THE MINISTER OF CONSTRUCTION

Pursuant to Law No. 38/2009/QH12 dated June 19, 2009 of the National Assembly amending and supplementing certain articles of laws related to construction investment;

Pursuant to Decree No. 83/2009/ND-CP dated October 15, 2009 of the Government on amending and supplementing certain articles of Decree No. 12/2009/ND-CP dated February 12, 2009 of the Government on project management for construction investment;

Pursuant to Decree No. 17/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decision No. 30/QD-TTg dated January 10, 2007 of the Prime Minister approving the Project on Simplifying Administrative Procedures in State Management Fields for the period 2007-2010;

Pursuant to Decision No. 07/QD-TTg dated January 4, 2008 of the Prime Minister approving the Implementation Plan for the Project on Simplifying Administrative Procedures in State Management Fields for the period 2007-2010;

Pursuant to Decision No. 838/QD-BXD dated August 12, 2009 of the Ministry of Construction on announcing the set of administrative procedures within the scope of management functions of the Ministry of Construction;

Considering the proposal of the Head of the Task Force implementing Project 30 of the Ministry of Construction,

Pursuant to …;:

Article 1. Announce the amendment and supplementation of some administrative procedures that have been announced in Decision No. 838/QD-BXD dated August 12, 2009 within the scope of state management functions of the Ministry of Construction as follows:

1) Amend and supplement the name and content in the dossier components for the provincial-level administrative procedure on Issuing Construction Permits for special-class, class I construction projects, religious construction projects, historical and cultural heritage construction projects; monument, advertisement, grand painting, and other construction projects on main urban streets; construction projects under foreign direct investment projects; construction projects under projects and other construction projects as specified by the People's Committee at the provincial level.

2) Amend and supplement the name and content in the dossier components for the district-level administrative procedure on Issuing Construction Permits for construction projects from class II downwards for individual houses in urban areas (excluding construction projects within the jurisdiction of the People's Committee at the provincial level).

3) Repeal requirement/condition 4 and amend and supplement requirements/conditions 1, 3, and 5 of the following administrative procedures:

- Central-level administrative procedure, file number TTHC: B-BXD-050240-TT on Amending Investment Projects for Construction Projects decided by the Prime Minister;

- Provincial-level administrative procedure, file number TTHC: B-BXD-050247-TT on Amending Investment Projects for Construction Projects decided by the Chairman of the People's Committee at the provincial level;

- District-level administrative procedure, file number TTHC: B-BXD-050249-TT on Amending Investment Projects for Construction Projects decided by the Chairman of the People's Committee at the district level;

- Commune-level administrative procedure, file number TTHC: B-BXD-050260-TT on Amending Investment Projects for Construction Projects decided by the Chairman of the People's Committee at the commune level.

Article 2. Entrust the Task Force implementing Project 30 to take the lead and coordinate with the Department of Construction Activity Management and the Information Center to revise the amended and supplemented contents in the set of announced administrative procedures.

Article 3. The Director of the Office of the Ministry, the Task Force implementing Project 30, the Head of the Legal Affairs Department, Heads of units and individuals concerned shall be responsible for implementing this Decision. This Decision takes effect from the date of signature./.
