DECREE

Of the Government Decision No. 118-CP dated September 7, 1994 on the functions, tasks,

powers, and organizational structure of the National Committee for Child Protection and Care

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Law on Child Protection, Care, and Education dated August 16, 1991 and Decree No. 374-HĐBT dated November 14, 1991 of the Council of Ministers (now the Government) detailing the implementation of the Law on Child Protection, Care, and Education;

Considering the proposal of the Minister responsible for child protection and care work and the Minister, Head of the Government Organization and Cadre Affairs Department;

DECREE:

Article 1. The National Committee for Child Protection and Care is an agency under the Government, with the function of assisting the Government in managing state affairs regarding child protection, care, and education, guiding, inspecting, urging, supervising, and organizing coordination among state agencies, people's organizations, social organizations, and economic organizations related to the implementation of tasks concerning child protection, care, and education.

Article 2. The National Committee for Child Protection and Care has the following tasks and powers:

1- To take the lead in coordinating with relevant agencies to develop and submit to the Government for approval strategies, programs, projects, and plans for child care, protection, and education nationwide; organize coordination with state agencies, people's organizations, and social organizations to implement these programs, projects, and plans.

2- To coordinate with relevant agencies to develop and submit to the Government draft laws, ordinances, and policies on child protection, care, and education; issue documents within its authority to guide and inspect sectors and localities in implementing state laws and policies on child protection and care. Organize coordination between ministries, sectors, localities, people's organizations, and mass media to promote and disseminate state laws and policies on child protection and care.

3- To coordinate with the State Planning Committee and the Ministry of Finance to develop and submit to the Government financial plans to implement the action program for children; guide and inspect the use of funds allocated for children according to approved objectives and plans.

4- To submit to the Government participation in international organizations, signing and ratifying international conventions on children; organize the implementation of international cooperation plans on children as prescribed by the Government; participate in international conferences and seminars on children when authorized.

5- To manage certain international-funded programs and projects supporting children's goals as prescribed by

6- To train and guide staff on management practices and programs and actions for children at all levels.

7- To manage and utilize the Central Child Protection Fund, guide and inspect the management and utilization of child assistance funds at various levels and sectors.

8- To perform inspection functions to enforce the Law on Child Protection, Care, and Education. Coordinate with relevant agencies to inspect the implementation and propose measures to address violations of state laws and policies concerning children.

Article 3. The composition of the National Committee for Child Protection and Care includes:

- Chairperson,

- Deputy Chairpersons specializing in specific areas; Deputy Chairpersons representing the Ministry of Education and Training, the Ministry of Health, the Vietnam Women's Union Central Committee, the Communist Youth Union Central Committee of Ho Chi Minh.

- Commission members concurrently serving as representatives from leading ministries, sectors, and people's organizations: the State Planning Commission, the Ministry of Finance, the Ministry of Foreign Affairs, the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Culture, Information, the Ministry of Justice, the Population and Family Planning Commission, the Ministry of Defense, the Ministry of Home Affairs, the General Sports Administration, the General Statistics Office, the Vietnam Fatherland Front, the All-Vietnam Trade Union Federation, the Vietnam Farmers' Association, the Vietnam Red Cross, the Vietnam Literature and Arts Association, the Ho Chi Minh Communist Youth League Central Committee.

Article 4. Tasks and powers of the members of the National Committee for Child Protection and Care:

- The Chairperson and Deputy Chairpersons specializing in specific areas are appointed and relieved of their duties by the Prime Minister. Other Deputy Chairpersons and concurrent Commission members are appointed by their respective agencies.

- The Chairperson of the Committee is responsible to the Prime Minister for the entire operation of the Committee. The Deputy Chairperson specializing in specific areas assists the Chairperson, is assigned by the Chairperson to direct certain aspects of work, and is accountable to the Chairperson for the tasks assigned.

- Deputy Chairpersons and concurrent Commission members of the Committee must fully participate in Committee meetings, engage in discussions and decisions on work policies of the Committee, and be responsible for the tasks of their respective ministries, sectors, or people's organizations concerning child protection, care, and education as assigned by the Committee.

Article 5

A- The specialized organizational structure of the National Committee for Child Protection and Care includes:

1- Office,

2- Child Protection and Care Inspection Bureau,

3- Planning, Finance, and Program Management Bureau,

4- International Relations Bureau.

B- Subordinate units of the Committee include:

1- Child Assistance Fund.

2- Children's Magazine.

The tasks, powers, and working procedures of named units are defined by the Committee Chairperson.

Article 6. Organizational structure for child protection and care operations at all levels:

a) In some ministries with many activities related to child protection, care, and education such as the Ministry of Health, the Ministry of Education and Training, the Ministry of Culture, Information, and the Ministry of Labor, Invalids, and Social Affairs, there should be dedicated staff to assist the Minister in overseeing, urging, and inspecting the enforcement of the Law on Child Protection, Care, and Education and the implementation of the Government's action program for children.

b) Provinces and centrally-administered cities shall establish a Child Protection and Care Committee under the People's Committee. The Chairman or Vice-Chairman of the People's Committee serves as the Chairperson of the Committee or appoints a dedicated Chairperson. Members of the Child Protection and Care Committee are decided by the Chairman of the People's Committee based on guidelines from the National Committee for Child Protection and Care. The Committee has a dedicated Deputy Chairperson and support staff appointed by the Chairman of the People's Committee.

c) At the district level and equivalent, establish a Committee for Child Protection and Care under the People's Committee, headed by the Chairman or Vice-Chairman of the People's Committee as the Director of the Committee; have a dedicated staff member assisting the Committee located at the People's Committee Office.

d) At the commune level and equivalent, establish a Board for Child Protection and Care under the People's Committee, headed by the Chairman or Vice-Chairman of the People's Committee as the Head of the Board, with a part-time staff member assisting from among the commune's existing staff as specified.

e) In agencies and enterprises, child protection and care must be included in the unit's work program, with a unit leader responsible and utilizing specialized units within the organization to assist.

Article 7. This Decree takes effect from the date of issuance. The Decree No. 362-HĐBT dated November 6, 1991 issued by the Council of Ministers and other previous regulations contrary to this Decree are hereby abolished.

Article 8. The Director of the National Committee for Child Protection and Care, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
