DECISION OF THE CHAIRMAN OF THE GOVERNMENT
On policies to support fishermen in mitigating risks caused by natural disasters at sea
PRIME MINISTER
Based on the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Fisheries Law dated November 26, 2003;
Considering the proposal of the Minister of Fisheries,
DECISION:
Article 1. Object and scope of application
This Decision stipulates certain support policies for organizations and individuals engaged in fishing, aquaculture, and marine fishery-related services along the coast and at sea to mitigate risks caused by natural disasters such as typhoons, tropical depressions, tsunamis, etc., occurring at sea, along the coast, and on islands (hereinafter referred to as at sea); and support for organizations and individuals not belonging to state forces participating in rescue operations for people and property affected by natural disasters at sea.
Article 2. Support for human losses
In addition to the assistance policies prescribed in Decree No. 67/2007/NĐ-CP dated April 13, 2007 of the Government on assistance policies for social welfare beneficiaries, supplementary support shall be provided for cases of human loss due to natural disasters at sea as follows:
1. Provide 100% funding for purchasing tickets for transportation back to their place of residence for cases where risks occur far from their place of residence (including risks outside Vietnam's territorial waters).
2. Provide 100% funding for emergency transportation costs from the sea to land, preservation of deceased victims' bodies, and information dissemination through mass media for up to 30 days regarding missing persons.
3. For those mobilized or voluntarily participating in search and rescue operations for people and other vessels, in addition to the policies stipulated in Clauses 1 and 2 of this Article, they will also enjoy special allowances as prescribed in Decision No. 70/2006/QĐ-TTg dated March 29, 2006 of the Chairman of the Government on special allowances for maritime search and rescue personnel, and may be considered for commendation according to current laws.
Article 3. Support for property losses
1. Consider providing support for losses of production means (vessels, boats, fishing gear, cages) that are lost or severely damaged; provide funding for salvaging production means (vessels, boats, fishing gear, cages) that have sunk or drifted; provide aquatic seedlings for areas of aquaculture that have suffered damage when restoring production.
Provincial People's Committees shall base their specific supplementary support levels on actual circumstances, the affected parties, the extent of damage, and budgetary capacity.
2. Consider exemption or reduction of taxes according to current laws.
3. Provide support for the provision of communication equipment and 100% lifebuoys for distant-water fishing vessels that have sunk or been severely damaged, when restoring production.
4. Provide 100% funding for fuel costs and repair costs (if the vessel is damaged) for vessels and boats mobilized or voluntarily participating in rescue operations for people and vessels affected by natural disasters at sea.
Article 4. Financial resources for implementation
1. Central budget supplements to localities according to the State Budget Law.
2. Local budgets allocate appropriate funds to proactively finance the implementation of policies prescribed in this Decision.
3. Contributions and sponsorships from domestic and foreign organizations and individuals.
Article 5. Implementation
1. The Ministry of Fisheries shall take the lead and coordinate with the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, and relevant ministries and sectors to guide the implementation of this Decision.
2. The Ministry of Planning and Investment and the Ministry of Finance shall balance and allocate annual budget funds for localities to implement.
3. Provincial People's Committees shall be responsible for organizing the implementation of policies and systems prescribed in this Decision; proactively allocate local budgets to provide timely support for risk cases; direct, inspect, and strictly manage to ensure that support is implemented according to objectives, contents, and prescribed recipients.
Article 6. Effectiveness and Responsibility for Implementation
This Decision takes effect 15 days after its publication in the Official Gazette.
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of coastal provinces and centrally governed cities are responsible for implementing this Decision./.
