RESOLUTION

Detailed regulations and guidance on organizing meetings of voters to seek opinions on candidates for People's Council representatives at village level and residential wards; on negotiation, introduction of candidates, and establishment of candidate lists for National Assembly representatives and People's Council representatives in supplementary electionsnominate to be a representative of the Commune People's Council at the village, residential quarter; the negotiation,introduction of candidates, establishment of the list of candidates for representatives of theORGANIZATION OF MEETINGS OF VOTERS TO SEEK OPINIONS ON CANDIDATES FOR NATIONAL ASSEMBLY REPRESENTATIVES AND PEOPLE'S COUNCIL REPRESENTATIVES

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Elections of Deputies to the National Assembly and People's Councils No. 85/2015/QH13;

RESOLUTION:

PART I

1. Meetings of voters where the candidate works to seek opinions on candidates for National Assembly representatives and People's Council representatives (including those introduced as candidates and self-nominated candidates) shall be organized at the place where the candidate works or performs duties (if applicable). In cases where the candidate has multiple workplaces, the meeting shall be held at the place where the candidate regularly works.

2. The authority to preside over and convene citizen meetings at place of work shall be implemented as follows:

a) For candidates working in full-time positions at Party agencies, Vietnam Fatherland Front agencies, political-social organizations, and social organizations, the head of the agency or organization shall coordinate with the Trade Union Committee of that agency or organization to convene and chair the meeting, except in the case provided for in point g of this clause;

b) For candidates who are Chairperson or Vice-Chairperson of the National Assembly, working at the Standing Committee of the Ethnic Council, Committees of the National Assembly, specialized departments under the Ethnic Council, Committees of the National Assembly, working at the National Assembly Office, or specialized Party cadres at the National Assembly Party Committee, the organization of citizen meetings to gather opinions at the workplace shall be decided and directed by the National Assembly Standing Committee, with the meeting convened and chaired by the leadership comprising the head and deputy heads of the National Assembly Office;

b) For candidates working at agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and the National Assembly Office, the National Assembly Office shall organize the collection of voter opinions at the workplace. For candidates who are full-time members of the National Assembly delegation, the National Assembly Office and the Provincial People's Council Office (or the National Assembly Delegation Office if not established) shall organize the collection of voter opinions at the workplace. The Director of the National Assembly Office, the Head of the National Assembly Delegation Office and Provincial People's Council Office, or the Head of the National Assembly Delegation Office shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting;

c) For candidates working at the Standing Body of the Provincial People's Council, the Committees of the Provincial People's Council, the National Assembly Delegation Office and Provincial People's Council Office, or the National Assembly Delegation Office and Provincial People's Council Office (where the National Assembly Delegation Office and Provincial People's Council Office have not been established), the National Assembly Delegation Office and Provincial People's Council Office, or the National Assembly Delegation Office and Provincial People's Council Office shall organize the collection of voter opinions at the workplace. For candidates working at the Standing Body of the District People's Council and the Committees of the District People's Council, the District People's Council Office and District People's Committee shall organize the collection of voter opinions at the workplace. The Head of the National Assembly Delegation Office and Provincial People's Council Office, or the Head of the National Assembly Delegation Office and District People's Council Office, or the Head of the District People's Council Office and District People's Committee shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting;

d) For candidates who are President, Vice President, Prime Minister, or Deputy Prime Minister, the Office of the President and the Government Office shall organize the collection of voter opinions at the workplace. For candidates who are members of the National Assembly and People's Council who are Chairmen or Deputy Chairmen of Provincial or District People's Committees, the Provincial People's Committee Office, the Provincial People's Council and People's Committee Office, or the District People's Council and People's Committee Office shall organize the collection of voter opinions at the workplace. The head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting;

đ) For candidates working at People's Courts, People's Procuratorates at all levels, State Audit Agency, Ministries, agencies equivalent to ministries, government agencies, specialized agencies under Provincial or District People's Committees, and other state agencies, the head of the agency shall coordinate with the Trade Union Committee of the agency to convene and chair the meeting;

e) For candidates working at public service units or economic organizations, the head of the unit or organization shall coordinate with the Trade Union Committee to convene and chair the meeting;

g) For candidates working at Party Committees, Standing Bodies of the People's Councils, People's Committees, Vietnam Fatherland Front Committees, political-social organizations at the commune level, or as commune-level civil servants, the meeting to seek opinions from voters at the workplace shall be held in a joint meeting between the Party Committee, Standing Body of the People's Council, People's Committee, Vietnam Fatherland Front Committee, and political-social organizations at the commune level. The head of the commune-level Party Committee shall convene and chair the meeting;

h) For candidates working in people's armed forces units, the leaders and commanders of the unit shall convene and chair the meeting;

i) In cases where the head of the agency, organization, or unit is a candidate, the deputy head of the agency, organization, or unit shall coordinate with the Trade Union Committee to convene and chair the meeting;

k) In cases where the workplace or place of duty of the candidate for National Assembly representative or People's Council representative specified in this clause does not have a Trade Union, the head or deputy head of the agency, organization, or unit shall convene and chair the meeting.

3. Where there are fewer than 100 voters, a general meeting of all voters shall be organized to seek opinions on candidates for National Assembly representatives and People's Council representatives, and it must ensure that the number of voters attending the meeting reaches at least two-thirds of the total number of voters summoned. Where there are 100 or more voters, a general meeting or a meeting of voter representatives may be organized, and it must ensure that at least 70 voters attend the meeting. Depending on the characteristics and actual situation of the agency, organization, or unit, the Trade Union Committee shall coordinate with the head of the agency, organization, or unit to allocate the number of people for the subordinate Trade Unions to send representatives to attend; in cases where there is no Trade Union, the head of the agency, organization, or unit shall allocate the number of people for the subordinate units to send representatives to attend.

4. Candidates for National Assembly representatives and People's Council representatives shall be invited to attend the meeting.

4. Nominees for National Assembly deputies and People's Council representatives shall be invited to attend the meeting.

Article 2. Organizing the residents' meeting

1. A residents' meeting to solicit opinions on candidates for National Assembly deputies and People's Council deputies (including both recommended candidates and self-nominated candidates) shall be organized at village, hamlet, ward, group, street, block, neighborhood, residential area, apartment complex, or other similar locality where the candidate usually resides or temporarily resides. In cases where the usual place of residence or temporary residence cannot be determined, the residents' meeting shall be held at the village or neighborhood where the candidate currently lives.

In cases where the candidate resides in an apartment complex or urban area that has not yet established a neighborhood association, the residents' meeting shall be organized within the apartment complex or urban area where the candidate lives to solicit opinions on the candidate.

2. The Standing Board of the Vietnam Fatherland Front Committee at the commune level shall coordinate with the People's Committee at the same level to convene and preside over the meeting.

The Head of the Mass Mobilization Committee shall cooperate with the Village Chief or Neighborhood Association Leader to compile a list and invite voters to attend the meeting. In cases where the residents' meeting is organized within an apartment complex or urban area that has not yet established a neighborhood association, the Head of the Mass Mobilization Committee shall cooperate with the Management Board of the Apartment Complex or Urban Area to compile a list and invite voters residing in the apartment building or urban area to attend the meeting.

3. For places with fewer than 100 voters, a general meeting of all voters shall be organized to solicit opinions on candidates for National Assembly deputies and People's Council deputies, and it must ensure that the number of voters attending the meeting reaches at least 50% of the total number of voters summoned. For places with 100 or more voters, either a general meeting or a representative household meeting may be organized, but it must ensure that there are at least 55 voters attending the meeting.

4. The Chairperson and Vice-Chairperson of the Commune People's Council, candidates for National Assembly deputies, candidates for People's Council deputies, representatives from agencies, organizations, units, villages, or neighborhood associations that have introduced candidates shall be invited to attend the meeting.

Article 3. Content and minutes of the meeting of voters

1. At the workplace residents' meeting and the place of residence residents' meeting, voters shall compare the candidates against the standards for National Assembly deputies and People's Council deputies, express their observations, and indicate their trust in the candidates.

2. The minutes of the residents' meeting must clearly record the composition, number of participants, proceedings, and results of the meeting; specifically, they must include the total number of voters summoned, the number of voters present, statements made, and the trust expressed by voters towards each candidate. The submission of the minutes shall be regulated as follows:

a) The minutes of the workplace residents' meeting soliciting opinions on candidates recommended by central agencies, organizations, or units for National Assembly deputies must be submitted together with the minutes of the leadership meeting of the agency, organization, or unit evaluating the recommended candidate to the Standing Committee of the Central Vietnam Fatherland Front before the second round of consultation meetings is held;

b) The minutes of the workplace residents' meeting soliciting opinions on candidates recommended by local agencies, organizations, or units for National Assembly deputies must be submitted together with the minutes of the leadership meeting of the agency, organization, or unit evaluating the recommended candidate to the Standing Committee of the Provincial Vietnam Fatherland Front before the second round of consultation meetings is held;

c) The minutes of the workplace residents' meeting soliciting opinions on candidates recommended for People's Council deputies must be submitted together with the minutes of the leadership meeting of the agency, organization, or unit where the candidate works evaluating the recommended candidate to the Standing Committee of the Vietnam Fatherland Front of the organization holding the consultation meeting before the second round of consultation meetings is held;

d) The minutes of the place of residence residents' meeting soliciting opinions on candidates recommended for National Assembly deputies by central agencies, organizations, or units must be submitted to the Standing Committee of the Central Vietnam Fatherland Front; the minutes of the place of residence residents' meeting soliciting opinions on candidates recommended for National Assembly deputies by local agencies, organizations, or units must be submitted to the Standing Committee of the Provincial Vietnam Fatherland Front immediately after the residents' meeting concludes;

đ) The minutes of the voter meeting seeking opinions on self-nominated candidates for National Assembly deputy must be sent to the Standing Committee of the Vietnam Fatherland Front Provincial Committee immediately after the voter meeting ends;

e) The minutes of the place of residence residents' meeting soliciting opinions on candidates recommended for People's Council deputies by agencies, organizations, or units, and the minutes of the residents' meeting soliciting opinions on self-nominated candidates for People's Council deputies must be submitted to the Standing Committee of the Vietnam Fatherland Front of the organization holding the consultation meeting immediately after the residents' meeting concludes.

Article 4. Procedures for organizing voter meetings

1. The chairperson of the meeting declares the purpose, introduces the representatives attending the meeting. The chairperson has the following responsibilities:

a) Introduce the purpose and requirements of the meeting;

b) Introduce the Meeting Secretary for the meeting to decide;

c) Report on the number of invited voters and the number of present voters;

d) Introduce the list of candidates;

d) Read the criteria for National Assembly deputies as stipulated in Article 22 of the Law on the Organization of the National Assembly (for voter meetings to seek opinions on candidates for National Assembly deputies), the criteria for People's Council deputies as stipulated in Article 7 of the Law on the Organization of Local Administration (for voter meetings to seek opinions on candidates for People's Council deputies), and the cases not eligible to be candidates for National Assembly deputies or People's Council deputies as stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Deputies.

2. The Meeting Secretary reads the brief biography of each candidate.

3. Voters express their opinions regarding each candidate.

4. Candidates make statements.

5. Representatives from agencies, organizations, units introducing candidates express their opinions.

6. The meeting shall vote by raising hands or secret ballot. The meeting shall elect a Vote Counting Team consisting of from three to five people.

In the case of voting by raising hands, the Counting Team counts and calculates the voting results for each candidate.

In case the meeting votes by secret ballot, the voter's letter of support from their workplace must bear the stamp of the organization or unit or the Trade Union Executive Committee of that organization or unit. The voter's letter of support from their place of residence must bear the stamp of the Vietnam Fatherland Front Committee at the commune level or the People's Committee at the same level. On the letter of support, clearly write the name and surname of the candidate. If there are multiple candidates, clearly write the name and surname of each candidate, arranged alphabetically from A, B, C... The voter crosses out the name of the candidate they do not support and puts it in the ballot box.

7. The head of the Vote Counting Team announces the voting results.

8. The meeting approves the minutes of the voter meeting (according to Model No. 01/HNCT or Model No. 02/HNCT).

Chapter II

INTRODUCTION OF CANDIDATES FOR DEPUTIES OF THE COMMUNE PEOPLE'S COUNCIL IN VILLAGE OR NEIGHBORHOOD

Article 5. Content and procedure for nominating people from villages and housing complexes to be introduced as candidates for deputies of the Commune Level People's Council

1. The Head of the Mass Mobilization Working Group coordinates with the Heads of the Village Associations to convene a meeting with the Secretary of the Village Party Branch, the Village Chief, or the Neighborhood Leader to propose individuals from the village or neighborhood to be introduced as candidates for deputies of the Commune People's Council according to the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity and structure of candidates.

2. The Head of the Mass Mobilization Working Group convenes and chairs a meeting comprising all members of the Mass Mobilization Working Group to discuss and propose individuals from the village or neighborhood to be introduced as candidates for deputies of the Commune People's Council.

3. The procedures for organizing the meeting are carried out as follows:

a) The Head of the Mass Mobilization Working Group introduces the purpose and requirements of the meeting, appoints the Meeting Secretary, and reads the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity, structure, and composition of individuals from the village or neighborhood to be introduced as candidates for deputies of the Commune People's Council; the criteria for deputies of the People's Council as stipulated in Article 7 of the Law on the Organization of Local Administration and the cases not eligible to be candidates for deputies of the People's Council as stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Deputies;

b) The Head of the Mass Mobilization Working Group presents the proposed individuals from the village or neighborhood to be introduced as candidates for deputies of the Commune People's Council;

c) The meeting discusses and comments on the proposed candidates;

d) The Head of the Mass Mobilization Working Group summarizes opinions and concludes the meeting;

đ) The meeting approves the minutes of the meeting (according to Model No. 03/HNMT).

Article 6. The Voters' Meeting Introduces Candidates for People's Council Deputies from Village and Neighborhood Ward

1. The Head of the Mass Mobilization Working Group coordinates with the Village Chief or the Neighborhood Leader to send invitations to attend the voter meeting to introduce candidates for deputies of the Commune People's Council from the village or neighborhood. The attendees include:

a) Voters or representatives of household voters.

For places with fewer than 100 voters, a general meeting of all voters should be organized and ensure that the number of voters attending the meeting is at least 50% of the total number of voters summoned. For places with 100 or more voters, a general meeting of all voters or a representative meeting of household heads may be organized, and it must ensure that at least 55 voters attend the meeting;

b) All members of the Mass Organization Work Board;

c) The Village Chief, Deputy Village Chief, or the Neighborhood Ward Leader, Deputy Neighborhood Ward Leader;

d) Representatives of the Standing Body of the People's Council, People's Committee, and the Vietnam Fatherland Front Standing Committee at the commune level.

2. The procedures for organizing the voter meeting are carried out as follows:

a) The Head or Deputy Head of the Mass Mobilization Working Group chairs the voter meeting, states the reasons for the meeting, and introduces the attendees; introduces the purpose and requirements of the meeting; introduces the Meeting Secretary for the meeting to decide; reports on the number of voters invited and the number present;

b) The chairperson of the meeting reads the notification of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level regarding the allocation of quantity and structure of individuals from the village or neighborhood to be introduced as candidates; reads the criteria for deputies of the People's Council as stipulated in Article 7 of the Law on the Organization of Local Administration and the cases not eligible to be candidates for deputies of the People's Council as stipulated in Article 37 of the Law on the Election of National Assembly Deputies and People's Council Deputies;

c) A representative of the Mass Mobilization Working Group reads the list of individuals proposed by the Mass Mobilization Working Group to be introduced as candidates for deputies of the Commune People's Council from the village or neighborhood. Voters may introduce additional candidates for the meeting to consider;

d) The meeting discusses the proposed candidates;

đ) The meeting decides to vote on the formal list of individuals from the village or neighborhood to be introduced as candidates by raising hands or secret ballot. The meeting elects a Vote Counting Team consisting of from three to five people.

If the meeting votes by raising hands, the counting team counts and calculates the voting results for each proposed candidate;

In case the meeting votes by secret ballot, the voter's letter of support must bear the stamp of the Vietnam Fatherland Front Committee at the commune level or the stamp of the People's Committee at the same level. On the letter of support, clearly write the name and surname of the individuals proposed by the voter meeting to be introduced as candidates. If there are multiple individuals proposed, clearly write the name and surname of each individual proposed, arranged alphabetically from A, B, C... The voter crosses out the name of the individual proposed whom they do not support and puts it in the ballot box.

The individual proposed as a candidate is one who receives more than 50% of the votes of the voters present. In case multiple individuals receive more than 50% of the votes of the voters present, the individual proposed as a candidate is determined based on the voting results ranked from highest to lowest until the allocated number is reached; in case the voting results are tied, the chairperson of the meeting prepares a list of those individuals for the meeting to vote again and selects the individual with the higher voting result without needing to reach more than 50% of the voters present. In case the re-vote results are still tied, whether to continue voting is decided by the meeting;

e) The head of the Vote Counting Team announces the voting results;

g) The meeting approves the minutes of the meeting (according to Model No. 04/HNCT).

Chapter III

COOPERATION, NOMINATION OF CANDIDATES FOR NATIONAL ASSEMBLY DELEGATES AND PEOPLE'S COUNCIL DELEGATES IN SUPPLEMENTARY ELECTIONS

Article 7. Work on consultation and introduction of candidates for supplementary elections

The cooperation and nomination of candidates for supplementary elections of National Assembly delegates and People's Council delegates shall be organized and implemented in accordance with the provisions of Section 2 and Section 3 of Chapter V of the Law on Elections of National Assembly Delegates and People's Council Delegates, and related detailed regulations and guidance. However, the time for conducting cooperation and nomination of candidates for supplementary elections shall be carried out in accordance with Article 8 of this Resolution.

Article 8. Time for conducting consultations and introducing candidates for supplementary elections

1. The first cooperation meeting to agree on the structure, composition, and number of persons proposed as candidates for National Assembly delegates and People's Council delegates shall be held no later than 20 days before the date of the supplementary election.

2. After the first cooperation meeting, agencies, organizations, units, villages, and residential wards allocated the number of persons to propose candidates shall select and nominate candidates no later than 19 days before the date of the supplementary election.

3. The second consultation meeting to agree on the preliminary list of candidates for National Assembly deputies and People's Council representatives shall be held no later than 16 days before the date of the supplementary election.

4. The meeting of voters to collect opinions and trust of voters residing and working (if applicable) regarding candidates for National Assembly delegates and People's Council delegates shall be conducted no later than 14 days before the date of the supplementary election.

5. The third cooperation meeting to select and establish a list of persons meeting the criteria for candidacy for National Assembly delegates and People's Council delegates shall be held no later than 12 days before the date of the supplementary election.

Chapter IV

IMPLEMENTING PROVISIONS

Article 9. Implementation Provisions

1. This Resolution takes effect from the date of issuance.

2. During the implementation of this Resolution, if there are difficulties or obstacles, agencies and organizations shall report to the Standing Committee of the National Assembly for timely guidance./.
