PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 38/2007/QĐ-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital;
Considering the proposal of the People's Committee of Ha Nam Province,
DECISION:
Article 1. Approves the Plan for Restructuring and Modernizing State-Owned Enterprises with 100% State Capital under the People's Committee of Ha Nam Province for the period 2007-2010 as follows:
1. Convert into Limited Liability Companies with One Member (in 2008):
- South Ha Nam Irrigation Works Exploitation Company;
- Kim Bang Irrigation Works Exploitation Company;
- Duy Tien Irrigation Works Exploitation Company;
- Lottery Construction Company.
2. Implement shareholding reform:
- Ha Nam Urban Construction Limited Liability Company with One Member (in 2008);
- Ha Nam Water Supply Limited Liability Company with One Member (in 2009).
Article 2.
1. The Chairman of the People's Committee of Ha Nam Province shall be responsible for:
a) Directing the implementation of the restructuring and modernization of state-owned enterprises with 100% state capital under its direct jurisdiction according to the approved content and schedule;
b) Deciding the proportion of shares held by the State when implementing the shareholding reform of the companies mentioned in this Decision based on the criteria and classification lists for state-owned enterprises with 100% state capital issued together with Decision No. 38/2007/QĐ-TTg dated March 20, 2007 of the Prime Minister.
2. The Ministries of Finance, Planning and Investment, Home Affairs, Labor, Invalids and Social Affairs, and related agencies shall be responsible for coordinating with the People's Committee of Ha Nam Province in the implementation of this Decision.
3. The Steering Committee for Enterprise Reform and Development shall be responsible for directing, urging, guiding, and monitoring the implementation.
Article 3. This Decision takes effect from the date of issuance.
The Chairman of the People's Committee of Ha Nam Province and the heads of related agencies are responsible for enforcing this Decision./.
