Circular No. 14/2022/TT-BTNMT stipulates code numbers and occupational standards for civil servants specializing in the natural resources and environment sector. How will civil servants who have been appointed or hold training certificates before this Circular takes effect be handled?

Amending and supplementing certain provisions on occupational standards for civil servants in the natural resources and environment sector
on natural resources and the environment
Pursuant to the Law on Enactment of Legal Normative Documents 2015; the Law amending and supplementing certain articles of the Law on Enactment of Legal Normative Documents 2020;
Pursuant to the Civil Servants Law 2010; the Law amending and supplementing certain articles of the Law on Cadres and Public Officials and the Civil Servants Law 2019;
Pursuant to Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for cadres, public officials, and civil servants;
Based on the proposal of the Director of the Cadre and Civil Servant Department;
Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Personnel Department and the Director of the Legal Department;
After reaching consensus with the Ministry of Home Affairs, the Minister of Natural Resources and Environment issues this Circular amending and supplementing certain provisions on occupational standards for civil servants in the natural resources and environment sector.
Article 1. Amending and supplementing certain articles of Joint Circular No. 52/2015/TTLT-BTNMT-BNV dated December 8, 2015 of the Minister of Natural Resources and Environment and the Minister of Home Affairs stipulating code numbers and occupational standards for civil servants specializing in land administration
1. Amending Clause 2, amending Point d and adding Point e Clause 3, and amending Clause 4 of Article 4 as follows:
"Article 4. Land Administration Officer Grade II - Code number: V.06.01.01
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is relevant to the job competency framework or the land management, land administration, cartography, surveying, remote sensing, geography field;
b) Hold a certificate of completion of the occupational standard training program for civil servants specializing in land administration.
3. Qualifications regarding professional expertise and skills:
d) Lead or participate in at least one of the following tasks: drafting or reviewing legal normative documents, drafting professional guidance documents or establishing regulations, rules for business management within the industry or sector; scientific and technological projects, programs, plans, and land resource and environmental planning approved by competent authorities at the level of passing or above, or put into use;
e) Possess skills in using information technology or specialized software for land administration, or foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.
4. A civil servant promoted from the position of Land Administration Officer Grade III to Land Administration Officer Grade II must have held the position of Land Administration Officer Grade III or equivalent for at least nine years (excluding probationary and trial periods); if they have an equivalent period in the position of Land Administration Officer Grade III, they must have held the position of Land Administration Officer Grade III for at least one year up to the deadline for submitting promotion registration applications."
2. Amending Clause 2, adding Point d Clause 3, and amending Clause 4 of Article 5 as follows:
"Article 5. Land Administration Officer Grade III - Code number: V.06.01.02
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is relevant to the job competency framework or the land management, land administration, cartography, surveying, remote sensing, geography field;
b) Hold a certificate of completion of the occupational standard training program for civil servants specializing in land administration.
3. Qualifications regarding professional expertise and skills:
d) Possess skills in using information technology, foreign languages, or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.
4. A civil servant promoted from the position of Land Administration Officer Grade IV to Land Administration Officer Grade III must have held the position of Land Administration Officer Grade IV for at least one year (excluding probationary and trial periods) up to the deadline for submitting promotion registration applications."
3. Amending Clause 2 Article 6 as follows:
"Article 6. Land Administration Officer Grade IV - Code number: V.06.01.03
2. Educational and training requirements: Hold a diploma or higher that is relevant to the job competency framework or the land management, land administration, cartography, surveying, remote sensing, geography field."
4. Adding Clause 5 of Article 9 as follows:
"Article 9. Salary Classification
5. Civil servants holding other ranks or occupational positions transferring to the occupational position of civil servants specializing in land administration shall have their salaries classified according to this Joint Circular and in accordance with the guidelines set out in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs guiding salary classification when upgrading, transferring, or changing types of civil servants and according to current regulations."
5. Amending Point a Clause 3, Point a Clause 4, and Point b Clause 5 of Article 11 as follows:
"Article 11. Implementation Organization
3. The heads of public service units directly managing and utilizing civil servants shall be responsible for:
a) Review job positions in units, develop plans to transfer civil servants holding land administration ranks to occupational positions of civil servants specializing in land administration (hereinafter referred to as transfer plans) for civil servants under the jurisdiction of the attached model of this Joint Circular, submit to competent authorities for approval or approve within their authority;
4. Heads of agencies and units under ministries, agencies at the ministerial level, government agencies, provincial people's committees, and centrally governed cities are responsible for:
a) Compiling transfer plans of subordinate agencies and units, submitting to competent authorities for approval or approving within their authority;
5. Ministries, agencies at the ministerial level, provincial people's committees, and centrally governed cities are responsible for:
b) Approving or delegating authority to approve transfer plans of subordinate agencies and units under their jurisdiction; resolving issues within their authority during the process of transferring occupational positions."
Article 2. Amend and supplement some articles of Circular Joint Circular No. 53/2015/TTLT-BTNMT-BNV dated December 8, 2015 issued by the Minister of Natural Resources and Environment and the Minister of Home Affairs on the code number and standards for occupational titles of environmental resource investigation professionals.
1. Amend Clause 2, amend Point e and supplement Point g Clause 3, and amend Clause 4 Article 4 as follows:
"Article 4. Environmental Resource Investigation Officer Level II - Code Number: V.06.02.04
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or majoring in geology, mineral resources, water resources, meteorology, hydrology, irrigation, marine literature, oceanography, land, cadastral, geography, environment, sea, climate change, natural resources and environment;
b) Hold a certificate of completion of the professional development program according to the occupational title standards for environmental resource investigation professionals.
3. Qualifications regarding professional expertise and skills:
e) Lead or participate in at least one of the following tasks: drafting or reviewing normative legal documents, drafting professional guidance documents or establishing management regulations of the sector or field; project, program, scientific research topic, scientific and technological task, planning, and natural resources and environment programs approved, passed, accepted, or put into use by competent authorities at a satisfactory level or higher.
g) Possess information technology skills or specialized software for environmental resource investigation, or foreign language or ethnic minority language skills for staff working in ethnic minority areas as required by the job position.
4. Staff promoted from Environmental Resource Investigation Officer Level III to Environmental Resource Investigation Officer Level II must have held the Environmental Resource Investigation Officer Level III position or equivalent for at least nine years (excluding probationary and trial periods); if they have an equivalent period in the Environmental Resource Investigation Officer Level III position, they must have held this position for at least one year up to the deadline for submitting the application for promotion."

Education and training standards: Hold a diploma or higher that is appropriate to the job position competency framework or majoring in geology, mineral resources, water resources, meteorology, hydrology, irrigation, marine literature, oceanography, land, cadastral, geography, environment, sea, climate change, natural resources and environment."
4. Adding Clause 5 of Article 9 as follows:
"Article 9. Salary Classification
5. For civil servants and staff holding other job positions who transfer to the occupational title of environmental resource investigation professionals, salary classification shall be implemented according to this Joint Circular and the guidelines stipulated in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 issued by the Minister of Home Affairs guiding salary classification when upgrading, transferring, or changing types of civil servants and staff, and according to current regulations.

1. Amending Clause 2, amending Point d and adding Point e Clause 3, and amending Clause 4 of Article 4 as follows:
"Article 4. Meteorological and Hydrological Forecaster Level II - Code Number: V.06.03.07
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or the field of meteorology, hydrology, irrigation, marine literature, oceanography, environment, geography, climate change, natural resources and environment;
b) Hold a certificate of completion of the training program according to the standards for occupational titles of specialized civil servants in meteorology and hydrology forecasting.
3. Qualifications regarding professional expertise and skills:
d) Lead or participate in at least one of the following tasks: drafting or reviewing legal normative documents, drafting professional guidance documents or establishing regulations, rules for business management within the industry or sector; scientific and technological projects, programs, plans, and land resource and environmental planning approved by competent authorities at the level of passing or above, or put into use;

4. Civil servants who are promoted from the position of Meteorological and Hydrological Forecaster Level III to Meteorological and Hydrological Forecaster Level II must have held the position of Meteorological and Hydrological Forecaster Level III or equivalent for at least nine years (excluding probationary and trial periods); if they have an equivalent period in the position of Meteorological and Hydrological Forecaster Level III, they must have held the position of Meteorological and Hydrological Forecaster Level III for at least one year up to the deadline for submitting the application for promotion."
2. Amend Clause 2, add Point g Clause 3 and amend Clause 4 Article 5 as follows:
"Article 5. Meteorological and Hydrological Forecaster Level III - Code Number: V.06.03.08
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or the field of meteorology, hydrology, irrigation, marine literature, oceanography, environment, geography, climate change, natural resources and environment;
b) Hold a certificate of completion of the training program according to the standards for occupational titles of specialized civil servants in meteorology and hydrology forecasting.

4. Adding Clause 5 of Article 9 as follows:

For civil servants and specialized civil servants currently holding other ranks or occupational titles who transfer to the occupational title of specialized civil servant in meteorology and hydrology forecasting, salary grading shall be implemented according to this Joint Circular and according to the guidance provided in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary grading when upgrading, transferring ranks, and changing types of civil servants, and according to current regulations."
5. Amending Point a Clause 3, Point a Clause 4, and Point b Clause 5 of Article 11 as follows:

Amend and supplement some articles of Circular Joint Circular No. 55/2015/TTLT-BTNMT-BNV dated December 8, 2015 of the Minister of Natural Resources and Environment and the Minister of Home Affairs on the code number and standards for occupational titles of specialized staff in meteorological and hydrological control.
1. Amend Clause 2, amend Point h and add Point i of Clause 3, and amend Clause 4 of Article 4 as follows:
"Article 4. Meteorological and Hydrological Control Officer Level II - Code: V.06.04.10
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or the field of meteorology, hydrology, irrigation, marine literature, oceanography, environment, geography, climate change, natural resources and environment;
b) Hold a certificate of completion of the training program according to the occupational title standards for specialized staff in meteorological and hydrological control.
3. Qualifications regarding professional expertise and skills:
h) Take the lead or participate in implementing at least one of the following contents: drafting or reviewing normative legal documents, drafting professional guidance documents or establishing management regulations of the industry; project proposals, projects, research topics, scientific and technological tasks, programs, plans, and planning on natural resources and environment that have been issued, approved, or accepted at a satisfactory level or put into use by competent authorities.
i) Possess skills in using information technology or specialized software and models for meteorological and hydrological control; use foreign languages or ethnic minority languages for staff working in ethnic minority areas as required by job positions.
4. Staff who are promoted from the position of Meteorological and Hydrological Control Officer Level III to Meteorological and Hydrological Control Officer Level II must have held the position of Meteorological and Hydrological Control Officer Level III or equivalent for at least nine years (excluding probationary and trial periods); if they have an equivalent period with the position of Meteorological and Hydrological Control Officer Level III, they must have held the position of Meteorological and Hydrological Control Officer Level III for at least one year up to the deadline for submitting promotion registration applications."

Civil servants and professionals holding other ranks or occupational qualifications transferring to the occupational qualification of environmental resource monitoring professionals shall have their salary grade determined in accordance with the provisions of this Joint Circular and the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on determining salary grades when upgrading, changing ranks, or changing types of civil servants and professionals, and in accordance with current regulations."
5. Amending Point a Clause 3, Point a Clause 4, and Point b Clause 5 of Article 11 as follows:
"Article 11. Implementation Organization
3. The heads of public service units directly managing and utilizing civil servants shall be responsible for:
a) Review the job positions of the unit, develop a plan to transfer and reassign professionals currently holding environmental resource monitoring ranks to the occupational qualification of environmental resource monitoring professionals (hereinafter referred to as the transfer and reassignment plan) for professionals under the management scope as stipulated in the model form attached to this Joint Circular, submit to the competent authority for approval or approve within its jurisdiction;
4. Heads of agencies and units under ministries, agencies at the ministerial level, government agencies, provincial people's committees, and centrally governed cities are responsible for:
a) Compiling transfer plans of subordinate agencies and units, submitting to competent authorities for approval or approving within their authority;
5. Ministries, agencies at the ministerial level, provincial people's committees, and centrally governed cities are responsible for:
b) Approving or delegating authority to approve transfer plans of subordinate agencies and units under their jurisdiction; resolving issues within their authority during the process of transferring occupational positions."
Article 6. Amend and supplement some articles of Circular Joint Circular No. 57/2015/TTLT-BTNMT-BNV dated December 8, 2015 issued by the Minister of Natural Resources and Environment and the Minister of Home Affairs on the code number and standards for career positions of specialized cadres in surveying and mapping.
1. Amending Clause 2, amending Point d and adding Point e Clause 3, and amending Clause 4 of Article 4 as follows:
"Article 4. Surveyor Level II - Code Number: V.06.06.16
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or the field of cartography, geodesy, land management, cadastral affairs, geography, remote sensing;
b) Hold a certificate of completion of the training program according to the standards for career positions of specialized cadres in surveying and mapping.
3. Qualifications regarding professional expertise and skills:
d) Lead or participate in at least one of the following tasks: drafting or reviewing legal normative documents, drafting professional guidance documents or establishing regulations, rules for business management within the industry or sector; scientific and technological projects, programs, plans, and land resource and environmental planning approved by competent authorities at the level of passing or above, or put into use;
e) Possess skills in using information technology or specialized software and models in surveying and mapping; possess foreign languages or ethnic minority languages for cadres working in ethnic minority regions as required by the job position.
4. A cadre promoted from the Surveyor Level III to Surveyor Level II must have held the Surveyor Level III position or equivalent for at least nine years (excluding probationary and trial periods); if they have an equivalent period in the Surveyor Level III position, they must have held it for at least one year up to the deadline for submitting the application for promotion."
2. Amend Clause 2, add Point c Clause 3, and amend Clause 4 Article 5 as follows:
"Article 5. Surveyor Level III - Code Number: V.06.06.17
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher that is appropriate to the job position competency framework or the field of cartography, geodesy, land management, cadastral affairs, geography, remote sensing;
b) Hold a certificate of completion of the training program according to the standards for career positions of specialized cadres in surveying and mapping.
3. Qualifications regarding professional expertise and skills:
c) Possess skills in using information technology, foreign languages, or ethnic minority languages for cadres working in ethnic minority regions as required by the job position.
4. A cadre promoted from the Surveyor Level IV to Surveyor Level III must have held the Surveyor Level IV position for at least one year (excluding probationary and trial periods) up to the deadline for submitting the application for promotion."
3. Amending Clause 2 Article 6 as follows:
"Article 6. Surveyor Level IV - Code Number: V.06.06.18
2. Educational and training requirements: Hold a diploma from a college or higher that is appropriate to the job position competency framework or the field of cartography, geodesy, land management, cadastral affairs, geography, remote sensing."
4. Adding Clause 5 of Article 9 as follows:
"Article 9. Salary Classification
5. Civil servants and cadres currently holding other rank or career positions who transfer to the career position of specialized cadres in surveying and mapping shall have their salary grade determined in accordance with this Circular and in accordance with the guidance provided in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 issued by the Minister of Home Affairs on determining salaries when upgrading ranks, transferring ranks, or changing types of civil servants and cadres, and in accordance with current regulations."

Article 7. Transitional Provisions
1. Cadres who were appointed to specialized career positions such as land administration, natural resource environment investigation, meteorology and hydrology forecasting, meteorology and hydrology control, environmental resource monitoring, surveying and mapping in accordance with the law before the effective date of this Circular shall be deemed to meet the standards for specialized career positions specified in this Circular corresponding to the career positions they were appointed to.
2. Cadres who had obtained certificates of training for standards of career positions of Levels II and III in fields such as land administration, natural resource environment investigation, meteorology and hydrology forecasting, meteorology and hydrology control, environmental resource monitoring, surveying and mapping in accordance with the law before June 30, 2022 shall be deemed to meet the requirements for training certificates according to the standards for specialized career positions specified in this Circular and may be used when considering a change in career positions, participating in examinations, or being considered for promotion in specialized career positions as stipulated in this Circular.
3. For agencies and units that have been approved by the competent authority for plans and programs to promote career positions of specialized cadres in natural resources and environment before the effective date of this Circular, they may continue to implement these plans and programs until completion.
Article 8. Implementation clause
1. This Circular takes effect from December 9, 2022.
2. Ministries, ministerial-level agencies, government agencies; provincial People's Committees and municipal People's Committees directly under the Central Government, and heads of agencies, units, organizations, and individuals related to this matter are responsible for implementing this Circular./.
