AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE EDUCATION LAW
Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;
The National Assembly enacts this Law amending and supplementing certain articles of the Education Law No. 43/2019/QH14.
Article 1. Amendments and supplements to certain articles of the Education Law
1. Amend and supplement certain points and clauses of Article 6 as follows:
a) Amend and supplement point c and point d clause 2 as follows:
“c) Vocational education includes primary, secondary vocational, intermediate, college, and other training programs;
d) Higher education includes university and postgraduate levels.”;
b) Amend and supplement Clause 3 as follows:
“3. The Prime Minister shall approve the Framework Structure of the National Education System and the National Qualifications Framework; specify the duration, standards for each level of training, minimum study load for each educational level, vocational education, and higher education; specify the duration, standards, subjects, and minimum study load for special education and training programs in the fields of arts, sports, and other specific areas.”.
2. Amend and supplement clause 2 and clause 3 of Article 9 as follows:

3. Amend and supplement Article 12 as follows:
“Article 12. Diplomas and Certificates
1. Diplomas of the national education system are documents issued in paper or digital form to students upon completion of high school; students who complete educational programs and training programs and meet the exit standards of corresponding levels in vocational education and higher education as stipulated by this Law.
2. Diplomas of the national education system include high school graduation diplomas, vocational high school diplomas, intermediate diplomas, college diplomas, bachelor's degrees, master's degrees, doctoral degrees, and specialized training program diplomas in certain specific fields.
3. Certificates of the national education system are documents issued in paper or digital form to confirm the results of studies after training and upgrading academic or vocational qualifications, or awarded to students who pass examinations to obtain certificates as prescribed.
4. Diplomas and certificates issued by educational institutions of various types and forms within the national education system have equal legal validity.
5. The Minister of Education and Training shall provide specific regulations on the management of diplomas and certificates of the national education system and the recognition of other certificates for use within the national education system.”.
4. Amend and supplement certain clauses of Article 14 as follows:
a) Amend and supplement Clause 1 as follows:
“1. Primary education and lower secondary education are compulsory.
The State implements universal preschool education for children aged from three to six years old.”;
b) Supplement clause 5 after clause 4 as follows:
“5. The Government shall provide detailed regulations on clause 1 and clause 2 of this Article.”.
5. Amend and supplement Article 19 as follows:
“Article 19. Scientific, technological, and innovation activities
1. Scientific, technological, and innovation activities are tasks of educational institutions; they are organized and implemented in accordance with the goals, programs, and tasks of each level of education and training.
2. Educational institutions may independently implement or cooperate with scientific and technological organizations, production, business, and service entities in educational, training, scientific research, technological development, and innovation activities in accordance with the provisions of the law.
3. The State has policies to encourage and promote scientific research, technological development, and innovation activities, the application of technology, and artificial intelligence under control in educational institutions, ensuring alignment with practical requirements, international trends to enhance the quality of education and human resource development, focusing on developing high-quality human resources to meet the requirements of economic and social development.
4. The State invests in comprehensive digital transformation in education and training through the development of digital infrastructure, platforms, national databases on education and training, and the application of digital technology to improve the effectiveness of state management, teaching and learning activities, scientific research, technology, and innovation.
5. The State has preferential policies and creates conditions for investment in infrastructure and technology, supports training to promote research, application, and development of artificial intelligence in education and training.
6. The Government shall provide detailed regulations for this Article.”
6. Amend and supplement Point b Clause 1 Article 25 as follows:
“b) Specify the required achievements regarding qualities and capabilities after completing preschool and kindergarten education; specify the content, activities, methods, forms, educational environment, and evaluation of children's development;”
7. Amend and supplement some Points and Clauses of Article 28 as follows:
a) Amend and supplement Point c Clause 1 as follows:
“c) Secondary general education is conducted over three academic years, from grade ten to grade twelve. Students entering grade ten must complete the secondary general education program or its equivalent. The age of students entering grade ten is fifteen years old and is calculated according to the year.”
b) Amend and supplement Clause 4 as follows:
“4. The Minister of Education and Training shall stipulate the teaching and learning of Vietnamese language for ethnic minority children before entering grade one; the teaching of the volume of general secondary education knowledge in vocational education institutions; the teaching of the volume of general education cultural knowledge in specialized training programs; cases where students can advance a grade, study at an older or younger age than specified in Clause 1 of this Article.”
8. Amend and supplement Article 32 as follows:
“Article 32. Textbooks for General Education and Local Educational Materials
1. Textbooks for general education are defined as follows:
a) Textbooks implement the general education curriculum, concretize the requirements of the general education curriculum regarding goals, educational content, student qualities and abilities; guide teaching methods and assessment procedures; the content and form of textbooks do not contain biases based on ethnicity, religion, profession, gender, age, and social status; textbooks are presented in printed form, Braille books, and electronic books;
b) The Government shall stipulate the provision of free textbooks for students; the Minister of Education and Training decides on a unified set of general education textbooks nationwide;
c) The National Council for Textbook Review, established by the Minister of Education and Training and formed for each subject and educational activity, reviews textbooks. The Council and its members are responsible for the content and quality of the review;
d) The Minister of Education and Training approves textbooks for use in general education institutions after they have been reviewed and rated as satisfactory by the National Council for Textbook Review; stipulates standards and procedures for compiling and revising general education textbooks.
2. Local educational materials are defined as follows:
a) Local educational materials are compiled by specialized agencies under provincial People's Committees to meet needs and fit local characteristics;
b) The Provincial People's Committee Chairman establishes the Council for Reviewing Local Educational Materials. The Council and its members are responsible for the content and quality of the review;
c) The Provincial People's Committee Chairman approves local educational materials for use in general education institutions after they have been reviewed and rated as satisfactory by the provincial Council;
d) The Minister of Education and Training stipulates standards and procedures for compiling, revising, and reviewing local educational materials.”
9. Amend and supplement Article 34 as follows:
“Article 34. Confirmation of Completion of Primary, Lower Secondary, and Upper Secondary Education Programs and Issuance of Upper Secondary Graduation Certificates
1. Students who complete the primary education program and the lower secondary education program and meet the conditions stipulated by the Minister of Education and Training shall be confirmed by the school principal on their academic records for the completion of the primary and lower secondary education programs.
2. Students who complete the upper secondary education program and meet the conditions stipulated by the Minister of Education and Training may take the examination; if they meet the requirements, they will be issued an upper secondary graduation certificate by the school principal.
In cases where students do not take the examination or fail to meet the requirements, they will be issued a certificate confirming the completion of the general education program by the school principal. This certificate can be used to register for the upper secondary graduation examination when the student has such a need, or to enroll in vocational education, and it can also be used in specific situations as prescribed by law.
10. Amend and supplement Article 35 as follows:
“Article 35. Levels of Vocational Education
1. Training at the basic level and other vocational training programs for individuals with appropriate educational qualifications.
2. Secondary vocational education for individuals who have completed the lower secondary education program or its equivalent; secondary vocational education at the same level as upper secondary general education.
3. Training at the college and university levels for individuals who have graduated from upper secondary general education, secondary vocational education, or its equivalent. For specialized fields in the arts, sports, and other areas as specified by the Prime Minister, training at the college level is provided.
11. Amend and supplement Article 38 as follows:
“Article 38. Levels of Higher Education Training
1. University-level training for individuals who have graduated from upper secondary general education, secondary vocational education, or its equivalent.
2. Post-university training includes:
a) Master's degree training for individuals with a bachelor’s degree or higher;
b) Doctoral degree training for individuals with a master’s degree or a bachelor’s degree or higher.
3. The Minister of Education and Training shall specify the rules for concurrent enrollment between secondary vocational education, college, university, and higher education.
12. Amend and supplement Point d Clause 1 Article 43 as follows:
“d) The lower secondary education program and the program leading to the issuance of certificates within the national education system.”
13. Amend and supplement Clause 4 Article 44 as follows:
“4. General education institutions, vocational education institutions, and higher education institutions must ensure their educational and training tasks when implementing regular education programs; they must implement the program specified in Point d Clause 1 Article 43 of this Law according to the regulations of the Minister of Education and Training.”
14. Amend and supplement Clause 2 and Clause 3 Article 45 as follows:
“2. Learners who complete the lower secondary education program specified in Point d Clause 1 Article 43 of this Law and meet the conditions stipulated by the Minister of Education and Training shall be confirmed by the head of the institution implementing the lower secondary education program on their academic records for the completion of the lower secondary education program.
3. Learners who complete the upper secondary education program specified in Point d Clause 1 Article 43 of this Law and meet the conditions stipulated by the Minister of Education and Training may take the examination; if they meet the requirements, they will be issued an upper secondary graduation certificate by the head of the institution implementing the upper secondary education program.
In cases where learners do not take the examination or fail to meet the requirements, they will be issued a certificate confirming the completion of the general education program by the head of the institution implementing the regular education program specified in Clause 4 Article 44 of this Law.”
“Article 52. Competence, procedures for establishing or permitting establishment, granting permission to operate education, suspending enrollment, suspending educational activities, revoking decisions on establishment or permission to establish, revoking decisions on permission to operate education, changing location of educational activities or training location, merging, dividing, splitting, dissolving, renaming educational institutions.
1. The establishment or permission to establish, granting permission to operate education, suspending enrollment, suspending educational activities, revoking decisions on establishment or permission to establish, revoking decisions on permission to operate education, changing location of educational activities or training location, merging, dividing, splitting, dissolving educational institutions must be consistent with strategies, planning, economic and social development requirements, educational level objectives, financial capacity, material infrastructure, staff, and other quality assurance conditions of the educational institution.
2. Competence to establish public schools and permit establishment of private schools is defined as follows:
a) The Chairman of the People's Committee at the commune level decides on kindergartens, primary schools, junior high schools; general schools with multiple levels, boarding schools for ethnic minorities, residential schools for ethnic minorities, residential schools, where the highest level is junior high school.
b) The Chairman of the People's Committee at the provincial level decides on high schools; general schools with multiple levels, boarding schools for ethnic minorities, residential schools for ethnic minorities, residential schools, where the highest level is high school; intermediate vocational schools, intermediate technical schools within the province; kindergartens, primary schools, junior high schools, high schools proposed by diplomatic agencies of foreign countries, intergovernmental international organizations.
c) The Minister of Education and Training decides on preparatory universities, colleges, universities, university-level institutions.
d) The Minister of National Defense decides on kindergartens, high schools, intermediate vocational schools, colleges under the Ministry of National Defense; the Minister of Public Security decides on high schools, intermediate vocational schools, colleges under the Ministry of Public Security.
3. Competence to grant permission to operate education for educational institutions at various educational levels and training degrees is implemented according to the regulations of the Government.
The person authorized to grant permission to operate education has the authority to decide on suspending enrollment, suspending educational activities, revoking decisions on permission to operate education.
4. The person authorized to establish or permit establishment of an educational institution has the authority to revoke decisions on establishment or permission to establish, decide on changing location of educational activities or training location, decide on merging, dividing, splitting, dissolving, renaming the educational institution.
In cases of merger between educational institutions not established by the same competent authority, the higher competent authority decides; in cases where the competent authorities are at the same level, those competent authorities agree to decide.
5. The Government stipulates the conditions and procedures for establishing or permitting establishment, granting permission to operate education, suspending enrollment, suspending educational activities, revoking decisions on establishment or permission to establish, revoking decisions on permission to operate education, changing location of educational activities or training location, merging, dividing, splitting, dissolving, renaming educational institutions.”
16. Amend and supplement Clause 3 of Article 54 as follows:
“3. Investors establishing private educational institutions may choose one of the following methods:
a) Investing to establish an economic organization in accordance with the Investment Law and the Enterprise Law, whereby the economic organization establishes a private educational institution in accordance with this Law;
b) Directly investing to establish a private educational institution in accordance with this Law.
In cases involving two or more investors, an economic organization must be established to carry out the establishment of the educational institution as provided in point a of Clause 3 of this Article.”
17. Amend and supplement Article 55 as follows:
“Article 55. School Council
1. The school council of private vocational education institutions, private higher education institutions, and vocational education institutions, higher education institutions established under agreements between the Government of Vietnam and foreign governments shall be implemented in accordance with the provisions of the Vocational Education Law and the Higher Education Law.
2. The school council of a privately-established kindergarten is an organizational body managing the school, established by the community that founded the school and nominates representatives; it is responsible for deciding on the direction of activities, planning, development plans, organization, personnel, finance, assets, ensuring the implementation of educational goals, in compliance with the law.
The composition of the school council includes representatives from the community, local government authorities at the commune level, and individuals who have contributed capital to establish and maintain the operation of the school.
3. The school council of a private kindergarten and a privately-established general education institution is an organizational body managing the school, exercising the rights on behalf of investors and related parties, and is responsible for organizing and implementing decisions made by the investors.
The composition of the school council of a private kindergarten and a privately-established general education institution includes representatives from the investors, members within and outside the school elected by the investors' assembly according to the proportion of capital contribution.
4. Procedures for establishment, organizational structure, tasks, and powers of the school council; relationships between investors and the school council, and the principal of the school are stipulated in Clause 2 and Clause 3 of this Article and are specified in the charter and regulations governing the organization and operation of the school.”
18. Amend and supplement some clauses of Article 61 as follows:
a) Amend and supplement Clause 1 as follows:
“1. The State establishes boarding schools for ethnic minority students, half-day boarding schools for ethnic minority students, boarding schools, and preparatory universities for students who are ethnic minorities, students permanently residing in areas with extremely difficult socio-economic conditions, areas inhabited by ethnic minorities and mountainous regions, border communes.”
b) Amend and supplement Clause 3 as follows:
“3. The Minister of Education and Training shall issue regulations on the organization and operation, and specify the conditions for students to attend boarding schools for ethnic minority students, half-day boarding schools for ethnic minority students, boarding schools, and preparatory universities.”
19. Amend and supplement Clause 1 of Article 62 as follows:
“1. Specialized schools are established at the secondary level for students who achieve outstanding results in their studies to develop talents in certain subjects based on comprehensive general education, creating sources for talent training, meeting the requirements of national development.
Artistic, sports, and other specialized schools are established to identify, nurture, and develop the talents and specialized skills of students in corresponding fields.”
20. Supplement Clause 3 after Clause 2 of Article 63 as follows:
“3. The Minister of Education and Training shall issue regulations on the organization and operation of schools and classes for persons with disabilities.”
21. Amend and supplement Article 66 as follows:
“Article 66. Teachers in educational institutions under the national education system
1. Teachers in educational institutions under the national education system include:
a) Full-time teachers are teachers recruited and work full-time at only one educational institution;
b) Part-time teachers of public vocational education and higher education institutions are regulated in accordance with the Vocational Education Law and the Higher Education Law;
c) Full-time contractual teachers after retirement are retired teachers who enter into full-time employment contracts with educational institutions to perform teaching duties;
d) Visiting lecturers are individuals invited by educational institutions to teach at least one subject, module, course component, seminar, or content within the educational program or training program implemented by the educational institution. Visiting lecturers include visiting teachers and visiting professors.
2. Full-time teachers shall be regulated in accordance with the Teachers Law.
3. The Minister of Education and Training shall provide detailed regulations on full-time contractual teachers after retirement and visiting lecturers.”
22. Supplement Article 66a and Article 66b to Section 2 Chapter IV as follows:
“Article 66a. Educational management officials and educational institution management officials
1. Educational management officials shall be defined as follows:
a) Educational management officials are civil servants and perform rights and obligations as prescribed by laws on civil servants;
b) Teachers who are assigned to work as educational management officials by competent authorities shall retain allowances for teachers as prescribed by the Government.
2. Educational institution management officials shall be defined as follows:
a) Management officials of public educational institutions are managerial staff working in managerial positions within educational institutions;
b) Educational institution management officials must meet the standards and conditions and perform rights and obligations as prescribed by the Minister of Education and Training and other relevant laws;
c) Management officials of vocational education institutions, higher education institutions, and schools of state agencies, political organizations, and social-political organizations who meet the required training qualifications may participate in part-time teaching at their current place of work if needed or concurrently teach if assigned by the institution;
d) Management officials of public educational institutions shall enjoy occupational allowance and other benefits as prescribed by the Government;
đ) The Government shall prescribe procedures and processes for appointing educational institution management officials.
3. This provision does not apply to educational management officials and management officials at educational institutions of armed forces.
Article 66b. Educational support personnel and other personnel
1. Educational support personnel in educational institutions shall be defined as follows:
a) Educational support personnel in educational institutions include those working in specialized and technical positions but are not teachers, supporting positions, and other positions suitable for the organizational model of the educational institution as prescribed by the competent authority (hereinafter referred to as educational support personnel);
b) Educational support personnel in public educational institutions shall enjoy occupational allowance and other benefits as prescribed by the Government;
c) The Minister of Education and Training shall prescribe the list, framework of job positions, and staffing levels for educational support personnel in public educational institutions.
2. Other personnel outside of educational support personnel as stipulated in Clause 1 of this Article (hereinafter referred to as other personnel) shall comply with the provisions of the Vocational Education Law, Higher Education Law, and other relevant laws.
3. Educational support personnel and other personnel must meet the standards as prescribed by the Minister of Education and Training and the Minister or Head of a ministry equivalent to a ministry managing specialized staff; they shall perform the rights and obligations of their positions as prescribed by law.
4. Localities, educational institutions, and entities participating in vocational education activities shall have policies to support educational support personnel and other personnel in accordance with practical conditions and financial resources of the unit.”
23. Amend and supplement some clauses of Article 85 as follows:
a) Amend and supplement Clause 1 and Clause 2 as follows:
“1. The State shall have policies to provide scholarships to the following groups:
a) Scholarships to encourage study for students at specialized schools, gifted schools as prescribed in Article 62 of this Law, and learners at vocational education institutions and higher education institutions; priority shall be given to learners in talent training programs, key fields of training that meet economic and social development needs in each period;
b) Policy scholarships for selected university students, preparatory high school students, boarding students from ethnic minority areas, learners at vocational education institutions for war invalids and persons with disabilities.
2. The State shall have policies to subsidize and reduce tuition fees for learners who are beneficiaries of social policies, ethnic minorities, learners residing in areas with extremely difficult economic and social conditions, ethnic minority and mountainous regions, border communes, orphans, children without parental care, persons with disabilities, households in poverty and near poverty.”
b) Supplement Clause 4a after Clause 4 as follows:
“4a. The National Scholarship Fund shall have legal personality, its own seal, and separate accounts under the Ministry of Education and Training, operating without profit-making purposes.
a) The National Scholarship Fund shall be formed from annual budget allocations from the state budget; voluntary contributions, donations, and other lawful sources as prescribed by law. At the end of the fiscal year, unused voluntary contributions, donations, and gifts shall be retained in the fund for future use and shall not be returned to the state budget;
b) The National Scholarship Fund shall provide scholarships to learners in talent training programs; prioritize postgraduate students and learners in basic sciences, engineering, technology, and other priority fields; encourage and support learning and research for high school, college, and postgraduate students; support skill development for learners linked to labor market demands and international integration, meeting economic and social development needs in each period and promoting the education sector;
c) The Government shall issue regulations on the organization, management, and use of the National Scholarship Fund.”
24. Amend and supplement Article 99 as follows:
“Article 99. Tuition fees, educational service and support costs for educational activities, costs of educational services and training
1. Tuition fees are the amount of money that students must pay to cover part or all of the costs of educational services and training. The level of tuition fees is determined according to the route ensuring the cost of educational services and training as prescribed by the Government; for vocational education institutions and higher education institutions, it shall be implemented in accordance with the provisions of the Vocational Education Law and the Higher Education Law.
2. Costs of educational services and training include the entire salary costs, direct costs associated with teaching activities, management costs, depreciation costs of fixed assets directly and indirectly serving educational activities according to the educational program.
The collection level of admission services is the financial amount that applicants must pay when participating in selection and examination processes, determined according to the principle of accurately and sufficiently calculating costs.
Educational service and support activities are organized to create favorable conditions, improve the quality and effectiveness of education to meet the comprehensive development needs of learners and the operation of educational institutions but are not guaranteed by the state budget or are not included in tuition fees; the collection level is determined according to the principle of accurately and sufficiently calculating costs.
3. Preschool children, secondary school students, and those studying general education programs in public educational institutions are exempt from tuition fees. Preschool children, secondary school students, and those studying general education programs in private and non-state educational institutions are supported by the State to pay tuition fees; the level of support is decided by the Provincial People's Council at the proposal of the Provincial People's Committee. The level of tuition fee support follows the framework set by the Government but does not exceed the tuition fee collection level of private and non-state educational institutions.
4. The mechanism for collecting and managing tuition fees and other service and support collections for educational activities is regulated as follows:
a) The Government stipulates the management mechanism for tuition fees, service and support activities for educational activities, and service prices in the field of education for educational institutions within the national education system;
b) The Provincial People's Council decides on specific tuition levels as the basis for implementing free tuition for preschool children, secondary school students, and those studying general education programs in public educational institutions; decides on the level of tuition support for preschool children, secondary school students, and those studying general education programs in private and non-state educational institutions according to the proposal of the Provincial People's Committee;
c) The Provincial People's Committee stipulates the mechanism for collecting and using admission service collection levels for various educational levels, decides on the list and collection levels of service and support activities for educational activities managed locally as prescribed in Clause 2 of this Article;
d) Vocational education institutions and higher education institutions decide on the list and collection levels of service and support activities for educational activities as prescribed in Clause 2 of this Article, except for services priced by the State and required to publicly disclose the collection levels of service and support activities for educational activities for each course, educational level, and academic year in accordance with the law;
e) Private and non-state educational institutions have the right to independently establish tuition levels and other service levels to ensure coverage of costs and accumulation; publicly disclose the costs of educational services and training and collection levels according to the establishment project; publicly disclose tuition fees and other services for each course, educational level, and academic year in accordance with the law.”
25. Amend and supplement Clause 3 of Article 102 as follows:
“3. The transfer of capital for private kindergartens, private primary schools, private secondary schools, private vocational education institutions, and private higher education institutions shall be carried out in accordance with the laws on investment, enterprises, and related laws; ensuring the stability and development of the institution without disrupting educational activities; ensuring the rights of learners, teachers, and employees.
After completing the capital transfer, the educational institution has the responsibility to notify the competent educational management authority at the appropriate level and in accordance with the regulations of the Government.”
26. Amend and supplement Clause 3 of Article 104 as follows:
“3. Regulations on professional standards for teachers and qualification criteria for other specialized positions under its management; working systems for teachers and educational institution managers; professional standards for heads and deputy heads in public educational institutions; lists or frameworks of job positions and staffing levels in educational institutions; conduct rules for teachers; equivalent positions to teacher positions; recruitment authority for teachers and conditions for educational institutions to recruit teachers; training programs; directing and organizing teacher and educational manager training, educational institution managers, and other personnel in educational institutions.”
27. Amend and supplement Clause 5 of Article 105 as follows:
“5. People's Committees at all levels implement state management of education within their assigned tasks and powers in accordance with the law, ensuring conditions for education development at the local level.”
28. Supplement Clause 2a after Clause 2 of Article 107 as follows:
“2a. The State encourages and creates conditions for Vietnamese educational institutions to establish representative offices, expand training, investment, cooperation, and scientific research activities with reputable educational institutions abroad, contributing to promoting Vietnamese education, accessing modern technology, and advancing knowledge diplomacy.”
29. Amend and supplement Article 109 as follows:
“Article 109. Recognition of Foreign Educational Credentials
1. Foreign educational credentials issued by foreign educational institutions shall be recognized when such foreign educational institutions operate legally, have educational programs that ensure the quality standards of the issuing country and are consistent with Vietnamese law.
2. The Minister of Education and Training shall provide detailed regulations on the conditions, procedures, authority for recognizing foreign educational credentials issued by foreign educational institutions.
30. Amend and supplement Article 110 as follows:
“Article 110. Ensuring Quality and Accreditation of Education
1. Ensuring the quality of education is a continuous and regular task of educational institutions within the national education system aimed at improving quality, enhancing accountability, meeting the needs of learners and society.
2. Ensuring the quality of preschool education, general education, and continuing education focuses on reforming teaching and learning methods, developing staff, strengthening quality assurance conditions, improving school management efficiency, and recognizing schools that meet national standards.
3. Ensuring quality and accreditation for vocational education and higher education shall be carried out in accordance with the provisions of the Vocational Education Law and the Higher Education Law.
4. The Minister of Education and Training shall regulate quality assurance activities at educational institutions; guide, inspect, and supervise the implementation of quality assurance and accreditation of education.
31. Amend, supplement, replace, and delete certain phrases; abolish certain articles and clauses as follows:
a) Add the phrase "educational institution management officers" after the phrase "education management officers" in Clause 2, Article 25, Clause 2, Article 31; add the phrase "boarding secondary schools" after the phrase "boarder secondary schools" in the name and Clause 2, Article 61; add the phrase "vocational high schools" after the phrase "secondary technical schools" in Clause 2, Article 80; add the phrase ", including allocating investment costs to reach at least 5% of the total state budget expenditure and funding for higher education to reach at least 3% of the total state budget expenditure" after the phrase "20% of the total state budget expenditure" at the end of Clause 1, Article 96; add the phrase "and MANAGEMENT" after the phrase "STUDYING" in Clause 1, Article 108; add the phrase "EDUCATION SUPPORT STAFF AND OTHER PERSONNEL" after the phrase "TEACHERS" in the name of Chapter IV;
b) Replace the phrase "domestic and foreign investors" with the phrase "as prescribed by the investment law" in Clause 11, Article 5; replace the phrase "education management officers" with the phrase "educational institution management officers" in Point c, Clause 2, Article 47, Article 74, Clause 8, Article 104; replace the phrase "secondary teacher training colleges, college teacher training institutes" with the phrase "vocational education" in Clause 2, Article 105; replace the phrase "permitting operation" with the phrase "granting operation license" in Clause 2, Article 112; replace the phrase "DUTIES AND RIGHTS OF TEACHERS" with the phrase "POSITIONS, ROLES, STANDARDS OF EDUCATION MANAGEMENT STAFF, EDUCATION SUPPORT STAFF, AND OTHER PERSONNEL" in the name of Section 2, Chapter IV; replace the phrase "QUALITY ASSURANCE OF EDUCATION" with the phrase "ENSURING QUALITY AND QUALITY ASSURANCE OF EDUCATION" in the name of Section 3, Chapter VIII;
c) Delete the phrase "vocational education" in Clause 1, Article 53; delete the phrase ", except vocational education centers" in Clause 3, Article 65; delete the phrase "and stipulate the responsibilities and authorities of the quality assurance organizations for preschool education, general education, and continuing education" in Point b, Clause 2, Article 112;
d) Delete the phrase "Minister of Labor, Invalids and Social Affairs" in Clause 4, Article 6, Clause 5, Article 8, Clause 5, Article 43, Clause 3, Article 53, Clause 3, Article 62, Clause 2, Article 64, Clause 3, Article 65, Clause 4, Article 74; delete the phrase "Ministry of Labor, Invalids and Social Affairs" in Clause 4, Article 105;
đ) Abolish Clause 3, Article 10, Article 18, Clause 2, Article 28, Clause 5, Article 44, Article 49, Article 50, Article 51, Clause 1, Article 54, Clause 3 and Clause 4, Article 56, Article 67, Article 68, Article 69, Article 70, Article 71, Article 72, Article 73, Article 75, Article 76, Article 77, Article 78, Clause 2, Article 103, Clause 3, Article 105, Article 111, Article 113, Article 115.
Article 2. Implementation clause
1. This Law shall take effect from January 1, 2026, except for the cases provided for in Clause 2 of this Article and the transitional provisions regarding the accreditation of preschool education, general education, and continuing education as provided for in Point a, Clause 3 of this Article.
2. Point b, Clause 1, Clause 4, Clause 13, Clause 15, Point b, Clause 23, Article 1 and the provision of the Government providing free textbooks for students as provided for in Clause 8, Article 1 of this Law shall take effect from July 1, 2026.
3. Transitional Provisions:
a) Certificates of educational institutions achieving quality accreditation for preschool education, general education, and continuing education issued before this Law takes effect shall continue to be valid until the expiration date stated on the Certificate.
Preschool education, general education, and continuing education institutions that have been notified by competent authorities to accept external evaluation registration applications before this Law takes effect shall continue to implement and complete the quality accreditation process according to the provisions of the Education Law No. 43/2019/QH14 and related laws until the end of the accreditation cycle.
From January 1, 2026, preschool education, general education, and continuing education institutions shall switch to implementing quality assurance activities according to other provisions of this Law and guiding documents;
b) From January 1, 2026, school boards of kindergartens, primary schools, and public general education institutions shall cease operations and are responsible for transferring all relevant files and documents to the principal; the principal shall be responsible for notifying the direct management agency within six months from the cessation date.
c) For administrative procedures for which the application files have been duly submitted to the competent authority before July 1, 2026, such authority shall continue to handle and resolve the matter in accordance with the laws in effect at the time of submission, even if the authority's jurisdiction over such administrative procedures has been adjusted according to this Law;
d) Local educational materials that have been submitted to the Minister of Education and Training for approval before July 1, 2026 shall be subject to the Minister’s written comments, and shall be approved by the Chairman of the People's Committee of the province;
đ) Secondary school graduation certificates issued before January 1, 2026 shall continue to be legally valid for use in education, recruitment, and other civil transactions as provided by law;
e) Investors who directly established private educational institutions under Point b, Clause 3, Article 54 of the Education Law No. 43/2019/QH14 and involve two or more investors shall establish an economic organization in accordance with the Government's regulations within the maximum period of 12 months from January 1, 2026.
