Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Competition and Rewards dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated November 16, 2013;
Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;
At the proposal of the Minister of Industry and Trade,
At the proposal of Issuing this Decree to stipulate the regulations on conferring the titles "People's Artisan", "Outstanding Artisan" in the field of traditional craft.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the subjects, criteria, procedures, and formalities for conferring the titles "People's Artisan", "Outstanding Artisan" in the field of traditional craft.
Article 2. Applicability
1. Vietnamese citizens working in the field of traditional craft, having profound knowledge of the craft, teaching and promoting the value of traditional craft.
2. Organizations and individuals related to the activities of conferring the titles "People's Artisan", "Outstanding Artisan".
Article 3. Rights and Obligations of People's Artisans and Outstanding Artisans
People's Artisans and Outstanding Artisans have the following rights and obligations:
1. Receiving the Medal, Certificate from the President of the State and monetary rewards accompanying the titles "People's Artisan" or "Outstanding Artisan" as prescribed by the laws on competition and rewards.
2. Actively preserving, teaching, and improving skills and techniques in their craft.
3. Other rights and obligations as prescribed by law.
Article 4. Budget for Conferment Activities and Monetary Rewards
1. The budget for conferring the titles "People's Artisan" and "Outstanding Artisan" shall be used for the following activities:
a) Building and implementing the Plan of the Council for conferring the titles "People's Artisan" and "Outstanding Artisan";
b) Reviewing the application files for awarding;
c) Organizing public opinion collection from local communities or professional associations;
d) Organizing Council meetings;
đ) Announcing information about the Council's selection results through mass media to solicit public opinions;
e) Holding press conferences to announce the President's Decision on bestowing the titles;
g) Organizing award ceremonies;
h) Other related activities as prescribed by law.
2. The budget for conferring the titles "People's Artisan" and "Outstanding Artisan" and accompanying monetary rewards:
a) The Ministry of Industry and Trade is responsible for allocating funds for the organizing activities of the specialized council at the ministry level, the national council, award ceremonies, and other related expenses as prescribed by law;
b) The Chairman of the People's Committee of provinces and centrally governed cities (hereinafter referred to as provincial level) is responsible for allocating funds for the organizing activities of the provincial council, monetary rewards accompanying the titles "People's Artisan" and "Outstanding Artisan", and other related expenses as prescribed by law.
Chapter II
CRITERIA FOR GRANTING TITLES
"PEOPLE'S ARTISAN", "OUTSTANDING ARTISAN"
Article 5. Criteria for Conferring the Title "People's Artisan"
The title "People's Artisan" is conferred upon individuals who have been bestowed the title "Outstanding Artisan" by the state and meet the following criteria:
1. Loyalty to the Socialist Republic of Vietnam; complying well with the Party's guidelines and state policies; internal rules and regulations of agencies, units, organizations, and localities.
2. Having good moral qualities, being exemplary in life; passionate and dedicated to their craft, respected and admired by colleagues and the public.
3. Possessing exceptional knowledge and skills, making significant contributions to protecting and promoting the value of traditional crafts nationwide, specifically:
a) Mastering skills and secrets; teaching and training at least 150 individuals, except in special cases or where one individual has already been trained and bestowed the title "Outstanding Artisan" by the state;
b) After receiving the title "Outstanding Artisan", the Artisan must personally design and produce two new products or works of economic, technical, and artistic value, winning awards or recognized with certificates of achievement in domestic and international contests, fairs, and exhibitions permitted by the Prime Minister.
4. Having worked in the craft for 20 years or more.
Article 6. Criteria for awarding the title "Outstanding Artisan"
The title "Outstanding Artisan" shall be awarded to individuals meeting the following criteria:
1. The criteria stipulated in Clause 1 and Clause 2 of Article 5 of this Decree.
2. Possessing exceptional knowledge and skills, making significant contributions to protecting and promoting the value of local traditional craft industries, specifically:
a) Mastering techniques and secrets; teaching the craft to at least 100 individuals, except in cases of special crafts.
b) Personally designing and producing at least 10 products with high economic, technical, and artistic value.
3. Having works or products that meet one of the following criteria:
a) Receiving awards or certificates of achievement from state organizations, economic organizations, social-professional organizations at national and international contests, fairs, or exhibitions approved by the Prime Minister.
b) Being selected for display in museums, cultural works, historical sites, or major national events.
c) Being chosen as models for teaching purposes at art schools or vocational training institutions.
d) Being used in the restoration of historical and cultural relics confirmed by the local authorities where such relics are located.
4. Having worked in the profession for at least 15 years.
Chapter III
THE AWARDING COUNCIL FOR THE TITLES OF "PEOPLE'S DOCTOR" AND "OUTSTANDING DOCTOR"
"PEOPLE'S ARTISAN", "OUTSTANDING ARTISAN"
Article 7. Duties, principles of operation, and composition of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan"
1. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall be established in batches at three levels:
a) Provincial Council.
b) Sectoral Council at the Ministry level;
c) National-level Council.
The Council shall dissolve itself upon completion of its tasks.
2. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall have the following duties:
a) Organizing the awarding process in accordance with the provisions of this Decree.
b) Announce the results of the selection on mass media to solicit public opinions;
c) Completing the awarding documentation and submitting it to the competent Council;
d) Considering and resolving recommendations related to the awarding process.
3. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall operate according to the following principles:
a) Democracy, transparency, and compliance with the legal regulations on competition and rewards;
b) A meeting of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall be organized when at least 75% of the Council members are present, including the Chairman of the Council or the Vice-Chairman authorized by the Chairman. The Secretary shall be responsible for collecting opinions from absent members through Ballot Forms No. 5 and No. 6 prescribed in the Appendix attached to this Decree.
c) The National Council shall only consider files submitted by the specialized council at the Ministry level, and the specialized council at the Ministry level shall only consider files submitted by the provincial council; it shall not consider files that do not comply with the laws on commendation and reward.
d) The provincial council shall submit to the specialized council at the Ministry level, the specialized council at the Ministry level shall submit to the National Council, and the National Council shall submit to the Prime Minister a list of individuals who receive at least 90% of the votes in favor from the total number of Council members.
đ) Members of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall not be candidates for these titles.
e) In one awarding period, a member of the provincial council shall not simultaneously be a member of the specialized council at the Ministry level or the National Council.
4. The composition of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" includes the Chairman of the Council, the Vice-Chairmen of the Council, and Council members representing state management agencies on commendation and reward at the same level; political-social organizations, social organizations, social-professional organizations; some People's Artisans, Outstanding Artisans, and reputable scientists with deep expertise in related traditional craft industries.
5. The Chairman of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall decide on the establishment of the Secretariat to assist the Council.
Article 8. Provincial Council
1. The Provincial Council shall be established by the Chairman of the Provincial People's Committee upon the proposal of the Director of the Department of Industry and Trade, consisting of from nine to eleven members. The composition of the Provincial Council includes:
a) The Chairman of the Council is a leader of the Provincial People's Committee;
b) The Vice-Chairman of the Council is the Director of the Department of Industry and Trade;
c) Other members of the Council.
2. The permanent office of the Provincial Council is the Department of Industry and Trade. The Provincial Council uses the seal of the Provincial People's Committee.
Article 9. Ministry-level Professional Council
1. The Ministry-level Professional Council shall be established by the Minister of Industry and Trade upon the proposal of the Head of the Department of Mobilization and Reward, consisting of from nine to eleven members. The composition of the Ministry-level Professional Council includes:
a) The Chairman of the Council is a leader of the Ministry of Industry and Trade;
b) The Vice-Chairman of the Council is the Head of the Department of Mobilization and Reward, Ministry of Industry and Trade;
c) Other members of the Council.
2. The permanent office of the Ministry-level Professional Council is the Department of Mobilization and Reward, Ministry of Industry and Trade. The Ministry-level Professional Council uses the seal of the Ministry of Industry and Trade.
Article 10. National Council
1. The National Council shall be established by the Prime Minister upon the proposal of the Minister of Industry and Trade, consisting of from nine to eleven members. The composition of the National Council includes:
a) The Chairman of the Council is the Minister of Industry and Trade;
b) The Vice-Chairman of the Council is a leader of the Central Mobilization and Reward Board; a leader of the Ministry of Industry and Trade;
c) Other members of the Council.
2. The permanent office of the National Council is the Ministry of Industry and Trade. The National Council uses the seal of the Ministry of Industry and Trade.
Chapter IV
DOCUMENTS, PROCEDURES AND PROCEDURAL REQUIREMENTS FOR PROPOSAL TO AWARDS
THE TITLE "PEOPLE'S ARTIST", "OUTSTANDING ARTIST"
Article 11. Documents for Proposal to Awards
1. The documents for proposing to award for individuals include:
a) A record of achievements for the proposal to award the title "People's Artist" according to Model No. 1 and a record of achievements for the proposal to award the title "Outstanding Artist" according to Model No. 2 as specified in the appendix issued together with this Decree;
b) One of the following documents proving contributions to preserving, transmitting, and teaching skills: video or audio recordings or images describing the skills currently possessed or a certified copy in case the individual submits the application through postal service, a photocopied copy (with original for comparison) in case the individual submits directly certificates, decisions on awarding Orders, Medals, Prizes, Certificates of Merit or other related documents.
2. The documents of the Provincial Council submitted to the Ministry-level Professional Council include:
a) A report of the Provincial Council according to Model No. 4 as specified in the appendix issued together with this Decree;
b) A list of proposals to award the titles "People's Artist", "Outstanding Artist" according to Model No. 7 as specified in the appendix issued together with this Decree, accompanied by individual documents as stipulated in Clause 1 of this Article;
c) Minutes of the meeting of the Provincial Council according to Model No. 8 as specified in the appendix issued together with this Decree; Voting slips of Council members according to Models No. 5 and No. 6 as specified in the appendix issued together with this Decree; Minutes of meetings to seek opinions of the local community or professional associations according to Model No. 3 as specified in the appendix issued together with this Decree;
d) A summary of the achievements of individuals listed in Point b of this Clause according to Model No. 9 as specified in the appendix issued together with this Decree;
đ) Decision establishing the Provincial Council.
3. The documents of the Ministry-level Professional Council submitted to the National Council include:
a) A report of the Ministry-level Professional Council according to Model No. 4 as specified in the appendix issued together with this Decree;
b) A list of proposals to award the titles "People's Artist", "Outstanding Artist" according to Model No. 7 as specified in the appendix issued together with this Decree, accompanied by individual documents as stipulated in Clause 1 of this Article;
c) Minutes of the meeting of the Ministry-level Professional Council according to Model No. 8 as specified in the appendix issued together with this Decree; Voting slips of Council members according to Models No. 5 and No. 6 as specified in the appendix issued together with this Decree;
d) A summary of the achievements of individuals listed in Point b of this Clause according to Model No. 9 as specified in the appendix issued together with this Decree;
đ) Decision establishing the Ministry-level Professional Council.
4. The documents of the National Council submitted to the Prime Minister include:
a) A report of the National Council according to Model No. 4 as specified in the appendix issued together with this Decree;
b) A list of proposals to award the titles "People's Artist", "Outstanding Artist" according to Model No. 7 as specified in the appendix issued together with this Decree, accompanied by individual documents as stipulated in Clause 1 of this Article;
c) Minutes of the meeting of the National Council according to Model No. 8 as specified in the appendix issued together with this Decree; Voting slips of Council members according to Models No. 5 and No. 6 as specified in the appendix issued together with this Decree;
d) A summary of the achievements of individuals listed in Point b of this Clause according to Model No. 9 as specified in the appendix issued together with this Decree;
đ) Decision on establishing the National Council.
Article 12. Submission and Acceptance of Documents for Proposal to Awards
1. Individuals proposing to be awarded may themselves or authorize (in writing) another person to prepare the documents and submit them directly or via postal service one set of documents to the Department of Industry and Trade where the individual resides during the time specified in the plan for awarding the titles "People's Artist", "Outstanding Artist".
2. The agency receiving documents for the proposal to award the titles "People's Artist", "Outstanding Artist" is responsible for checking the validity and completeness of the documents and papers in accordance with regulations and reply in writing within ten working days from the date of receipt of the documents. In cases requiring supplementation or correction of documents in the file, the agency receiving the documents guides the individual to complete the file and resubmit it no later than twenty working days from the date of receipt of the guidance letter.
Article 13. Procedures and formalities for awarding at the provincial council
1. The permanent office of the provincial council has the responsibility to assist the council in performing the following tasks:
a) Submit to the Chairman of the Provincial People's Committee for decision on establishing the provincial council to award the titles "People's Artist" and "Outstanding Artist";
b) Organize the collection of opinions from the local community (commune, ward, town) where the individual applying for the award resides or from the relevant professional association where the individual applies for the award to include in the application dossier according to Model No. 3 stipulated in the annex issued together with this Decree;
c) Announce the list of individuals applying for the award on the province’s or centrally-administered city’s mass media; post the list and the achievement statements of the individuals applying for the award on the provincial People's Committee's electronic portal to collect public opinions within 15 working days;
d) Send the application dossier and related documents to the members of the provincial council and organize a meeting of the council to select candidates;
2. The provincial council shall organize the examination of application files and proceed with selection as follows:
a) Review the contents of the documents in the dossier, examine whether the individual meets the criteria for each title as prescribed in this Decree;
b) Receive and process complaints from organizations and individuals (if any) and conduct secret ballot voting to select individuals who meet the criteria for the award of the titles "People's Artist" and "Outstanding Artist" to be submitted to the Ministry-level specialized council;
c) Publicly announce the selection results on the provincial People's Committee's electronic portal and the province’s or centrally-administered city’s mass media within 15 working days;
d) Send a report on the selection results of the provincial council along with five (5) sets of dossiers as prescribed in Clause 2, Article 11 of this Decree to the Ministry-level specialized council according to the time specified in the plan for awarding the titles "People's Artist" and "Outstanding Artist";
đ) Notify the selection results in writing to the individual who has submitted the application dossier;
Article 14. Procedures and formalities for awarding at the Ministry-level specialized council
1. The permanent office of the Ministry-level specialized council shall have the responsibility to assist the council in performing the following tasks:
a) Submit to the Minister of Industry and Trade for decision on establishing the Ministry-level specialized council;
b) Receive and check the validity and completeness of the documents and materials in the dossier sent by the provincial council; in case of need for supplementation or correction of the documents in the dossier, provide guidance for the provincial council to complete and resubmit within the latest 15 working days from the date of receipt of the guidance document;
c) Post the list of individuals proposed for the award by the provincial council on the Ministry of Industry and Trade's electronic portal to collect public opinions within 15 working days;
d) Send the application dossier and related documents to the members of the Ministry-level specialized council and organize a meeting of the council to select candidates;
2. The Ministry-level specialized council organizes the review of the dossiers and conducts the selection as follows:
a) Review the contents of the documents in the dossier, examine whether the individual meets the criteria for each title as prescribed in this Decree;
b) Receive and process complaints from organizations and individuals (if any) and conduct secret ballot voting to select individuals who meet the criteria for the award of the titles "People's Artist" and "Outstanding Artist" to be submitted to the State-level council;
c) Post the selection results on the Ministry of Industry and Trade's electronic portal within 15 working days;
d) Send a report on the selection results of the Ministry-level specialized council along with four (4) sets of dossiers as prescribed in Clause 3, Article 11 of this Decree to the State-level council according to the time specified in the plan for awarding the titles "People's Artist" and "Outstanding Artist";
đ) Notify the selection results in writing to the provincial council that has submitted the dossier.
Article 15. Procedures for awarding at the State Council
1. The permanent office of the State Council shall have the duty to assist the Council in performing the following tasks:
a) Submitting to the Prime Minister for decision on establishing the State Council;
b) Receiving, examining the validity and completeness of documents and materials in the dossier sent by the specialized council under the Ministry; in cases where supplementation or correction of materials in the dossier is required, guidance shall be provided to the specialized council under the Ministry to complete and resubmit within no more than 10 working days from the date of receipt of the guidance document;
c) Publishing the list of individuals proposed for awarding by the specialized council under the Ministry on the Government's electronic portal and mass media to solicit public opinion for a period of 15 working days;
d) Sending the award proposal documents and dossier to members of the Council and organizing a meeting of the Council to select candidates;
2. The State Council shall organize the examination of dossiers and selection as follows:
a) Review the contents of the documents in the dossier, examine whether the individual meets the criteria for each title as prescribed in this Decree;
b) Receiving and processing complaints and suggestions from organizations and individuals (if any) and conducting secret voting to choose individuals who meet the criteria for awarding the titles of "People's Artist" and "Outstanding Artist";
c) Publishing the selection results on the Government's electronic portal and mass media for a period of 15 working days;
d) Completing the dossier and submitting it to the Prime Minister for consideration, and presenting it to the President for decision to confer the titles of "People's Artist" and "Outstanding Artist";
đ) Sending the report on the selection results of the State Council along with three (3) sets of dossiers as stipulated in Clause 4, Article 11 of this Decree to the Central Board of Awards and Commendations for consolidation and submission to the Prime Minister according to the time schedule specified in the plan for conferring the titles of "People's Artist" and "Outstanding Artist";
e) Notifying the selection results in writing to the specialized council under the Ministry;
Article 16. Announcing the Decision of the President conferring and presenting the titles of "People's Artist" and "Outstanding Artist"
The Ministry of Industry and Trade organizes the ceremony to announce the Decision of the President conferring and presenting the titles of "People's Artist" and "Outstanding Artist".
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
1. This Decree takes effect from February 15, 2015.
2. All provisions in other documents that are inconsistent with the provisions of this Decree are hereby abolished.
Article 18. Responsibility for Implementation
1. The Ministry of Industry and Trade issues the Plan for awarding the title of "People's Artist", "Outstanding Artist" in the field of traditional craft.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, relevant organizations and individuals are responsible for implementing this Decree./.
