Detailed regulations on implementation of certain provisions of Government Decree No. 05/2011/NĐ-CPdated January 14, 2011 on Ethnic Work

Pursuant to Decree No. 05/2011/ND-CP dated January 14, 2011 of the Government on Ethnic Affairs;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Ethnic Culture,

The Minister of Culture, Sports and Tourism promulgates this Circular detailing the implementation of certain provisions of Government Decree No. 05/2011/NĐ-CP dated January 14, 2011 on Ethnic Work.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular details the implementation of policies on cultural preservation and development, sports and physical education development policy, and tourism development policy as stipulated in Articles 13, 14, and 15 of Government Decree No. 05/2011/NĐ-CP dated January 14, 2011 on Ethnic Work (referred to as Decree No. 05/2011/NĐ-CP).

Article 2. Applicability

This Circular applies to agencies, units under the Ministry, organizations, and individuals related when participating in ethnic work.

Chapter II
SPECIFIC PROVISIONS

Section 1
CULTURAL PRESERVATION AND DEVELOPMENT

(detailed regulations for Article 13 of Decree No. 05/2011/NĐ-CP)

Article 3. Supporting the preservation and promotion of tangible and intangible cultural values of ethnic minorities in Vietnam

1. Prioritize funding for projects and research topics on studying, collecting, preserving, and promoting the value of tangible and intangible cultural heritage of ethnic minorities in accordance with the law.

2. Enhance the capacity of cultural subjects; provide forms of commendation, encouragement, and support for artisans and those involved in traditional cultural and artistic activities; collect, study, introduce, and teach traditional folk songs, dances, and music of ethnic minorities, create new cultural and artistic values to serve ethnic minority communities.

3. Collect, publish, and introduce folk literature of ethnic minorities.

4. Produce film works reflecting the social life of mountainous areas inhabited by ethnic minorities.

5. Collect, restore, and promote traditional handicrafts and craft villages of ethnic minorities; preserve and promote distinctive traditional cultural and artistic values of ethnic minorities.

6. Prioritize research and prepare files for ranking or recognizing tangible and intangible cultural heritage of ethnic minorities according to the law on cultural heritage.

7. Develop programs and projects for inventorying, researching, collecting, preserving, displaying, and promoting typical traditional cultural heritage of ethnic minorities.

Article 4. Support for maintaining languages and scripts of ethnic minorities

1. Support for research, collection, and restoration of languages and scripts of ethnic minorities in accordance with the law on cultural heritage.

2. Organize cultural and artistic exchanges among ethnic groups; encourage and create conditions for ethnic artisans to perform programs in their own language; organize competitions for singing folk songs, storytelling, and creating new lyrics for folk songs, singing new songs in ethnic minority languages.

3. Prioritize publishing books, newspapers in ethnic minority languages or bilingual versions; support the provision of books, newspapers, magazines to public libraries in ethnic minority regions.

4. Organize literary and artistic creation in ethnic minority languages, translate suitable works from Vietnamese into ethnic minority languages; prioritize funding for new creations and organize dissemination in ethnic minority languages; encourage the creation of works in mother tongues among ethnic minority artists.

5. Prioritize production of films with ethnic minority voiceovers or dubbing, audio tapes introducing in ethnic languages, CDs and DVDs of ethnic minority music.

Article 5. Prioritize the construction of cultural institutions to serve ethnic minority groups

1. Prioritize investment and construction of cultural institutions, provide equipment and facilities to serve areas with ethnic minority populations according to approved programs and projects.

2. Support funds according to the分级管理权限来实施以下活动:

a) Organizing exhibitions and displays of economic and cultural products;

b) Equipping mobile film teams with projection equipment;

c) Investing in equipment, books, and newspapers for public libraries to circulate and serve ethnic minority groups, remote and border areas, islands.

Article 6. Preservation and promotion of traditional festivals of ethnic minorities

1. Inventory, select, and guide ethnic minority groups to revive representative traditional festivals and folk performances that are consistent with local customs and current conditions.

2. Create favorable conditions for ethnic minority groups to preserve and promote the distinctive cultural values of traditional festivals.

3. Encourage the widespread dissemination both domestically and internationally of representative traditional festivals of ethnic minorities.

Article 7. Supporting the organization of cultural and artistic movements

1. Regularly organize meetings, days, contests, performances, cultural exchanges, sports, and tourism events for ethnic minorities by region or ethnicity.

2. Prioritize support for building mass art teams, cultural and artistic clubs, and cultural activities at local cultural institutions.

3. Improve the quality of cultural propaganda team activities, provide appropriate incentives for participants; rotate organizing regional cultural propaganda team meetings; strengthen activities and expand the "Border Cultural Bright Spot" model.

Article 8. Organizing professional artistic activities to serve ethnic minority groups

1. Support bringing special cultural and artistic activities (conducted by central and provincial-level art units) to serve ethnic minority groups, prioritizing border areas and extremely difficult regions.

2. Provide funding according to分级管理权限or establish incentive mechanisms for professional art troupes and mobile propaganda teams to organize activities serving ethnic minority groups in remote, border, island, and extremely difficult areas.

Article 9. Prioritizing training, instruction, and capacity building for ethnic minority cultural cadres

1. Prioritize supporting the training, instruction, and capacity building of cultural cadres who can use the languages and scripts of ethnic minorities in difficult areas with ethnic minority populations.

2. Organize basic knowledge training and instruction on management and administration for cultural cadres, grassroots cultural and artistic nuclei, enhancing awareness and organizational capabilities for village, commune, ward, hamlet, and community cadres to organize community cultural and artistic activities.

Section 2
DEVELOPMENT OF PHYSICAL EDUCATION AND SPORTS IN ETHNIC MINORITY AREAS

(detailed provisions of Article 14 of Decree No. 05/2011/NĐ-CP)

Article 10. Development of traditional sports of ethnic minorities

1. Support the collection, research, protection, preservation, and popularization of folk games and traditional sports of ethnic minorities; compile statistics on folk games of ethnic minorities as part of the task of collecting, preserving, and promoting intangible cultural heritage of Vietnam.

2. Select some folk games and traditional sports of ethnic minorities that meet the conditions to be included in the national mass sports competition system; organize folk games and traditional sports of ethnic minorities in festival, day, and sports competitions.

3. Organize traditional festivals and sports competitions in the Cultural, Sports, and Tourism Festival of each ethnic group. Hold Ethnic Minority Sports Contests biennially from the grassroots level to the region and nationwide. Hold Ethnic Traditional Sports Congresses every four years.

4. Guide the practice, performance, and competition of ethnic sports and promote ethnic sports abroad.

Article 11. Organizations to build and support physical activities such as sports, construction of stadiums, gymnasiums, and sports training centers for ethnic minority regions.

1. Training and organizing human resources for sports in ethnic minority regions according to programs and projects that have been approved by competent authorities.

2. Mobilizing local resources to ensure each village (hamlet, commune, ward) has at least one centralized sports practice point with a core sports team.

3. Implementing planning for the construction of sports infrastructure such as stadiums, training and competition halls, swimming pools suitable for the characteristics of the locality and customs of ethnic minorities in various regions and areas.

For national key regional centers, implement Decision No. 1752/QD-TTg dated September 30, 2013, of the Prime Minister on the Planning of National Sports Infrastructure Systems until 2020, with a vision to 2030.

4. Prioritize investment funds to construct cultural and sports centers at the commune level; sports areas in villages of ethnic minority regions according to Decision No. 2164/QD-TTg of the Prime Minister dated November 11, 2013, on the Overall Planning for the Development of Grassroots Cultural and Sports Facilities from 2013 to 2020, with a vision to 2030.

Section 3
DEVELOPMENT OF TOURISM IN ETHNIC MINORITY REGIONS

(details of Article 15 of Decree No. 05/2011/NĐ-CP)

Article 12. Development of tourism in ethnic minority regions.

1. Prioritizing support for promotional activities, advertising, and marketing of tourism in ethnic minority regions; researching and surveying tourism potential, selecting and building distinctive tourism products for ethnic minority regions; developing mountainous area tourism models with community participation of ethnic minorities. Specifically as follows:

a) Supporting research and surveys of tourism potential, and the development of tourism plans for ethnic minority regions;

b) Supporting the selection and construction of distinctive tourism products for ethnic minority regions with developed tourism potential, in line with overall tourism development plans for regions, areas, and localities;

c) Prioritizing the development of mountain-based tourism models with community participation of ethnic minorities; supporting the protection and preservation of natural and cultural environments where tourism activities take place;

d) Supporting promotional and marketing activities for tourist destinations and products in ethnic minority regions; creating conditions for tourism management units to participate in promotional events and programs at both regional and national levels.

2. Supporting sustainable and responsible tourism development, ensuring that ethnic minority communities have the right to participate and benefit from tourism activities:

a) Prioritizing surveys and assessments of tourism potential in ethnic minority regions; organizing the rational exploitation of tourism resources and landscapes in accordance with conservation principles, attracting local residents to participate and benefit from tourism activities;

b) Prioritizing support for community-based tourism development in ethnic minority villages and hamlets through homestays; utilizing traditional cultures of ethnic minorities to serve tourism development; minimizing negative impacts of tourism on the lives and cultures of ethnic minorities;

c) Guiding tourists visiting ethnic minority villages and tourist sites to respect local customs, lifestyles, and traditional cultures;

d) Establishing mechanisms to attract investment in tourist sites and ethnic minority villages under community-based tourism models, prioritizing projects supported by non-governmental organizations;

e) Prioritizing the organization of tourism events in ethnic minority regions.

3. Prioritizing support for training and capacity-building programs to develop tourism human resources in mountainous areas and ethnic minority regions with tourism potential, as follows:

a) Ensuring the quantity, quality, and structure of tourism human resources, effectively utilizing and providing appropriate incentives to meet the needs of tourism development in ethnic minority regions with developed or potential tourism;

b) Concentrating investments in developing ethnic minority tourism human resources (especially tour guides and interpreters) to basic standards; applying special preferential policies for training and recruitment;

c) Mobilizing investment resources, encouraging, and providing the highest possible incentives regarding land, taxes, and other benefits for training and capacity-building of tourism human resources in ethnic minority regions with tourism potential; leveraging the role of ethnic minority communities in tourism development;

d) Prioritizing favorable conditions for children of ethnic minorities to be trained comprehensively in tourism professions from vocational to university and postgraduate levels;

e) Creating favorable conditions for domestic organizations and individuals, as well as foreign organizations and individuals, to participate in developing ethnic minority tourism human resources;

f) Allocating state budget funds according to management levels and applying special financial mechanisms to implement tasks, programs, and projects related to training and capacity-building of ethnic minority tourism human resources, especially in regions with tourism potential;

g) Encouraging tourism training institutions and tourism enterprises to invest in training and capacity-building of ethnic minority tourism human resources; creating favorable conditions for enterprises to participate in recruiting and using ethnic minority tourism human resources.

Article 13. Support for the construction of infrastructure serving tourism in conjunction with environmental protection

1. Prioritize investment support for tourism infrastructure from the central budget for ethnic minority regions with potential for tourism development as prescribed by law.

2. Integrate the construction of tourism infrastructure into programs and projects for investment at the local level.

3. Provide investment support for tourism infrastructure integrated with programs, projects from the central budget for ethnic minority regions with potential for tourism development but facing financial difficulties as prescribed by law.

4. Mobilize support and funding from domestic and international organizations to invest in tourism infrastructure for areas with ethnic minority populations.

Chapter III
IMPLEMENTATION

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

1. Agencies and units under the Ministry of Culture, Sports and Tourism, within their functions, tasks, and authorities, shall be responsible for:

a) Developing plans and implementing cultural, sports, and tourism activities for ethnic minority regions according to this Circular and other relevant documents.

b) Coordinating with related agencies, units, and organizations to allocate resources for investment, support, and integration of cultural, sports, and tourism activities with economic and social development programs, projects already underway or being implemented in ethnic minority regions.

2. Departments of Culture, Sports and Tourism of provinces and centrally-administered cities shall develop plans for cultural, sports, and tourism activities in ethnic minority regions within their jurisdictions according to this Circular and other relevant documents, submit them to the People's Committees of provinces and centrally-administered cities for approval and implementation.

3. Information and reporting system:

Every six months and annually, agencies, units, and localities shall submit reports on the implementation of ethnic policies in the fields of culture, sports, and tourism to the Ministry of Culture, Sports and Tourism (through the Department of Ethnic Minority Affairs) for consolidation and reporting to the Minister of Culture, Sports and Tourism, the National Ethnic Minorities Committee, and the Prime Minister.

Article 15. Effective Date

1. This Circular takes effect from November 25, 2014.

2. During implementation, if there are difficulties or obstacles, agencies, units, organizations, and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Department of Ethnic Minority Affairs) for review and appropriate amendments and supplements.
