The Minister of Natural Resources and Environment and the Minister of Home Affairs issue this Joint Circular regulating job codes and qualification standards for specialized land administration officials."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."u.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Joint Circular stipulates job codes, qualification standards, and appointment and grading according to job titles for specialized land administration officials.
2. This Joint Circular applies to specialized land administration officials working in public service units.
Article 2. Job Code and Classification of Specialized Land Administration Official Positions
1. Land Administration Officer Grade II Job Code: V.06.01.01
2. Land Administration Officer Grade III Job Code: V.06.01.02
3. Land Administration Officer Grade IV Job Code: V.06.01.03
Article 3. General Professional Ethics Standards for Specialized Land Administration Officials
1. High sense of responsibility towards assigned tasks, always adhering to laws; fulfilling all duties of a public official in professional activities.
2. Having a spirit of inquiry, cooperation, and continuous learning to improve professional skills; actively researching and applying scientific achievements in land administration work; passionate about their work.
3. Not exploiting positions or powers to harm national defense, security, or national interests; not seeking personal benefits; maintaining state secrets within their professional scope.
4. Living a healthy lifestyle, being exemplary; not bureaucratic or corrupt; practicing thrift, opposing waste, and actively combating negative behaviors.
5. Being honest, united, objective, modest, and not harassing or obstructing citizens' rights and interests when performing tasks.
Chapter II
OCCUPATIONAL STANDARDS
Article 4. Land Administration Officer Grade II - Job Code: V.06.01.01
1. Duties:
a) Leading the preparation or adjustment of provincial or national land use planning and plans;
b) Leading the implementation of surveys and evaluations of land quality, potential, degradation, pollution, and classification (hereinafter referred to collectively as land survey and evaluation) at provincial, regional, and national levels;
c) Leading the establishment of provincial and national land information systems;
d) Directing the development and implementation of economic and technical solutions for cadastral surveying, land registration, statistics, inventory, valuation, and construction of current land use maps at various levels;
đ) Leading or participating in the development of programs, projects, and strategies for research and basic investigations on land management and use;
e) Leading the compilation of technical guidelines, standards, and norms in land management;
g) Directing the compilation of materials and participating in training and capacity building for land administration officials at equivalent or lower grades.
a) Graduated from university or higher in land resources, land administration, surveying, or related fields; if graduated in another field, must complete the professional knowledge and skill enhancement program prescribed by the land administration official management agency;
b) Possessing foreign language proficiency level 3 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level Vietnamese Foreign Language Proficiency Framework (hereinafter abbreviated as Circular No. 01/2014/TT-BGDĐT);
c) Possessing computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Usage Standards (hereinafter abbreviated as Circular No. 03/2014/TT-BTTTT);
d) Holding a certificate for professional capacity building for Land Administration Officer Grade II position.
a) Mastering the strategy for developing the land management sector and land laws;
b) Having expertise in one of the fields related to land resources;
c) Having the ability to analyze and synthesize socio-economic conditions and scientific and technological information relevant to land administration work;
d) Having the ability to organize and implement scientific and technical research; develop and implement economic and technical solutions for land use planning, cadastral surveying, land registration, issuance of land use right certificates, land statistics, inventory, construction of current land use maps, land survey and evaluation, establishment of land information systems, and land valuation;
To be promoted from Land Administration Officer Grade III to Land Administration Officer Grade II, the official must have worked in the Land Administration Officer Grade III position or an equivalent position for at least nine years, including at least two years in the most recent period holding the Land Administration Officer Grade III position.
Article 5. Grade III Land Administration Officer - Code: V.06.01.02
1. Duties:
a) Lead in drafting or adjusting land use planning at district level; participate in drafting land use planning at provincial and national levels;
b) Lead in developing and implementing economic-technical plans for cadastral surveying, land registration, establishing land databases, land statistics, land valuation, and current land use maps at district and commune levels;
c) Participate in developing and implementing strategic programs and projects on land development, research, and basic investigations on land management and utilization (quality assessment, potential, degradation, pollution, classification of land);
d) Participate in compiling technical guidance materials, standards, technical regulations, and economic-technical norms on land;
e) Participate in compiling materials and training for land administration officers of equivalent grades or lower;
g) Perform management tasks and propose adjustments to issues arising within the scope of assigned authority;
a) Graduated from university or higher in land resources, land administration, surveying, or related fields; if graduated in another field, must complete the professional knowledge and skill enhancement program prescribed by the land administration official management agency;
b) Have a foreign language proficiency level of grade 2 as stipulated in Circular No. 01/2014/TT-BGDĐT;
c) Have computer skills meeting the basic information technology standards as stipulated in Circular No. 03/2014/TT-BTTTT;
d) Hold a certificate of training according to the criteria for the position of Grade III Land Administration Officer;
3. Qualifications regarding professional expertise and skills:
a) Understand land laws;
b) Having expertise in one of the fields related to land resources;
c) Master technical standards, economic-technical norms, and other regulations on land;
a) For initial recruitment with a college degree or higher, must have at least two years of work experience in the position of Grade IV Land Administration Officer;
b) For initial recruitment with a secondary vocational degree, must have at least three years of work experience in the position of Grade IV Land Administration Officer.
A civil servant promoted from the position of Grade IV Land Administration Officer to Grade III Land Administration Officer must have worked in the position of Grade IV Land Administration Officer for the following period:
Article 6. Grade IV Land Administration Officer - Code: V.06.01.03
1. Duties:
a) Participate in developing and implementing economic-technical plans for cadastral surveying, land registration, and issuing land use right certificates at commune level; participate in implementing economic-technical plans for drafting land use planning, land registration, and issuing land use right certificates;
b) Conduct land statistics, build current land use maps at commune level; participate in conducting land surveys and assessments; participate in building land database systems at district and commune levels;
c) Carry out technical tasks for specific parcels of land regarding cadastral surveying, rectification of cadastral maps, extraction of cadastral data, land registration, updating and rectifying cadastral files, issuing land use right certificates, managing and utilizing documents and files;
d) Perform technical management tasks within the scope of assigned duties according to technical standards and regulations; identify and propose adjustments within the scope of assigned authority for technical activities that violate current regulations in assigned tasks;
e) Propose technical solutions and improvements to enhance productivity, quality, and efficiency within the scope of assigned tasks.
a) Graduated from a secondary vocational degree or higher in land, land administration, surveying, or related fields; if graduated from another field, must complete a professional knowledge and skill enhancement program prescribed by the land administration civil servant management agency;
b) Have a foreign language proficiency level of grade 1 as stipulated in Circular No. 01/2014/TT-BGDĐT;
c) Have computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;
3. Qualifications regarding professional expertise and skills:
a) Understand the basic contents of land laws; understand legal provisions and industry regulations on land use planning, cadastral surveying, land registration, establishment of cadastral files, issuance of land use right certificates, land statistics, land surveys, land evaluation, and classification;
b) Be able to apply technical standards, regulations, and other provisions in land use planning, cadastral surveying, land registration, issuance of land use right certificates, land statistics, construction of current land use maps, land evaluation, and classification; be proficient in technical management content and methods of organizing implementation within the scope of assigned tasks;
c) Understand relevant socio-economic conditions;
Chapter III
APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES
Article 7. Principles for Appointment and Salary Classification According to Professional Titles
1. Appointment to the profession and salary grading for land administration civil servants must be based on job positions; educational and training qualifications; professional expertise and duties currently undertaken;
2. Civil servants appointed to the profession and salary grading must meet the criteria for the profession of land administration civil servants as stipulated in Chapters I and II of this Joint Circular;
3. When appointing from the current rank of civil servant to the corresponding profession of land administration civil servant, it shall not combine salary increment and promotion of the profession of civil servant.
Article 8. Appointment to occupational titles
In cases where civil servants have been transferred to new ranks and salary grades or appointed to cadastre ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008 of the Minister of Natural Resources and Environment promulgating the business standards for civil servant ranks in the natural resources and environment sector (hereinafter referred to as Decision No. 07/2008/QĐ-BTNMT) and Circular Joint No. 30/2010/TTLT-BTNMT-BNV dated November 25, 2010 of the Ministry of Natural Resources and Environment - Ministry of Home Affairs guiding the transfer to new ranks and salary grades for civil servants in the natural resources and environment sector (hereinafter referred to as Circular Joint No. 30/2010/TTLT-BTNMT-BNV), their appointment to occupational titles shall be as follows:
1. Appointment to the occupational title of Cadastre Officer Level II (code V.06.01.01) for civil servants currently holding the rank of Senior Cadastre Officer (rank code 14.237).
2. Appointment to the occupational title of Cadastre Officer Level III (code V.06.01.02) for civil servants currently holding the rank of Cadastre Officer (rank code 14.238).
3. Appointment to the occupational title of Cadastre Officer Level IV (code V.06.01.03) for civil servants currently holding the ranks of College Cadastre Officer (rank code 14.239) and Intermediate Cadastre Officer (rank code 14.240).
Article 9. Salary Grading Method
1. The occupational titles of civil servants specializing in cadastre shall apply the Salary Scale for Professional and Business Staff in State-run Organizations (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for officials, civil servants, staff members, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP), as follows:
a) The occupational title of Cadastre Officer Level II shall apply the grade and salary coefficient of type A2, group 1 (A2.1), from salary coefficient 4.40 to 6.78;
b) The occupational title of Cadastre Officer Level III shall apply the grade and salary coefficient of type A1, from salary coefficient 2.34 to 4.98;
c) The occupational title of Cadastre Officer Level IV shall apply the grade and salary coefficient of type B, from salary coefficient 1.86 to 4.06.
2. When assigning salary grades after civil servants complete their probation period and are appointed to occupational titles: After completing the probation period as prescribed and being appointed to an occupational title by the competent authority managing civil servants, the following salary grades and coefficients shall be assigned according to the appointed occupational title:
a) In cases where civil servants with a doctoral degree are appointed to the occupational title of Cadastre Officer Level III (code V.06.01.02), they shall be assigned grade 3/9, salary coefficient 3.00 of type A1;
b) In cases where civil servants with a master's degree are appointed to the occupational title of Cadastre Officer Level III (code V.06.01.02), they shall be assigned grade 2/9, salary coefficient 2.67 of type A1;
c) In cases where civil servants with a bachelor's degree are appointed to the occupational title of Cadastre Officer Level III (code V.06.01.02), they shall be assigned grade 1/9, salary coefficient 2.34 of type A1;
d) In cases where civil servants with a college degree are appointed to the occupational title of Cadastre Officer Level IV (code V.06.01.03), they shall be assigned grade 2/12, salary coefficient 2.06 of type B;
đ) In cases where civil servants with an intermediate degree are appointed to the occupational title of Cadastre Officer Level IV (code V.06.01.03), they shall be assigned grade 1/12, salary coefficient 1.86 of type B.
3. The assignment of salary grades to occupational titles of civil servants as stipulated in Clause 1 of this Article for those who have been transferred to new ranks and salary grades or appointed to cadastre ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT and Circular Joint No. 30/2010/TTLT-BTNMT-BNV shall be implemented as follows:
a) In cases where civil servants meet the conditions for appointment to the occupational title of cadastre specialist and have the same salary grade and coefficient as in their previous rank, they shall continue to enjoy the same salary grade, coefficient, and any additional seniority allowance (if applicable) as in their previous rank (including the time for the next salary grade increase or additional seniority allowance application in the previous rank) when appointed to the new occupational title.
Example 1: Mr. Phan Van A, working at the Land Development Fund Center under the Department of Natural Resources and Environment of Hanoi City, has been appointed to the rank of Cadastre Officer (rank code 14.238) with grade 5/9 and salary coefficient 3.66 since January 1, 2013. Now, if Mr. Phan Van A meets the conditions and criteria and is appointed to the occupational title of Cadastre Officer Level III (code V.06.01.02) by the competent authority, he will be assigned the salary grade 5/9 and coefficient 3.66 of the occupational title of Cadastre Officer Level III from the date the decision takes effect; the time for the next salary grade increase will be calculated from January 1, 2013.
b) In cases where cadastre specialists with a college degree are currently assigned salaries under type A0 as prescribed in Decree No. 204/2004/NĐ-CP and are now appointed to the occupational title of Cadastre Officer Level IV (code V.06.01.03), their salary assignment shall be based on the time of compulsory social insurance contributions according to the state-prescribed salary scale (excluding the probation period), as follows:
- Starting from grade 2 of the occupational title of Cadastre Officer Level IV, every two years (24 months) they will be promoted to the next salary grade (if there are interruptions in contributions without receiving social insurance benefits, the periods will be accumulated); in cases where there are years during which tasks were not completed or disciplinary actions were taken, the promotion period will be extended according to the regular salary increase system.
- After transferring to the salary grade for the land administration officer position at level IV as mentioned above, if the salary coefficient assigned to the land administration officer position at level IV plus any seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient currently enjoyed at the old rank, then the individual shall be entitled to retain the difference coefficient to equalize it with the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) at the old rank; this retained difference coefficient shall be enjoyed throughout the entire period during which the civil servant is assigned to the land administration officer position at level IV. Subsequently, if the civil servant is promoted to a higher position within the land administration officer profession, the retained difference coefficient shall be added to the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) to determine the salary for the newly appointed position upon promotion, and the retention of the difference coefficient shall cease from the date the new position's salary takes effect.
Example 2: Mr. Nguyen Van B, who graduated from a college specializing in Land Administration, was recruited to work at the Land Development Fund Center under the Department of Natural Resources and Environment of Kien Giang Province, has been contributing to social insurance since January 1, 2008, and currently holds the rank of college-level land administration officer (rank code 14.239), grade 3/10, with a salary coefficient of 2.72 for type A0 civil servants since July 1, 2014; during his tenure, he has consistently fulfilled his assigned tasks without any disciplinary actions. Now, Mr. Nguyen Van B meets the criteria and has been appointed by the competent authority to the land administration officer position at level IV (position code V.06.01.03), the grading, salary coefficient will be as follows:
- The period of service of Mr. Nguyen Van B from January 1, 2008, excluding the six-month probationary period, is calculated from grade 2 of the land administration officer position at level IV, and every two years, he is promoted one grade; therefore, on July 1, 2014, Mr. Nguyen Van B will be assigned to grade 5/12, with a salary coefficient of 2.66 for the land administration officer position at level IV from the date this decision becomes effective; the next salary increase review date will be July 1, 2014; concurrently, Mr. Nguyen Van B will enjoy a retained difference coefficient of 0.06 (2.72 - 2.66).
- On July 1, 2016 (after two years), if Mr. Nguyen Van B meets the conditions and standards, the competent authority will promote him to grade 6/12, with a salary coefficient of 2.86 for the land administration officer position at level IV, and continue to enjoy the retained difference coefficient of 0.06 (total salary coefficient received is 2.92).
Chapter IV
IMPLEMENTING PROVISIONS
Article 10. Provisions on Application
The agencies and units authorized to manage and utilize civil servants are responsible for creating conditions for civil servants to supplement the remaining criteria of the land administration professional positions specified in this Joint Circular for those civil servants who have been transferred to new ranks and salary grades or appointed to land administration ranks as stipulated in Decision No. 07/2008/QĐ-BTNMT and Joint Circular No. 30/2010/TTLT-BTNMT-BNV.
Article 11. Implementation Organization
1. This Circular serves as the basis for implementing the recruitment, utilization, and management of land administration civil servants in public service organizations.
2. Non-public sector organizations may apply these regulations to recruit, utilize, and manage personnel engaged in land administration work.
3. The heads of public service units directly managing and utilizing civil servants shall be responsible for:
b) Issue the appointment decision for land administration professional positions within the scope of authority or as delegated after the transfer and assignment plan has been approved by the competent authority.
4. The heads of subordinate agencies, departments under ministries, agencies equivalent to ministries, government agencies, provincial people's committees, and centrally-administered city people's committees are responsible for:
b) Issue the appointment decision for land administration professional positions within the scope of authority or as delegated after the transfer and assignment plan has been approved by the competent authority.
5. Ministries, agencies equivalent to ministries, and provincial people's committees of centrally-administered cities are responsible for:
a) Directing subordinate agencies and departments under their management to implement the transfer and assignment of professional positions;
c) Issuing the appointment decisions for land administration professional positions within their authority;
d) Annually reporting the results of appointments and salary assignments for land administration civil servants under their management to the Ministry of Natural Resources and Environment and the Ministry of Home Affairs.
Article 12. Effective Date
1. This Circular shall take effect from February 1, 2016.
2. Abolish the provisions on the titles and codes of land administration civil servant ranks in Decision No. 01/2008/QĐ-BNV dated August 4, 2008, issued by the Minister of Home Affairs concerning the issuance of titles and codes for land administration civil servant ranks in the natural resources and environment sector.
3. Abolish the provisions on the professional standards of land administration civil servant ranks in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008, issued by the Minister of Natural Resources and Environment concerning the issuance of professional standards for land administration civil servant ranks in the natural resources and environment sector.
4. REPEAL THE PROVISIONS ON GUIDELINES FOR TRANSFER AND GRADING OF RANKS AND SALARIES OF SPECIALIST CIVIL SERVANTS IN LAND ADMINISTRATION AS SET OUT IN JOINT CIRCULAR NO. 30/2010/TTLT-BTNMT-BNV DATED NOVEMBER 25, 2010 ISSUED BY THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT AND THE MINISTRY OF HOME AFFAIRS ON GUIDELINES FOR TRANSFER AND GRADING OF RANKS AND SALARIES OF CIVIL SERVANTS IN THE NATURAL RESOURCES AND ENVIRONMENT SECTOR.
Article 13. Responsibility for Implementation
1. THE MINISTER, HEADS OF MINISTRIES EQUIVALENT TO MINISTRIES; HEADS OF GOVERNMENT AGENCIES, CHAIRMEN OF PROVINCE PEOPLE'S COMMITTEES, AND DIRECTLY-GOVERNED CITY PEOPLE'S COMMITTEES SHALL BE RESPONSIBLE FOR IMPLEMENTING THIS JOINT CIRCULAR.
2. IF ANY DIFFICULTIES ARISE DURING IMPLEMENTATION, THEY ARE REQUESTED TO REPORT TO THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT FOR COMBINATION AND LEADERSHIP IN COOPERATION WITH THE MINISTRY OF HOME AFFAIRS TO CONSIDER AND RESOLVE THEM.
