Guidelines on positions for leading and managing civil servants; common professional tasks; support and service positions in administrative agencies and organizations; common professional job titles and support and service positions in public institutions.
Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;
Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units;

The Minister of Home Affairs issues this Circular to provide guidelines on positions for leading and managing civil servants; common professional tasks; support and service positions in administrative agencies and organizations; common professional job titles and support and service positions in public institutions.
Article 1. Scope of Regulation
a) Leadership and management positions in public service units under the archival sector;
a) Positions for leading and managing civil servants; common professional tasks; support and service positions in administrative agencies and organizations;
b) Common professional job titles; support and service positions in public institutions.
2. The positions defined in this Circular include: A list of positions; job descriptions and competency frameworks for each position.
Article 2. Applicability
1. Administrative agencies and organizations under the management of Ministries, ministerial-level agencies, government agencies, administrative organizations established by the Government or the Prime Minister, provincial People's Committees, district People's Committees.
2. Public institutions established in accordance with the provisions of the law.
Article 3. Principles for determining job positions
1. Positions for leading and managing civil servants; common professional tasks; and support and service positions in administrative agencies and organizations are determined based on the principles set forth in Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and civil servant quotas.
2. Common professional job titles; and support and service positions in public institutions are determined based on the principles set forth in Article 3 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on positions and staffing levels in public institutions and are applied similarly to common professional tasks and support and service positions in administrative agencies and organizations.
3. Positions are adjusted in accordance with the organizational restructuring, functional and task adjustments between agencies and organizations at different management levels as provided by specialized laws; agencies, organizations, and units are responsible for effectively allocating, managing, and utilizing civil servant quotas and staffing levels assigned according to positions, ensuring the implementation of the goal of reducing the number of staff as prescribed.
Article 4. List of positions in administrative agencies and organizations
1. The list of positions for leading and managing civil servants as specified in Appendix I.
a) Inspection;
b) International cooperation;
c) Legal affairs (for positions preventing and resolving international investment disputes used in conjunction with positions for specialized civil servants in the judicial sector);
d) Cadre and civil servant organization (organizational structure and human resource management), commendation and reward, administrative reform;
d) Office;
e) Planning and finance.
The provisions regarding the list of positions at points a and d of Clause 2 of this Article are used in conjunction with positions for specialized civil servants in the inspection and home affairs sectors.
3. The list of support and service positions as specified in Appendix III.
Article 5. List of job positions in public service units
a) International cooperation;
b) Legal affairs;
c) Organizational cadres (organizational structure and human resource management), commendation and reward (to be used in conjunction with job positions for civil servants in specialized fields within the internal affairs sector);
d) Office (including two positions related to archives that can be shared with positions for professional titles and occupations in specialized fields under the home affairs sector);
d) Planning and finance.
2. The list of supporting and service job positions as specified in Appendix V.
Article 6. Job descriptions and competency frameworks for job positions
1. Job descriptions and competency frameworks for leadership and management civil servant job positions as specified in Appendix VI.
2. Job descriptions and competency frameworks for common professional civil servant job positions in administrative agencies and organizations as specified in Appendix VII.
4. Job descriptions and competency frameworks for supporting and service job positions in administrative agencies and organizations as specified in Appendix VIII.
5. Job descriptions and competency frameworks for supporting and service job positions in public service units as specified in Appendix IX.
6. Competency frameworks and levels for job positions include:
a) Common competency group;
b) Professional competency group;
c) Management competency group.
The level framework for each competency group mentioned above is specified in Appendix X.
Article 7. Transitional Provisions
1. For leading and managing civil servants and civil servants, staff placed in supporting and service job positions currently receiving salaries based on the rank, grade, and category of staff positions shall continue to be implemented until new guidelines on salary systems are issued as prescribed.
2. For civil servants and staff currently holding higher ranks or categories than required by the job positions specified in this Circular, such higher ranks or categories shall be retained until new guidelines on salary systems are issued as prescribed.
Article 8. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from February 15, 2023.
2. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, heads of organizations established by the Government or the Prime Minister that are not public service units, Chairpersons of provincial People's Committees under central cities, relevant agencies, organizations, and individuals are responsible for implementing this Circular.
3. In case of difficulties during implementation, please report to the Ministry of Home Affairs and the relevant management ministries and sectors for guidance and resolution.
