ON THE FUNCTIONS, DUTIES AND ORGANIZATION OF THE INVESTMENT PREPARATION BOARD FOR HYDROLOGY PROJECTS
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, duties, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Investment Management Regulations issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 and Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain articles of the Investment Management Regulations issued together with Decree No. 52/1999/NĐ-CP;
Considering the proposal of the Director of the Basic Construction Investment Department and the Director of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1.- The Investment Preparation Board for Hydrology Projects, abbreviated as the Investment Preparation Board for Hydrology, established pursuant to Decision No. 63-QĐ/TCCB dated February 4, 1985 of the Minister of Water Resources, is an agency under the Ministry of Agriculture and Rural Development, tasked with directly managing and utilizing state capital to organize the implementation of the investment preparation phase for hydrology projects managed by the Ministry until the project is approved.
Article 2.- The Investment Preparation Board for Hydrology has the main tasks as follows:
1/- Based on the long-term plan orientation of the Ministry and the approved (or approved in principle) water resources planning, propose the investment preparation plan for hydrology projects funded by the Ministry (and other sources if any) to be compiled, balanced within the overall plan of the Ministry.
2/- Based on the plan assigned by the Ministry, organize bidding or selection of consultants to prepare investment projects; sign contracts for preparing projects (pre-feasibility study reports, feasibility study reports) with consulting organizations that have legal personality and have been selected, to implement the work of preparing investment projects.
3/- Monitor the process of preparing pre-feasibility study reports, feasibility study reports, receive files, conduct internal acceptance, organize research, compare and select options, unify with consulting organizations to submit to the Ministry for examination and approval.
4/- After receiving the investment decision of the project, transfer files and hand over the site to the Project Management Board to implement the investment according to the decision of the Ministry.
Manage project files that have not yet been approved or do not have an investment implementation plan for exploitation and use when required.
5/- Manage the allocated investment preparation capital according to its purpose, plan, and state financial regulations.
Acceptance, liquidation of contracts, settlement and final accounting of investment preparation capital for each project with the project preparation units and funding agencies.
6/- Implement reporting, statistical, economic information, and summarization of experiences in investment preparation work, propose to the Ministry regulations on investment preparation work.
7/- Manage cadres, civil servants, and assets of the Board in accordance with state regulations and those of the Ministry.
Article 3.- The Investment Preparation Board for Hydrology is an economic public service unit, having legal personality, its own bank account and seal, and is able to directly receive investment preparation capital from funding agencies to pay to the project preparation units according to state regulations.
The operating costs of the Investment Preparation Board for Hydrology are based on the budget approved by the Ministry, taken from the investment preparation fund, and allocated to each project according to state regulations.
Cadres and civil servants of the Investment Preparation Board for Hydrology are classified and paid salaries according to Decision No. 198/1999/QĐ-TTg dated September 30, 1999 of the Prime Minister.
The Investment Preparation Board for Hydrology operates under a directorate system directly with specialists and staff.
The Director of the Investment Preparation Board for Hydrology promulgates operational rules and arranges staff according to their authority.
Article 4.- THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
Previous regulations concerning the functions, duties, and organization of the Investment Preparation Board for Hydrology that conflict with this decision are abolished.
Relevant functional agencies of the Ministry assist the Ministry in managing, guiding, and inspecting the activities of the Investment Preparation Board for Hydrology according to their functions.
The Head of the Ministry's Office, the Director of the Cadre and Civil Servant Organization Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Investment Preparation Board for Hydrology are responsible for implementing this decision./.
