ORDINANCE

SPECIFIC PROVISIONS ON ORGANIZATION

OF THE SUPREME PROSECUTOR'S OFFICE

Pursuant to Article 106 of the Constitution of the Democratic Republic of Vietnam and the Law on the Organization of the People's Procuratorate dated July 15, 1960;

To ensure the effective implementation of the supervision of law enforcement, contributing to strict and consistent compliance with the law, and maintaining the people's democratic legal system,

The Standing Committee of the National Assembly hereby provides specific provisions on the organization of the Supreme People's Procuracy as follows:

Article 1

The Supreme People's Procuracy consists of the Procurator General, Deputy Procurators General, Procurators, and Procurator Candidates.

At the Supreme People's Procuracy, the Procuracy Supervision Committee of the Supreme People's Procuracy shall be established, comprising the Procurator General, Deputy Procurators General, and some Procurators.

Article 2

The Procurator General of the Supreme People's Procuracy leads the Supreme People's Procuracy, local People's Procuracies, and military People's Procuracies uniformly.

The Procurator General of the Supreme People's Procuracy has the following duties and powers:

a) Report the work of the procuratorial sector to the National Assembly and the Standing Committee of the National Assembly;

b) Submit draft laws and ordinances concerning matters within the scope of specialized work of the procuratorial sector to the National Assembly or the Standing Committee of the National Assembly; submit proposals for legal interpretations to the Standing Committee of the National Assembly;

c) Implement general supervisory tasks, investigations, and supervisory investigations; supervise trials and detention; direct lower-level People's Procuracies to promptly apply measures prescribed by law to combat violations of the law;

d) Direct organizational construction, training, and capacity building for procuratorial staff;

đ) Direct local People's Procuracies to disseminate and popularize laws among the people.

Article 3

Deputy Procurators General of the Supreme People's Procuracy assist the Procurator General in performing their duties.

Procurators and Procurator Candidates of the Supreme People's Procuracy perform supervisory tasks according to their assignments and under the direction of the Procurator General.

Article 4

The Procuracy Supervision Committee of the Supreme People's Procuracy comprises seven to nine members.

The Procuracy Supervision Committee of the Supreme People's Procuracy discusses and resolves important issues in supervisory work as follows:

a) Issues related to the policy and principles of supervisory work; the program of work of the Supreme People's Procuracy;

b) Drafts of significant protests against resolutions, decisions, circulars, directives, and measures of agencies under the Council of Ministers and local state agencies that are deemed inconsistent with the law;

c) Issues related to investigative research, prosecution, and protesting court judgments and decisions in major cases;

d) Draft laws, ordinances, and proposals for legal interpretations that the Procurator General of the Supreme People's Procuracy will submit to the National Assembly or the Standing Committee of the National Assembly.

The Procuracy Supervision Committee of the Supreme People's Procuracy operates based on the principle of collective democracy under the leadership of the Procurator General. In the Procuracy Supervision Committee of the Supreme People's Procuracy, the Procurator General has the final decision-making power. When the Procurator General decides differently from the majority opinion in the Procuracy Supervision Committee, the Procurator General shall report to the Standing Committee of the National Assembly for review.

Article 5

The working apparatus of the Supreme People's Procuracy includes:

- The General Supervision Department;

- The Investigative Research Department;

- The Investigation Supervision Department;

- The Criminal Trial Supervision Department;

- The Civil Trial Supervision Department;

- The Consolidation and Inspection Department;

- The Organization and Cadre Department;

- Office.

In addition to these departments, there is a Detention Supervision Office directly subordinate to the Procurator General.

The Supreme People's Procuracy may establish other offices directly subordinate to the Procurator General when deemed necessary.

The specific organization and tasks of the above departments, offices, and other offices are stipulated by the Procurator General of the Supreme People's Procuracy.

The general staffing of the Supreme People's Procuracy is determined by the Procurator General of the Supreme People's Procuracy and submitted to the Standing Committee of the National Assembly for approval.

Article 6

The Procurator General of the Supreme People's Procuracy is elected and removed by the National Assembly.

Deputy Procurators General, Procurators, Procurator Candidates, and members of the Procuracy Supervision Committee of the Supreme People's Procuracy are appointed and removed by the Standing Committee of the National Assembly.

Heads and deputies of departments, directors and deputy directors of offices, heads and deputies of rooms are appointed and removed by the Procurator General of the Supreme People's Procuracy.

To enhance the effectiveness of supervisory work, the position of Procurator is now established.

This Ordinance was adopted by the Standing Committee of the National Assembly on April 16, 1962.
