GUIDELINES FOR IMPLEMENTING THE ADJUSTMENT OF MONTHLY SUBSIDIES FOR MEMBERS AND SOLDIERS OF THE NATIONAL POLICE FORCE WHO ARE ELIGIBLE FOR MONTHLY SUBSIDIES PURSUANT TO DECISION NO. 53/2010/QĐ-TTg OF AUGUST 20, 2010 AND DECISION NO. 62/2011/QĐ-TTg OF NOVEMBER 9, 2011 OF THE GOVERNMENT PRIME MINISTER
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 4, Article 4 of Decree No. 35/2012/NĐ-CP dated April 18, 2012 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies for civil servants who have retired;
The Minister of Public Security and the Minister of Finance issue this Circular guiding the implementation of the adjustment of monthly subsidy levels for members and soldiers of the National Police Force eligible for monthly subsidies under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister.
Article 1. Scope of application
1. Members and soldiers of the National Police Force eligible for monthly subsidies as stipulated in Article 4 of Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC dated November 8, 2010 of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government Prime Minister regarding the treatment of members and soldiers of the National Police Force who participated in the resistance against the United States with less than 20 years of service in the National Police Force and have retired, been discharged, and returned to their localities.
2. Members and soldiers of the National Police Force eligible for monthly subsidies as stipulated in Clause 1, Article 3 of Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC dated May 14, 2012 of the Minister of Public Security, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance guiding the implementation of policies for officers, non-commissioned officers, soldiers, workers, and civil servants of the National Police Force under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister concerning policies for individuals who participated in wars to protect the country and international missions in Cambodia and assisting Laos after April 30, 1975 and have been demobilized, discharged, or retired.
Article 2. Adjustment of Monthly Allowance
As of May 1, 2012, the subjects specified in Article 1 of this Circular shall be adjusted their monthly subsidy level according to the following formula:

Example 1: Comrade Nguyen Van A is eligible for monthly subsidies under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government Prime Minister, with a total service period of 18 years and 6 months, and a monthly subsidy level in April 2012 of 1,063,841 VND.
From May 1, 2012, Comrade Nguyen Van A's monthly subsidy level will be adjusted as follows:
1,063,841 VND x 1.265 = 1,345,759 VND/month.
Example 2: Comrade Pham Van B is eligible for monthly subsidies under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government Prime Minister, with a total service period of 16 years and 10 months, and a monthly subsidy level in April 2012 of 971,250 VND.
From May 1, 2012, Comrade Pham Van B's monthly subsidy level will be adjusted as follows:
971,250 VND x 1.265 = 1,228,631 VND/month.
Article 3. Implementation Organization
3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities shall implement adjustments and pay monthly allowances to the cases specified in Article 1 of this Circular who are currently receiving monthly allowances at the Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities.
4. Four models are attached to this Circular, including Nos. 01/QĐ-X33, 02/GT-X33, 03/QĐ-X33, and 04/GT-X33.
This Circular shall take effect from November 19, 2013.
3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities shall implement the adjustment and payment of monthly subsidies for cases specified in Article 1 of this Circular who are currently receiving monthly subsidies at the Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities.
During the implementation process, if there are any difficulties, agencies and units should report to the Ministry of Public Security (through the General Department of Public Security Force Construction) for coordination with the Ministry of Finance to resolve them./.
Article 4. Effective date
This Circular takes effect from October 31, 2012.
The adjustment of monthly subsidies for the subjects specified in Article 1 of this Circular shall be implemented from May 1, 2012.
During the implementation process, if there are any difficulties, the agencies and units shall report to the Ministry of Public Security (through the General Department for Building Police Force) to coordinate with the Ministry of Finance to resolve them./.
