Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on the Ratification, Accession, and Implementation of International Treaties dated May 24, 2005;
Pursuant to current tax laws;
Pursuant to the Law on Vietnamese Nationality dated November 13, 2008; Pursuant to the Ordinance on Privileges and Immunities for Diplomatic Missions, Consular Posts of Foreign Countries, and Representative Offices of International Organizations in Vietnam dated August 23, 1993;
Pursuant to Decree No. 131/2006/NĐ-CP dated November 9, 2006 of the Government on the Issuance of the Rules on Management and Utilization of Official Development Assistance;
The Prime Minister issues this Decision on principles, criteria, and allocation standards for state budget investment capital development phase 2016-2020.
DECISION:
Article 1. Attached hereto are the Rules on foreign experts implementing official development assistance programs and projects in Vietnam (referred to as the Rules on foreign experts).
Article 2. This Decision takes effect from November 20, 2009 and replaces Decision No. 211/1998/QĐ-TTg dated October 31, 1998 of the Prime Minister on the Rules on foreign experts implementing official development assistance programs and projects in Vietnam.
Article 3. The Ministry of Planning and Investment and the Ministry of Finance shall issue Circulars guiding the implementation of these Rules and inspect their implementation according to their respective functions.
Article 4. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
