Regarding the construction, management, and use of the information system on housing and the real estate market

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Law on Housing dated December 25, 11 year 2014;
Pursuant to the Law on Real Estate Business dated November 25, 2014;
At the proposal of the Minister of Construction,
The Government issues this Decree on the construction, management, and use of the information system on housing and the real estate market.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the construction, management, exploitation, and use of the information system on housing and the real estate market; the responsibilities and authorities of agencies, organizations, and individuals in the construction, management, and use of the information system on housing and the real estate market.
Article 2. Applicability
This Decree applies to agencies, organizations, and individuals related to the construction, management, exploitation, and use of the information system on housing and the real estate market.
Article 3. Information System on Housing in and the Real Estate Market
1. The information system on housing and the real estate market includes:
a) Database on housing and the real estate market;
b) Technical infrastructure for information technology on housing and the real estate market;
c) Software systems serving management, operation, and exploitation.
2. The information system on housing and the real estate market shall be constructed uniformly nationwide to provide basic information on housing and the real estate market for agencies, organizations, and individuals, serving state management work and the publication of housing and real estate market indicators, meeting the requirements of economic and social development.
Article 4. Principles for the Construction, Management, and Use of the Information System on Housing and the Real Estate Market
The construction, management, and use of the information system on housing and the real estate market must comply with the following principles:
1. The information system on housing and the real estate market must be constructed and managed uniformly from central to local levels; it must comply with standards and technical regulations on the application of information technology in state agencies to ensure scientificity and convenience for exploitation and use.
2. The database on housing and the real estate market must ensure timely service to the needs of state management work and economic and social development, ensuring national security.
3. Information and data on housing and the real estate market collected, updated, maintained, exploited, and used must ensure accuracy and objectivity.
4. The exploitation and use of information and data on housing and the real estate market must ensure compliance with their intended purposes and follow the provisions of the law.
Article 5. Prohibited Acts and Handling of Violations in the Construction, Management, and Use of the Information System on Housing and the Real Estate Market
1. Prohibited Acts
a) Providing inaccurate, incomplete, or untimely information as prescribed in this Decree;
b) Distorting, damaging, or losing information and data on housing and the real estate market;
c) Illegally possessing, destroying, or damaging information and data on housing and the real estate market;
d) Exploiting or using information on housing and the real estate market contrary to the provisions of this Decree and other laws;
e) Obstructing the exploitation and use of information on housing and the real estate market as prescribed.
2. Disciplinary Actions
Agencies, organizations, and individuals violating the provisions of Clause 1 of this Article shall be subject to disciplinary action, administrative violation handling, or criminal prosecution according to the law depending on the nature and severity of the violation.
Chapter II
CONTENT OF THE DATABASE ON HOUSING AND THE REAL ESTATE MARKET
Article 6. Housing and Real Estate Market Database
1. The housing and real estate market database is a collection of basic information and data on housing and the real estate market that has been collected, verified, evaluated, processed, digitized, integrated, and systematically stored in electronic systems, storage devices, and carriers to be updated, managed, and utilized through information technology systems for state management tasks, economic and social activities, and other legitimate purposes.
2. The housing and real estate market database includes:
a) National housing and real estate market database: A compilation of comprehensive information and data on housing and the real estate market across the country derived from local housing and real estate market databases, information provided by ministries and sectors, and national housing surveys.
The national housing and real estate market database is the responsibility of the Ministry of Construction for establishment, storage, and management.
The contents of the national housing and real estate market database are specified in Article 7 of this Decree.
b) Local housing and real estate market database: A compilation of all basic information and data on housing and the real estate market collected within the provincial or centrally-administered city territory.
The local housing and real estate market database is assigned by the People's Committee of the province or centrally-administered city (hereinafter referred to as the Provincial People's Committee) to the local Construction Department for establishment, storage, and management.
The contents of the local housing and real estate market database are specified in Article 8 of this Decree.
3. Information and data stipulated in Point c, e Clause 2 Article 7 and Points b, c, e, g Clause 2 Article 8 of this Decree shall be collected and updated for the following types of real estate permitted for business:
a) Land plots for residential construction;
b) Individual houses, apartment buildings;
c) Office spaces;
d) Hotels;
đ) Commercial floors, service areas;
e) Technical infrastructure of industrial zones, clusters;
g) Ecotourism areas, resorts.
4. The Ministry of Construction shall take the lead and coordinate with relevant agencies and units to propose the Government to adjust and supplement the contents of the database, necessary information related to housing and the real estate market in the housing and real estate market database.
Article 7. Contents of the National Housing and Real Estate Market Database
1. The national housing database includes:
a) Systems of legal regulations related to housing and land use issued by the National Assembly, the Government, and ministries and sectors within their respective jurisdictions;
b) The number and area of each type of housing; the area of land for investment in housing construction; the number and area of urban and rural housing; the number and area of housing according to ownership forms; housing classified according to the degree of construction durability as specified in Points c, d, đ, e Clause 1 Article 8 of this Decree, compiled from local housing databases;
c) Statistical figures, results, reports of national housing survey programs;
d) Programs and plans for national housing development;
đ) The number and area of public service housing;
e) Other statistical indicators on housing.
2. The national real estate market database includes:
a) Systems of legal regulations related to the real estate market issued by the National Assembly, the Government, and ministries and sectors within their respective jurisdictions;
b) The number of businesses operating in the real estate sector;
c) Data on real estate projects; demand for various types of real estate as per statistics and forecasts; real estate transaction situation; financial data; real estate trading floor database as specified in Points b, c, d, đ Clause 2 Article 8 of this Decree, compiled from local real estate market databases;
d) Information and data on credit debt for real estate business operations;
đ) Database of individuals engaged in real estate brokerage;
e) Other statistical indicators on the development of the real estate market.
Article 8. Content of the Housing and Real Estate Market Database
The Housing and Real Estate Market Database at the local level is compiled according to administrative boundaries at the district level and for the entire province or centrally governed city, including:
1. The local housing database includes:
a) The system of legal regulations on housing and residential land issued by the locality within its authority;
b) Data, results of statistics, compilations, and reports from housing survey and statistical programs at the locality;
c) Information and data on housing development programs and plans of the locality; basic information and quantity of housing investment projects; quantity and area of each type of housing; land area for housing construction investment;
d) Quantity and area of urban and rural housing;
đ) Quantity and area of housing owned by the State, collective organizations, individuals, and foreign organizations and individuals;
e) The housing database classified by the degree of construction durability;
g) Changes related to the management and use of housing and residential land;
h) Quantity of certificates issued for land use rights and ownership of houses;
i) Management of apartment buildings;
k) Other statistical indicators on housing at the locality.
2. The real estate market database at the local level includes:
a) The system of legal regulations related to the real estate market issued by the locality within its authority;
b) Quantity and implementation status of projects, quantity of each type of real estate product in the project; demand for various types of real estate according to statistics and forecasts;
c) Real estate transaction situation including information on transaction volume and transaction prices;
d) Information and data on budget revenues from land and business activities in the real estate sector;
đ) Real estate trading floor database;
e) Quantity of rental housing and other types of real estate specified in Point c, d, đ Clause 3 Article 6 of this Decree including information: Land and construction characteristics; scale, purpose of use; ownership registration;
g) Other statistical indicators on the development situation of the real estate market at the locality.
Chapter III
BUILDING THE INFORMATION SYSTEM ON HOUSING AND REAL ESTATE MARKET

1. The housing and real estate market database is built in accordance with the national information system architecture, meeting standards for databases and technical standards, information technology standards, and economic-technical norms.
2. The housing and real estate market database is connected online with the land database, databases under ministries, sectors, and localities related to it, between central and provincial levels, and between provincial and district-level housing management agency databases.
3. The content of building the housing and real estate market database includes collecting, updating, processing information, storing, and preserving in accordance with Articles 10, 11, and 12 of this Decree.
Article 10. Collecting and Updating Information and Data
1. Collecting and updating information and data on housing and the real estate market must comply strictly with relevant regulations, procedures, and economic-technical norms.
2. Forms of collecting and updating information and data on housing and the real estate market:
a) From regular and ad hoc reports of agencies, organizations, and individuals as prescribed;
b) From specialized databases;
c) From existing data on housing and the real estate market;
d) From survey and research data;
đ) Other forms.
3. The agency managing the housing and real estate market database is responsible for receiving information and data provided by agencies, organizations, and individuals to integrate into the housing and real estate market database.
4. The Construction Department proposes and reports to the People's Committee of the province on collecting and updating additional information and data on housing and the real estate market of the locality to serve timely management, economic and social development, and implementation upon approval.
Article 11. Processing information and data
1. The agency managing the database on housing and real estate market shall be responsible for processing information and data before they are integrated and stored in the housing and real estate market database to ensure rationality and consistency. The content of information and data processing includes:
a) Checking and evaluating compliance with regulations and procedures in collecting information and data;
b) Checking and evaluating the legal basis and reliability of information and data;
c) Summarizing, arranging, and classifying information and data in accordance with the prescribed content.
2. For information and data updated from specialized databases, the agency managing such specialized databases shall be responsible for ensuring the accuracy of the information and data.
Article 12. Storing and preserving information and data
1. Information and data on housing and the real estate market must be digitized, stored, and preserved in accordance with the laws on archiving and specialized regulations to ensure safety and convenience in managing, exploiting, and using information.
2. Agencies and units entrusted with the responsibility of managing the housing and real estate market database must have plans to digitize data that are not yet in digital form; must implement management measures, business practices, and technical measures for the information system to ensure the security of digital information and data on housing and the real estate market.
Article 13. Reporting and providing information and data by agencies and organizations
1. Information and data provided periodically every month:
a) Real estate trading floors and organizations engaged in real estate brokerage services provide information as stipulated in Point c Clause 2 Article 8 of this Decree to the Construction Departments of localities according to Form Nos. 1, 2, and 3 attached to this Decree;
b) Project investors provide information on real estate transaction situations of projects as stipulated in Point c Clause 2 Article 8 of this Decree to the Construction Departments of localities according to Form Nos. 4a, 4b, 4c, and 5 attached to this Decree;
c) Departments of Justice, People's Committees at the commune level provide and report information on the number of real estate transactions as stipulated in Point c Clause 2 Article 8 of this Decree through notarization activities to the Construction Departments of localities according to Form No. 6 attached to this Decree.
2. Information and data provided periodically every quarter:
a) Project investors provide information on the implementation of housing and real estate projects, the number of products of projects as stipulated in Point b Clause 2 Article 8 of this Decree to the Construction Departments of localities according to Form Nos. 8a, 8b, 8c, and 8d attached to this Decree;
b) Departments of Natural Resources and Environment provide information as stipulated in Point h Clause 1 Article 8 of this Decree to the Construction Departments of localities according to Form No. 9 attached to this Decree.
3. Information and data provided periodically every six months:
a) People's Committees at the district level provide information as stipulated in Point i Clause 1 Article 8 of this Decree to the Construction Departments of localities for consolidation and storage according to Form No. 10 attached to this Decree;
b) Departments of Natural Resources and Environment, Tax Departments provide information on land area for housing construction as stipulated in Point c Clause 1 Article 8 and information as stipulated in Point d Clause 2 Article 8 of this Decree to the Construction Departments of localities for consolidation and storage according to Form Nos. 11 and 12 attached to this Decree;
c) Departments of Planning and Investment provide information as stipulated in Point b Clause 2 Article 7 of this Decree to the Construction Departments of localities for consolidation, storage, and reporting to the Ministry of Construction according to Form No. 13 attached to this Decree.
4. Information and data provided periodically annually:
a) People's Committees at the district level provide information as stipulated in Points d and e Clause 1 Article 8 of this Decree to the Construction Departments of localities for consolidation and storage according to Form Nos. 14 and 15 attached to this Decree;
b) Ministries and ministerial-level agencies according to their management functions provide information on housing types under their management as stipulated in Point đ Clause 1 Article 7 of this Decree to the Ministry of Construction according to Form No. 16 attached to this Decree.
5. Time limit for providing information and data
a) For information and data provided to Construction Departments:
- Before the 5th day of the month following the reporting month for information and data required to be provided monthly;
- Before the 10th day of the first month of the quarter following the reporting quarter for information and data required to be provided quarterly;
- Before the 15th day of the first period of the period following the reporting period for information and data required to be provided semi-annually;
- Before January 20 of the year following the reporting year for information and data required to be provided annually;
b) For information and data provided to the Ministry of Construction:
- Before the 15th day of the first month of the quarter following the reporting quarter for information and data required to be provided quarterly;
- Before the 20th day of the first period of the period following the reporting period for information and data required to be provided semi-annually;
- Before January 25 of the year following the reporting year for information and data required to be provided annually.
6. Information related to the characteristics of land, changes related to the process of ownership of residential land and housing, and various types of real estate as stipulated in Point c, d, đ Clause 3 Article 6; planning and land use plans, residential land prices are connected and integrated from the land database managed by the natural resources and environment agencies at the local level responsible for collecting, updating, and managing.
7. The database on legal documents concerning housing, residential land, and the real estate market is connected and integrated from the national legal database managed by the Ministry of Justice.
8. Statistical data, results, summaries, and reports of surveys and statistics on housing and housing development plans carried out by the agencies entrusted with the main responsibility must be provided to the agency managing the housing and real estate market database no later than 20 days after the authorized authority approves the survey and statistical results to integrate them into the database.
9. Information on housing projects and real estate properties as specified in Point b Clause 2 Article 8 shall be reported by the investors to the local Construction Departments within fifteen days from the date of the project approval decision and any adjustment decision (if applicable) using Forms 7a, 7b, 7c, and 7d attached to this Decree.
10. Forms of providing information and data
a) Sending information and data directly through electronic information networks;
b) Sending information and data in writing.
11. The Ministry of Construction shall specify in detail the contents, frequency, and deadlines for providing other statistical indicators on housing and the real estate market as stipulated in this Decree.
Article 14. Construction of Information Technology Infrastructure and Software Systems for Managing, Operating, and Exploiting Housing and Real Estate Market Information Systems
1. Information technology infrastructure for housing and the real estate market includes a set of computing devices (servers, workstations), network connection devices, network security and safety devices, databases, storage devices, peripheral devices, auxiliary devices, and internal networks.
2. Software systems for managing, operating, and exploiting housing and real estate market information systems include: Operating systems, database management systems, application software, and network security and safety software.
Article 15. Investment in Housing and Real Estate Market Information Systems
1. Funding for constructing information technology infrastructure, software for managing, operating, and exploiting information systems; building databases and maintaining regular operations of housing and real estate market information systems at the central level; surveys and statistics on housing and the real estate market across multiple provinces and centrally-administered cities from development investment funds; regular funding guaranteed by the central budget according to laws on state budget and other sources as prescribed by law.
2. Funding for conducting surveys, collecting information, building databases, and maintaining regular operations of housing and real estate market information systems at the local level from regular funding guaranteed by the local budget according to laws on state budget and other sources as prescribed by law.
3. The agency managing housing and real estate market information systems may lease information technology infrastructure to serve management, operation of databases to reduce investment costs and save state budget.
Leasing of information technology infrastructure shall be carried out in accordance with relevant laws.
Article 16. Organization and Operation Management of Housing and Real Estate Market Information Systems
1. The Ministry of Construction shall utilize existing organizational structures and staffing to manage and operate housing and real estate market information systems at the central level; organize training and professional development for staff assigned to manage and operate housing and real estate market information systems at both the central and local levels.
2. Local Construction Departments shall utilize existing organizational structures and staffing to develop organizational plans, allocate personnel suitable for managing and operating housing and real estate market information systems at the local level following the principle of not increasing organizational structures and staffing, and report to the provincial People's Committees.
3. The agency managing housing and real estate market information systems may entrust organizations with sufficient capacity to undertake certain tasks in the construction and management of housing and real estate market information systems, including:
a) Building and providing services for information technology infrastructure systems;
b) Building and providing software systems for management, operation, and exploitation;
c) Implementing management and operation of servers, computer equipment, computer networks, and other technical operations related to information systems;
d) Conducting surveys and investigations to build databases on housing and the real estate market;
đ) Determining statistical indicators on housing and the real estate market.
4. Organizations entrusted with the task of constructing and managing housing and real estate market information systems must have sufficient conditions and capabilities in terms of operational experience, personnel, equipment, and other conditions appropriate to the tasks they undertake as stipulated in Clause 3 of this Article.
Entrusted organizations must bear legal responsibility for the content of their work as prescribed in this Decree and other relevant laws.
Chapter IV
MANAGEMENT AND USE OF HOUSING AND REAL ESTATE MARKET INFORMATION SYSTEMS
Article 17. Management of Housing Information System and Real Estate Market
1. The Ministry of Construction shall uniformly manage the housing information system and real estate market.
2. Local Construction Departments shall implement management of the housing information system and real estate market at the local level.
3. State management agencies shall issue detailed regulatory documents within their authority to guide the provision, collection, updating, processing, storage, preservation, exploitation, and utilization of housing and real estate market information; stipulate financial regimes for the collection, updating, processing, management, exploitation, and utilization of housing and real estate market information; ensure adequate and timely funding for the construction and operation of the housing information system and real estate market.
4. Agencies managing the housing information system and real estate market shall establish regulations on database construction and information system management; develop and implement security and safety measures for information; directly or entrust organizations with sufficient capacity to undertake the management and operation of servers, computer equipment, computer networks, ensuring the operation of the system; grant and assign access rights to agencies, organizations, and individuals registered to exploit and utilize information and data from the housing and real estate market database according to regulations.
Article 18. Exploitation and Utilization of Housing and Real Estate Market Databases
1. Forms of exploitation and utilization of housing and real estate market databases include:
a) Through the Internet;
b) Through electronic information pages prescribed by the agency managing the housing and real estate market databases;
c) Through dedicated networks;
d) Through request forms or written requests;
e) By contracts between the agency managing the housing and real estate market databases and the parties exploiting and utilizing housing and real estate market data according to the law.
2. Subjects and Scope of Exploitation and Utilization
a) Agencies participating in building and maintaining housing and real estate market databases have the right to exploit data within their own management scope. Exploitation of housing and real estate market data outside their management scope must be approved by the agency managing the housing and real estate market databases;
b) State agencies with authority have the right to request the provision of housing and real estate market information related to state administration work, investigative activities, verification, and handling of violations of the law;
c) Agencies, organizations, and individuals not specified in Points a and b of this Clause have the right to request the provision of housing and real estate market information for legitimate purposes;
d) The agency managing the housing and real estate market databases shall not provide information affecting national security, business secrets of enterprises, and personal information except when serving investigative activities, verification, and handling of violations of the law and serving state administration work of authorized agencies.
3. Subjects specified in Point c of Clause 2 of this Article, when needing to use information, must pay for the service of providing housing and real estate market information according to regulations.
Revenue from services providing housing and real estate market information and data shall be managed and utilized according to the law on the state budget.
The Ministry of Construction shall take the lead and coordinate with the Ministry of Finance to provide specific guidance on this Clause.
Article 19. Disclosure of Information on Housing and the Real Estate Market
1. Basic information on housing and the real estate market shall be disclosed through mass media and websites of central and local agencies to serve the community and the economic and social development needs of the country.
2. The Ministry of Construction shall stipulate the contents and periodicity of disclosing basic information on housing and the real estate market nationwide.
3. The People's Committee of each province shall instruct the provincial Construction Department to periodically disclose basic information on housing and the real estate market of their locality according to the contents prescribed by the Ministry of Construction.
4. Real estate associations and organizations with sufficient capacity may disclose information related to housing and the real estate market that they have collected, processed, and are responsible for. When widely disclosing such information, real estate associations and organizations with sufficient capacity must clearly state the data sources, scope of data, and submit the disclosed content to the Ministry of Construction and the provincial Construction Departments for monitoring and supervision.
Chapter V
RESPONSIBILITIES AND LIMITS OF AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS IN THE CONSTRUCTION, MANAGEMENT, AND USE OF INFORMATION SYSTEMS ON HOUSING AND THE REAL ESTATE MARKET
Article 20. Responsibilities of the Ministry of Construction
1. To be responsible before the Government for performing state management functions regarding construction, management, and use of information systems on housing and the real estate market.
2. To draft and submit to the Government for promulgation or promulgate within its authority legal documents, mechanisms, and policies on construction, management, exploitation, and use of information systems on housing and the real estate market; to provide detailed guidance on the contents of provision, collection, updating, processing, storage, preservation, exploitation, and use of information and data on housing and the real estate market.
3. To develop investment projects for building technical infrastructure for information technology to connect to provincial Construction Departments, software systems serving management, operation, and exploitation of information systems on housing and the real estate market in accordance with laws on investment and construction.
4. To organize the construction of unified software systems for managing, operating, and exploiting information systems on housing and the real estate market; to build technical infrastructure for information technology on housing and the real estate market to connect to provincial Construction Departments; to establish databases, manage, and organize the operation of information systems on housing and the real estate market at the central level; to provide information on housing and the real estate market to agencies, organizations, and individuals in accordance with the law.
5. To propose programs for surveys and statistics on housing and the real estate market across multiple provinces and centrally-administered cities for submission to the Prime Minister for consideration and decision-making, and to organize implementation after approval.
6. To periodically report to the Prime Minister on the development situation of the real estate market; to provide and share information in the database on housing and the real estate market with ministries and sectors for state management purposes.
7. To periodically disclose basic information in the national database on housing and the real estate market; to guide localities in establishing statistical indicators and disclosing basic information on housing and the real estate market of their locality.
8. To develop plans and manage the use of allocated funds for surveys, establishment of databases, construction, maintenance, and upgrading of technical infrastructure for information technology, software systems serving management, operation, and exploitation of information systems on housing and the real estate market in compliance with current regulations.
9. To take the lead, coordinate, and urge ministries, sectors, and localities to implement the provisions stipulated in this Decree.
Article 21. Responsibilities of Ministries, ministerial-level agencies, and government agencies
1. Shall be responsible before the Government for collecting and providing information related to housing and the real estate market as prescribed in this Decree within their scope of management functions; directing subordinate agencies located at localities to provide information as prescribed in this Decree.
2. Coordinate with the Ministry of Construction in connecting, integrating, and sharing information from relevant databases under their management, while ensuring the maintenance, connection, and sharing of information with the database on housing and the real estate market, specifically:
a) The Ministry of Natural Resources and Environment shall connect, integrate, and share information and data on land planning, residential land prices, situations of issuing certificates of land use rights and ownership certificates for houses, information on residential land and houses, changes in ownership of residential land and houses and real estate, characteristics of land as prescribed in this Decree;
b) The Ministry of Justice shall connect, integrate, and share information and data on the system of legal regulations related to housing and the real estate market;
c) The Ministry of Planning and Investment shall connect, integrate, and share information and data on the number and information about enterprises operating in the real estate sector.
3. The State Bank shall provide comprehensive information on credit balances for business activities in the real estate sector to the Ministry of Construction according to Form No. 17 attached to this Decree.
4. The Ministry of Finance shall allocate regular funds to serve the construction of databases and the operation of the information system on housing and the real estate market in accordance with laws on state budget; coordinate with the Ministry of Construction to guide the management and use of funds obtained from exploiting and using information and data from the database on housing and the real estate market.
5. The Ministry of Science and Technology shall appraise and announce national standards, appraise national technical regulations; support national scientific and technological research tasks on building, managing, and using the information system on housing and the real estate market.
6. The Ministry of Information and Communications shall guide, inspect, and evaluate compliance with regulations, standards, and technical norms on the application of information technology in building the information system on housing and the real estate market.
7. The Ministry of Planning and Investment shall be responsible for allocating funds from the state budget to serve the construction, upgrading of technical infrastructure for information technology, software serving management, operation, and exploitation of the information system on housing and the real estate market.
Article 22. Responsibilities of the People's Committee at the provincial level
1. Entrust the Department of Construction to take the lead:
a) Organizing the operation of the information system on housing and the real estate market at the locality;
b) Taking the lead and coordinating with related units to collect information related to housing and the real estate market at the locality; receiving information related to housing and the real estate market at the locality provided by agencies, organizations, and individuals;
c) Providing information to agencies, organizations, and individuals who need to exploit and use information in accordance with the law;
d) Announcing periodically basic information on housing and the real estate market of the locality as prescribed;
đ) Building and reporting to the provincial People's Committee the plan for investigating, collecting, and updating information on housing and the real estate market of the locality in their plans and tasks and organizing implementation after approval;
e) Monitoring, urging, and inspecting developers, real estate trading floors, organizations conducting real estate brokerage services on the implementation of reporting systems, provision of information, and data as prescribed in this Decree;
g) Summarizing and reporting to the Ministry of Construction and the provincial People's Committee periodically and urgently information on housing and the real estate market of the locality.
2. Direct the implementation of ensuring the connection of the database on housing and the real estate market to housing management agencies at the district level in the locality.
3. Issuing coordination regulations and directing related units in the construction, maintenance of the information system, and provision of information and data on housing and the real estate market at the locality.
4. Direct departments to connect specialized databases related to housing and the real estate market under their management as prescribed in this Decree with the database on housing and the real estate market at the locality; direct the connection, integration, and sharing of information between the land database managed by the local natural resources and environment agency and the database on housing and the real estate market at the locality.
5. Direct the Department of Construction to establish an organizational structure and staff to build and manage the information system on housing and the real estate market as prescribed in Clause 2, Article 16 of this Decree.
6. Allocate an annual budget for investigation, construction of databases, management, operation of the information system, and calculation of other statistical indicators on housing and the real estate market at the locality.
Article 23. Responsibilities and authorities of agencies, organizations, and individuals in providing and using information and data on housing and the real estate market
1. Agencies, organizations, and individuals shall be responsible for:
a) Adhering to the principles regarding the construction and use of information and data on housing and the real estate market as stipulated in Article 4 of this Decree and related provisions of competent authorities;
b) Providing complete information to the management agency of the housing and real estate market information system in accordance with regulations within the prescribed time limit;
c) Not exploiting the provision of information to harass, seek personal gain, or disseminate information contrary to legal provisions;
d) Not providing third parties with data provided by state agencies with authority for their own exploitation and use unless permitted by the competent management agency of the housing and real estate market database;
đ) Promptly notifying the management agency of the housing and real estate market database of any errors in the information and data they have provided.
2. Agencies, organizations, and individuals shall have the right:
a) To refuse requests for the provision of information and data that contravene the provisions of this Decree and other relevant legal provisions;
b) To lodge complaints and denunciations in accordance with the law when their rights to exploit and use information are violated.
Chapter VI
IMPLEMENTING PROVISIONS
Article 24. Effective Date
This Decree takes effect from January 1, 2016.
Article 25. Implementation organization
1. The Minister of Construction shall be responsible for guiding and supervising the implementation of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial People's Committees shall be responsible for implementing this Decree./.
