THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
On the basis of Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
On the basis of Decree No. 48/2008/ND-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to the proposal of the Director of the Public Administration Reform Department and the Director of the Cadre and Civil Servant Organization Department;
DECISION:
Article 1. Position and Function
The Public Administration Reform Department is an organization under the Ministry of Home Affairs, with the function of advising the Minister on state management of public administration reform work and performing the standing tasks of public administration reform for the Government.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. To perform the following tasks to assist the Minister:
a. Drafting normative legal documents in the field of public administration reform according to the division of labor assigned by the Government for submission to the competent authority for issuance.
b. Drafting programs, plans, and general projects on public administration reform for each period according to the division of labor assigned by the Government for submission to the Government.
c. Studying and proposing policies and solutions to promote public administration reform for submission to the Government and the Prime Minister for decision.
d. Reviewing pilot projects on public administration reform proposed by Ministries, ministerial-level agencies, government agencies, and provincial and municipal people's committees directly under the central government for submission to the Prime Minister.
e. Directing, guiding, and inspecting the implementation of normative legal documents, projects, programs, and plans on public administration reform issued by the Government.
g. Preparing monthly, quarterly, and annual reports on public administration reform work for submission to the Government meetings.
h. Summarizing and concluding the implementation of public administration reform tasks by Ministries, ministerial-level agencies, government agencies, and provincial and municipal people's committees directly under the central government.
i. Guiding, monitoring, urging, and inspecting Ministries, ministerial-level agencies, government agencies, and provincial and municipal people's committees directly under the central government in building and implementing public administration reform plans, and implementing public administration reform at the ministry, sector, and local levels.
2. To monitor the implementation of Decision No. 93/TTg dated June 22, 2007 of the Prime Minister promulgating the Mechanism for One-Stop Service and Interconnected One-Stop Service Mechanism at local administrative agencies.
3. To coordinate with relevant agencies and organizations to disseminate information about public administration reform.
4. To take the lead and coordinate with related units to organize training, research, and surveys domestically and internationally on public administration reform.
5. To coordinate with units within the Ministry in drafting, providing comments on proposals, normative legal documents, and resolving issues related to the functions and tasks of the Department.
6. To provide professional guidance in the field of public administration reform to the Cadre and Civil Servant Organization Departments of Ministries, ministerial-level agencies, government agencies, and provincial and municipal people's committees directly under the central government.
7. To take the lead or coordinate in handling complaints and appeals related to public administration reform work according to the instructions of the Minister.
8. To implement statistical and summary work on public administration reform and coordinate with the Information Center to apply information technology in management, exploitation, and utilization to serve leadership and management by the Ministry regarding public administration reform work.
9. To take the lead or participate in researching scientific topics in the field of public administration reform.
10. Performing other tasks assigned by the Minister.
Article 3. Organization and working regime of the Department
1. The Department shall have a Director, several Deputy Directors, and other cadres and civil servants.
2. The Director is responsible to the Minister for organizing and implementing the tasks specified in Article 2 and the specific duties and powers as follows:
a. Organizing and directing the implementation of the Department's tasks and being responsible before the Minister for all aspects of the Department's work;
b. Assigning tasks, monitoring, urging, and inspecting the implementation of tasks by Deputy Directors and cadres and civil servants in the Department;
c. Signing on behalf of the Minister to respond, clarify, guide, and request the provision of information from organizations with functions and tasks related to managing public administration reform work of state agencies or individuals concerning matters related to public administration reform;
d. Implementing information dissemination for cadres and civil servants in the Department according to the Ministry's Working Regulations;
e. Deciding on the contents of interim and final reports, and making recommendations to the Minister on policies and solutions in implementing the Department's tasks;
g. Implementing the regulations of the Ministry; managing cadres, civil servants, and assets allocated according to the Ministry's classification.
3. Deputy Directors shall perform their professional duties and assist the Director in managing one or more areas of work as assigned by the Director; they are responsible to the Director for the tasks assigned to them.
4. Cadres and civil servants shall perform their professional duties as assigned by the Director and be responsible to the Director for the performance of those tasks.
5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership works directly with Deputy Directors or specialists, Deputy Directors and specialists shall execute the leadership's opinions and promptly report back to the Director.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature and replaces Decision No. 59/2003/QD-BNV dated September 24, 2003 of the Minister of Home Affairs stipulating the functions, tasks, powers, and organizational structure of the Public Administration Reform Department.
2. The Head of the Ministry's Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Public Administration Reform Department, heads of organizations and civil servants related to the Ministry shall be responsible for implementing this Decision immediately./.
