JOINT CIRCULAR
Guidelines for adjusting the monthly allowance level for officers and soldiers of the People's Public Security who are entitled to monthly allowances pursuant to Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011Pursuant to Clause 4, Article 4 of the Government Decree No. 35/2012/NĐ-CP dated April 18, 2012 on adjusting pensions, social insurance allowances, and monthly allowances for civil servants who have retired;of the Prime Minister

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
The Minister of Public Security and the Minister of Finance issue this Joint Circular guiding the implementation of adjustments to the monthly allowance levels for officers and soldiers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister.
1. Officers and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Article 4 of the Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC dated November 8, 2010 of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister regarding the regime for officers and soldiers of the People's Public Security who participated in the resistance war against America with less than 20 years of service in the People's Public Security and have ceased working, been discharged, or returned to their home province.
Article 1. Scope of application
2. Officers and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Clause 1, Article 3 of the Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC dated May 14, 2012 of the Ministers of Public Security, Labor, Invalids and Social Affairs, and Finance guiding the implementation of policies for officers, non-commissioned officers, soldiers, workers, and civil servants of the People's Public Security under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister regarding policies for individuals who participated in wars to protect the country and international missions in Cambodia and Laos after April 30, 1975 and have been demobilized, discharged, or ceased working.
As of May 1, 2012, the subjects specified in Article 1 of this Circular shall be adjusted their monthly allowance level according to the following formula:

Example 1: Comrade Nguyen Van A, who is entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister, has a service period of 18 years and 6 months with a monthly allowance of VND 1,063,841 in April 2012. |
From May 1, 2012, Comrade Nguyen Van A's monthly allowance will be adjusted as follows:
VND 1,063,841 x 1.265 = VND 1,345,759/month.
Example 2: Comrade Pham Van B, who is entitled to monthly allowances under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister, has a service period of 16 years and 10 months with a monthly allowance of VND 971,250 in April 2012.
From May 1, 2012, Comrade Pham Van B's monthly allowance will be adjusted as follows:
VND 971,250 x 1.265 = VND 1,228,631/month.
3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities shall implement adjustments and pay monthly allowances to cases specified in Article 1 of this Circular who are currently receiving monthly allowances at the Department of Labor, Invalids and Social Affairs of the province or centrally-administered city.
Article 3. Implementation Organization
3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities shall implement adjustments and pay monthly allowances to the cases specified in Article 1 of this Circular who are currently receiving monthly allowances at the Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities.
4. Four models are attached to this Circular, including Nos. 01/QĐ-X33, 02/GT-X33, 03/QĐ-X33, and 04/GT-X33.
This Circular shall take effect from November 19, 2013.
This Circular takes effect from October 31, 2012.
During the implementation process, if there are any difficulties, agencies and units should report to the Ministry of Public Security (through the General Department of Public Security Force Construction) for coordination with the Ministry of Finance to resolve them./.
Article 4. Effective date
Adjustments to the monthly allowance levels for the subjects specified in Article 1 of this Circular shall be implemented from May 1, 2012.

During the implementation process, if there are any difficulties, the agencies and units shall report to the Ministry of Public Security (through the General Department for Building Police Force) to coordinate with the Ministry of Finance to resolve them./.
