DIRECTIVE
ON REGULATING THE WORK OF ORGANIZING PASSENGER TRANSPORTATION BY BUS BETWEEN PROVINCES

After more than one year of implementing the Road Traffic Law, Government Decree No. 92/2001/NĐ-CP and other management documents of the Ministry of Transport, there have been initial positive changes in traffic order. Transportation enterprises have proactively modernized their vehicles to meet the increasingly high demands of passengers, established plans for organizing passenger transport on various routes, and some routes have reasonably determined stops and parking points, facilitating passenger travel. Many localities have reorganized bus stations to attract more buses to pick up and drop off passengers, reducing the phenomenon of unauthorized bus stations ("bến cóc") and unlicensed buses ("xe dù"), with a significant decrease in disguised contract buses. These initial results have contributed to improving service quality and received social approval.
However, passenger transportation by bus between provinces still has several shortcomings that cause dissatisfaction among passengers and public concern on some long-distance routes. The phenomenon of buses operating outside their scheduled routes and times, selling passengers along the way, raising prices, overloading, carrying goods in passenger buses, circling at terminal points to pick up passengers, stopping and parking in unauthorized locations, not dropping passengers at designated terminals, extending driving time, bringing passengers to roadside eateries, drivers exceeding the prescribed driving time under Article 60 of the Road Traffic Law, causing traffic accidents, and incidents of bus fires...
The causes of these shortcomings are due to the fact that the management work of the transport management agencies has not strictly implemented the regulations of the Government and the Ministry of Transport, with some places having lax management. Additionally, oversupply on some routes has led to fierce competition, and some transportation enterprises have simply applied a quota system, prioritizing profit over service quality for passengers and allowing drivers to violate national regulations in the field of passenger transport management for personal gain.
To maintain and further develop the achieved results, address the shortcomings after more than one year of implementing the Road Traffic Law, Government Decree No. 92/2001/NĐ-CP, and other management documents, the Minister of Transport instructs the Director of the Vietnam Highway Administration, the Directors of Provincial Departments of Transport (Public Works) within their scope of duties and authority to organize the implementation of the following tasks:
1. Continue to organize the implementation of the following documents:
Directive No. 22/CT-TW dated February 24, 2003 of the Politburo on strengthening Party leadership in traffic safety assurance work and Resolution No. 13/2002/NQ-CP dated November 19, 2002 of the Government on measures to control and reduce traffic accidents and congestion, aiming to restore traffic order and safety, including safety in inter-provincial passenger transport.
Government Decree No. 14/2003/NĐ-CP dated February 19, 2003 detailing the implementation of certain provisions of the Road Traffic Law.
Government Decree No. 15/2003/NĐ-CP dated February 19, 2003 on administrative penalties for violations of road traffic regulations.
2. The Vietnam Highway Administration shall coordinate with the Provincial Departments of Transport (Public Works):
Review and eliminate inter-provincial passenger transport routes that do not meet standards. Revoke permission documents for route exploitation from enterprises that fail to comply with Decision No. 4127/2001/QĐ-BGTVT of the Minister of Transport and organize for other enterprises to take over operations.
Urgently complete the project to build bus stop and rest points on national highways and submit it to the Ministry of Transport for approval.
In the short term, in 2003, based on existing stops and parking points along National Highway 1, select some points on the Hanoi-Ho Chi Minh City section to direct passenger transport enterprises to develop driving schedules and times for each leg of the journey in compliance with the driver's working hours stipulated in Article 60 of the Road Traffic Law. Require transport enterprises on this route to sign contracts with rest stations and restaurants to provide passengers with rest according to the approved driving schedule. Study and pilot the inclusion of passenger meals in ticket prices at reasonable costs, ensuring hygiene and quality for passengers, and draw lessons for implementation on remaining routes in 2004.
Implement the installation of signs for bus stops and passenger pick-up/drop-off points on all national highways managed by the Vietnam Highway Administration.
Study and propose changes to the management mechanism for bus transport enterprises in line with current management documents. Develop plans for regular and specific cooperation with the Administrative Management Police Department to establish order and safety at bus stations and stops on National Highway 1.
Propose to the Minister to issue regulations on the responsibilities of bus drivers and measures to handle violations by bus drivers and management agencies.
3. Provincial Departments of Transport (Public Works) directly under the Central Government:
Advise provincial People's Committees to direct local authorities where selected stops and parking points are located to require restaurant owners to commit to maintaining security, order, food safety, and transparent pricing while respecting passenger freedom.
Organize technical inspection services for vehicles at stops and parking points.
Study and advise provincial People's Committees to plan and encourage economic sectors to invest in building and upgrading inter-provincial bus stations.
Coordinate with local authorities at all levels to firmly eliminate unauthorized bus stations ("bến cóc") and unlicensed buses ("xe dù") locally, and end the practice of ticket scalping and passenger allocation at bus stations.
Organize the installation of signs for bus stops and passenger pick-up/drop-off points on national highways entrusted to management and other roads managed by localities.
Direct traffic inspectors to check and penalize bus drivers, conductors, and station staff who violate regulations at bus stations such as:
Introducing vehicles without the business name on the vehicle door to pick up passengers, vehicles without registration, with fake registration, vehicles past their service life limit, or vehicles not clearly marked with the number of seats.
Loading goods inside the vehicle, transporting bulky goods on the roof of the vehicle.
Refusing to sell tickets to passengers before leaving the station.
Directing bus stations to fulfill their duties and powers as prescribed in Decision No. 4128/2001/QĐ-BGTVT of the Ministry of Transport.
Regularly inspecting transport enterprises within the jurisdiction to ensure compliance with approved schedules, adequate driver allocation to meet working hours stipulated by the Road Traffic Law, and handling enterprises and drivers reported by the media and confirmed to have violated regulations.
The Ministry of Transport requests the Ministry of Public Security and provincial People's Committees to direct police forces and inspection teams to strictly control cargo and luggage, preventing drivers, vehicle owners, and passengers from carrying hazardous materials and flammable/explosive items on passenger vehicles; ensuring public order and safety on passenger vehicles; imposing severe penalties for violations and prosecuting those who intentionally violate and cause consequences according to the law.
Requesting the Director of the Vietnam Highway Administration, Directors of Provincial Departments of Transport (Public Works), centrally-administered cities, and related transportation units to strictly implement this Directive, submitting monthly reports on results to the Vietnam Highway Administration for consolidation and reporting to the Ministry of Transport./.
