PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Cultural Heritage dated June 29, 2001;
Considering the proposal of the Ministry of National Defense (report No. 795/TTr-BQP dated February 12, 2007) and the opinion of the Ministry of Planning and Investment (letter No. 6048/BKH-QPAN dated August 16, 2006) regarding the approval of the overall planning and detailed planning for the conservation, restoration, enhancement, and promotion of the historical value of the Ho Chi Minh Trail - Eastern Truong Son,
DECISION:
Article 1. Approves the overall planning for the conservation, restoration, enhancement, and promotion of the historical value of the Ho Chi Minh Trail - Eastern Truong Son.
1. Name of the Plan:
Overall planning for the conservation, restoration, enhancement, and promotion of the historical value of the Ho Chi Minh Trail - Eastern Truong Son; planning at a scale of 1/500 for the management and control area and some key relics in Quang Binh Province.
2. Objectives:
a) Systematically conserve all historical relics of the Ho Chi Minh Trail - Eastern Truong Son.
b) Propose the number and scale of key relic clusters as a basis for establishing component projects and recommending appropriate classification levels for relics systematically.
c) Determine the scale and priority order for establishing component projects.
d) Manage and direct construction according to a unified plan.
đ) Construct a management area serving cultural tourism, combined with eco-tourism; preserve the pride of the heroic national tradition across generations and contribute to promoting tourism development and socio-economic development in the process of building a prosperous nation.
3. Scope of Planning and Zoning:
a) Overall planning: scope of 271.44 hectares. Includes 7 clusters and some individual relics:
Relics from Tan Ky (Nghe An) to Loc Ninh (Binh Phuoc), including:
- Cluster 1: Lac Thien - Dong Loc - Huong Do relics in Ha Tinh Province;
- Cluster 2: Route 12, Route 20, Route 16 relics in Quang Binh Province (border crossing cluster);
- Cluster 3: Ho Chi Minh Trail relics in Quang Tri Province;
- Cluster 4: A Luoi relics in Thua Thien Hue Province;
- Cluster 5: Kham Duc relics in Quang Nam Province;
- Cluster 6: Western Highlands relics in Kon Tum, Gia Lai, Dak Lak, and Dak Nong Provinces (Border Junction Cluster);
- Cluster 7: Loc Ninh relics in Binh Phuoc Province;
- Some individual relics in Nghe An Province.
b) Management and control area and some key relics in Quang Binh Province:
- Preservation area covering 73.34 hectares including: the Xuan Son ferry area and a section of Route 15; Nguyen Van Troi floating bridge area (Ferry B); Information Cave; warehouse cave, NH cave; Trang Ang key point; Ba Tang Pass; Command Post of the 559 General Staff at Co Gianh - Cu Num; Hoa Thanh - Hoa Tien area; Command Post of the Truong Son General Staff in 1973 at Hien Ninh;
- Development area for infrastructure to enhance cultural and historical value covering 30.8 hectares including: management control area; green space; parking lot; service area; camping area; reminiscence and activity area for soldiers and volunteers; traffic land.
Construction location: Km 15 Route 20 Quyet Thang, Quang Binh Province.
4. Component Projects:
a) Project No. 1: project to complete the dossier for relic classification.
b) Project No. 2: project to invest in constructing a complete system of monuments for national historical sites along the Ho Chi Minh Trail.
c) Project No. 3: investment project for Cluster 1 (Lac Thien - Dong Loc - Huong Do relics in Ha Tinh Province).
d) Project No. 4: project to invest in conserving, restoring, and enhancing some key relics in Quang Binh Province (Cluster 2 relics within Quang Binh Province).
đ) Project No. 5: project to invest in the management and control area, enhancing the value of Ho Chi Minh Trail historical relics in Quang Binh Province.
e) Project No. 6: project to invest in the remaining relics of Cluster 2 (relics within Quang Binh Province).
g) Project No. 7: project to invest in Cluster 3 (Ho Chi Minh Trail relics in Quang Tri Province).
h) Project No. 8: project to invest in Cluster 4 (A Luoi relics in Thua Thien Hue Province).
i) Project No. 9: project to invest in Cluster 5 (Kham Duc relics in Quang Nam Province).
k) Project No. 10: project to invest in Cluster 6 (Western Highlands relics in Kon Tum, Gia Lai, Dak Lak, and Dak Nong Provinces).
l) Project No. 11: project to invest in Cluster 7 (Loc Ninh relics in Binh Phuoc Province).
m) Project No. 12: project to invest in some relics in Nghe An Province.
5. Conservation Objectives: The main focus of the conservation plan is "clusters of relics along the Ho Chi Minh Trail - Eastern Truong Son," including the route, structures, landscapes, transportation, military hospitals, and anti-aircraft artillery positions, etc.
6. Sources of Investment Funds:
a) Central government budget funds (not included in the annual regular budget allocation for cultural works of the Ministry of National Defense).
b) Funds from the national target program on culture.
c) Local government budget funds.
d) Other legitimate sources of funding.
7. Priority Order for Investment:
a) Group of projects concentratedly invested using central government budget funds and funds from the national target program on culture: including four component projects:
- Project No. 1: completing the dossier for relic classification;
- Project No. 2: investing in constructing a complete system of monuments for national historical sites along the Ho Chi Minh Trail - Eastern Truong Son;
- Project No. 4: project to invest in conserving, restoring, and enhancing some key relics in Quang Binh Province;
- Project No. 5: management and control area, enhancing the value of Ho Chi Minh Trail historical relics in Quang Binh Province);
- Implementation period: from 2007 to 2012.
b) Group of projects invested based on the ability to mobilize various sources of funds: state, local government budgets, and other legitimate sources of funding for component projects No. 3, 6, 7, 8, 9, 10, 11, 12 (project names listed in Section 4);
- Implementation period: from 2008 to 2014.
Article 2. Implementation organization:
1. The Ministry of National Defense is responsible for leading and coordinating with the Ministry of Culture, Sports and Tourism and relevant agencies and localities to implement tasks:
a) Select and assign tasks to the project owner to prepare, organize reviews, decide on investments, and implement the component projects No. 2, 4, and 5 as prescribed.
b) Coordinate with localities to implement project number 1; continue researching and collecting materials to determine and supplement scientific basis documents to clarify more the ranking of relics, delineate areas for relic protection, and accurately assess the value of relics and related works.
2. The People's Committee of Quang Binh Province shall coordinate with the Ministry of National Defense to announce the master plan, proceed with marking boundary stakes, relocate works within the relic area, transfer land for the implementation of projects number 2, 4, and 5; upon completion of construction projects, accept, manage, and effectively utilize them. At the same time, establish supplementary files for relic rankings that are still lacking, develop component project number 6, organize reviews, approve, and implement according to state regulations.
3. The People's Committees of the provinces of Nghe An, Ha Tinh, Quang Tri, Thua Thien Hue, Quang Nam, Kon Tum, Gia Lai, Dak Lak, Dak Nong, and Binh Phuoc, after the overall planning approval, the localities with relics shall establish supplementary files for relic rankings that are still lacking based on the ability of available capital sources to develop investment projects, organize reviews, approve, and implement.
4. The Ministry of Culture, Sports and Tourism shall direct localities with relics to establish supplementary files for relic rankings that are still lacking, be responsible for reviewing the technical aspects of component projects, monitor and supervise the implementation of the master plan to ensure compliance with set objectives. Consider allocating funds from the national target program on culture for the project according to approved content.
5. The Ministry of Planning and Investment and the Ministry of Finance, within their respective functions and responsibilities, shall consider and balance the portion of state budget funds to implement approved investment projects within this master plan.
6. The Vietnam National Administration of Tourism shall take the lead and coordinate with relevant ministries, sectors, and localities to connect tourism routes nationwide and promote the value of the historical relic site along the Ho Chi Minh Trail - Eastern Truong Son.
7. Relevant ministries and sectors shall have the responsibility to coordinate, monitor, and create favorable conditions to assist in the implementation of the master plan to ensure its compatibility with sectoral plans within the scope of the historical relic site of the Ho Chi Minh Trail - Eastern Truong Son.
Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette.
The Ministers of the Ministries of Planning and Investment, Finance, Culture, Sports and Tourism, National Defense, Construction, Transportation; the Chairpersons of the People's Committees of the provinces of Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, Kon Tum, Gia Lai, Dak Lak, Dak Nong, and Binh Phuoc; the Ministers and Heads of relevant agencies shall be responsible for implementing this Decision./.
