Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Vocational Training Law dated November 29, 2006;
Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,
DECISION:
Article 1. Operation Mechanism of Vocational Training Institutions Under the Ministry of National Defense
Vocational training institutions under the Ministry of National Defense shall implement autonomy and self-responsibility regarding their tasks, organizational structure, staffing, and finance as stipulated for public service units of central ministries and sectors in Decree No. 43/2006/NĐ-CP dated April 25, 2006 issued by the Government.
Article 2. Support Policies for Veterans Learning Trades
1. Veterans who wish to learn a trade shall be supported once by the State to learn one trade.
2. For cases where veterans learn intermediate or higher-level trades.
a) They shall study according to the procurement mechanism for vocational training institutions as prescribed in Decision No. 39/2008/QĐ-TTg dated March 14, 2008 issued by the Prime Minister on the regulations, bidding, procurement, and assignment of state budget-funded public services;
b) They shall be eligible to borrow money to learn trades pursuant to Decision No. 157/2007/QĐ-TTg dated September 27, 2007 issued by the Prime Minister on credit for students and trainees.
3. For cases where veterans learn primary-level trades.
a) They shall be issued a "Trade Study Card" with a maximum value equal to 12 months of the general minimum wage at the time of studying, valid for one year from the date of issuance. The "Trade Study Card" will be revoked and subject to legal action if not used in accordance with regulations;
b) The State shall pay the training costs to vocational training institutions based on the "Trade Study Card," actual training costs of the learned trade, and the certificate issued to the learner, but not exceeding the value of the "Trade Study Card." If the actual training cost exceeds the value of the "Trade Study Card," the learner shall bear the difference themselves.
Article 3. 1. The funding for determining the degree of disability and issuing the Disability Confirmation Certificate is allocated in the annual budget estimate of the commune in accordance with the State Budget Law and guiding documents.
The financial resources for implementing point a of Clause 2 and Article 3 of this Decision shall be allocated in the annual budget of the Ministry of National Defense.
Article 4. Implementation
1. The Ministry of National Defense shall be responsible for:
a) Leading and coordinating with the Ministry of Finance to guide vocational training institutions under the Ministry of National Defense in implementing Article 1 of this Decision;
b) Printing, issuing, and managing "Trade Study Cards;"
c) Guiding vocational training institutions for veterans to establish training cost levels for each trade and each level of education as prescribed;
d) Specifying procedures and formalities for: registering for trade studies, issuing "Trade Study Cards" to veterans; organizing bidding and procurement of trade training; annual settlement of funds for vocational training institutions as stipulated in point a of Clause 2 and Article 3 of this Decision;
e) Organizing trade training for veterans through vocational training institutions under the Ministry of National Defense and other vocational training institutions within the national education system as prescribed in this Decision;
f) Compiling annual budgets for veteran trade training and submitting them to the Ministry of Finance and the Ministry of Planning and Investment;
g) Conducting annual self-inspection, supervision, and evaluation of the implementation of support policies for veterans learning trades and reporting to the Ministry of Labor, Invalids, and Social Affairs.
2. The Ministry of Labor, Invalids, and Social Affairs shall be responsible for:
Leading and coordinating with the Ministries of Finance, Planning and Investment, and National Defense to inspect, supervise the implementation of support policies for veterans learning trades; compiling reports The Prime Minister.
3. The Ministry of Finance shall be responsible for:
a) Compiling annual budget estimates for veteran trade training and presenting them to the Government;
b) Coordinating with the Ministry of National Defense to guide vocational training institutions under the Ministry of National Defense in implementing Article 1 of this Decision;
c) Coordinating with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Planning and Investment, and the Ministry of National Defense to inspect, supervise the implementation of support policies for veterans learning trades.
4. The Ministry of Planning and Investment shall be responsible for:
a) Coordinating with the Ministry of Finance to balance the annual budget to ensure funding for the implementation of support policies for veterans learning trades;
b) Coordinating with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Finance, and the Ministry of National Defense to inspect, supervise the implementation of support policies for veterans learning trades.
Article 5. Effectiveness
This Decision shall take effect from November 23, 2009.
Article 6. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
