The Prime Minister issues this Decision on mechanisms and policies for job placement and vocational training for individuals whose land has been reclaimed as stipulated in Clauses 2 and 3 of Article 109 of the Land Law dated January 18, 2024.
Article 1. Scope of Regulation
This Decision sets forth mechanisms and policies for job placement and vocational training for individuals whose land has been reclaimed as provided for in Clauses 2 and 3 of Article 109 of the Land Law dated January 18, 2024.
Article 2. Applicability
1. Individuals whose land has been reclaimed include:
a) Individuals belonging to households or individuals supported under Clause 2 of Article 109 of the Land Law and detailed regulations implementing the Land Law (hereinafter referred to collectively as individuals with reclaimed agricultural land);
b) Individuals belonging to households or individuals as provided for in Clause 3 of Article 109 of the Land Law (hereinafter referred to collectively as individuals with reclaimed business land).
2. Agencies, enterprises, organizations, and individuals related to the contents prescribed in Article 1 of this Decision.
Article 3. Conditions for domestic job placement support and overseas employment under contract
Individuals whose land has been reclaimed are eligible for domestic job placement support and overseas employment under contract if they meet the following conditions: They must be workers as defined in Clause 1 of Article 3 of the Labor Law No. 38/2013/QH13 dated November 16, 2013, passed by the National Assembly.
Article 4. Duration of Support
Individuals whose land has been reclaimed will benefit from the support policy for a period of five years starting from the date of the land expropriation decision.
Article 5. Vocational Training Support
1. Individuals whose land has been reclaimed participating in basic-level vocational training programs lasting less than three months shall be supported according to the provisions of
2. Individuals whose land has been reclaimed participating in intermediate-level and college-level vocational training programs shall be supported with tuition fees for one course. The amount of tuition fee support shall be equal to the actual tuition fee charged by the vocational education institution but shall not exceed the maximum tuition fee cap for public vocational education institutions that have not yet achieved self-sufficiency in regular expenses as stipulated by law.
3. Individuals whose land has been reclaimed participating in basic-level vocational training programs lasting less than three months, intermediate-level, and college-level vocational training programs may borrow student loans. The loan procedures, borrowing amounts, loan terms, interest rates, and application processes shall comply with the provisions of

The vocational training support funds specified in Clauses 1 and 2 of this Article shall be included in the training, occupation transition, and job search plan and counted within the investment costs of the project or the total compensation and resettlement plan approved by competent state authorities.
5. Individuals whose land has been reclaimed shall be supported for vocational training once according to the policy stipulated in this Article.
Article 6. Domestic Job Placement Support
Individuals whose land has been reclaimed shall be supported as follows:
1. Free job counseling and referral services at employment service centers;
2. Borrowing funds from the National Employment Fund and other preferential credit sources as stipulated by law to create, maintain, and expand jobs.
Article 7. Overseas Employment Under Contract Support
1. Individuals with reclaimed agricultural land going to work overseas under contract shall be supported according to the Government's policies on supporting workers going to work overseas under contract.
2. Individuals with reclaimed business land going to work overseas under contract shall be supported similarly to individuals with reclaimed agricultural land as stipulated in Clause 1 of this Article.
3. The funding for overseas employment under contract support specified in Clauses 1 and 2 of this Article shall be included in the training, occupation transition, and job search plan and counted within the investment costs of the project or the total compensation and resettlement plan approved by competent state authorities.
4. Individuals whose land has been reclaimed shall be supported for overseas employment under contract once according to the policy stipulated in this Article.
Article 8. Support for preferential loans to work abroad under contracts
1. Persons whose land has been reclaimed may obtain preferential loans from the Social Policy Bank to work abroad under contracts.
2. Conditions for obtaining loans:
a) Having full capacity for civil acts;
b) Having signed a contract with a service enterprise or organization sending workers to work abroad under contracts;
c) Having permanent residence registration in the area where the Social Policy Bank processes loan procedures for persons whose land has been reclaimed;
d) Providing collateral for the loan according to the law for amounts exceeding 100 million VND.
3. The maximum loan amount shall be 100% of the costs incurred to work abroad under contracts signed between workers and enterprises or organizations sending workers to work abroad under contracts.

6. The maximum loan term shall be the duration of the contract for sending Vietnamese workers to work abroad, excluding any contract extension periods.
7. Management of risky loan losses shall be carried out in accordance with the Government's regulations on mechanisms for handling risky loan losses at the Social Policy Bank.
Article 9. Implementation Organization
1. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with relevant ministries and agencies to compile and report
2. The Social Policy Bank shall organize the provision of loans to persons whose land has been reclaimed in accordance with this Decision.
3. Annually before December 15 and upon request, People's Committees of provinces and centrally-administered cities shall have the responsibility to report training results and employment resolution for persons whose land has been reclaimed to the Ministry of Labor, Invalids and Social Affairs for compilation and reporting.
4. People's Committees of districts, towns, and cities under provinces and centrally-administered cities shall be responsible for formulating and implementing plans for vocational training, occupational transition, and job search for persons whose land has been reclaimed.
Article 10. Effectiveness and Responsibility for Implementation
