Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Enactment of Legal Regulatory Documents No. 17/2008/QH12 dated June 3, 2008;

Pursuant to the High Technology Law No. 21/2008/QH12 dated November 13, 2008;

Pursuant to Decision No. 49/2010/QĐ-TTg dated July 19, 2010 of the Government approving the List of high technology fields prioritized for investment and development and the List of high technology products encouraged for development;

Considering the proposal of the Minister of Industry and Trade,

DECISION:

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Decision stipulates incentive policies for the development of supporting industries in the following sectors: mechanical manufacturing, electronics and information technology, automobile assembly, textiles and garments, leather and footwear, and supporting industries for the development of high technology industries.

a) State management agencies, organizations, and individuals related to supporting industries.

b) Projects producing supporting industry products.

Article 2. Interpretation of Terms

In this Decision, the following terms shall be understood as follows:

1. Supporting industry: refers to industries producing materials, spare parts, components, accessories, and semi-finished products supplied to manufacturing and assembly industries that produce complete products as means of production or consumer goods.

2. Supporting industry product: refers to products produced by the industries specified in Clause 1 of Article 1, including materials, spare parts, components, accessories, and semi-finished products manufactured in Vietnam for supply to the assembly and production stages of complete products.

3. Project producing supporting industry products: refers to investment projects in Vietnam (including new investments and additional investments) aimed at producing supporting industry products.

Article 3. Encouragement for the Development of Supporting Industries

1. The State encourages and creates conditions for domestic and foreign organizations and individuals to invest in developing supporting industries.

2. Encouragement for market development

a) Projects producing supporting industry products are entitled to free advertising and introduction of their products on the Ministry of Industry and Trade's electronic information website and those of provincial Departments of Industry and Trade.

b) Projects producing supporting industry products are given priority consideration for financial support from trade promotion programs and investment promotion programs according to the regulations governing the establishment, management, and implementation of such programs.

c) Investors in projects producing supporting industry products for the development of high technology industries are provided with state-created conditions to participate in forming networks for supplying products and services in accordance with laws on high technology.

3. Encouragement for infrastructure

a) Projects producing supporting industry products are given priority support and suitable land funds for projects in terms of area, location, and land rental fees.

b) Projects producing supporting industry products located within industrial clusters are entitled to use infrastructure facilities, public services, and other services within the cluster; they are supported and facilitated in recruitment and training of labor; and they enjoy other supportive policies as stipulated in Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister on the Management Regulations for Industrial Clusters.

c) Investors in projects producing supporting industry products who are small and medium-sized enterprises are entitled to supportive policies regarding production premises as stipulated in Decree No. 56/2009/NĐ-CP dated June 30, 2009 of the Government on Assistance for the Development of Small and Medium-Sized Enterprises.

d) Projects producing supporting industry products for the development of high technology industries are subject to land encouragement policies as stipulated by laws on high technology.

4. Encouragement for science and technology, and human resource training

a) Projects producing supporting industry products are considered for partial funding from the National Science and Technology Development Fund and other related funds for technology transfer costs, purchase of design copyrights, software purchases, and hiring of foreign experts.

b) Investors in projects producing supporting industry products who are small and medium-sized enterprises are entitled to supportive policies for enhancing technological capacity, technical proficiency, and human resource development as stipulated in Decree No. 56/2009/NĐ-CP dated June 30, 2009 of the Government on Assistance for the Development of Small and Medium-Sized Enterprises.

c) Projects producing supporting industry products are considered for partial funding for human resource training from the state budget according to current regulations.

d) Projects producing supporting industry products for the development of high technology industries are subject to supportive policies for human resource development as stipulated by laws on high technology.

5. Regarding information provision

a) Ministries, sectors, People's Committees of provinces and centrally governed cities provide through their electronic information portals regular updates on relevant legal documents concerning the development of supporting industries and state technical assistance programs for projects producing supporting industry products.

b) Investors in projects producing supporting industry products who are small and medium-sized enterprises are entitled to supportive policies for information provision and consulting as stipulated in Decree No. 56/2009/NĐ-CP dated June 30, 2009 of the Government on Assistance for the Development of Small and Medium-Sized Enterprises.

6. Regarding finance

a) Projects producing supporting industry products are entitled to preferential import and export tax benefits according to current laws on export and import taxes.

b) Projects producing supporting industry products are considered for partial borrowing of state investment development credit funds according to current regulations.

c) Investors in projects producing supporting industry products who are small and medium-sized enterprises are entitled to financial assistance policies as stipulated in Decree No. 56/2009/NĐ-CP dated June 30, 2009 of the Government on Assistance for the Development of Small and Medium-Sized Enterprises.

d) Projects producing supporting industry products for the development of high technology industries are considered for tax policies according to laws on high technology.

Article 4. Incentives for the Development of Support Industries

Projects producing support industry products listed in the Priority Support Industry Product Catalogue shall be considered for appropriate incentive mechanisms. The project investor shall establish the project in accordance with current regulations, proposing specific suitable incentive mechanisms, and submit to the Support Industry Development Project Review Board for examination, reporting to the Prime Minister for decision.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Ministry of Industry and Trade:

a) Take the lead and coordinate with the Ministry of Science and Technology and relevant ministries and sectors in building and submitting to the Prime Minister for issuance of the Priority Support Industry Product Catalogue. Regularly review, update, and supplement the above-mentioned catalogue to meet the development requirements of each period, reporting to the Prime Minister for examination and decision.

b) Establish the Support Industry Development Project Review Board chaired by a Deputy Minister of Industry and Trade, with members including representatives from the Ministries of Planning and Investment, Finance, Science and Technology, Information and Communications, Natural Resources and Environment, Justice, Vietnam Development Bank, and related industry associations to review projects producing support industry products listed in the Priority Support Industry Product Catalogue.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and heads of related agencies within their respective functions and tasks, are responsible for providing detailed guidance and supervising the implementation of this Decision. During the implementation process, if there are difficulties or need for amendments, supplements, or adjustments to this Decision, relevant ministries, ministerial-level agencies, provincial People's Committees shall promptly reflect to the Ministry of Industry and Trade for consolidation and reporting to the Prime Minister for examination and decision.

Article 6. Effectiveness

This Decision takes effect from April 15, 2011.

Article 7. Responsibility for Implementation

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and heads of related agencies and units are responsible for implementing this Decision./.
