Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the functions, tasks, powers of Ministries and ministerial-level agencies;
Pursuant to Decree No. 96/CP dated December 7, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decree No. 56/1998/NĐ-CP dated July 30, 1998 of the Government stipulating forms, recipients, and criteria for awards granted by the Government, Ministries, ministerial-level agencies, and government agencies at all levels;
Pursuant to Decision No. 931/2001/QĐ-LĐTBXH dated September 14, 2001 of the Minister of Labor, Invalids and Social Affairs on the adoption of regulations on awards for labor, invalids, and social affairs work;
At the proposal of the Director of the Overseas Labor Management Department and the Standing Committee of the Ministry's Competition and Award Council,
DECISION:
Article 1. These regulations on awards for labor export and expert work are hereby adopted.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Article 3. AThe Office Director of the Ministry, the Director of the Overseas Labor Management Department, the Director of the Planning and Finance Department, the Heads of units under the Ministry, the Heads of units and individuals concerned are responsible for implementing this Decision.

REGULATIONS
AWARDS FOR LABOR EXPORT AND EXPERT WORK
(Adopted pursuant to Decision No. 1247/2002/QĐ-BLĐTBXH dated October 17, 2002 of the Minister of Labor, Invalids and Social Affairs)
Article 1. These regulations stipulate the recipients, criteria, forms, and procedures for award applications for collectives and individuals with outstanding achievements in labor export and expert work.
Article 2. Recipients of awards:
Clause 2.1. Collectives and individuals of Vietnamese nationality:
Point 1. Collectives:
- Enterprises with permits to operate labor export and expert work;
- Organizations and units of ministries, sectors, localities, and Vietnamese representative offices abroad.
Point 2. Individuals:
- Staff members of enterprises engaged in labor export and expert work;
- Civil servants, public officials, and employees of ministries, sectors, localities, and Vietnamese representative offices abroad;
- Vietnamese workers and experts working abroad.
Clause 2.2. Organizations and individuals of foreign nationality.
Article 3. Criteria for awards:
Clause 1. For collectives and individuals of Vietnamese nationality:
Point 1.1. Collectives:
a) Enterprises with permits to operate labor export and expert work must meet the following criteria:
- In one year, dispatching 1,000 or more workers abroad;
- Adhering to current state regulations on contract registration, worker selection, training, orientation before departure, and provision of workers and experts to the foreign side;
- Complying fully with financial regulations in labor export;
- Effectively managing and promptly addressing all issues related to workers;
- The rate of workers breaking contracts and workers who have completed their contract terms but have not returned home (if any) must be below 3%;
- The enterprise and its staff must not have committed any violations subject to disciplinary action or higher during the period under review;
- Properly fulfilling reporting requirements.
b) Vietnamese representative offices abroad must meet the following criteria:
- Making significant contributions to providing information about markets, achieving positive results in market exploration and opening new markets, contributing to consolidating, expanding, and developing overseas labor markets;
- Actively participating in management and protecting the legitimate rights and interests of Vietnamese workers and enterprises abroad.
c) Other organizations and units: Making active and effective contributions to labor export and expert work.
Point 1.2. Individuals: Achieving outstanding results and making active contributions to promoting labor export and expert work.
Clause 2. For collectives and individuals of foreign nationality, they must meet the following criteria:
- Making significant contributions to receiving and utilizing Vietnamese workers;
- Adhering to agreements and protecting the legitimate rights and interests of Vietnamese workers.
Forms of awards: Based on the level of achievement and contribution, collectives and individuals will be considered for one of the following forms of awards:
Article 4. - Certificate of Merit from the Director of the Overseas Labor Management Department;
- Medal of Merit from the Minister of Labor, Invalids and Social Affairs;
- Medal for the Cause of Labor, Invalids, and Social Affairs (awarded only to individuals);
- Certificate of Merit from the Prime Minister.
For collectives and individuals with particularly outstanding achievements, they will be considered for higher forms of recognition by the State.
Article 5. Amount of monetary awards:
- Collectives and individuals awarded Certificates of Merit from the Minister of Labor, Invalids and Social Affairs and the Prime Minister shall be entitled to monetary awards according to Circular No. 25/2001/TT-BTC dated April 16, 2001 of the Ministry of Finance.
- Medal for the Cause of Labor, Invalids, and Social Affairs: Award amount: 200,000 VND.
- Certificate of Merit from the Director of the Overseas Labor Management Department:
+ Individual award amount: 100,000 VND;
+ Collective award amount: 300,000 VND.
+ Amount of award: three hundred thousand VND for the collective.
Article 6. Sources for award expenses: derived from the award fund allocated by the competent authority within the annual budget estimate.
Article 7. Procedures and documents for award recommendations:
1. The procedures and documents for recommending the Director of the Overseas Labor Management Department to award workers and experts include:
- A recommendation letter from the Head of the Overseas Labor Management Unit (or Section) with comments from the Ambassador (or head of the representative office) of Vietnam abroad (attached with the individual's achievement record);
- A document from the Vietnamese enterprise directly sending and managing the workers during their work period abroad (attached with the individual's achievement record);
2. The procedures and documents for recommending the Ministry to award:
a) Individuals and groups:
- A report from the Director of the Overseas Labor Management Department;
- A list of individuals and groups recommended for awards;
- An award recommendation letter from the head of the unit with comments from the direct superior management;
- A summary report on achievements of individuals and groups confirmed by the head of the unit;
- An endorsement document from the People's Committee of the province or centrally governed city (for groups and individuals from localities); from Ministries, Committees, and Sectors (for groups and individuals from central agencies).
b) For labor export enterprises and experts, in addition to the procedures stipulated in point a above, there must also be:
- Confirmation of compliance with obligations and policies during the award review period.
3. The procedures and documents for recommending the Prime Minister to confer Commendation Certificates according to Decree No. 56/1998/NĐ-CP of the Government.
4. For foreign groups and individuals:
- A report from the Director of the Overseas Labor Management Department;
- An award recommendation letter from a Vietnamese enterprise sent to the Overseas Labor Management Department detailing the contributions of the foreign partner group or individual and the proposed form of award;
- An assessment document from the Vietnamese agency in the host country.
Article 8. Time for award consideration:
- Awards are given at the end-of-year, five-year, and special topic reviews on labor export.
- The Ministry's receipt period for award applications: From December 1 to January 31 of the following year.
- Groups and individuals with outstanding achievements will be considered for immediate awards upon recommendation by the Director of the Overseas Labor Management Department.
Article 9. The Director of the Overseas Labor Management Department is responsible for guiding, inspecting, receiving, perfecting award application documents submitted to the Ministry, and organizing commendation activities in accordance with this regulation./.
