Regarding policies for cadres, civil servants, public officials, and salary recipients in the armed forces working in areas with particularly difficult socio-economic conditions

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister of Home Affairs,
DECREE:
Article 1. Scope of Regulation
1. This Decree stipulates the provisions on attraction allowances, long-term service allowances, certain subsidies, and reimbursement of travel expenses for cadres, civil servants, public officials, and salary recipients in the armed forces (the People's Army and the People's Public Security Force) working in areas with particularly difficult socio-economic conditions.
2. The areas with particularly difficult socio-economic conditions referred to in Clause 1 of this Article include:
a) Truong Sa, Hoang Sa, DK1 districts;
b) Particularly difficult communes in ethnic minority and mountainous areas, and particularly difficult communes in coastal and island areas according to the Prime Minister's decision;
c) Particularly difficult villages, hamlets, neighborhoods, settlements, phums, socs, ăps, etc. (collectively referred to as villages) according to the competent authority's decision.
Article 2. Applicability
Cadres, civil servants, public officials, and salary recipients in the armed forces referred to in Clause 1 of Article 1 of this Decree working in areas with particularly difficult socio-economic conditions include:
1. Cadres, civil servants, public officials, and those working under labor contracts, including probationers and trainees, in Party, State, and political-social organizations from central to commune levels;
2. Officers, professional military personnel, technical non-commissioned officers, and those receiving salaries from the State budget, including those working under labor contracts in the People's Army and the People's Public Security Force;
3. The subjects specified in Clauses 1 and 2 of this Article working in communes not classified as particularly difficult but located within poor districts according to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government shall be subject to the policies stipulated in this Decree.
The subjects specified in Clauses 1, 2, and 3 of this Article include those currently working and those who will start working in areas with particularly difficult socio-economic conditions after this Decree takes effect.
2. Industrial emission testing must ensure timeliness, accuracy, objectivity, compliance with procedures, and adherence to legal provisions.
Cadres, civil servants, public officials, and salary recipients in the armed forces falling under the scope of application of the policy stipulated in this Decree, while also falling under the scope of application of similar policies stipulated in other regulatory legal documents, shall only enjoy the highest level of such policy.
Article 4. Attraction Allowance
1. The subjects specified in Article 2 of this Decree shall receive an attraction allowance equivalent to 70% of their current monthly salary, including: position salary, rank, grade, or rank level, and leadership position allowance, if applicable.
2. The period for receiving the attraction allowance is the actual time worked in areas with particularly difficult socio-economic conditions and shall not exceed five years. The time point for calculating the attraction allowance is as follows:
a) If currently working in areas with particularly difficult socio-economic conditions, the attraction allowance shall be calculated from the date this Decree takes effect;
b) If starting work after this Decree takes effect, the attraction allowance shall be calculated from the date of the competent authority's decision.
Article 5. Long-term Service Allowance in Areas with Extremely Difficult Socio-Economic Conditions
The subjects specified in Article 2 of this Decree shall receive a monthly allowance based on the actual time worked in areas with particularly difficult socio-economic conditions, and if there are intermittent periods, they shall be accumulated as follows:
1. A rate of 0.5 compared to the general minimum wage for those with actual working time in areas with particularly difficult socio-economic conditions from five to less than ten years;
2. A rate of 0.7 compared to the general minimum wage for those with actual working time in areas with particularly difficult socio-economic conditions from ten to less than fifteen years;
3. A rate of 1.0 compared to the general minimum wage for those with actual working time in areas with particularly difficult socio-economic conditions of fifteen years or more.
Article 6. Initial Allowance and Relocation Allowance
The subjects specified in Article 2 of this Decree who work in areas with particularly difficult socio-economic conditions for at least three years for women and five years for men shall be entitled to allowances as follows:
1. An initial allowance equal to ten months of the general minimum wage.
2. In cases where family members accompany them, in addition to the initial allowance, they will also receive travel expenses for family members accompanying them and a relocation allowance equal to twelve months of the general minimum wage for the household.
3. Only one-time payment of the allowances stipulated in Clause 1 and Clause 2 of this Article shall be made during the entire period of working in areas with particularly difficult socio-economic conditions.
Article 7. Subsidy for Purchasing and Transporting Fresh and Clean Water
1. The subjects specified in Article 2 of this Decree working in areas with particularly difficult socio-economic conditions lacking fresh water seasonally shall be entitled to allowances for purchasing and transporting fresh water to meet daily living needs after deducting the cost of fresh water included in their salary.
2. The People's Committee of provinces and centrally governed cities with areas lacking fresh water shall submit to the People's Council at the same level to decide on the duration and amount of allowances for purchasing and transporting fresh water suitable to the specific situation of areas lacking fresh water in the locality.
Article 8. One-time Allowance when Transferring Work Outside Areas with Particularly Difficult Socio-Economic Conditions or Retirement
1. The subjects specified in Article 2 of this Decree who have worked in areas with particularly difficult socio-economic conditions for at least ten years, when transferring work outside these areas or retiring, shall be entitled to a one-time allowance based on the actual time spent working in areas with particularly difficult socio-economic conditions.
2. The amount of the one-time allowance is determined as follows: For each year worked in areas with particularly difficult socio-economic conditions, the allowance is equivalent to half (one-half) of the current monthly salary, including: position salary, rank, grade, or rank level, and leadership position allowance, if applicable, at the time of transferring work outside areas with particularly difficult socio-economic conditions or retirement.
3. Actual time spent working in areas with particularly difficult socio-economic conditions, if there are fractional months, shall be calculated as follows:
a) Less than three (three) months shall not be counted;
b) From three (three) months to six (six) months shall be counted as half (one-half) of a year of work;
c) More than six (six) months up to twelve (twelve) months shall be counted as one (one) year of work.
Article 9. Payment for transportation expenses
During the period of working in areas with particularly difficult socio-economic conditions, the subjects specified in Article 2 of this Decree who take annual leave, public holidays, or personal leave shall be paid travel expenses for visiting their families according to the provisions of labor laws.
Article 10. Allowance for sightseeing, study, and professional training
The subjects specified in Article 2 of this Decree shall enjoy allowances for sightseeing, study, and professional training as follows:
1. In cases where they are sent by competent authorities to attend training courses on specialized knowledge, vocational skills, foreign languages, study tours, or experience exchanges, they shall be supported with the cost of purchasing learning materials and 100% of tuition fees and travel expenses from the workplace to the place of study.
2. In cases where they work in areas inhabited by ethnic minorities and self-study ethnic minority languages to fulfill assigned tasks, they shall be supported with the cost of purchasing learning materials and a subsidy for self-study of ethnic minority languages equivalent to the support provided for regular school or class training.
Article 11. Sources of funds and responsibility for payment
1. Funding sources:
a) For cadres and civil servants in Party and State agencies, organizations, political-social organizations, and personnel receiving salaries in the armed forces, the source of funds to implement the policy prescribed in this Decree shall be guaranteed from the State budget in accordance with the provisions of the State Budget Law and guiding documents.
b) For civil servants and public officials in Party and State non-business units, political-social organizations, the source of funds to implement the policy prescribed in this Decree shall be guaranteed from the State budget and from the legitimate income of the non-business units.
2. Responsibility for payment:
a) For allowances for attracting personnel, long-term service allowances in areas with extremely difficult socio-economic conditions, subsidies for purchasing and transporting clean water, travel expenses, and subsidies for sightseeing, study, and professional training, the entity responsible for paying such benefits shall be the agency, organization, or unit that includes the beneficiary in its payroll.
b) For initial subsidies and regional transfer subsidies, the receiving agency, organization, or unit shall be responsible for payment. In cases of temporary assignment, the assigning agency, organization, or unit shall be responsible for payment.
c) For one-time subsidies when transferring work outside areas with extremely difficult socio-economic conditions or upon retirement, the managing agency, organization, or unit prior to the transfer of work or retirement of the beneficiary shall be responsible for payment.
Article 12. Implementation Provisions
1. This Decree shall take effect from March 1, 2011.
2. The Ministry of Home Affairs shall take the lead and coordinate with the Ministry of Finance to be responsible for guiding the implementation of this Decree.
3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
