DECREE

THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Law on the Organization of People's Councils and People's Committees dated June 21, 1994, and the Ordinance on Specific Tasks and Authorities of People's Councils and People's Committees at Each Level dated June 25, 1996;
Pursuant to Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government on streamlining staffing in administrative agencies and public service units;
Pending the National Assembly's approval of the Law on the Organization of the Government, the Law on the Organization of People's Councils and People's Committees (amended), and to implement the Resolution of the Seventh Plenary Session of the Central Committee of the Communist Party of Vietnam, Eighth Term;
At the proposal of the Minister, Head of the Organization and Cadre Department of the Government,
DECREE:
Article 1
1. Establish the Population, Family, and Children Commission under the People's Committee of provinces and centrally governed cities based on the merger of the Population Commission and Family Planning Commission and the Child Protection and Care Commission.
2. Rename the Office of the People's Committee of provinces and centrally governed cities established pursuant to Decree No. 156/HĐBT dated December 17, 1981 to the Office of the People's Council and People's Committee. In those provinces and centrally governed cities where the Office of the People's Committee has been separated into two offices (Office of the People's Committee and Office of the People's Council), they shall be merged into one office named the Office of the People's Council and People's Committee.
The functions, tasks, and organizational structure of the Office of the People's Council and People's Committee of provinces and centrally governed cities will be specified in a separate document issued by the Government.
3. Based on geographical, economic characteristics, management tasks, requirements, and the capacity of managerial cadres, the People's Committee of provinces and centrally governed cities shall decide on the establishment of specialized agencies under the People's Committees of districts, counties, towns, and provincial-level cities, but not exceeding ten departments in districts and counties, eleven departments in towns and provincial-level cities, twelve departments in provincial-level cities (class 2 urban areas), and eight departments in island districts.
Specialized agencies under the People's Committees of districts, counties, towns, and provincial-level cities that have been defined in Laws and Ordinances shall maintain their current organization and names.
4. Transfer the state management responsibilities for health care in the respective areas from the Health Centers of districts, counties, towns, and provincial-level cities to the corresponding level People's Committees.
Article 2
1. This Decree takes effect from the date of signature.
2. The Minister of the Government Organizational and Cadre Affairs Department shall be responsible for coordinating with relevant agencies to guide the implementation of this Decree.
Article 3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
