SUPERVISION ACTIVITIES OF THE NATIONAL ASSEMBLY AND PEOPLE'S COUNCILS

On the basis of The Constitution of the Socialist Republic of Vietnam has been amended and supplemented with some articles pursuant to Resolution No. 203/2025/QH15;

The National Assembly promulgates the Law on Supervision Activities of the National Assembly and People's Councils.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Law stipulates the supervision activities of the National Assembly and People's Councils; the rights and responsibilities of supervisory subjects, agencies, organizations, and individuals subject to supervision, and other agencies, organizations, and individuals related to supervision activities; measures to ensure supervision activities.

Article 2. Interpretation of Terms

In this Law, the following terms shall be understood as follows:

1. Supervision of the National Assembly and People's Councilsis a method of controlling state power through the supervisory subjects of the National Assembly and People's Councils following, examining, and evaluating the activities of agencies, organizations, and individuals subject to supervision in compliance with the Constitution and laws, handling according to their authority or requesting competent authorities to handle, contributing to improving policies, laws, deciding important issues of the country and locality, ensuring discipline and order, enhancing the effectiveness of state machinery operations.

2. Supervisory subjects of the National Assemblyinclude the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members.

3. Supervisory subjects of the People's Councilsinclude the People's Councils, the Permanent Delegation of the People's Councils, the Committees of the People's Councils, Delegations of People's Council Members, and People's Council Members.

4. Supreme supervisionis the supervision carried out by the National Assembly at its sessions over agencies, organizations, and individuals subject to supervision in compliance with the Constitution, laws, and resolutions of the National Assembly.

5. Special topic supervisionis the supervision carried out by supervisory subjects specified in this Law on issues or areas of activity of agencies, organizations, and individuals subject to supervision in compliance with the Constitution and laws.

6. Legal normative document supervisionis the supervision carried out by supervisory subjects specified in this Law on the constitutionality, legality, and consistency of legal normative documents within the legal system; timeliness, completeness, and compliance with authority, form, procedure, and process for issuing legal normative documents.

Article 3. Principles of supervision activities

1. Ensuring comprehensive and direct leadership of the Communist Party of Vietnam.

2. Compliance with the Constitution and laws.

3. Ensuring objectivity, transparency, and effectiveness.

4. Comprehensive but focused supervision, meeting practical requirements.

5. Ensuring the connection between supervision activities and policy improvement, law completion, and decision-making on important national and local issues.

6. Not obstructing the normal operation of agencies, organizations, and individuals subject to supervision.

Article 4. Rights of the supervisory subject

1. Request agencies, organizations, and individuals under supervision to report, provide information and documents related to the content of supervision, explain issues of concern to the supervisory subject; request other agencies, organizations, and individuals to provide information and documents related to the content of supervision.

2. When deemed necessary, request appraisal, invite expert consultation, collect information, meet and exchange with agencies, organizations, and individuals related to the issues of concern to the supervisory subject; organize examination and verification of such issues.

3. Require, propose that agencies, organizations, and individuals related to send representatives to participate in supervision activities; cooperate in implementing supervision activities.

4. Require agencies, organizations, and individuals with authority to apply necessary measures to promptly stop violations of laws, examine responsibility, handle violators, and promptly restore the interests of the State, legitimate rights and interests of organizations and individuals who have been violated. Agencies, organizations, and individuals with authority shall be responsible for resolving and replying within fifteen days from the date of receipt of the request. If no reply is received beyond this period, the supervisory subject may request the head of the higher-level agency, organization to examine and resolve; the head of the higher-level agency, organization shall be responsible for resolving and replying within thirty days from the date of receipt of the request.

5. Issue resolutions, conclusions, or recommendations on supervision within their authority.

6. Require, propose that agencies, organizations, and individuals with authority examine and handle responsibility against agencies, organizations, and individuals under supervision who obstruct, intervene illegally, or fail to comply with requests, resolutions, conclusions, or recommendations of the supervisory subject; depending on the nature and degree of violation, require, propose that agencies, organizations, and individuals with authority handle according to the provisions of the law against the heads of supervised agencies, organizations and related persons.

7. Exercise other rights as provided for in this Law and other relevant laws.

Article 5. Responsibilities of the supervisory subject

1. Properly implement the principles of supervision activities stipulated in Article 3 of this Law.

2. Notify in advance about the plan, content, requirements of supervision, and content of the reporting requirement to agencies, organizations, and individuals under supervision and related agencies, organizations, and individuals.

3. Properly implement the scope of authority, procedures, and formalities of supervision and the program, plan, and content of supervision.

4. Manage, use, and protect information and documents collected during the supervision process in accordance with the provisions of the law.

5. Reply to issues related to supervision activities to agencies, organizations, and individuals under supervision and related agencies, organizations, and individuals.

6. Be responsible for requests, reports, resolutions, conclusions, and recommendations on supervision; review conclusions, recommendations on supervision when requested by agencies, organizations, and individuals under supervision.

7. Monitor, urge, and examine the implementation of resolutions, conclusions, and recommendations on supervision as stipulated in Clause 3, Article 40 of this Law.

8. Report on the results of supervision activities periodically as stipulated in Article 12 of this Law or when requested by competent authorities or persons.

Article 6. Rights of agencies, organizations, and individuals subject to supervision

1. To be informed in advance about the plan, content, requirements for supervision, and the content of reports requested; to receive answers regarding issues related to supervisory activities.

2. To explain and defend the correctness of their implementation of policies and laws within their duties and powers.

3. To request the supervisory subject to reconsider conclusions and recommendations of supervision related to their activities according to Clause 2 of Article 40 of this Law.

Article 7. Obligations of agencies, organizations, and individuals subject to supervision

1. To fully implement plans, contents, and requirements for supervision; to report and explain truthfully, objectively, completely, and promptly according to the requests of the supervisory subject.

2. To provide information and documents related to their tasks upon the request of the supervisory subject, except for information classified as state secrets under the law on protecting state secrets, which the supervisory subject is not authorized to access; to bear responsibility for the accuracy, truthfulness, and completeness of the information and documents they provide. Information and documents must be provided within five working days from the date of receiving the request; in cases where the information and documents are complex and require time to compile, the deadline for provision may be extended but shall not exceed fifteen days.

3. Individuals and heads of agencies and organizations subject to supervision have the direct responsibility to report, explain, and answer issues requested by the supervisory subject; if unable to report, explain, or answer directly, they may delegate to their deputy with the consent of the supervisory subject; for questioning activities, the person being questioned may not delegate another person to answer in their place unless otherwise provided by other laws.

4. To take necessary measures to promptly stop violations of the law, restore the interests of the State, and the legitimate rights and interests of organizations and individuals that have been violated.

5. Not to obstruct or illegally interfere with the supervisory activities of the supervisory subject.

6. Strictly comply with the resolutions of the National Assembly and the Standing Committee of the National Assembly, People's Councils; strictly implement the conclusions and recommendations of the Standing Committee of the National Assembly, the Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, National Assembly Deputies, the Standing Body of People's Councils, Committees of People's Councils, and People's Council Deputies.

Article 8. Participation in Supervision by Agencies, Organizations, and Individuals

1. The Vietnam Fatherland Front Committee, experts with specialized knowledge and experience in the supervised issues and fields may be invited to participate in supervisory activities.

2. Agencies, organizations, and individuals related to the matter have the responsibility to participate in supervisory activities when requested or required by the supervisory subject.

Article 9. Coordination in Supervisory Activities

1. The supervisory subject coordinates with other supervisory subjects and the Vietnam Fatherland Front Committee, inspection bodies, audit bodies, and other competent agencies and organizations in developing programs, plans, and contents of supervision and implementing supervisory activities to avoid overlap and enhance supervisory effectiveness.

2. During the implementation of supervisory activities, if any inadequacies or limitations in policies and laws, or in the implementation of laws fall within the jurisdiction or areas of responsibility of another supervisory subject, there is a responsibility to promptly inform that supervisory subject to coordinate in supervision.

3. Inspection bodies, audit bodies, and other competent agencies and organizations have the responsibility to provide information and documents related to the content of supervision when requested by the supervisory subject, except where otherwise provided by law; to bear responsibility for the accuracy, truthfulness, and completeness of the information and documents they provide. Information and documents must be provided within five working days from the date of receiving the request; in cases where the information and documents are complex and require time to compile, the deadline for provision may be extended but shall not exceed fifteen days.

4. Inspection bodies, audit bodies, and other competent agencies and organizations have the responsibility to appoint members to participate in supervisory activities when requested or required by the supervisory subject.

Article 10. Transparency in Supervisory Activities

1. Programs, plans, reports on supervisory results, resolutions, conclusions, supervisory recommendations, and reports on the implementation of supervisory resolutions, conclusions, and recommendations, responses to interpellations, documents resolving and responding to citizen recommendations, and other documents as prescribed by law must be published on the electronic portal, website of the National Assembly or People's Councils, or through mass media or made public in another form as prescribed by law on access to information, except where otherwise provided by law.

2. News agencies have the right to access and report on supervisory activities as prescribed by law.

3. Organizations and individuals have the right to access information about supervisory activities, contribute opinions, and make recommendations to the National Assembly and People's Councils regarding supervisory activities as prescribed by law.

Article 11. Effectiveness of Supervision

1. The effectiveness of supervision by the National Assembly and People's Councils shall be evaluated based on the following contents:

a) Implementation of the Party’s guidelines and policies, the Constitution, and state laws;

b) Appropriateness of the issues and areas under supervision and the timing of supervision;

c) Impact on the efficiency of state machinery operations, policy and legal improvement, and decision-making on important national and local issues.

2. Supervisors are responsible for reporting on the effectiveness of their supervisory activities when fulfilling periodic reporting obligations as stipulated in Article 12 of this Law or upon request from competent authorities.

Article 12. Periodic Reporting Obligations of Supervisors

1. The National Assembly reports to voters nationwide on its highest supervisory activities through mass media and voter contact activities of National Assembly deputies.

2. The Standing Committee of the National Assembly reports to the National Assembly on the results of implementing the supervisory program of the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, Committees of the National Assembly, Delegations of National Assembly members, and National Assembly deputies.

3. The Ethnic Council and Committees of the National Assembly report to the National Assembly and the Standing Committee of the National Assembly on the results of implementing their supervisory programs.

4. Delegations of National Assembly members report to the Standing Committee of the National Assembly on the results of implementing their supervisory programs and the supervisory activities of National Assembly deputies within the delegation.

5. National Assembly deputies report to Delegations of National Assembly members on the results of implementing their supervisory programs; report to local voters on their supervisory activities through voter contact activities.

6. People's Councils report to local voters on their supervisory activities through mass media and voter contact activities of People's Council deputies.

7. The Standing Body of People's Councils reports to People's Councils on the results of implementing the supervisory program of the People's Councils, the Standing Body of People's Councils, Committees of the People's Councils, People's Council deputies, and the results of supervisory activities of Delegations of People's Council deputies assigned by the People's Councils and the Standing Body of People's Councils.

8. Committees of People's Councils report to People's Councils and the Standing Body of People's Councils on the results of implementing their supervisory programs.

9. Delegations of People's Council deputies report to People's Councils and the Standing Body of People's Councils on the results of supervisory activities on issues assigned by the People's Councils and the Standing Body of People's Councils; report to the Standing Body of People's Councils on the results of implementing the supervisory program of People's Council deputies within the delegation.

10. People's Council deputies report to the Standing Body of People's Councils on the results of implementing their supervisory programs through Delegations of People's Council deputies; report to local voters on their supervisory activities through voter contact activities.

Chapter II

SUPERVISION BY THE NATIONAL ASSEMBLY

Section 1

THE NATIONAL ASSEMBLY'S SUPREME SUPERVISION

Article 13. The highest supervisory authority of the National Assembly

1. The highest supervision of the activities of the President of the State, the Standing Committee of the National Assembly, the Government, the Prime Minister, Ministers, other members of the Government, the Supreme People's Court, the Supreme People's Procuracy, the National Election Council, the State Audit Agency, and other agencies established by the National Assembly in compliance with the Constitution, laws, and resolutions of the National Assembly.

2. The highest supervision of normative legal documents prescribed in Clauses 3, 4, 5, 6, 7, 8, and 9 of Article 4 of the Law on Enacting Normative Legal Documents.

3. In cases where necessary due to practical requirements, the National Assembly conducts supervision over the activities of other agencies, organizations, and individuals in compliance with the Constitution and laws.

Article 14. Activities of the highest supervision of the National Assembly

1. The National Assembly shall carry out the following supervisory activities:

a) Reviewing reports on the work of the President of the State, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the National Election Council, the State Audit Agency, other agencies established by the National Assembly, and other reports as prescribed by law or at the request of the Standing Committee of the National Assembly;

b) Reviewing normative legal documents prescribed in Clause 3 of Article 4 of the Law on Enacting Normative Legal Documents that have signs contrary to the Constitution, laws, and resolutions of the National Assembly upon the proposal of the President of the State; reviewing normative legal documents prescribed in the Clauses 4, 5, 6, 7, 8, and 9 of Article 4 of the Law on Enacting Normative Legal Documents that have signs contrary to the Constitution, upon the proposal of the Standing Committee of the National Assembly;

c) Reviewing the responses to questions posed to those questioned as prescribed in Point a, Clause 1, Article 25 of this Law;

d) Organizing a Supervision Delegation to conduct specialized supervision and review the reports on the results of the supervision of the Supervision Delegation;

đ) Reviewing the reports on the results of the supervision of the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly on topics assigned by the National Assembly; reviewing the reports on the results of the supervision on other topics upon the proposal of the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly when it deems necessary;

e) Establishing a Temporary Committee to investigate a specific issue and reviewing the reports on the results of the investigation of the Committee;

g) Reviewing the implementation of resolutions of the National Assembly on supervision;

h) Reviewing the reports of the Standing Committee of the National Assembly on the recommendations for supervision of the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, and the Members of the National Assembly;

i) Conducting confidence votes and secret ballots on individuals holding positions elected or approved by the National Assembly according to the regulations of the National Assembly on confidence votes and secret ballots.

2. The procedures and formalities for implementing the activities of the highest supervision of the National Assembly during its sessions as prescribed in Clause 1 of this Article shall be carried out in accordance with the Rules of Procedure of the National Assembly sessions and related regulations of the National Assembly; in cases where there are no such regulations, they shall be detailed by the Standing Committee of the National Assembly.

3. The National Assembly decides its annual supervision program based on the proposal of the Standing Committee of the National Assembly; entrusting the Standing Committee of the National Assembly to promulgate the plan and organize the implementation of the National Assembly's supervision program; entrusting the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, and the Delegations of the National Assembly to organize the implementation of certain contents within the supervision program and report the results to the National Assembly. In cases where necessary due to practical requirements, during periods when the National Assembly is not in session, the Standing Committee of the National Assembly decides to adjust the National Assembly's supervision program and report to the National Assembly at the next session.

Article 15. The National Assembly's authority in reviewing the results of oversight

1. Request the Standing Committee of the National Assembly, the Government, the Prime Minister, Ministers, Heads of Ministries, the Supreme People's Court Judges Council, the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General to promulgate detailed regulations on laws and resolutions of the National Assembly.

2. Repeal part or all of the normative legal documents prescribed in Clauses 3, 4, 5, 6, 7, 8, and 9 of Article 4 of the Law on Enacting Normative Legal Documents that contravene the Constitution, laws, and resolutions of the National Assembly.

3. Remove from office, dismiss, or impeach the President, Vice Presidents, Chairperson, Vice Chairpersons of the National Assembly, Members of the Standing Committee of the National Assembly, Chairperson of the National Ethnic Council, Chairperson of the Committees of the National Assembly, Secretary-General of the National Assembly - Director of the National Assembly Office, the Prime Minister, the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the Chairman of the National Election Council, the State Auditor General, heads of other agencies established by the National Assembly; approve proposals for removal from office, dismissal, or demotion of Deputy Prime Ministers, Ministers, other members of the Government, Supreme People's Court Judges.

4. Conduct confidence votes for persons elected or approved by the National Assembly according to the National Assembly's provisions on confidence votes.

5. Require agencies or individuals with authority to remove from office, dismiss, or demote, or otherwise handle persons who seriously violate the law.

6. Decide on other matters within the authority of the National Assembly.

Section 2

OVERSIGHT BY THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Article 16. Oversight Authority of the Standing Committee of the National Assembly

1. Oversee the activities of the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, other agencies established by the National Assembly, and Provincial People's Councils in adhering to the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

2. Oversee normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Enacting Normative Legal Documents.

3. Oversee resolutions of Provincial People's Councils.

4. Assist the National Assembly in organizing oversight when assigned by the National Assembly.

5. In cases where necessary due to practical requirements, the Standing Committee of the National Assembly may conduct oversight of the activities of other agencies, organizations, or individuals in adhering to the Constitution and laws.

Article 17. Oversight Activities of the Standing Committee of the National Assembly

1. The Standing Committee of the National Assembly shall carry out the following oversight activities:

a) Review reports on work of the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, other agencies established by the National Assembly, and other reports as prescribed by law during the period between two sessions of the National Assembly as assigned by the National Assembly or when deemed necessary;

b) Review normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Enacting Normative Legal Documents that appear to contravene the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, either independently discovered or upon request from the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, the Central Committee of the Vietnam Fatherland Front, central agencies of political-social organizations, recommendations from the National Ethnic Council, Committees of the National Assembly, or National Assembly deputies;

c) Review responses to questioning of those questioned as stipulated in Point a Clause 1 of Article 25 of this Law during the period between two sessions of the National Assembly;

d) Organizing a Supervision Delegation to conduct specialized supervision and review the reports on the results of the supervision of the Supervision Delegation;

d) Review reports on the results of oversight by the National Ethnic Council and Committees of the National Assembly on specific topics assigned by the Standing Committee of the National Assembly; review reports on the results of oversight on other specific topics upon request from the National Ethnic Council and Committees of the National Assembly when deemed necessary;

e) Supervise the handling of complaints, petitions, and reflections from agencies, organizations, and individuals;

g) Supervise the handling and response to citizens' petitions;

h) Supervise compliance with procedures for soliciting opinions during the drafting of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly as prescribed by the Law on Enacting Normative Legal Documents and other relevant laws;

i) Supervise the election of National Assembly deputies and provincial People's Council deputies;

k) Review reports on the activities of provincial People's Councils;

l) Review provincial People's Council resolutions that appear to contravene the Constitution, normative legal documents of higher-level state agencies;

m) Review the implementation of resolutions of the Standing Committee of the National Assembly on oversight;

n) Review recommendations for oversight from the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Deputies, and National Assembly deputies;

o) Propose the National Assembly to conduct confidence votes for persons elected or approved by the National Assembly according to the National Assembly's provisions on confidence votes.

2. The Standing Committee of the National Assembly decides and organizes its annual oversight program; assigns the National Ethnic Council, Committees of the National Assembly, and Delegations of National Assembly Deputies to organize certain contents of the oversight program and report the results to the Standing Committee of the National Assembly; in cases where necessary due to practical requirements, it may adjust the oversight program.

Article 18. The Standing Committee of the National Assembly's authority in reviewing the results of supervision

1. Deciding to interpret the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly; requesting the Government, Prime Minister, Minister, Head of a ministry-level agency, Supreme People's Court Judges Council, President of the Supreme People's Court, Prosecutor General of the Supreme People's Procuracy, State Auditor General to issue detailed regulations on laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

2. Suspending the implementation of part or all of normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Issuing Normative Legal Documents that are contrary to the Constitution, laws, and resolutions of the National Assembly, and submitting to the National Assembly for consideration and decision on the abolition of part or all of such documents at the nearest session.

3. Abolishing part or all of normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Issuing Normative Legal Documents that are contrary to ordinances and resolutions of the Standing Committee of the National Assembly.

4. Recommending the National Assembly or requesting competent authorities to relieve, remove, or dismiss from office, and handle persons who seriously violate the law.

5. Proposing the National Assembly to vote on confidence in persons holding positions elected or approved by the National Assembly according to the National Assembly's provisions on voting on confidence.

6. Abolishing part or all of provincial People's Council resolutions that are contrary to the Constitution and normative legal documents of higher state agencies; dissolving provincial People's Councils if they cause serious damage to the interests of the people.

7. Deciding other matters within the Standing Committee of the National Assembly's authority.

Section 3

SUPERVISION BY THE NATIONAL ASSEMBLY'S ETHNIC COMMITTEE AND STANDING COMMITTEES

Article 19. Supervisory Authority of the Ethnic Committee and Standing Committees of the National Assembly

1. Within their duties and powers, supervising the activities of the Government, Ministries, equivalent ministries, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, and other central state agencies in adhering to the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

2. Supervising normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Issuing Normative Legal Documents within the areas of responsibility of the Ethnic Committee and Standing Committees of the National Assembly.

3. Assisting the National Assembly and the Standing Committee of the National Assembly in organizing supervision when assigned by the National Assembly and the Standing Committee of the National Assembly.

4. In case of necessity due to practical requirements, the Ethnic Committee and Standing Committees of the National Assembly may conduct supervision over the activities of other agencies, organizations, and individuals in adhering to the Constitution and laws.

Article 20. Supervision Activities of the Ethnic Committee and Standing Committees of the National Assembly

1. The Ethnic Committee and Standing Committees of the National Assembly shall carry out the following supervision activities:

a) Reviewing reports of the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, and other reports as prescribed by law within the areas of responsibility of the Ethnic Committee and Standing Committees of the National Assembly or as assigned by the Standing Committee of the National Assembly;

b) Supervising normative legal documents prescribed in Clauses 5, 6, 7, 8, and 9 of Article 4 of the Law on Issuing Normative Legal Documents;

c) Organizing inspection teams to conduct specialized inspections and reviewing reports on the results of inspections by such teams;

d) Organizing explanatory sessions during Ethnic Committee and Standing Committee meetings for members of the Government, President of the Supreme People's Court, Prosecutor General of the Supreme People's Procuracy, State Auditor General, and relevant individuals to explain issues within the areas of responsibility of the Ethnic Committee and Standing Committees of the National Assembly;

đ) Supervising the handling of complaints, petitions, suggestions, and reflections by agencies, organizations, and individuals within the areas of responsibility of the Ethnic Committee and Standing Committees of the National Assembly or as assigned by the Standing Committee of the National Assembly;

e) Supervising the handling and responding to suggestions from voters as assigned by the Standing Committee of the National Assembly;

g) Within their duties and powers, supervising the compliance of agencies, organizations, and individuals with the authority to organize solicitation of opinions during the drafting of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly according to the Law on Issuing Normative Legal Documents and other related laws;

h) Within their duties and powers, coordinating with relevant agencies of the National Assembly involved in international treaties and agreements to supervise the implementation of such treaties and agreements based on respect for independence, sovereignty, equality, mutual benefit, and compliance with the provisions of the treaties and agreements, and relevant laws and actual conditions of the parties;

i) Recommending the Standing Committee of the National Assembly to consider proposing the National Assembly to vote on confidence in persons holding positions elected or approved by the National Assembly according to the National Assembly's provisions on voting on confidence.

2. The Ethnic Committee and Standing Committees of the National Assembly decide their annual supervision programs; assigning the Ethnic Committee's and Standing Committees' permanent bodies to organize the implementation of the supervision program. In case of necessity due to practical requirements, the Ethnic Committee's and Standing Committees' permanent bodies may adjust the supervision program and report to the Ethnic Committee and Standing Committees of the National Assembly at the nearest meeting.

The Ethnic Committee and Standing Committees of the National Assembly are responsible for reporting to the Standing Committee of the National Assembly on their supervision programs.

Article 21. The authority of the National Assembly's Ethnic Council and Committee in reviewing the results of supervision

1. Based on the results of the supervision activities stipulated in Points a, b, c, d, đ, e, g, and i Clause 1 Article 20 of this Law, the National Assembly's Ethnic Council and Committee have the following authorities:

a) To request the Standing Committee of the National Assembly to interpret the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;

b) To request competent agencies, organizations, and individuals to amend, supplement, replace, suspend the effectiveness, cease implementation, abolish partially or entirely normative legal documents that violate the Constitution, normative legal documents of higher-level state agencies; competent agencies, organizations, and individuals receiving such requests shall be responsible for examining and replying within thirty days from the date of receipt of the request.

To request competent agencies, organizations, and individuals to issue detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;

c) To request the Prime Minister, other members of the Government, the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General, and heads of central agencies related to the matter, the Chairman of the Provincial People's Council to resolve issues related to the implementation of policies, laws under the jurisdiction of the National Assembly's Ethnic Council and Committee. The person receiving the request shall be responsible for examining and replying within fifteen days from the date of receipt of the request; in cases of force majeure or complex contents, the deadline may be extended but not exceeding thirty days. If no reply is received beyond this period or if the content of the reply is not agreed upon, they have the right to request the Chairman of the National Assembly to require the person receiving the request to reply at a session of the Standing Committee of the National Assembly or at the nearest session of the National Assembly; in the case of the Chairman of the Provincial People's Council, the Prime Minister shall be requested to examine and handle according to the provisions of this Law and relevant laws;

d) To request the Standing Committee of the National Assembly to consider submitting to the National Assembly for a vote of confidence regarding persons holding positions elected or approved by the National Assembly according to the National Assembly's provisions on voting of confidence;

đ) To decide on other matters within the authority of the National Assembly's Ethnic Council and Committee.

2. Based on the results of cooperative supervision activities stipulated in Point h Clause 1 Article 20 of this Law, the National Assembly's Ethnic Council and Committee have the authority to request competent agencies of the Socialist Republic of Vietnam to address the following contents:

a) Improving policies and laws to enhance the effectiveness of implementing international treaties and agreements;

b) Adjusting methods and mechanisms for organizing the implementation of international treaties and agreements;

c) Considering amending, supplementing, extending, terminating the effectiveness, renouncing, withdrawing from, temporarily suspending the implementation of international treaties and agreements.

Section 4

SUPERVISION BY THE NATIONAL ASSEMBLY DELEGATION

Article 22. Supervisory Authority of the National Assembly Delegation

1. Supervising the activities of the People's Council, agencies under the People's Council, People's Court, People's Procuracy, civil enforcement agency, and other agencies at the local level in adhering to the Constitution and laws.

2. Assisting the National Assembly and the Standing Committee of the National Assembly in conducting supervision when assigned by the National Assembly and the Standing Committee of the National Assembly; participating in the supervision activities of the National Assembly, the Standing Committee of the National Assembly, the National Assembly's Ethnic Council and Committee, and the Provincial People's Council at the local level when requested or proposed.

Article 23. Activities of supervision by the Delegation of National Assembly Deputies

1. The Delegation of National Assembly Deputies shall carry out the following supervision activities:

a) Organizing a Supervision Team to conduct specialized supervision and review the results of the Supervision Team's work;

b) Supervising the handling of complaints, denunciations, suggestions, and reflections from agencies, organizations, and individuals;

c) Participating in supervising the resolution and response to the suggestions of voters within the jurisdiction of central agencies, organizations, and individuals with authority, according to the division of labor by the Standing Committee of the National Assembly; coordinating with the Provincial People's Council Standing Committee and the Vietnam Fatherland Front Provincial Committee to supervise the resolution and response to the suggestions of voters within the jurisdiction of local agencies, organizations, and individuals with authority;

d) Dispatching National Assembly deputies in the Delegation to participate in the supervision activities of the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, and the Provincial People's Councils at the local level when required or proposed.

2. The Delegation of National Assembly Deputies decides and organizes the implementation of its annual supervision program; in cases where necessary due to practical requirements, it may decide to adjust the supervision program. The Delegation of National Assembly Deputies has the responsibility to report to the Standing Committee of the National Assembly on its supervision program.

Article 24. Authority of the Delegation of National Assembly Deputies in reviewing the results of supervision

1. Proposing local agencies and individuals with authority to amend, supplement, replace, suspend the effectiveness, cease enforcement, or abolish part or all of normative legal documents that contravene the Constitution or normative legal documents of higher-level state agencies. Agencies and individuals with authority receiving the proposal have the responsibility to examine and respond within thirty days from the date of receipt of the proposal.

2. Proposing local agencies, organizations, and individuals with authority to resolve issues related to the implementation of policies, laws, and regulations. Agencies, organizations, and individuals with authority receiving the proposal have the responsibility to examine and respond within fifteen days from the date of receipt of the proposal; in cases of force majeure or complex content, the deadline may be extended but not exceed thirty days. If no response is received beyond this period or if the content of the response is not agreed upon, there is the right to propose that agencies, organizations, and individuals with authority examine and resolve the issue, while reporting to the Standing Committee of the National Assembly for examination and decision.

3. Proposing central agencies, organizations, and individuals with authority to amend, supplement, replace, suspend the effectiveness, cease enforcement, or abolish part or all of normative legal documents that contravene the Constitution or normative legal documents of higher-level state agencies; resolving issues within their authority related to the implementation of policies, laws, and regulations at the local level. Agencies, organizations, and individuals with authority receiving the proposal have the responsibility to examine and respond within thirty days from the date of receipt of the proposal.

Proposing central agencies, organizations, and individuals with authority to promulgate detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

The Delegation of National Assembly Deputies sends proposals to central agencies, organizations, and individuals with authority, and simultaneously sends them to the Standing Committee of the National Assembly, the Ethnic Council, and the Committees of the National Assembly under their respective areas of responsibility for coordination in monitoring, urging, and supervising the resolution of the issue by agencies, organizations, and individuals with authority.

4. Deciding on other matters within the authority of the Delegation of National Assembly Deputies.

Section 5

SUPERVISION BY NATIONAL ASSEMBLY DEPUTIES

Article 25. Authority and supervision activities of National Assembly deputies

1. National Assembly deputies have the authority and carry out the following supervision activities:

a) Questioning the President of the State, the Chairman of the National Assembly, the Prime Minister of the Government, Ministers, other members of the Government, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General;

b) Supervising normative legal documents;

c) Supervising the implementation of laws at localities where National Assembly deputies are members of National Assembly delegations;

d) Supervising the handling of complaints, petitions, suggestions, and reflections from agencies, organizations, and individuals;

e) Participating in the supervision activities of National Assembly delegations to which they belong; participating in the supervision activities of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, Committees of the National Assembly, and provincial People's Councils when requested or proposed.

2. National Assembly deputies decide and organize the implementation of their annual supervision program (if any); in cases of necessity due to practical requirements, they may adjust the supervision program. National Assembly deputies are responsible for notifying their National Assembly delegation about their supervision program (if any).

National Assembly delegations are responsible for organizing National Assembly deputies within their delegation to conduct supervision at localities.

Article 26. Authority of National Assembly deputies in reviewing the results of supervision

1. Propose the Standing Committee of the National Assembly to interpret the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

2. Propose agencies, organizations, and individuals with authority to amend, supplement, replace, suspend the effect, cease enforcement, or abolish part or all of normative legal documents that contravene the Constitution or normative legal documents of higher-level state agencies. Agencies, organizations, and individuals with authority receiving such proposals are responsible for examining and replying within thirty days from the date of receipt of the proposal.

Propose agencies, organizations, and individuals with authority to issue detailed regulations on laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

3. Propose agencies, organizations, and individuals with authority to examine and resolve issues related to the implementation of policies and laws. Agencies, organizations, and individuals with authority receiving such proposals are responsible for examining and replying within fifteen days from the date of receipt of the proposal; in cases of force majeure or complex contents, the period may be extended but not exceeding thirty days. If no reply is received beyond this period or if the content of the reply is not agreed upon, there is the right to propose agencies, organizations, and individuals with authority to examine and resolve, while simultaneously reporting to the Standing Committee of the National Assembly for examination and decision.

4. Propose the Standing Committee of the National Assembly to consider submitting to the National Assembly for a vote of confidence regarding persons holding positions elected or approved by the National Assembly according to the National Assembly's regulations on voting confidence.

Chapter III

SUPERVISION BY THE PEOPLE'S COUNCIL

Section 1

SUPERVISION BY THE PEOPLE'S COUNCIL AT SESSIONS

Article 27. Supervisory Authority of the People's Council

1. The provincial People's Council supervises the activities of the Provincial People's Council Standing Committee, the Council's Committees, the provincial People's Committee, the People's Committee of special administrative zones where there is no local administration level, the People's Court, the People's Procuracy, the civil enforcement agency, and other agencies at the locality in their compliance with the Constitution, laws, and implementation of resolutions of the provincial People's Council; it also supervises normative legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Normative Legal Documents and normative legal documents of the People's Committee of special administrative zones where there is no local administration level.

In cases deemed necessary due to practical requirements, the provincial People's Council may conduct supervision over the activities of other agencies, organizations, and individuals at the commune level in their compliance with the Constitution and laws.

2. The commune-level People's Council supervises the activities of the Commune People's Council Standing Committee, the Council's Committees, the commune-level People's Committee, and other agencies at the locality in their compliance with the Constitution, laws, and implementation of resolutions of the commune-level People's Council; it also supervises normative legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Normative Legal Documents.

Article 28. Supervisory Activities of the People's Council

1. The provincial People's Council shall carry out the following supervisory activities:

a) Reviewing reports on work of the Provincial People's Council Standing Committee, the Council's Committees, the provincial People's Committee, the People's Court, the People's Procuracy, the provincial civil enforcement agency, the People's Committee of special administrative zones where there is no local administration level, and other reports as prescribed by law, resolutions of the provincial People's Council, or upon the proposal of the Provincial People's Council Standing Committee;

b) Reviewing normative legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Normative Legal Documents and normative legal documents of the People's Committee of special administrative zones where there is no local administration level that show signs of contravening the Constitution, normative legal documents of higher state agencies, and resolutions of the provincial People's Council, upon the proposal of the Provincial People's Council Standing Committee;

c) Reviewing responses to interpellations of those questioned as stipulated in Point a, Clause 1, Article 36 of this Law;

d) Organizing a Supervision Delegation to conduct specialized supervision and review the reports on the results of the supervision of the Supervision Delegation;

d) Reviewing reports on the results of supervision by the Provincial People's Council Standing Committee and the Council's Committees on topics assigned by the People's Council; reviewing reports on the results of supervision on other topics upon the proposal of the Provincial People's Council Standing Committee and the Council's Committees when deemed necessary;

e) Reviewing the implementation of resolutions of the provincial People's Council on supervision;

g) Reviewing reports of the Provincial People's Council Standing Committee on proposals for supervision made by the Provincial People's Council Standing Committee, the Council's Committees, and provincial People's Council deputies.

2. The commune-level People's Council shall carry out the following supervisory activities:

a) Reviewing reports on work of the Commune People's Council Standing Committee, the Council's Committees, the commune-level People's Committee, and other reports as prescribed by law, resolutions of the commune-level People's Council, or upon the proposal of the Commune People's Council Standing Committee;

b) Reviewing normative legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Normative Legal Documents that show signs of contravening the Constitution, normative legal documents of higher state agencies, and resolutions of the commune-level People's Council, upon the proposal of the Commune People's Council Standing Committee;

c) Reviewing responses to interpellations of those questioned as stipulated in Point a, Clause 2, Article 36 of this Law;

d) Organizing a Supervision Delegation to conduct specialized supervision and review the reports on the results of the supervision of the Supervision Delegation;

d) Reviewing reports on the results of supervision by the Commune People's Council Standing Committee and the Council's Committees on topics assigned by the People's Council; reviewing reports on the results of supervision on other topics upon the proposal of the Commune People's Council Standing Committee and the Council's Committees when deemed necessary;

e) Reviewing the implementation of resolutions of the commune-level People's Council on supervision;

g) Reviewing reports of the Commune People's Council Standing Committee on proposals for supervision made by the Commune People's Council Standing Committee, the Council's Committees, and commune-level People's Council deputies.

3. The People's Council shall take confidence votes and secret ballots on persons holding positions elected by the People's Council according to the provisions of the National Assembly on taking confidence votes and secret ballots.

4. The People's Council decides its annual supervision program based on the proposal of the People's Council Standing Committee; assigns the People's Council Standing Committee to issue plans and organize the implementation of the supervision program; assigns the People's Council Standing Committee, the Council's Committees, and the Delegation of People's Council representatives to implement certain contents within the supervision program and report the results to the People's Council. In cases deemed necessary due to practical requirements, during periods when the People's Council is not in session, the People's Council Standing Committee may decide to adjust the People's Council's supervision program and report to the People's Council at the nearest session.

Article 29. The authority of the People's Council in examining the results of supervision

1. The provincial People's Council suspends the implementation, abolishes partially or entirely normative legal documents prescribed in Clause 11 and Clause 12, Article 4 of the Law on Enacting Normative Legal Documents; abolishes partially or entirely normative legal documents prescribed in Clause 14, Article 4 of the Law on Enacting Normative Legal Documents; requests the Chairman of the Provincial People's Committee to suspend the implementation, abolish partially or entirely normative legal documents of the Special Administrative-Economic Unit People's Committee that organize local administrative levels contrary to the Constitution, normative legal documents of higher state agencies, resolutions of the provincial People's Council.

The communal People's Council suspends the implementation, abolishes partially or entirely normative legal documents prescribed in Clause 15, Article 4 of the Law on Enacting Normative Legal Documents contrary to the Constitution, normative legal documents of higher state agencies, resolutions of the communal People's Council.

2. The provincial People's Council dismisses, removes from office the Chairperson, Vice Chairpersons, Heads of Committees of the People's Council, Chairperson, Vice Chairpersons, and members of the People's Committee at the provincial level; dismisses, removes from office the People's Judge according to the provisions of the law; requires competent authorities or persons with authority to handle according to the provisions of the law against the Chairperson, Vice Chairpersons of the People's Committee of the Special Administrative-Economic Unit where local administrative levels are not organized and related persons.

The communal People's Council dismisses, removes from office the Chairperson, Vice Chairpersons, Heads of Committees of the People's Council, Chairperson, Vice Chairpersons, and members of the People's Committee at the communal level.

3. The provincial People's Council dissolves the communal People's Council in cases where it causes serious damage to the interests of the people and submits for approval by the Standing Committee of the National Assembly.

4. Proposes competent agencies, organizations, and individuals at the central level to examine and amend, supplement, replace, temporarily suspend the effect, suspend the implementation, abolish partially or entirely normative legal documents contrary to the Constitution, normative legal documents of higher state agencies; resolve issues within their authority related to the implementation of policies, laws at the local level. Competent agencies, organizations, and individuals receiving the proposal have the responsibility to examine and respond within thirty days from the date of receipt of the proposal.

Proposing central agencies, organizations, and individuals with authority to promulgate detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

The provincial People's Council sends proposals to competent agencies, organizations, and individuals at the central level, simultaneously sending them to the Standing Committee of the National Assembly, the National Ethnic Council, the relevant committees of the National Assembly for coordination in monitoring and urging the resolution of the competent agencies, organizations, and individuals. The communal People's Council sends proposals to the Standing Body of the provincial People's Council for examination and consolidation before sending proposals to the competent agencies, organizations, and individuals at the central level.

5. Conducts confidence votes for persons holding positions elected by the People's Council according to the National Assembly's regulations on confidence votes.

6. Decides other matters within the authority of the People's Council.

Section 2

SUPERVISION BY THE STANDING BODY OF THE PEOPLE'S COUNCIL

Article 30. Supervisory Authority of the Standing Committee of the People's Council

1. The Standing Committee of the Provincial People's Council shall supervise the activities of the People's Committee and its affiliated agencies at the provincial level, the People's Committee of special administrative zones where no local administration is organized, the People's Court, the People's Procuracy, the civil enforcement agency, and other local agencies, and the People's Councils at the commune level in their compliance with the Constitution and laws and the implementation of resolutions of the Provincial People's Council; supervise normative legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Normative Legal Documents and normative legal documents of the People's Committee of special administrative zones where no local administration is organized; assist the Provincial People's Council in organizing supervision when assigned by the Provincial People's Council.

In cases deemed necessary due to practical requirements, the Standing Committee of the Provincial People's Council may conduct supervision over the activities of other agencies, organizations, and individuals at the commune level in their compliance with the Constitution and laws.

2. The Standing Committee of the Commune People's Council shall supervise the activities of the People's Committee and its affiliated agencies at the commune level and other local agencies in their compliance with the Constitution and laws and the implementation of resolutions of the Commune People's Council; supervise normative legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Normative Legal Documents; assist the Commune People's Council in organizing supervision when assigned by the Commune People's Council.

Article 31. Supervisory Activities of the Standing Committee of the People's Council

1. The Standing Committee of the People's Council shall carry out the following supervisory activities:

a) Organizing a Supervision Team to conduct specialized supervision and review the results of the Supervision Team's work;

b) Review reports on the results of supervision conducted by Committees of the People's Council on specific topics assigned by the Standing Committee of the People's Council; review reports on the results of supervision on other specific topics upon request of Committees of the People's Council when deemed necessary;

c) Supervise the handling of complaints, petitions, suggestions, and reflections from agencies, organizations, and individuals;

d) Supervise the resolution and response to citizens' suggestions.

2. The Standing Committee of the Provincial People's Council shall carry out the supervisory activities stipulated in Clause 1 of this Article and the following additional supervisory activities:

a) Review reports on the work of the People's Committee, People's Court, People's Procuracy, civil enforcement agency at the provincial level, People's Committee of special administrative zones where no local administration is organized, and other reports as prescribed by law and resolutions of the Provincial People's Council during the period between two sessions of the Provincial People's Council, as assigned by the Provincial People's Council;

b) Review normative legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Normative Legal Documents and normative legal documents of the People's Committee of special administrative zones where no local administration is organized that appear to be contrary to the Constitution, normative legal documents of higher-level state agencies, and resolutions of the Provincial People's Council when discovered independently or upon request of the People's Committee, Vietnam Fatherland Front Committee at the same level, National Assembly deputies, or suggestions of Committees of the People's Council, and deputies of the People's Council at the same level;

c) Reviewing responses to interpellations of those questioned as stipulated in Point a, Clause 1, Article 36 of this Law;

d) Organize explanatory sessions at meetings of the Standing Committee of the People's Council to require members of the People's Committee, Chief Judge of the People's Court, Procurator of the People's Procuracy, Director of the civil enforcement agency at the provincial level, Chief Judge of the People's Court, Procurator of the People's Procuracy in the region, and Chairman of the People's Committee of special administrative zones where no local administration is organized to provide explanations and for relevant individuals to participate in explaining issues of concern to the Standing Committee of the Provincial People's Council.

3. The Standing Committee of the Commune People's Council shall carry out the supervisory activities stipulated in Clause 1 of this Article and the following additional supervisory activities:

a) Review reports on the work of the Commune People's Committee and other reports as prescribed by law and resolutions of the Commune People's Council during the period between two sessions of the Commune People's Council, as assigned by the Commune People's Council;

b) Review normative legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Normative Legal Documents that appear to be contrary to the Constitution, normative legal documents of higher-level state agencies, and resolutions of the Commune People's Council when discovered independently or upon request of the Commune People's Committee, Vietnam Fatherland Front Committee at the same level, National Assembly deputies, or suggestions of Committees of the People's Council, and deputies of the People's Council at the same level;

c) Reviewing responses to interpellations of those questioned as stipulated in Point a, Clause 2, Article 36 of this Law;

d) Organize explanatory sessions at meetings of the Standing Committee of the People's Council to require members of the Commune People's Committee to provide explanations and for relevant individuals to participate in explaining issues of concern to the Standing Committee of the Commune People's Council.

4. The Standing Committee of the People's Council shall decide and organize the implementation of its annual supervision program; assign Committees of the People's Council and Delegation Groups of the People's Council to implement certain contents within the supervision program and report the results to the Standing Committee of the People's Council; in cases deemed necessary due to practical requirements, decide to adjust the supervision program.

Article 32. The authority of the Standing Committee of the People's Council in reviewing the results of supervision

1. To recommend local agencies and individuals with authority to amend, supplement, replace, suspend the effect, terminate the implementation, revoke partially or entirely normative legal documents that contravene the Constitution, normative legal documents of higher-level state agencies, resolutions of the same-level People's Council. Agencies and individuals with authority receiving such recommendations shall be responsible for considering and replying within thirty days from the date of receipt of the recommendation.

2. To recommend local agencies, organizations, and individuals with authority to resolve issues related to the implementation of policies and laws. Agencies, organizations, and individuals with authority receiving such recommendations shall be responsible for considering and replying within fifteen days from the date of receipt of the recommendation; in cases of force majeure or complex contents, the deadline may be extended but not exceeding thirty days.

3. The Standing Committee of the Provincial People's Council recommends the Provincial People's Council to relieve, dismiss the Chairman, Vice Chairmen, Heads of Committees of the People's Council, Chairmen, Vice Chairmen of the People's Committee, and members of the Provincial People's Committee; recommends the People's Council to relieve, dismiss People's Court judges according to the provisions of the law; requests agencies and individuals with authority to handle according to the provisions of the law regarding the Chairman, Vice Chairmen of the People's Committee of special zones where there is no local administrative level and related individuals.

The Standing Committee of the Commune People's Council recommends the Commune People's Council to relieve, dismiss the Chairman, Vice Chairmen, Heads of Committees of the People's Council, Chairmen, Vice Chairmen of the People's Committee, and members of the Commune People's Committee.

4. The Standing Committee of the Provincial People's Council recommends the Provincial People's Council to dissolve the Commune People's Council in cases where it causes serious damage to the interests of the people.

5. To recommend central agencies, organizations, and individuals with authority to amend, supplement, replace, suspend the effect, terminate the implementation, revoke partially or entirely normative legal documents that contravene the Constitution, normative legal documents of higher-level state agencies; to resolve issues within their authority related to the implementation of policies and laws at the local level. Agencies, organizations, and individuals with authority receiving such recommendations shall be responsible for considering and replying within thirty days from the date of receipt of the recommendation.

Proposing central agencies, organizations, and individuals with authority to promulgate detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

The Standing Committee of the Provincial People's Council reviews and compiles its own recommendations, recommendations of Committees of the People's Council, and representatives of the Provincial People's Council, recommendations of the People's Council, Standing Committee of the People's Council, Committees of the People's Council, and representatives of the Commune People's Council to send to central agencies, organizations, and individuals with authority, while sending to the Provincial People's Council for reporting and sending to the National Ethnic Council and the Committee of the National Assembly under their respective areas of responsibility for coordination in monitoring and urging the resolution of issues by agencies, organizations, and individuals with authority. The Standing Committee of the Commune People's Council reviews and compiles its own recommendations and recommendations of Committees of the People's Council and representatives of the Commune People's Council to send to the Commune People's Council for reporting and sending to the Standing Committee of the Provincial People's Council.

6. To decide on other matters within the authority of the Standing Committee of the People's Council.

Section 3

SUPERVISION BY COMMITTEES OF THE PEOPLE'S COUNCIL

Article 33. Supervisory Authority of Committees of People's Councils

1. Within their tasks and powers, Committees of Provincial People's Councils supervise the activities of the People's Committee and its subordinate agencies, People's Committees of special administrative regions where no local administration is organized, People's Courts, People's Procuracy, civil enforcement agencies, and other local agencies in their compliance with the Constitution, laws, and implementation of resolutions of the Provincial People's Council; supervise regulatory legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Regulatory Legal Documents and regulatory legal documents of People's Committees of special administrative regions where no local administration is organized; assist the Provincial People's Council and its Standing Body to organize supervision when assigned by the Provincial People's Council and its Standing Body.

In cases deemed necessary due to practical requirements, Committees of Provincial People's Councils may conduct supervision over the activities of agencies, organizations, and individuals at the commune level in their compliance with the Constitution and laws.

2. Within their tasks and powers, Committees of Commune-level People's Councils supervise the activities of the Commune People's Committee, its subordinate agencies, and other local agencies in their compliance with the Constitution, laws, and implementation of resolutions of the Commune People's Council; supervise regulatory legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Regulatory Legal Documents; assist the Commune People's Council and its Standing Body to organize supervision when assigned by the Commune People's Council and its Standing Body.

Article 34. Supervisory Activities of Committees of People's Councils

1. Committees of People's Councils carry out the following supervisory activities:

a) Organizing a Supervision Team to conduct specialized supervision and review the results of the Supervision Team's work;

b) Supervising the handling of complaints, denunciations, suggestions, and reflections from agencies, organizations, and individuals;

c) Supervise the handling and response to citizens' petitions according to the assignment of the Standing Body of the same-level People's Council.

2. Committees of Provincial People's Councils carry out the supervisory activities stipulated in Clause 1 of this Article and the following supervisory activities:

a) Review reports on the work of the People's Committee, People's Court, People's Procuracy, civil enforcement agency at the provincial level, People's Committees of special administrative regions where no local administration is organized, and other reports as prescribed by law and resolutions of the Provincial People's Council within the Committee's area of responsibility or as assigned by the Standing Body of the Provincial People's Council;

b) Supervise regulatory legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Regulatory Legal Documents and regulatory legal documents of People's Committees of special administrative regions where no local administration is organized.

3. Committees of Commune-level People's Councils carry out the supervisory activities stipulated in Clause 1 of this Article and the following supervisory activities:

a) Review reports on the work of the Commune People's Committee and other reports as prescribed by law and resolutions of the Commune People's Council within the Committee's area of responsibility or as assigned by the Standing Body of the Commune People's Council;

b) Supervise regulatory legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Regulatory Legal Documents.

4. Committees of People's Councils decide and organize the implementation of their annual supervision program; in cases deemed necessary due to practical requirements, they may adjust the supervision program. Committees of People's Councils have the responsibility to report to the Standing Body of the People's Council about their supervision program.

Article 35. The Authority of Committees of People's Councils in Examining Supervision Results

1. To recommend local authorities with jurisdiction to amend, supplement, replace, suspend the effect, cease implementation, revoke partially or entirely normative legal documents that appear to be contrary to the Constitution, normative legal documents of higher-level state agencies, and resolutions of the same-level People's Council. The authority receiving the recommendation shall be responsible for reviewing and replying within thirty days from the date of receipt of the recommendation.

2. To recommend local authorities with jurisdiction to resolve issues related to the implementation of policies, laws under the Committee's responsibility. The authority receiving the recommendation shall be responsible for reviewing and replying within fifteen days from the date of receipt of the recommendation; in cases of force majeure or complex contents, the deadline may be extended but not exceeding thirty days.

3. Proposing central agencies, organizations, and individuals with authority to amend, supplement, replace, suspend the effectiveness, cease enforcement, or abolish part or all of normative legal documents that contravene the Constitution or normative legal documents of higher-level state agencies; resolving issues within their authority related to the implementation of policies, laws, and regulations at the local level. Agencies, organizations, and individuals with authority receiving the proposal have the responsibility to examine and respond within thirty days from the date of receipt of the proposal.

Proposing central agencies, organizations, and individuals with authority to promulgate detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

The Committee of the provincial People's Council sends recommendations to the Standing Body of the provincial People's Council. The Committee of the commune-level People's Council sends recommendations to the Standing Body of the commune-level People's Council for examination and consolidation to send to the Standing Body of the provincial People's Council.

4. To decide on other matters within the Committee's authority.

Section 4

SUPERVISION BY PEOPLE'S COUNCIL DELEGATES AND DELEGATION OF PEOPLE'S COUNCIL DELEGATES

Article 36. The Authority and Supervisory Activities of People's Council Delegates

1. Provincial-level People's Council delegates have the authority and carry out the following supervisory activities:

a) Questioning the Chairman of the People's Committee, other members of the People's Committee, heads of agencies under the People's Committee, Chief Justice of the People's Court, and Procurator of the People's Procuracy at the provincial level;

b) Supervising normative legal documents stipulated in Clauses 11, 12, and 14 of Article 4 of the Law on Enacting Normative Legal Documents and normative legal documents of the People's Committee in special administrative zones where there is no local administration;

c) Supervising the enforcement of laws at the local level;

d) Supervising the handling of complaints, petitions, recommendations, and reflections by agencies, organizations, and individuals under the jurisdiction of local agencies, organizations, and individuals;

đ) Participating in the supervision activities of the People's Council, the Standing Body of the People's Council, the Committee of the People's Council, and the Delegation of People's Council Delegates at the provincial level, and the Local Delegation of National Assembly Members when requested or proposed.

2. Commune-level People's Council delegates have the authority and carry out the following supervisory activities:

a) Questioning the Chairman of the People's Committee, other members of the People's Committee, and heads of agencies under the commune-level People's Committee;

b) Supervising normative legal documents stipulated in Clause 15 of Article 4 of the Law on Enacting Normative Legal Documents;

c) Supervising the enforcement of laws at the local level;

d) Supervising the handling of complaints, petitions, recommendations, and reflections by agencies, organizations, and individuals under the jurisdiction of local agencies, organizations, and individuals;

đ) Participating in the supervision activities of the People's Council, the Standing Body of the People's Council, the Committee of the People's Council, and the Delegation of People's Council Delegates at the commune level when requested or proposed.

3. People's Council delegates decide and organize the implementation of their own supervision program (if any); if necessary due to practical requirements, they decide to adjust the supervision program. People's Council delegates are responsible for reporting to the Standing Body of the People's Council through the Delegation of People's Council Delegates about their own supervision program (if any).

The Standing Body of the People's Council is responsible for organizing for People's Council delegates to carry out supervision.

Article 37. Oversight Activities of the Delegation of People's Council Members

The delegation of People's Council members shall oversee the implementation of laws at the local level when assigned by the People's Council or the Standing Committee of the People's Council at the same level; report the results of oversight for the People's Council and the Standing Committee of the People's Council to consider and decide.

Article 38. Authority of People's Council Members in Reviewing Oversight Results

1. To recommend local authorities with jurisdiction to amend, supplement, replace, suspend the effect, cease implementation, revoke partially or entirely normative legal documents that appear to be contrary to the Constitution, normative legal documents of higher-level state agencies, and resolutions of the same-level People's Council. The authority receiving the recommendation shall be responsible for reviewing and replying within thirty days from the date of receipt of the recommendation.

2. Propose relevant agencies, organizations, or individuals with authority at the local level to examine and resolve issues related to the implementation of policies, strategies, and laws. Agencies, organizations, or individuals with authority receiving such proposals shall be responsible for examining and responding within fifteen days from the date of receipt; in cases of force majeure or complex matters, the deadline may be extended but not exceeding thirty days.

3. Propose the Standing Committee of the People's Council to review and submit to the People's Council for a vote of confidence regarding individuals holding positions elected by the People's Council according to the National Assembly's regulations on votes of confidence.

4. Propose relevant agencies, organizations, or individuals with authority at the central level to amend, supplement, replace, suspend the effectiveness, cease enforcement, or abolish part or all of normative legal documents that contravene the Constitution, normative legal documents of higher-level state agencies; resolve issues within their authority related to the implementation of policies, strategies, and laws at the local level. Agencies, organizations, or individuals with authority receiving such proposals shall be responsible for examining and responding within thirty days from the date of receipt.

Proposing central agencies, organizations, and individuals with authority to promulgate detailed regulations for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

Provincial-level People's Council members send proposals to the Standing Committee of the provincial-level People's Council. Commune-level People's Council members send proposals to the Standing Committee of the commune-level People's Council for consideration and consolidation to be submitted to the Standing Committee of the provincial-level People's Council.

Chapter IV

ENSURING OVERSIGHT ACTIVITIES

Article 39. Directing, Coordinating, and Cooperating in Oversight Activities

1. Authority of the Standing Committee of the National Assembly in directing, coordinating, and cooperating in oversight activities:

a) Adjust the planned highest-level oversight activities during the sessions of the National Assembly in a year, report to the National Assembly for consideration and decision when building specific oversight programs for each session; proactively adjust the Standing Committee of the National Assembly's oversight activities in a year;

b) Assign the Ethnic Council and Committees of the National Assembly to review reports; assign the Ethnic Council, Committees of the National Assembly, and Delegations of National Assembly representatives to implement certain contents in the National Assembly's and the Standing Committee of the National Assembly's oversight programs;

c) Require the Ethnic Council, Committees of the National Assembly, and Delegations of National Assembly representatives to adjust their programs, plans, and coordinate in implementing oversight activities to avoid overlap and ensure effective oversight.

2. Authority of the Standing Committee of the People's Council in directing, coordinating, and cooperating in oversight activities:

a) Adjust the planned oversight activities during the sessions of the People's Council in a year, report to the People's Council for consideration and decision when building specific oversight programs for each session; proactively adjust the Standing Committee of the People's Council's oversight activities in a year;

b) Assign Committees of the People's Council to review reports; assign Committees of the People's Council and Delegations of People's Council members to implement certain contents in the People's Council's and the Standing Committee of the People's Council's oversight programs;

c) The Standing Committee of the provincial-level People's Council requires Committees of the People's Council, Delegations of provincial-level People's Council members, and the Standing Committee of the commune-level People's Council to adjust their programs, plans, and coordinate in implementing oversight activities to avoid overlap and ensure effective oversight.

Article 40. Ensuring the Implementation of Resolutions, Conclusions, and Supervisory Recommendations

Clause 1. The resolutions of the National Assembly, the Standing Committee of the National Assembly, and the People's Councils have mandatory legal force for implementation.

The conclusions and recommendations of supervision by the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, the National Assembly deputies, the Standing Body of the People's Councils, the Committees of the People's Councils, and the People's Council deputies must be strictly implemented by the agencies, organizations, and individuals subject to supervision and those related agencies, organizations, and individuals.

Clause 2. In cases where there is disagreement with the conclusions or recommendations of supervision, the agencies, organizations, and individuals subject to supervision may request the supervisory body to reconsider the relevant conclusions or recommendations concerning their activities. Within fifteen days from the date of receipt of the request, the supervisory body has the responsibility to review and respond; in cases of force majeure or complex issues, the deadline may be extended but not exceeding thirty days. If they do not agree with the response result of the supervisory body, the agencies, organizations, and individuals subject to supervision may themselves or report to the head of the competent agency or organization to request the National Assembly, the Standing Committee of the National Assembly, or the People's Council to reconsider the conclusions or recommendations of supervision.

Clause 3. The Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, the National Assembly deputies, the Standing Body of the People's Councils, the Committees of the People's Councils, and the People's Council deputies have the responsibility to regularly monitor, urge, and review the implementation of resolutions, conclusions, and recommendations of supervision; if the agencies, organizations, and individuals subject to supervision fail to implement or implement incorrectly the resolutions, conclusions, or recommendations of supervision, they shall require such agencies, organizations, and individuals to report and explain. The agencies, organizations, and individuals responsible for explaining must do so within fifteen days from the date of receipt of the request; in cases of force majeure or complex issues, the deadline may be extended but not exceeding thirty days. Beyond this deadline, if no response is received or if they do not agree with the explanation content of the agencies, organizations, and individuals subject to supervision, they shall decide on handling according to their authority or propose to the competent agencies, organizations, and individuals to handle according to the provisions of this Law and other relevant laws.

Article 41. Ensuring Material Bases and Financial Resources for Supervisory Activities

Clause 1. The financial resources serving the supervisory activities of the National Assembly and the People's Councils are guaranteed by the state budget according to the provisions of the State Budget Law.

Clause 2. The State ensures the resources for investment in material bases, modernization of technical infrastructure, working equipment, databases on supervisory activities, application of technology, and digital transformation to serve the supervisory activities of the National Assembly and the People's Councils according to the provisions of the State Budget Law, the Public Investment Law, and other relevant laws.

Article 42. Ensuring Human Resources for Supervisory Activities

Clause 1. Within the scope of their tasks and powers, the Office of the National Assembly, the specialized departments of the Ethnic Council, the Committees of the National Assembly, the Offices of the Delegations of the National Assembly and the Provincial People's Councils, and the Offices of the People's Councils and Commune People's Committees have the responsibility to organize services for the supervisory activities of the National Assembly and the People's Councils.

Clause 2. Within the scope of their tasks and powers, the relevant agencies, organizations, and individuals have the responsibility to meet the requirements for serving supervisory activities and create favorable conditions for the supervisory activities of the National Assembly and the People's Councils.

Clause 3. The State has mechanisms and policies to mobilize experts to participate in the supervisory activities of the National Assembly and the People's Councils; train, enhance, and improve the supervisory capacity and skills of National Assembly deputies and People's Council deputies; train, enhance, and improve the professional qualifications and expertise of the staff and civil servants involved in advising and serving supervisory activities.

Article 43. Application of technology and digital transformation in oversight activities

1. The National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, the National Assembly deputies, the People's Councils, the Standing Bodies of the People's Councils, the Committees of the People's Councils, the Delegation Groups of the People's Councils, and the People's Council deputies shall be responsible for applying technology and accelerating digital transformation in their oversight activities; ensuring interoperability and data sharing among oversight subjects, agencies, organizations, and individuals involved.

2. Within their respective duties and powers, the inspection agencies, auditing bodies, and other authorized agencies, organizations, and individuals shall be responsible for strengthening the application of technology and accelerating digital transformation to share common data, facilitating access by oversight subjects to information and documents on inspection and auditing activities and other related information to support oversight activities.

Chapter V

IMPLEMENTING PROVISIONS

Article 44. Effective date of implementation

1. This Law shall take effect from March 1, 2026.

2. The Law on Oversight Activities of the National Assembly and People's Councils No. 87/2015/QH13 shall cease to be effective from the date this Law takes effect, except for the provisions set out in Clause 2 of Article 45 of this Law.

3. The Standing Committee of the National Assembly shall provide detailed regulations and guidance on the implementation of Articles 9, 12, 14, 17, 20, 22, 23, 25, 27, 28, 30, 31, 33, 34, 36, 37, 39, 40, 41, and 42 of this Law.

Article 45. Transitional Provisions

1. For oversight activities that have been decided upon before the effective date of this Law but will commence implementation from March 1, 2026, the provisions of this Law shall apply.

2. For oversight activities that are being implemented before the effective date of this Law, the provisions of Law No. 87/2015/QH13 shall continue to apply.

This Law was passed by the National Assembly of the Socialist Republic of Vietnam, the 10th Session of the 15th Term, on December 10, 2025.
