Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
On the basis of Resolution No. 67/NQ-CP dated December 24, 2010, issued by the Government regarding the simplification of administrative procedures within the scope of management functions of the Ministry of Science and Technology;
Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,
The Minister of Science and Technology stipulates:
Article 1. Amending and supplementing certain provisions of the Regulation on the Recognition of Capability to Calibrate Measuring Instruments issued together with Decision No. 20/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology as follows:
1. Amending and supplementing Article 7 as follows:
Article 7. Receiving applications
1. In the case of initial recognition, the organization requesting shall submit one (01) set of application documents to the General Department. The application includes:
a) A request for recognition of the capability to calibrate measuring instruments according to the form prescribed in Appendix I of Decision No. 20/2006/QĐ-BKHCN;
b) A report on the capability to calibrate measuring instruments according to the form prescribed in Appendix II of this Regulation;
c) A copy (certified true copy by the entity) of the document regarding the legal status of the organization.
2. In the case of re-recognition or expanded recognition, two (02) months before the recognition decision expires for the re-recognition cases specified in point a, Clause 2, Article 3 of Decision No. 20/2006/QĐ-BKHCN or when there is a need for re-recognition for the cases specified in point b, Clause 2, Article 3 of Decision No. 20/2006/QĐ-BKHCN or for expanded recognition for the cases specified in Clause 3, Article 3 of Decision No. 20/2006/QĐ-BKHCN, the calibration organization shall submit one (01) set of application documents to the General Department. The application includes:
a) A request for recognition of the capability to calibrate measuring instruments according to the form prescribed in Appendix I of Decision No. 20/2006/QĐ-BKHCN;
b) A report on the capability to calibrate measuring instruments according to the form prescribed in Appendix II of Decision No. 20/2006/QĐ-BKHCN (if there are changes from the initial recognition);
c) A copy of the certificate of recognition or certification prescribed in Article 12 of Decision No. 20/2006/QĐ-BKHCN (if there is a request for exemption from on-site assessment in Appendix I of Decision No. 20/2006/QĐ-BKHCN).
2. Amend and supplement Article 8 as follows:
Article 8. Processing applications
1. Within three (03) working days from the date of receipt of the application, if the application does not comply with the regulations, the General Department shall notify the requesting organization of the contents that need to be supplemented or completed.
2. In the case where the application is valid and requires on-site assessment:
a) Within fifteen (15) working days from the date of receipt of the complete and valid application, the General Department shall issue a Decision to establish an On-Site Assessment Team;
b) Within one (01) month from the date of receipt of the Decision to establish the On-Site Assessment Team (including by fax, email, etc.), the On-Site Assessment Team must submit a valid report on the results of the on-site assessment to the General Department.
c) Within twelve (12) working days from the date of receipt of the valid report on the results of the on-site assessment by the On-Site Assessment Team, the General Department shall issue a decision recognizing the capability to calibrate.
3. In the case where the application is valid and exempted from on-site assessment, within ten (10) working days from the date of receipt of the complete and valid application, the General Department shall issue a decision recognizing the capability to calibrate.
3. Amending and supplementing Clause 2, Article 11 as follows:
"2. The on-site assessment application must be submitted to the General Department within the time limit prescribed in Clause 2, Article 1 of this Circular."
Article 2. The General Department of Standardization, Metrology and Quality Assurance is responsible for guiding and organizing the implementation of this Circular.
Article 3.
1. This Circular takes effect from August 20, 2011.
2. The Director of the General Department of Standardization, Metrology and Quality, the Head of the Legal Affairs Department, and relevant organizations and individuals are responsible for implementing this Circular./.
