, civil servants, and other subjects
1. Cadres, party members, civil servants
a) Subjects for national defense and security knowledge enhancement
- Subject 1: Heads and deputies of heads of ministries, ministerial-level agencies, agencies under the Government, the Central Office and various Party Committees, the National Assembly Office, the Ethnic Council and various National Assembly Committees, the President's Office, central agencies of political-social organizations (hereinafter referred to as central ministries, committees, and sectors), and national universities. Heads and deputies of heads of general departments under central ministries, committees, and sectors. Secretaries, Deputy Secretaries, Standing Members of Provincial Party Committees and Municipal Party Committees directly under the Central Government; Chairpersons and Vice-Chairpersons of People's Councils and People's Committees at the provincial level (hereinafter referred to as provincial level). Chairpersons and Vice-Chairpersons of Management Boards, heads and deputies of heads of economic groups and state-owned corporations established by the Prime Minister's Decision. National Assembly Deputies who do not hold the aforementioned positions shall enhance their national defense and security knowledge at the National Defense Academy.
The Central Organization Department and the Ministry of Home Affairs shall coordinate with the Ministry of National Defense and the Ministry of Public Security to decide on the enrollment of trainees. The Ministry of National Defense shall direct the National Defense Academy to develop plans and organize the enhancement of national defense and security knowledge.
- Subject 2: Heads and deputies of heads of bureaus, departments, institutes, and equivalent positions within central ministries, committees, and sectors. Chairpersons and Vice-Chairpersons of Management Boards, heads and deputies of heads of economic groups and state-owned corporations established by decisions of central ministries and sectors. Principals and Deputy Principals of universities and colleges located within military regions. Secretaries, Deputy Secretaries, Standing Members of County Party Committees, District Party Committees, City Party Committees, and Town Party Committees; Chairpersons and Vice-Chairpersons of People's Councils and People's Committees at the county level (hereinafter referred to as county level). Heads and deputies of heads of provincial departments, committees, and sectors and equivalent positions at the provincial level. County-level People's Council Deputies who do not hold the aforementioned positions shall enhance their national defense and security knowledge at military region schools and provincial military schools.
The Standing Committee of the Provincial Party Committee, the Provincial People's Committee; heads of central agencies with headquarters within military regions shall decide on the enrollment of cadres under their jurisdiction based on military region quotas. Based on the number of cadres in Subject 2, the Military Region Commander shall decide on the plan and organize the enhancement of national defense and security knowledge at military region schools and provincial military schools.
- Subject 3: Heads and deputies of heads of provincial departments, committees, and sectors, and equivalent positions within bureaus, departments, institutes, and public service organizations, Principals and Deputy Principals of secondary vocational schools and vocational schools under central ministries, committees, and sectors with headquarters at the provincial level. Principals and Deputy Principals of high schools; Heads and deputies of heads of county-level departments, committees, and sectors. County-level People's Council Deputies who do not hold the aforementioned positions. Secretaries, Deputy Secretaries, Standing Members of Village Party Committees, Chairpersons and Vice-Chairpersons of People's Councils and People's Committees at the village level (hereinafter referred to as village level). General Managers and Deputy General Managers of enterprises with headquarters at the provincial level shall enhance their national defense and security knowledge at provincial military schools.
The Provincial Party Committee's Organization Department and the Provincial Department of Home Affairs shall coordinate with the Provincial Military Command and Provincial Public Security Bureau to decide on the enrollment of trainees under their jurisdiction. The Standing Committee of the County Party Committee, the County People's Committee Chairperson, and heads of central agencies with headquarters at the county level shall decide on the enrollment of trainees under their jurisdiction. The County People's Committee Chairperson shall decide on the quota of trainees, based on the number of cadres in Subject 3, decide on the plan and organize the enhancement of national defense and security knowledge at provincial military schools and county-level political training centers.
- Subject 4: Principals and Deputy Principals of middle schools, primary schools, kindergartens, and equivalent positions of heads of other agencies with headquarters at the county level. Specialized and professional cadres at the village level who do not hold positions in Subject 3. Secretaries, Deputy Secretaries of village branches, Cooperative Leaders; Heads of villages, wards, communes, hamlets, clusters, neighborhoods, and residential areas (hereinafter collectively referred to as village level). Village-level People's Council Deputies who do not hold the aforementioned positions shall enhance their national defense and security knowledge at county-level political training centers.
The Standing Committee of the County Party Committee, the County People's Committee Chairperson, and heads of other agencies with headquarters at the county level shall decide on the enrollment of trainees under their jurisdiction. Based on the number of cadres in Subject 4, the County People's Committee Chairperson shall decide on the plan and organize the enhancement of national defense and security knowledge at county-level political training centers or at the village level.
- Subject 5: Heads of village-level mass organizations and party members not included in Subjects 1, 2, 3, and 4. Secretaries of Village Party Committees, Chairpersons of Village People's Committees, and equivalent positions of heads of other agencies with headquarters at the village level shall convene the subjects under their jurisdiction. Village People's Committee Chairpersons and heads of other agencies with headquarters at the village level shall decide on the plan and organize the enhancement of national defense and security knowledge at the village level or within their agencies.
b) Program for enhancing national defense and security knowledge
The Ministry of National Defense and the Ministry of Public Security shall coordinate with the Ministry of Education and Training, the Ministry of Home Affairs, the Central Propaganda Commission, and relevant agencies to establish the program for enhancing national defense and security knowledge for the subjects mentioned in Clause 1 of this Article.
c) The authority to issue certificates, certifications, and manage subjects who have completed national defense and security knowledge training.
- The Director of the National Defense Academy issues certificates for subject 1; the Principal of the Military School of the Military Region issues certificates for subject 2; the Principal of the Provincial Military School issues certificates for subject 3; the Director of the Political Training Center at the district level issues certificates for subject 4.
- The Chairman of the People's Committee at the commune level, or the head of other agencies with offices within the commune, issues certifications for subject 5.
- The Secretary of the grassroots Party Committee, or the head of agencies managing the subjects mentioned in Clause 1 of this Article who have completed national defense and security knowledge training.
2. Other Subjects
a) Cadres and civil servants not belonging to the subjects specified in Clause 1 of this Article; workers in agencies and organizations at all levels and in economic organizations; junior high school students; individuals with qualifications and health conditions voluntarily seeking vocational education in national defense and security through sports clubs for vocational national defense and military technology, and sports clubs for vocational security; young people of age to perform military service but not studying in the national education system, nor participating in the civilian self-defense force; remaining subjects.
b) Program for education and training in national defense and security knowledge
The Ministry of National Defense shall coordinate with the Ministry of Public Security, the Ministry of Education and Training, and relevant agencies to define the authority to convene, issue certifications, organize implementation, and establish the program for education and training in national defense and security knowledge for the subjects mentioned in this Clause.
Article 6. Exemption, postponement, reduction of national defense and security knowledge education and training
1. Subjects exempted from national defense and security knowledge education and training
a) Cadres and civil servants at all levels, except those positions specified in point a of Clause 1 of Article 5 of this Decree, who have studied the national defense and security education course in their training programs at academies, political schools, administrative schools under the National Academy of Politics and Administration Ho Chi Minh City, or who hold a national defense and security education certificate and a bachelor's degree or higher, are exempted from national defense and security knowledge training according to the corresponding training level. When promoted to a higher position, they must continue to undergo national defense and security knowledge training according to the program corresponding to the new position;
b) Students pursuing a second bachelor's degree (excluding political science second bachelor's degree students) who already have a national defense and security education certificate issued by the university or a completion certificate for the national defense and security knowledge training course issued by the National Defense Academy or the Military School of the Military Region.
2. Subjects postponed from national defense and security knowledge education and training
a) Vietnamese students, trainees, and pupils currently studying abroad or at foreign schools, joint ventures, or joint programs with foreign countries in Vietnam;
b) Subjects as stipulated in Article 4 and Clause 1 of Article 5 of this Decree who are currently studying the national defense and security education course and are ill or injured and hospitalized at county-level hospitals or above, or due to natural disasters or fires and must take a leave of absence, confirmed by the commune authorities or above;
c) Female students, trainees, and pupils who are pregnant or have small children may be temporarily postponed from military skills practical exercises.
3. Subjects reduced from national defense and security knowledge education and training
a) Individuals with physical disabilities affecting movement, certified by county-level hospitals or equivalent; military personnel and police officers transferred to other sectors or retired may be reduced from military skills practical exercises.
b) Retired cadres and civil servants who are party members and hold a national defense and security knowledge training certificate; senior officers of the People's Army and Public Security who have undergone long-term training in officer schools or academies and are transferred to other sectors or retired may be reduced from previously learned content.
Chapter III
ADVISORY AND DIRECTING AGENCIES, MANAGEMENT STAFF FOR EDUCATION WORK
TRAINING OF NATIONAL DEFENSE AND SECURITY KNOWLEDGE
Article 7. Advisory and directing agencies for education and training in national defense and security knowledge
1. Establishing the Central Council for National Defense and Security Education, Military Region Councils, Provincial Councils, District Councils, and Commune-level National Defense and Security Training and Education Work.
a) The Central Council for National Defense and Security Education includes: The Chairman is a Deputy Prime Minister, Vice Chairmen are Ministers of the Ministries of National Defense, Public Security, and Education and Training; Members are Deputy Ministers or equivalents from related Ministries, Committees, and Agencies;
b) The Military Region Council for National Defense and Security Education includes: The Chairman is the Commander of the Military Region, Vice Chairmen are members of the Military Region Command and leaders of the General Department of Force Building under the Ministry of Public Security, and Members are Chairmen of the Provincial Councils for National Defense and Security Education and some leaders of Military Region Schools, Military Colleges, and Universities within the Military Region;
c) Provincial and District Councils for National Defense and Security Education
- At the provincial level: The Chairman is the Chairman or Vice Chairman of the People's Committee; Vice Chairmen are the Chief of the Provincial Military Command, the Director of Public Security, and the Director of the Department of Education and Training; Members of the Council are heads of some Departments, Committees, and Agencies at the provincial level;
- At the district level: The Chairman of the Council is the Chairman or Vice Chairman of the People's Committee; Vice Chairmen are the Chief of the District Military Command, the Head of Public Security, and the Head of Propaganda or the Director of Education; Members of the Council are heads of some Committees and Agencies at the district level;
d) The Commune Conscription Council is responsible for implementing national defense and security education and training work.
2. The Councils for National Defense and Security Education at various levels have permanent offices assisting them located at the Ministry of National Defense, the Military Region Command, the Provincial Military Command, and the District Military Command in the order specified in point a, b, c of Clause 1 of this Article.
The National Defense and Security Education Councils at all levels operate on a concurrent duty system. The Prime Minister decides to establish, define functions, and tasks of the Central National Defense and Security Education Council and the Military Zone National Defense and Security Education Council. The Chairman of the Provincial People's Committee decides to establish, define functions, and tasks of the provincial and district-level National Defense and Security Education Councils.
Article 8. Management staff, lecturers, teachers of national defense and security education
1. The Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs shall appoint dedicated staff for national defense and security education. Ministries, sectors, agencies, organizations, and people's committees at all levels shall arrange dedicated or concurrent staff based on the requirements of their tasks, practical situations of their agencies, and localities to assist leaders in implementing national defense and security education and training tasks.
2. The Ho Chi Minh National Academy of Political Administration, affiliated academies and schools of political administration and public administration under the Ho Chi Minh National Academy of Political Administration, central mass organizations, provincial political schools, and county-level political training centers shall arrange dedicated or concurrent staff to manage and teach national defense and security education courses, combining with military and police academies to implement guest lecturer systems.
3. The Department of Education and Training shall arrange dedicated staff; the Department of Labor, Invalids and Social Affairs shall arrange concurrent staff; some key provinces shall be reinforced with one military officer assigned to assist the Director of the Department of Education and Training in managing and organizing the implementation of national defense and security education and training tasks.
4. Public secondary schools, intermediate vocational schools, and technical schools shall appoint dedicated or concurrent staff for national defense and security education, organize subject departments for national defense and security education or combined subject departments. Non-public schools and regular education centers shall arrange concurrent staff to teach national defense and security education courses.
5. Organizing and arranging staffing for management staff of student national defense and security education centers under the Ministry of Education and Training and knowledge education and training centers under the Ministry of National Defense. Management staff and lecturers of national defense and security education subjects in these centers and universities shall initially be mainly military officers, supplemented by lecturers within the education and training sector.
Chapter IV
ASSURANCE WORK AND RESPONSIBILITIES OF MINISTRIES, AGENCIES
AND PROVINCE AND CITY PEOPLE'S COMMITTEES UNDER THE CENTRAL GOVERNMENT
Article 9. Ensuring the budget for national defense and security education and training
1. The central budget ensures the implementation of national defense and security education and training tasks of ministries, ministerial-level agencies, government agencies, and related agencies at the central level.
2. Local budgets ensure the implementation of national defense and security education and training tasks of related agencies and units at the local level.
Article 10. Ensuring funding for national defense and security education and training
1. Regular expenditure items
a) Drafting legal regulations; developing programs, textbooks, teaching materials, reviewing, accepting, approving, printing, and distributing;
b) Implementing national defense and security education and training programs in educational and training institutions; disseminating and educating about national defense and security through mass media;
c) Training, instructing, and enhancing management staff, lecturers, and teachers; building model projects; ensuring benefits and rights of lecturers, teachers, and management staff; conducting scientific research and overseas study;
d) Purchasing, repairing, and maintaining training equipment, weapons, specialized classrooms, and facilities serving the activities of the National Defense and Security Education Councils and centers, and schools responsible for national defense and security education and training;
đ) Activities of the National Defense and Security Education Councils and their permanent offices at various levels; inspection, supervision, mid-term review, final assessment, and commendation.
2. Expenditure items for the development of national defense and security education and training
a) Planning, constructing, upgrading national defense and security education centers; military schools in military zones and provinces tasked with national defense and security education and training;
b) Planning, constructing, upgrading defense-oriented vocational sports clubs and military technology clubs, security-oriented vocational sports clubs;
c) Other projects and programs directly serving national defense and security education and training tasks.
Article 11. Ensuring infrastructure and material conditions for national defense and security education and training
1. The Ministry of National Defense shall ensure weapons, technical equipment, and specialized learning aids for teaching and learning national defense education content in training institutions nationwide; ensure textbooks and materials for national defense knowledge training; working tools, research materials for national defense education staff, teachers, and lecturers in professional agencies, education and training centers under the Ministry of National Defense.
2. The Ministry of Public Security shall ensure technical equipment, specialized learning aids, textbooks, and materials for teaching and learning security education content in training institutions nationwide; ensure research textbooks and materials, working tools, and equipment for security education staff, teachers, and lecturers in professional agencies under the Ministry of Public Security.
3. Ministries, ministerial-level agencies, government agencies, and provincial people's committees shall ensure working tools, materials, and equipment for professional agencies and national defense and security education staff and teachers in education and training centers under their jurisdiction.
4. The system of national defense-security education centers shall be planned in accordance with the network of national universities, university colleges, military region military schools, corps military schools, provincial military schools, and some military academies and schools tasked with national defense-security education and training.
The Prime Minister decides on planning the system of national defense-security education centers throughout the country.
Article 12. Ensure the training and upgrading of teachers and lecturers for national defense-security education.
1. Teachers and lecturers must be trained to the standard level as prescribed in points c, d, and e of Clause 1, Article 77 of the Education Law 2005.
2. Training methods: long-term basic program training; second bachelor's degree training for teachers and lecturers who have graduated from pedagogical universities; short-term combined training and annual refresher courses for teachers who have graduated from universities and are concurrently teaching national defense-security subjects.
3. Training institutions for teachers and lecturers:
a) Pedagogical universities shall take the lead and collaborate with military schools to train, upgrade, and conduct workshops for national defense-security teachers for secondary schools, vocational colleges, and vocational training centers.
b) The Political-Military Academy, Army Academy, People's Security Academy, Public Security Academy, National Security University, Public Security University, First Infantry Officer School, Second Infantry Officer School shall collaborate with universities and college institutions to train, upgrade, and conduct workshops for lecturers and teachers for national defense-security education for universities, colleges, and national defense-security education centers according to the joint training project between the Ministry of Education and Training, the Ministry of Defense, and the Ministry of Public Security. The National Defense Academy, Political-Military Academy, Army Academy, People's Security Academy, and Public Security Academy shall provide upgrading and workshops for lecturers teaching national defense-security knowledge in military and public security academies and schools.
Article 13. Ensure the working conditions and benefits for management staff, lecturers, and teachers.
1. Management staff, lecturers, and teachers of national defense-security education as stipulated in Article 8 of this Decree shall enjoy the current state regulations on benefits for general staff, lecturers, and teachers. In addition, they shall enjoy preferential treatment based on the specific nature of the subject, specifically:
a) Full-time or part-time lecturers and teachers in educational and training institutions (including teachers who are army officers on secondment) shall receive 1% of the minimum wage for each lecture hour.
b) Full-time lecturers and teachers in educational and training institutions shall be provided uniforms annually; the quantity and style of uniforms shall be regulated uniformly by the Ministry of Education and Training in coordination with relevant agencies.
2. Other benefits for staff and lecturers who are army officers on secondment.
a) Army officers on secondment teaching at universities, colleges, and national defense-security education centers shall receive overtime pay as stipulated in the current regulations on overtime pay and class combination allowances in the education sector.
b) Educational institutions and units using army officers on secondment shall ensure working conditions, equipment, housing, travel expenses, welfare benefits for staff and teachers who are army officers on secondment as those for staff and teachers at the same level.
c) They shall be selected for study and professional training; provided with information; allowed to participate in educational and training activities; considered for commendation and disciplinary action as civil servants of the institution or unit using army officers on secondment.
3. Lecturers and teachers concurrently performing other duties.
a) Lecturers and teachers at universities and national defense-security education centers concurrently managing students shall have their lecture hours reduced.
b) Lecturers and teachers assigned to concurrently perform management duties, party work, political-social work, local national defense-security work shall have their participation time converted into standard hours to reduce lecture hours.
c) Lecturers and teachers (excluding teachers who are army officers on secondment) within the age limit must undergo military training as prescribed by law; the time spent on military training shall be converted into standard hours to reduce lecture hours. Lecturers and teachers of national defense-security education participating in training for self-defense forces and school guards shall not be deducted from lecture hours but may have their common school activities reduced or receive allowances under the upgrading system.
d) Lecturers and teachers directly involved in disaster prevention and control as required by the school and locality shall have their lecture hours reduced based on specific circumstances.
4. The standard lecture hours for lecturers and teachers of national defense-security education shall be uniformly defined like those for lecturers and teachers of other departments, without distinction based on type of school, region, province, field, or profession. Lecturers and teachers of national defense-security education are responsible for self-study and upgrading their professional skills. When assigned by the school or competent authority to attend workshops, competitions, or sports events, the formal time spent shall be converted into standard hours to deduct from lecture hours. The conversion rate of standard hours and reduction of lecture hours shall be regulated uniformly by the Ministry of Education and Training in coordination with the Ministry of Defense and the Ministry of Public Security.
5. Management staff, lecturers, and teachers of national defense-security education while teaching the national defense-security subject shall be entitled to policy benefits if they are injured or have an accident, as prescribed in current regulations.
Article 14. Responsibilities of Ministries, Agencies, and Provincial People's Committees under the Central Government.
1. The Ministry of National Defense
a) Take the lead in coordinating with the Ministry of Public Security and collaborating with relevant ministries and agencies to submit to the Government for issuance or issue within their authority legal normative documents on education and national defense-security knowledge training; submit to the Prime Minister for decision on establishing the Council and its permanent office for national defense-security education as stipulated in Article 7 of this Decree.
b) Chair and coordinate with the Ministry of Public Security to cooperate with the Ministry of Home Affairs, the Ministry of Education and Training, the Central Organization Commission, and the Central Propaganda Commission to develop a program for national defense and security knowledge training for the subjects specified in Clause 1, Article 5 of this Decree. Coordinate with the Ministry of Public Security and the Ministry of Education and Training to organize the compilation, review, and acceptance of programs, textbooks, and educational materials for national defense and security knowledge training to be used uniformly at educational institutions suitable for each subject. Coordinate with the Central Organization Commission to unify with the Ministry of Home Affairs to guide the criteria for mandatory national defense and security knowledge for officials and civil servants.
c) Direct military academies and military schools to cooperate and link with universities to implement the task of training and enhancing management cadres, lecturers, and teachers for national defense education at secondary schools through universities as stipulated in Clause 3, Article 12 of this Decree.
d) Annually, coordinate with the Central Organization Commission, the Ministry of Home Affairs, and the Ministry of Public Security on the number of Category 1 cadres who need to be trained in national defense and security knowledge to direct the National Defense Academy to develop plans and organize implementation. Direct military academies to prepare lecturers to assist the National Academy of Political Administration and other political academies to teach topics on national defense in the national defense and security course for the subjects specified in Clause 2, Article 4 of this Decree.
đ) Direct the Military Region Command to coordinate with provincial People's Committees, central agencies, and economic organizations headquartered within their respective military regions regarding plans to deploy and organize the implementation of national defense and security education tasks in accordance with this Decree.
e) Annually, coordinate with the Central Organization Commission, the Ministry of Home Affairs, and the Ministry of Public Security on the number and composition of Category 2 subjects specified in Clause 1, Article 5 of this Decree to inform the Military Region Commanders to organize implementation.
g) Chair and coordinate with the Ministry of Education and Training and relevant ministries and agencies within their authority to decide or propose competent authorities to decide on establishing, defining functions, tasks, powers, organizational staffing, and investment in construction of national defense and security education centers, sports clubs for vocational orientation in national defense and military technology under the Ministry of National Defense management. Direct national defense and security education centers under its jurisdiction to operate in accordance with current education laws. Decide on the organization, staffing, functions, and tasks of the permanent bodies of the national defense education councils at all levels and full-time national defense education officers as stipulated in Clause 1, Article 8 of this Decree. Develop a plan to consolidate national defense and security education centers, military schools of military regions, military corps, provincial military schools, and some military academies and schools to perform national defense and security education and training tasks, to submit to the Prime Minister.
h) Chair and coordinate with the Ministry of Public Security to cooperate with relevant ministries and agencies to organize inspections, reviews, mid-term evaluations, and final assessments of the implementation of national defense and security education and training tasks at agencies, organizations, and localities. Regularly report annually to the Prime Minister.
2. Ministry of Public Security
a) Coordinate and unify with the Ministry of National Defense to implement the contents prescribed in points a, b, c, d, đ, e, g, h of Clause 1 of this Article.
b) Direct military academies, schools, and units under its jurisdiction to prepare teachers and lecturers to cooperate with local party committees, governments, educational management agencies, and national defense and security knowledge training institutions to implement teaching of security education and security knowledge enhancement for the subjects specified in this Decree.
c) Direct police academies and schools to cooperate with military officer academies, universities, colleges, and national defense and security education centers to implement the task of training, enhancing, and training teachers and lecturers for national defense and security education according to the joint training project stipulated in Clause 3, Article 12 of this Decree.
3. The Ministry of Education and Training
a) Manage, direct, and organize the implementation of national defense and security education tasks at educational institutions in the national education system.
b) Chair and coordinate with the Ministry of National Defense, the Ministry of Public Security, and relevant agencies to develop programs, compile, and issue textbooks for national defense and security education for the subjects specified in Clause 1, Article 4 of this Decree (excluding intermediate vocational and higher vocational education). Define the content, examination regulations, scoring methods, and recording of grades for the national defense and security education course in the national education system; issue, manage, guide usage, and grant certificates for the national defense and security education course for university and college students.
c) Coordinate with the Ministry of Home Affairs, the Ministry of Labor, Invalids, and Social Affairs, and relevant agencies to define positions, staffing, and policies for national defense and security education managers, teachers, and lecturers at ministry agencies, provincial Departments of Education and Training, and educational institutions in the national education system.
d) Coordinate with the Ministry of National Defense and the Ministry of Public Security to define staffing and positions and directly manage the contingent of officers seconded to work in national defense and security education management and teaching at educational institutions under its jurisdiction.
đ) Chair and coordinate with the Ministry of National Defense, the Ministry of Public Security, and relevant ministries and agencies to develop a planning system for student national defense and security education centers under the Ministry of Education and Training, to submit to the Prime Minister for consideration and decision. Within the scope of their authority, define functions, tasks, powers, improve organizational structures, staffing, and invest in building student national defense and security education centers at universities and colleges nationwide.
e) Chair and coordinate with the Ministry of National Defense, the Ministry of Public Security, relevant ministries and agencies to establish a framework program and organize training, capacity building, and instruction for managers, lecturers, and teachers in national defense and security education for schools under the national education system as stipulated in Clause 3, Article 12 of this Decree.
4. Ministry of Labor, Invalids, and Social Affairs
a) Direct, manage, and organize the implementation of national defense and security education tasks in vocational secondary schools and vocational colleges;
b) Chair and unify with the Ministry of National Defense, the Ministry of Public Security, the Ministry of Education and Training, and relevant agencies to develop programs, issue textbooks, and educational materials on national defense and security for students in vocational secondary schools and vocational colleges. Specify the content, regulations, methods of scoring, and recording scores in the student record book for the national defense and security education subject; issue, manage, guide the use, and grant certificates for the national defense and security education subject for students in vocational colleges;
c) Annually, coordinate with the Ministry of National Defense and the Ministry of Public Security, the Ministry of Education and Training to organize specialized and vocational training for managers, teachers, and lecturers in national defense and security education in vocational secondary schools and vocational colleges.
5. The Ministry of Culture, Sports and Tourism
a) Chair and coordinate with the Ministry of National Defense, the Ministry of Public Security, and relevant agencies to direct mass media organizations to annually develop programs, contents, and methods of propaganda and education on national defense and security through mass media;
b) Chair and coordinate with the Central Propaganda Department, the Ministry of National Defense, the Ministry of Public Security, annually organize training and capacity building for the content and methods of propaganda, education, and knowledge enhancement on national defense and security for managers, reporters, and editors of central and local mass media organizations; guide and direct localities to build plans and implement plans for information dissemination, propaganda, education, and knowledge enhancement on national defense and security through various forms of culture, art, literature, and art suitable for the requirements of national defense and security tasks in each region;
6. The Ministry of Home Affairs
a) Chair and coordinate with the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and relevant agencies to provide guidance on the organization and staffing of the cadre of managers and teachers in national defense and security education at ministries, sectors, localities, and educational and training institutions;
b) Coordinate with the Ho Chi Minh National Academy of Politics and Public Administration to develop programs, compile textbooks, and materials on national defense and security for subjects under its management. Direct affiliated schools to implement the program and course regulations on national defense and security education in the regular training curriculum;
c) Coordinate with the Ministry of National Defense to implement the contents prescribed in Points a, b, c, d, đ, e, g, h of Clause 1, Article 1 of this Decree.
7. The Ministry of Finance
Coordinate with relevant ministries, agencies, and localities in the work of establishing, implementing, and settling the state budget allocated for national defense and security education tasks in accordance with the State Budget Law and related regulatory legal documents.
8. Ministry of Planning and Investment
Coordinate with relevant ministries, agencies in planning investment in constructing national defense and security education centers; sports clubs for vocational military orientation and military technology, sports clubs for vocational security orientation; upgrading military district schools, provincial military schools, some academies, and military officer schools to perform national defense and security education tasks.
9. The Ho Chi Minh National Academy of Politics and Public Administration
Chair and unify with the Ministry of National Defense, the Ministry of Public Security, coordinate with the Ministry of Home Affairs and relevant agencies to establish programs, compile and issue textbooks and materials on national defense and security for the subjects mentioned in Clause 2, Article 4 of this Decree; guide affiliated political and administrative academies, provincial political schools to implement the program and course regulations on national defense and security education.
10. Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency
According to their main functions, chair and coordinate with the Central Propaganda Department, the Ministry of National Defense, the Ministry of Public Security, and relevant agencies to develop programs and plans for regular and key propaganda on national defense and security throughout the population.
11. The Governmental Committee for Religious Affairs
Coordinate with the Vietnam Fatherland Front Central Committee, the Ethnic Minority Committee to direct provincial religious management agencies to cooperate with provincial functional agencies to propagate and mobilize religious clergy and functionaries to participate in knowledge enhancement on national defense and security as stipulated in Clause 2, Article 5 of this Decree.
12. Suggest that Party Committees, the Vietnam Fatherland Front Central Committee, the Vietnam Veterans Association Central Committee, the Ho Chi Minh Communist Youth Union Central Committee, the Vietnam Women's Union Central Committee, the Vietnam General Confederation of Labor, the Vietnam Farmers' Association Central Committee coordinate to direct the work of education and knowledge enhancement on national defense and security for cadres, civil servants, workers, members, and community-wide education.
13. Social organizations, occupational social organizations, economic organizations of all components have the responsibility to coordinate with the Provincial and District National Defense and Security Education Councils to implement the work of education and knowledge enhancement on national defense and security for cadres and workers under their jurisdiction as stipulated in Point a, Clause 2, Article 5 of this Decree.
14. People's Committees of provinces and centrally governed cities
a) Implement national defense and security education tasks and knowledge enhancement on national defense and security for subjects under local management as stipulated in Article 5 of this Decree;
b) Allocate dedicated teachers for national defense and security education in secondary general schools, vocational secondary schools, and vocational schools as stipulated in Article 8 of this Decree;
c) Establish, implement, and settle the state budget allocated for national defense and security education tasks in accordance with the State Budget Law and related regulatory legal documents;
d) Summoning officials under their authority and officials and civil servants from central agencies and economic organizations with headquarters in the province belonging to category 2 according to the plan for national defense and security knowledge training organized by the Military Region Commander;
đ) Taking the lead and coordinating with the Ministry of National Defense, the Ministry of Education and Training, and related agencies to manage national defense and security education centers in universities within the province, reinforcing and upgrading provincial military school national defense and security education centers;
Chapter V
REWARD AND VIOLATION HANDLING
Article 15. Awards
Organizations and individuals who have achievements in national defense and security education work shall be rewarded in accordance with state regulations;
Article 16. Handling of violations
Organizations and individuals who commit violations in national defense and security education work will be subject to disciplinary action, administrative handling, or criminal prosecution depending on the nature and severity of the violation as stipulated by law;
Chapter VI
IMPLEMENTING PROVISIONS
Article 17. Effectiveness of the Decree
This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Government Decree No. 15/2001/NĐ-CP dated May 1, 2001, on national defense education;
Article 18. Responsibility for guiding and implementing the Decree
1. The Ministry of National Defense shall take the lead in working with the Ministry of Public Security, the Ministry of Education and Training, and the Ministry of Home Affairs to issue a joint Circular to guide the implementation of this Decree;
2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees directly under the Central Government, and relevant agencies are responsible for implementing this Decree./.
