Pursuant to the Land Law dated January 18, 2024; the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15 dated June 29, 2024;
Pursuant to the Government Decree No. 71/2024/NĐ-CP dated June 27, 2024 regarding land prices;
Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

PART I
GENERAL PROVISIONS
Article 1. Scope of application
These Circularsprovide detailed regulations on training, upgrading, and updating knowledge for individuals engaged in land valuation consulting services and the framework of training and upgrading programs on land valuation business as stipulated in Article 36 of the Government Decree No. 71/2024/NĐ-CP dated June 27, 2024 regarding land prices (hereinafter referred to as Decree No. 71/2024/NĐ-CP).

Chapter II
TRAINING, UPGRADING, AND UPDATING KNOWLEDGE FOR INDIVIDUALS ENGAGED IN LAND VALUATION CONSULTING SERVICES
ENGAGING IN LAND VALUATION CONSULTING AND FRAMEWORK OF TRAINING AND UPGRADING PROGRAMS ON LAND VALUATION BUSINESS
TRAINING AND PROFESSIONAL DEVELOPMENT ON LAND VALUATION
Section 1
TRAINING, UPGRADING, AND UPDATING KNOWLEDGE FOR INDIVIDUALS ENGAGED IN LAND VALUATION CONSULTING SERVICES
ENGAGING IN LAND VALUATION CONSULTING
Article 3. Guidelines for training and upgrading plans on land valuation business
1. Training institutions meeting the provisions at points a and b of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP shall develop training and upgrading plans on land valuation business (hereinafter referred to as Training Plans) in accordance with point c of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP and submit them to the Ministry of Natural Resources and Environment.
2. Training Plans shall be developed annually ensuring all contents prescribed at point c of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP.
During the implementation process, if there are changes in the teaching staff, the expected number of trainees, content, or new state regulations related to the land valuation field in the textbooks and teaching materials, examination question banks, and knowledge updates for individuals engaged in land valuation consulting services, the Training Plan must be adjusted and submitted to the Ministry of Natural Resources and Environment.
3. Training Institutions with Training Plans meeting the conditions stipulated at point c of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP shall have their Training Plans publicly announced on the Ministry's website and issued certificates of completion of training and upgrading programs on land valuation business (hereinafter referred to as Certificates) in accordance with Clause 4 of this Article based on the expected number of trainees consistent with the Training Plan.
4. The Certificate codes shall be centrally managed uniformly nationwide and issued by the Land Planning and Development Department. The Certificate codes shall be recorded on the Certificates for inspection and monitoring purposes.
Article 4. Implementation of Training Plans
Training Institutions publicly announced on the Ministry's website shall implement Training Plans as follows:
1. Implement training activities,upgrading professional training on land valuation according to the Training Plan reported to the Ministry of Natural Resources and Environment.
2. Training Institutions collect feedback from trainees on the quality of the training and upgrading program on land valuation business through the Trainee Evaluation Form at the end of the course in accordance with the contents prescribed in Model No. 01 of Appendix I attached to this Circular. Conduct examinations according to the examination question bank for completing the training and upgrading program on land valuation business..
3. 4. Issue Certificates ensuring the contents stipulated for those trainees who meet the conditions to complete the training and upgrading program on land valuation business in accordance with the training and upgrading regulations of the Training Institution.
5. Within no more than five working days from the date of issuing the Decision on issuing Certificates,Form No. 02 Conduct examinations according to the examination question bank for completing the training and upgrading program on land valuation business. perform
the following tasks: Training Institutions a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. The report on the results of training and upgrading must be accompanied by a list of individuals receiving Certificates in accordance with Model No. 03 of Appendix I attached to this Circular;
b) Publicly announce the list of trainees receiving Certificates on the Ministry's website or the Training Institution's website.
6. The files and reports stipulated in this Article shall be directly submitted or sent through the Ministry's website or the specialized information reporting system when it is established and operational.
7. Training Institutions shall submit ad hoc reports when requested by competent state authorities regarding the organization of training and upgrading programs on land valuation business and updating knowledge for individuals engaged in land valuation consulting services; provide full, accurate, and timely information, documents, and reports as required.
8. Training Institutions shall self-assess and bear full responsibility for ensuring the conditions stipulated at points a and b of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP before developing Training Plans, implementing Training Plans, issuing Certificates, managing and using Certificate codes, and complying with the requirements of other relevant laws as stipulated in Clauses 5, 6, and 7 of this Article.
7. The training institution shall submit ad hoc reports to the competent state agency when requested about the situation of organizing training and professional development on land valuation, updating knowledge for individuals engaged in land valuation consulting; providing complete, accurate, and timely information, documents, and reports as required.
8. The training institution shall self-assess and bear full responsibility for ensuring the conditions stipulated in points a and b of Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP before drafting the Training Plan, implementing the Training Plan, issuing Certificates, managing and using Certificate codes, reports specified in Clauses 5, 6, and 7 of this Article, and complying with other relevant laws.
Article 5.Inspection and supervision on training and vocational enhancement regarding land valuation
1. The Ministry of Natural Resources and Environment's inspection agency and specialized inspection agencies under the Ministry of Natural Resources and Environment within the field of land shall conduct inspections and supervisions on compliance with the following contents by educational institutions:
a) Conditions stipulated in points a and b of Clause 3 of Article 36 of Decree No. 71/2024/NĐ-CP;
b) Implementation process of training and vocational enhancement activities on land valuation according to the training plan;
c) Organization of training in accordance with the framework curriculum for vocational enhancement on land valuation prescribed in Article 7 of this Circular;
d) Management of training, issuance of Certificates, and management of Certificate codes.
2. In case educational institutions do not meet the conditions and fail to comply with the contents prescribed in Clause 1 of this Article, they will be removed from the public list on the Ministry of Natural Resources and Environment’s electronic portal.
Article 6.Guidelines for compiling and reporting lists of organizations providing land valuation services and land appraisers
1. Within no more than 15 working days from the date that organizations providing land valuation services register lists of land appraisers and changes or additions to such lists, provincial land management agencies shall compile the list according to Model No. 04 of Appendix I issued together with this Circular and submit it to the Ministry of Natural Resources and Environment. Provincial land management agencies are responsible for the accuracy of information in the lists of organizations providing land valuation services and land appraisers.
2. Based on the lists of organizations providing land valuation services and land appraisers submitted by provincial land management agencies, the Ministry of Natural Resources and Environment shall provide comments on the following matters:
a) Conditions for organizations providing land valuation services stipulated in Clause 3 of Article 162 of the Land Law;
b) Personal information sent by provincial land management agencies, including information of certificate holders provided by educational institutions to the Ministry of Natural Resources and Environment; personal information of those who have been granted land appraisal certificates which are still valid and do not fall under the circumstances for revocation of land appraisal certificates as prescribed in point a of Clause 4 of Article 39 of Decree No. 71/2024/NĐ-CP; personal information of individuals who have completed land valuation enhancement courses according to the land valuation enhancement program issued by the Ministry of Natural Resources and Environment but have not yet been granted land appraisal certificates as prescribed in point b of Clause 4 of Article 39 of Decree No. 71/2024/NĐ-CP.
3. During the process of monitoring compliance with laws on land valuation service provision by organizations providing land valuation services and land appraisers, provincial land management agencies shall report to the Ministry of Natural Resources and Environment cases where organizations providing land valuation services and land appraisers fail to comply with laws on land valuation service provision so that the Ministry of Natural Resources and Environment can publicly announce them on its electronic portal.
Section 2
FRAMEWORK CURRICULUM FOR TRAINING AND VOCATIONAL ENHANCEMENT
ON LAND VALUATION
Article 7. Framework for land valuation training and professional development programs
1. The framework for land valuation training and professional development programs accompanying this Circular at Appendix II is issued to serve the construction of textbooks and teaching materials as prescribed in point c, Clause 3, Article 36 of Decree No. 71/2024/NĐ-CP.
2. The duration of a land valuation training and professional development program as stipulated in Clause 1 of this Article shall be a minimum of 120 class hours, excluding time for review and final examination.
3. A land valuation training and professional development class shall have a maximum of 80 trainees.
Chapter III
IMPLEMENTING PROVISIONS
Article 8. Responsibility for Implementation
1. Ministries, ministerial-level agencies, agencies under the Government; People's Committees of provinces and centrally-administered cities shall be responsible for directing the implementation of this Circular.
2. The Land Planning and Development Agency shall be responsible for inspecting and urging the implementation of this Circular.
3. Land management agencies at all levels shall be responsible for assisting the People's Committees at their respective levels in organizing the implementation of this Circular locally.
4. Relevant agencies, organizations, and individuals shall be responsible for enforcing this Circular.
Article 9. Effectiveness
1. This Circular shall take effect from August 1, 2024.
2. The following circulars shall cease to be effective from the date this Circular takes effect:
a) Circular No. 36/2014/TT-BTNMT dated June 30, 2014, of the Minister of Natural Resources and Environment detailing the methods for land valuation; the establishment and adjustment of land price lists; specific land valuation, and advice on determining land prices;
b) Article 22 of Circular No. 02/2015/TT-BTNMT dated January 27, 2015, of the Minister of Natural Resources and Environment detailing certain provisions of Decree No. 43/2014/NĐ-CP and Decree No. 44/2014/NĐ-CP dated May 15, 2014, of the Government;
c) Circular No. 61/2015/TT-BTNMT dated December 15, 2015, of the Minister of Natural Resources and Environment regarding the issuance and management of Land Valuation Certificates;
d) Article 10 of Circular No. 33/2017/TT-BTNMT dated September 29, 2017, of the Minister of Natural Resources and Environment detailing Decree No. 01/2017/NĐ-CP dated January 6, 2017, of the Government amending and supplementing certain decrees providing detailed regulations for the implementation of the Land Law and amending and supplementing certain articles of circulars guiding the implementation of the Land Law;
đ) Article 6 of Circular No. 09/2021/TT-BTNMT dated June 30, 2021, of the Minister of Natural Resources and Environment amending and supplementing certain articles of circulars detailing and guiding the implementation of the Land Law;
e) Clause 3, Article 1 of Circular No. 11/2022/TT-BTNMT dated October 20, 2022, of the Minister of Natural Resources and Environment amending and supplementing certain articles of circulars related to business activities within the scope of the Ministry of Natural Resources and Environment’s state management functions;
g) Clause 4 and Clause 5, Article 1 of Circular No. 19/2023/TT-BTNMT dated November 15, 2023, of the Minister of Natural Resources and Environment amending and abolishing certain circulars within the purview of the Minister of Natural Resources and Environment's issuance authority.
3. Transitional Provisions
Organizations currently engaged in land valuation consulting activities according to the 2013 Land Law regulations that meet the conditions for engaging in land valuation consulting activities as stipulated in Clause 3, Article 162 of the 2024 Land Law must complete the registration procedures for land valuation experts with the provincial land management agency where the main office is registered, in accordance with the 2024 Land Law regulations.
During the implementation process, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should promptly report them to the Ministry of Natural Resources and Environment for consideration and resolution./.
