Issuing the plan to implement the Law on Prevention and Combating Trafficking in Persons

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 136/2013/NĐ-CP dated October 21, 2013 of the Government stipulating social assistance policies for beneficiaries of social protection;

Considering the proposal of the Minister of Public Security,

DECISION:

Article 1. This Decision attaches the Plan for Implementing the Law on Prevention and Combating Trafficking in Persons.

Article 2. The funding for implementing this Decision shall be allocated from the State budget.

Article 3. This Decision shall take effect from the date of signing.

Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for enforcing this Decision.

PLAN

IMPLEMENTATION OF THE LAW ON PREVENTION AND COMBATING TRAFFICKING IN PERSONS

(Attached to Decision No. 1173/QĐ-TTg dated July 18, 2011 of the Prime Minister)

I. OBJECTIVES AND REQUIREMENTS

1. Objective

Assign specific tasks to ministries, sectors, and localities to ensure unified and effective implementation of the Law on Prevention and Combating Trafficking in Persons.

2. Requirements

a) Ministries, sectors, and localities assigned tasks must proactively and positively implement them, ensuring timely progress, quality, economy, avoiding formalism and waste.

b) Based on their functions, tasks, and authorities, ministries, sectors, and local governments shall develop implementation plans, coordinate with relevant units, promptly address difficulties and obstacles arising during the implementation of this Plan.

II. CONTENT AND SPECIFIC TASKS

1. Propaganda and dissemination of the Law on Prevention and Combating Trafficking in Persons

a) Organize propaganda and dissemination of the Law on Prevention and Combating Trafficking in Persons and related regulatory documents to enhance responsibility and unify understanding among management staff, frontline personnel working on prevention and combating trafficking in persons, and the general public.

b) Compile materials and organize specialized training on the Law on Prevention and Combating Trafficking in Persons for frontline personnel engaged in combating trafficking in persons.

c) Assignment:

- Lead agency: Ministry of Public Security

- The Ministry of National Defense shall cooperate with the Ministry of Public Security to organize specialized training on the Law on Prevention and Combating Trafficking in Persons and related regulatory documents for frontline personnel combating trafficking in persons within the People's Army.

- The Ministry of Information and Communications shall lead and coordinate with the Ministry of Public Security, the Ministry of National Defense, the Government's Council for Popularizing and Promoting Legal Education, the Vietnam Women's Union, and provincial and municipal People's Committees to guide and instruct central and local media outlets to disseminate and popularize the Law on Prevention and Combating Trafficking in Persons and related regulatory documents.

- Request the Supreme People's Court and the Supreme People's Procuracy to organize training, dissemination, and thorough understanding of the contents of the Law on Prevention and Combating Trafficking in Persons and related regulatory documents for leaders and staff directly handling cases related to trafficking in persons within their respective sectors.

- Request the Vietnam Fatherland Front and its member organizations to implement the propaganda and dissemination plan of the Law on Prevention and Combating Trafficking in Persons for members and various strata of the population.

d) Timeframe: In 2011 and 2012.

2. Review and systematize regulatory documents on prevention and combating trafficking in persons.

a) Content:

Ministries, sectors, and provincial and municipal People's Committees shall review regulatory documents related to prevention and combating trafficking in persons based on their functions, tasks, and authorities, compile statistics on documents that need revision, supplementation, replacement, or abolition to align with the Law on Prevention and Combating Trafficking in Persons, and submit them to the Ministry of Public Security for consolidation and reporting to the Prime Minister.

b) Lead agency: Ministry of Public Security and relevant ministries, sectors, and provincial and municipal People's Committees.

c) Completion time: Fourth quarter of 2011.

3. Drafting detailed regulations and guidelines for implementing the Law on Prevention and Combating Trafficking in Persons

a) Draft Decree of the Government on identifying victims of trafficking and protecting their safety and that of their relatives.

- Lead agency: Ministry of Public Security.

- Coordinating agencies: Ministry of National Defense, Ministry of Justice, Ministry of Labor, Invalids and Social Affairs, Ministry of Foreign Affairs, Supreme People's Procuracy, Supreme People's Court.

- Submission deadline: October 2011.

b) Draft Decree of the Government on support facilities; support systems; procedures and processes for supporting victims of trafficking.

- Lead agency: Ministry of Labor, Invalids, and Social Affairs.

- Coordinating agencies: Ministry of Public Security, Ministry of National Defense, Ministry of Justice, Ministry of Health, Ministry of Education and Training, Ministry of Foreign Affairs, Ministry of Finance, State Bank of Vietnam.

- Submission deadline: October 2011.

c) Draft Joint Circular of the Ministry of Public Security, Ministry of National Defense, Ministry of Justice, Supreme People's Procuracy, and Supreme People's Court guiding the handling of criminal acts of trafficking in persons.

- Lead agency: Supreme People's Court.

- Coordinating agencies: Ministry of Public Security, Ministry of National Defense, Ministry of Justice, Supreme People's Procuracy.

- Completion time: April 2012.

d) Draft Joint Circular of the Ministry of Public Security, Ministry of National Defense, Ministry of Labor, Invalids and Social Affairs, and Ministry of Foreign Affairs guiding coordination in receiving and verifying victims of trafficking.

- Lead agency: Ministry of Public Security.

- Coordinating agencies: Ministry of National Defense, Ministry of Labor, Invalids and Social Affairs, Ministry of Foreign Affairs.

- Completion time: April 2012.

đ) The Minister of Public Security shall issue a Circular detailing measures to protect the safety of victims of trafficking and their relatives.

e) The Minister of National Defense shall issue a Circular specifying concrete measures of the People's Army in combating trafficking in persons and other related violations.

III. FINANCIAL GUARANTEES

Funding for implementing this Plan shall be guaranteed by the State budget according to current budget management levels and other legitimate financial sources.

Provincial and municipal People's Committees shall allocate local budgets to implement the Law on Prevention and Combating Trafficking in Persons for tasks under their responsibilities.

For 2011 specifically, the Ministry of Finance shall supplement funds for implementing this Plan.

IV. IMPLEMENTATION

1. The agencies assigned as the main coordinators shall be responsible for completing the tasks, ensuring progress, quality, and effectiveness; the agencies supporting coordination shall be responsible for coordinating with the main coordinator to implement the specific tasks assigned. The Ministries, ministerial-level agencies, provincial People's Committees, and centrally governed city People's Committees shall report the results of implementing this Plan to the Government (through the Ministry of Public Security).

2. The Ministry of Public Security shall be responsible for guiding, monitoring, inspecting, urging the implementation of this Plan, and reporting the results of its implementation to the Prime Minister./.
