Regulations on awarding Commemorative Medals for sectors and fields under the management authority of the Ministry of Home Affairs

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to Decree No. 98/2023/NĐ-CP of the Government dated December 31, 2023 providing details on the implementation of certain provisions of the Law on Competition and Reward;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Office of the Ministry of Home Affairs;

The Minister of Home Affairs issues this Circular to regulate the awarding of Commemorative Medals for sectors and fields under the management authority of the Ministry of Home Affairs.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the name, principles, recipients, criteria; monetary awards for Commemorative Medals; rights and responsibilities of organizations and individuals in the process of awarding Commemorative Medals; models of Commemorative Medals for sectors and fields under the management authority of the Ministry of Home Affairs (hereinafter referred to collectively as Commemorative Medals).

Article 2. Applicability

This Circular applies to individuals eligible for Commemorative Medals; agencies and organizations proposing and presenting Commemorative Medals; other agencies and organizations related to the process of awarding Commemorative Medals.

Article 3. Commemorative Medals under the management authority of the Ministry of Home Affairs

Commemorative Medals are forms of recognition awarded by the Minister of Home Affairs to acknowledge and encourage individuals who have made contributions and sacrifices to the construction and development of the Ministry and the Home Affairs sector, including the following types:

1. Commemorative Medal "For the Cause of the Civil Service Sector"

2. Commemorative Medal "For the Cause of Competition and Awards"

3. Commemorative Medal "For the Cause of State Management of Beliefs and Religions"

4. Commemorative Medal "For the Cause of Archives and Records Management"

Article 4. Principles for awarding Commemorative Medals

1. Each type of Commemorative Medal can only be awarded once to an individual. If an individual meets the criteria, they may be awarded multiple types of Commemorative Medals. There is no posthumous awarding of Commemorative Medals.

2. The awarding of Commemorative Medals must ensure accuracy, fairness, democracy, transparency, and timeliness, in accordance with the specified recipients and criteria set forth in this Circular.

3. Disciplinary periods shall not be counted towards the period of service when considering for Commemorative Medals.

In cases where disciplinary measures were unjustly imposed and subsequently rectified, the unjust disciplinary period shall be counted towards the period of service when considering for Commemorative Medals.

4. The Ministry of Home Affairs will award Commemorative Medals on anniversaries of traditional days of various sectors or on special occasions for exceptional cases.

Article 5. Monetary Awards for Commemorative Medals

1. Individuals receiving Commemorative Medals shall receive Certificates, Frames, Commemorative Medals, and Presentation Cases along with a monetary award equivalent to 0.4 times the base salary.

2. Vietnamese individuals residing abroad; foreign individuals; individuals who have provided financial or material support for the development of the Ministry of Home Affairs or within sectors and fields under its management, upon being awarded Commemorative Medals, shall receive Certificates, Frames, Commemorative Medals, Presentation Cases, and commemorative gifts of equivalent value to 0.4 times the base salary.

Article 6. Responsibilities of Organizations and Individuals in the Process of Awarding Commemorative Medals

1. Organizations proposing the awarding of Commemorative Medals must accurately, fully, and promptly implement the regulations stipulated in this Circular and other relevant regulations on competition and awards, and bear responsibility for the accuracy and truthfulness of the proposed recipients, criteria, and application materials.

2. Individuals receiving Commemorative Medals are responsible for preserving and maintaining awarded items and upholding the traditions of the Ministry and the Home Affairs sector, serving as exemplary models in implementing Party policies and state laws.

3. Organizations and individuals have the right to appeal or report regarding the proposal and awarding of Commemorative Medals according to the law on appeals and complaints.

Chapter II

RECIPIENTS AND CRITERIA FOR AWARDING COMMENDATION MEDALS

Article 7. Recipients of Commendation Medal

1. Individuals who have been and are working in the Civil Service Organization sector; Encouragement and Reward sector; State Management of Beliefs and Religions; Archival Affairs:

a) Commendation Medal "For the Civil Service Organization Sector":

Civil servants, officials, and workers employed in agencies, units, and organizations under the Ministry of Home Affairs, including: Departments, Office of the Ministry, Inspectorate of the Ministry, Office of the Party Committee of the Ministry, Specialized Party Organization Agency, Office of the Trade Union of the Ministry, Ho Chi Minh Communist Youth Union of the Ministry of Home Affairs, Institute of Civil Service Organization Science, Civil Service Organization Journal, Information Center.

Civil servants and officials engaged in personnel work at units directly under the Ministry of Home Affairs, including: National Archives Administration, Central Steering Committee for Encouragement and Reward, Government Religious Board, National Academy of Public Administration.

Officials, civil servants, officials, and workers specializing or concurrently performing personnel work in ministries, departments, agencies, political organizations, political-social organizations, and occupational-political-social organizations with party groups or party organizations under the Central Party Committee of Government Agencies.

Civil servants and workers engaged in the Civil Service Organization sector at Provincial Home Affairs Departments under central cities and provinces.

Civil servants working in the Civil Service Organization sector at Home Affairs Offices at district level.

Officials and civil servants specializing or concurrently performing personnel work at People's Council and People's Committee Offices at district and provincial levels.

b) Commendation Medal "For the Encouragement and Reward Sector":

Members of the Central Steering Committee for Encouragement and Reward.

Civil servants, officials, and workers employed in departments and units under the Central Steering Committee for Encouragement and Reward.

Officials and civil servants specializing or concurrently performing encouragement and reward work in ministries, departments at the level of ministries, government agencies; Supreme People's Court; Supreme People's Procuracy; Central Party Office, Party Committees and equivalent bodies at the central level; National Assembly Office, President's Office; State Audit Office; Vietnam Fatherland Front Central Committee and central agencies of political-social organizations, occupational-political-social organizations with party groups or party organizations under the Central Party Committee of Government Agencies.

Civil servants employed in Encouragement and Reward Departments (Offices) under Provincial Home Affairs Departments under central cities and provinces; civil servants specializing or concurrently performing encouragement and reward work at Home Affairs Offices at district level.

Officials and civil servants specializing or concurrently performing encouragement and reward work at communes, wards, towns.

c) Commendation Medal "For the State Management of Beliefs and Religions Sector":

Civil servants, officials, and workers employed in units under and directly under the Government Religious Board.

Officials, civil servants, and workers specializing or concurrently performing belief and religion work in Party, State, Vietnam Fatherland Front, political-social organizations at the central, provincial, district, and commune levels.

Civil servants and workers engaged in state management of beliefs and religions in specialized agencies under Provincial People's Committees.

Civil servants specializing or concurrently performing state management of beliefs and religions in specialized agencies under District People's Committees.

Officials and civil servants concurrently performing belief and religion work at Commune People's Committees.

d) Commendation Medal "For Archival Affairs Sector":

Civil servants, officials, and workers employed in units under and directly under the National Archives Administration.

Civil servants, officials, and workers employed in Archive-Library Branches or Planning Departments assisting Provincial Home Affairs Departments in managing archival affairs at Provincial Historical Archive Centers under central cities and provinces.

Civil servants engaged in archival work in specialized agencies under Provincial People's Committees and workers specializing or concurrently performing archival work in state-owned enterprises established by the Chairman of the Provincial People's Committee.

Civil servants engaged in planning to implement state management functions over archival affairs at district level.

Officials, civil servants, officials, and workers specializing or concurrently performing archival work in ministries, departments, Party, State, Vietnam Fatherland Front, political-social organizations, public service units; social organizations, occupational-social organizations; holding companies and economic groups established by the Prime Minister.

2. Leaders of the Party and State; leaders of ministries, departments, Vietnam Fatherland Front, political-social organizations at the central level; leaders of central cities and provinces; leaders of General Departments and Bureaus under ministries and departments; leaders of districts, urban districts, towns, and cities under central cities and provinces who have made contributions to the development of the Ministry of Home Affairs or one of the sectors under its jurisdiction.

3. Individuals who are overseas Vietnamese or foreigners who have contributed to building and consolidating comprehensive friendly cooperation relations with the Ministry of Home Affairs or one of the sectors under its jurisdiction.

4. Citizens who have made contributions to the development of the Ministry of Home Affairs or one of the sectors under its jurisdiction.

5. Other cases as decided by the Minister of Home Affairs.

Article 8. Criteria for awarding Commemorative Medals

1. For subjects specified in Clause 1, Article 7:

a) Individuals engaged in full-time or part-time work for at least 15 years, performing their duties satisfactorily during the prescribed period, shall be considered eligible for the award.

In cases where individuals are sent to study or fulfill military service obligations and comply with the regulations of the training institution, training center, or military unit, complete their assigned tasks, and achieve satisfactory results (for courses that have grading), the time spent studying or fulfilling military service obligations shall be counted towards the working period for the award of the Commemorative Medal.

b) For individuals who have worked in sectors or fields under the management authority of the Ministry of Home Affairs, if the working period in each sector or field does not meet the criteria for awarding the Commemorative Medal for that sector or field, the total working period in various sectors or fields of such individual shall be counted towards the award of the Commemorative Medal, and they may be recommended for the award of the Commemorative Medal for the current sector or field they are working in at the time of application (or before retirement).

c) Female individuals may be considered for the award of the Commemorative Medal two years earlier than the prescribed period.

d) As of the retirement date, if an individual is still short of one to less than twelve months compared to the prescribed period, they may be considered for the award of the Commemorative Medal before retirement.

2. For subjects specified in Clause 2, Article 7:

a) Party, State, and Central Vietnam Fatherland Front leaders who have made contributions to the construction and development of the Ministry of Home Affairs.

b) Leaders of central ministries, agencies, political-social organizations; leaders of General Departments and Bureaus under ministries and agencies; Secretaries and Deputy Secretaries of Provincial Party Committees directly under the Central Committee; Chairpersons and Vice-Chairpersons of Provincial People's Councils and Municipal People's Councils directly under the Central Committee; Members of Provincial Party Committees' Standing Committees directly under the Central Committee; Heads of Delegations of National Assembly Members of Provinces and Municipalities directly under the Central Committee; leaders of Provincial Home Affairs Departments directly under the Central Committee: Have held positions for at least five years managing one of the four sectors or fields under the management authority of the Ministry of Home Affairs.

c) Leaders of provincial-level Vietnam Fatherland Front Committees and leaders of provincial-level political-social organizations; Secretaries and Deputy Secretaries of County Party Committees, District Party Committees, City Party Committees, and Town Party Committees; Chairpersons and Vice-Chairpersons of County-level People's Councils and County-level People's Committees; Members of County Party Committees' Standing Committees, City Party Committees' Standing Committees, and Town Party Committees' Standing Committees directly under Provincial Party Committees; Members of District Party Committees' Standing Committees, County Party Committees' Standing Committees, City Party Committees' Standing Committees, and Town Party Committees' Standing Committees directly under Municipal Party Committees: Have held positions for at least ten years managing one of the four sectors or fields under the management authority of the Ministry of Home Affairs.

d) Leaders or members of the Central Awards and Commendation Council: Serving concurrently for at least five years.

đ) The time served in positions can be accumulated for the purpose of awarding the Commemorative Medal if the individual has not continuously managed a sector or field under the management authority of the Ministry of Home Affairs.

3. For subjects specified in Clause 3, Article 7:

Achieving outstanding results in consolidating international cooperation relations, making positive contributions to the construction and development of the Ministry of Home Affairs or one of the sectors or fields under its management authority.

4. For subjects specified in Clause 4, Article 7:

Citizens who have contributed archival materials to National Archives Centers or provincial historical archives centers; citizens who have provided financial support or material assistance for the development of the Ministry of Home Affairs or one of the sectors or fields under its management authority.

Article 9. Subjects not eligible for and those who cannot be considered for the Commendation Medal

1. Subjects not yet eligible for consideration for the Commendation Medal

a) Individuals currently under disciplinary review or involved in criminal cases without a conclusion from competent state agencies.

b) Individuals undergoing investigation, audit, inspection when there are signs of violation, or have complaints or denunciations, issues related to corruption or negative practices that are being verified according to Clause 4, Article 4 of Decree No. 98/2023/NĐ-CP dated December 31, 2023 of the Government detailing implementation of certain provisions of the Law on Competition and Rewards.

2. Subjects ineligible for consideration for the Commendation Medal

Individuals who have been disciplined with dismissal, criminally prosecuted, or expelled from the Party.

Chapter III

MODEL OF THE COMMENDATION MEDAL

Article 10. Design of the Commendation Medal

1. The Commendation Medal "For the Cause of the Civil Service Sector"

a) The Stem of the Commendation Medal:

The material of the stem is brass alloy, dimensions 31mm x 13mm, thickness 3mm, outer edge gold-plated width 1.5mm.

Front side of the stem of the Commendation Medal: A five-pointed star gold-plated on a red background; attached with clips, pinned to the lapel, parallel to the horizontal rectangle of the body of the Commendation Medal.

Back side of the stem of the Commendation Medal has a pin measuring 23mm x 3mm, made of brass alloy.

b) The Body of the Commendation Medal:

The body of the Commendation Medal is made of brass alloy, gold-plated on the outside, dimensions 45mm x 43mm, thickness 4mm.

The body of the Commendation Medal features a stylized five-pointed star embossed; the diameter of the inscribed circle of the star is 22.5mm. On the front of the body of the Commendation Medal: A circular band with inner and outer edges, between the two bands is written text, approximately 3.2mm wide. Around the inside of the inscribed circle of the star is the phrase "FOR THE CAUSE OF THE CIVIL SERVICE SECTOR" in an arc above, written in Times New Roman font, all capital letters, upright. Below the half-circle is an image of a gear wheel placed between two bundles of rice, each bundle containing 11 grains. In the center of the circle is an image of the Presidential Palace, directly below which is the date "28/8/1945". The entire background of the inscribed circle is red.

Back side of the body of the Commendation Medal: Embossed with small mesh pattern.

c) The stem and body of the Commendation Medal are connected by three small circles 4mm in diameter made of brass alloy.

d) The design of the Commendation Medal is illustrated in Model No. 01 of the Appendix accompanying this Circular.

2. The Commendation Medal "For the Cause of Competition and Rewards"

a) The Stem of the Commendation Medal:

The material of the stem is gold-plated brass alloy, dimensions 32mm x 14mm, thickness approximately 1.5mm, surface coated with a transparent organic glass layer.

Front side of the stem of the Commendation Medal is the National Flag in rectangular shape, surface coated with a transparent organic glass layer. Back side of the stem of the Commendation Medal has a pin, made of brass alloy.

b) The Body of the Commendation Medal:

The body of the Commendation Medal is made of brass alloy, gold-plated.

The body of the Commendation Medal features a stylized five-pointed star embossed, the thickest part is 4.5mm; the diameter of the circumscribed circle of the star is 51mm. The diameter of the inscribed circle of the star is 25mm. Around the inside of the inscribed circle of the star is the phrase "COMPETITION IS LOVE FOR THE COUNTRY - LOVING THE COUNTRY MEANS COMPETING" in yellow, Times New Roman font, all capital letters, upright. In the center of the inscribed circle is a bust of Uncle Ho embossed, below the image of Uncle Ho is a lotus flower embossed. The entire background of the inscribed circle is red.

Back side of the body of the Commendation Medal: Smooth.

c) The stem and body of the Commendation Medal are connected by one small circle 4mm in diameter made of brass alloy.

d) The design of the Commendation Medal is illustrated in Model No. 02 of the Appendix accompanying this Circular.

3. The Commendation Medal "For the Cause of State Management of Beliefs and Religions"

a) The Stem of the Commendation Medal:

The material of the stem is gold-plated brass alloy, dimensions 24mm x 8mm, thickness approximately 3mm, outer edge gold-plated width 1.5mm.

Front side of the stem of the Commendation Medal: A rectangle in the middle with a five-pointed star in gold on a red background; attached with clips, pinned to the lapel, parallel to the horizontal rectangle of the body of the Commendation Medal. Back side of the stem of the Commendation Medal has a pin measuring 23mm x 3mm, made of gold-plated brass alloy.

b) The Body of the Commendation Medal:

The body of the Commendation Medal is made of brass alloy, gold-plated on the outside, dimensions 42mm x 41mm, thickness 3mm.

The body of the Commendation Medal features a stylized five-pointed star embossed; the diameter of the inscribed circle of the star is approximately 21mm. On the front of the body of the Commendation Medal: A circular band with inner and outer edges, between the two bands is written text, approximately 3.2mm wide. Around the inside of the inscribed circle of the star is the phrase "FOR THE CAUSE OF STATE MANAGEMENT OF BELIEFS AND RELIGIONS" in an arc above and the date "02-8-1955" in an arc below on a yellow background, red text, Times New Roman font, all capital letters, upright. Following the arc above the phrase "FOR THE CAUSE OF STATE MANAGEMENT OF BELIEFS AND RELIGIONS" is an image of 54 grains of rice and below the arc is the phrase "STATE RELIGIOUS COMMITTEE" in yellow on a red background. The innermost arc above is an image of nine Lac birds and the arc below is a pink lotus flower. The small circle in the center is the Emblem of the Socialist Republic of Vietnam, radiating out from the emblem are blue and white stripes.

Back side of the body of the Commendation Medal: Smooth, gold-plated.

c) The stem and body of the Commendation Medal are connected by two small circles approximately 4mm in diameter made of brass alloy.

d) The design of the Commendation Medal is illustrated in Model No. 03 of the Appendix accompanying this Circular.

4. The Commendation Medal "For the Cause of Archival Affairs"

a) The Stem of the Commendation Medal

Rectangular shape, 3D brass alloy gold-plated, dimensions 24mm x 8mm, thickness 1mm.

Front side of the stem: Coated with glass, printed with two centered lines of text on a red background with gold text, the top line reads "SOCIALIST REPUBLIC OF VIETNAM", the bottom line reads "MINISTRY OF HOME AFFAIRS", Times New Roman font, all capital letters, upright.

Back side of the stem: Attached with a lapel pin, centrally aligned along the width of the rectangular stem of the Commendation Medal, dimensions 20mm x 4mm, gold-plated brass alloy.

b) The Body of the Commendation Medal

3D brass alloy gold-plated, dimensions 41mm x 42mm, thickness 4mm.

The front side features a five-pointed star radiating light, made of gold-plated copper alloy; at the center of the star is a circular glass-covered emblem with a diameter of 23mm, surrounded by a 3mm-wide outer circular border. The upper half of the outer border bears the phrase "FOR THE CAUSE OF DOCUMENTATION AND ARCHIVING" in uppercase Times New Roman font, standing upright; the lower half displays the gear wheel placed between two sheaves of rice (the symbol of the National Emblem of Vietnam), with the central logo of the State Archives and Records Administration in red on a light blue background.

The back side: Smooth, made of gold-plated copper alloy.

c) The ribbon and the body of the Commemorative Medal are connected by a circular ring with a diameter of 7mm, made of gold-plated copper alloy.

d) The model of the Commemorative Medal is illustrated in Appendix Model No. 04 attached to this Circular.

Article 11. Commemorative Medal Certificate

1. Ornamental patterns on the Certificate:

a) Decorative patterns around the edge: A double continuous line border, the outermost line being 2pt wide, black color.

b) The background of the Certificate is white, featuring a light yellow pattern of bronze drums; on the left side, starting from the middle of the Certificate width upwards, is the Commemorative Medal of the sector or field under the management authority of the Ministry of Home Affairs; on the right side is the content text area.

2. Content on the Certificate:

a) The first line on the right records the State Emblem: "SOCIALIST REPUBLIC OF VIETNAM", presented in uppercase Times New Roman font, size 13, upright bold style, black color.

b) The second line on the right records the Motto: "INDEPENDENCE - FREEDOM - HAPPINESS", presented in lowercase Times New Roman font, size 14, upright bold style, black color immediately below the State Emblem; the first letter of each phrase is capitalized, hyphenated between phrases, with spaces; there is a solid horizontal line below, equal in length to the text line.

c) The third line on the right records: "MINISTRY OF HOME AFFAIRS", in uppercase Times New Roman font, size 25pt, upright bold style, red color.

d) The fourth line on the right records: "PRESENTED", in uppercase Times New Roman font, size 16, upright bold style, black color.

đ) The fifth line on the right records the award form "COMMEMORATIVE MEDAL", in uppercase Times New Roman font, size 25, upright bold style, red color.

e) The sixth line on the right records the type of Commemorative Medal of the Ministry of Home Affairs.

g) Subsequent lines record: The name of the individual being awarded, in lowercase Times New Roman font, size 16, italic bold style, black color; the position and working unit of the individual being awarded, in lowercase Times New Roman font, size 14, italic bold style, black color; achievements and contributions to the development of the sector or field under the management authority of the Ministry of Home Affairs, in lowercase Times New Roman font, size 14, italic bold style, black color.

h) On the left bottom side is the decision number, date, month, year recorded in figures, and the "Golden Book Number" placed below the decision number recording the serial number of the awardee in the decision; these two lines are in lowercase Times New Roman font, size 11, italic bold style, black color.

i) On the right bottom side is recorded: "HANOI, DAY MONTH YEAR", in lowercase Times New Roman font, size 11, italic bold style, black color.

k) Below the place name is a line indicating the authority of the person authorized to make the award decision: "MINISTER", in uppercase Times New Roman font, size 13, upright bold style, black color.

1) Space for signature, stamp, and recording the full name of the Minister

m) The model of the Commemorative Medal Certificate is illustrated in Appendix Model No. 05 attached to this Circular.

Article 12. Memorial Medal Box

The Memorial Medal box for sectors and fields under the management authority of the Ministry of Home Affairs shall have dimensions of 68 mm wide x 92 mm long x 14 mm thick. The lid is transparent plastic, the body is red; the foam tray securely fixes the Memorial Medal, covered with red velvet to hold the Memorial Medal.

Chapter IV

IMPLEMENTATION

Article 13. Responsibility for preparing files to propose awarding Memorial Medals

Ministries, agencies, central mass organizations, provincial Departments of Home Affairs under the central government are responsible for receiving files from units, comparing them with standards, preparing individual files meeting the criteria, and sending them to the Ministry of Home Affairs to implement the process of awarding Memorial Medals as prescribed.

Article 14. Organization of Awarding Memorial Medals

1. The time for organizing the awarding of Memorial Medals on the occasion of commemorating the traditional day of each sector: State Administration (August 28); Patriotic Competition (June 11); State Management of Beliefs and Religions (August 2) and Archival Affairs (January 3).

2. The Minister of Home Affairs shall present the Memorial Medals or delegate the heads of agencies, units, and organizations that proposed the awarding of Memorial Medals to organize the presentation to individuals according to current regulations on awards, ensuring solemnity, avoiding ostentation, formality, and waste.

Article 15. Effective Date

This Circular takes effect from February 15, 2025, and replaces Circular No. 14/2019/TT-BNV dated November 15, 2019, issued by the Minister of Home Affairs regarding the awarding of Memorial Medals for sectors and fields under the management authority of the Ministry of Home Affairs, and Circular No. 08/2022/TT-BNV dated September 19, 2022, issued by the Minister of Home Affairs amending and supplementing certain provisions of Circular No. 14/2019/TT-BNV dated November 15, 2019, issued by the Minister of Home Affairs regarding the awarding of Memorial Medals for sectors and fields under the management authority of the Ministry of Home Affairs.

Article 16. Implementation Provisions

1. The Office of the Ministry of Home Affairs, Heads of agencies and units under and directly under the Ministry of Home Affairs; central ministries, sectors, and agencies; provinces and centrally-administered cities; relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties, agencies, units, organizations, and individuals are requested to promptly reflect them to the Ministry of Home Affairs for research and appropriate amendments and supplements.
