BASED ON THE STANDARDS AND TECHNICAL REGULATIONS LAW dated June 29, 2006, and THE AMENDMENT AND SUPPLEMENTATION LAW OF CERTAIN PROVISIONS OF THE STANDARDS AND TECHNICAL REGULATIONS LAW dated November 20, 2018;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Law on Management and Use of Weapons, Explosive Materials, and Supporting Tools dated June 20, 2017 and the Law Amending and Supplementing Certain Provisions of the Law on Management and Use of Weapons, Explosive Materials, and Supporting Tools dated June 20, 2017; Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing certain provisions of the Law on Standards and Technical Regulations; Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
The Minister of Public Security issues this Circular to issue National Technical Regulations on safety in production, business, storage, use, and disposal of fireworks and explosive fireworks; List of fireworks and explosive fireworks; Detailed list of HS code for fireworks and explosive fireworks.
1. Amending and supplementing Clause 2 and Clause 3 of Article 3 as follows:
1. National Technical Regulations on safety in production, business, storage, use, and disposal of fireworks and explosive fireworks, code QCVN 04:2021/BCA and appendices accompanying the regulations, including: Fireworks and explosive fireworks storage warehouse file (Appendix A); Technical requirements and testing methods for fireworks and explosive fireworks (Appendix B).
Article 1. 1. National Technical Regulation on Railway Traffic Signals, number QCVN 21:2025/BXD.
2. List of fireworks and explosive fireworks specified in Appendices C and D.
3. Detailed list of HS code for fireworks and explosive fireworks specified in Appendix E.
1. National Technical Regulations on safety in production, business, storage, use, and disposal of fireworks and explosive fireworks issued together with this Circular shall take effect from March 1, 2022.
Article 2. Effective Date
2. List of fireworks and explosive fireworks specified in Appendices C and D and detailed list of HS code for fireworks and explosive fireworks specified in Appendix E issued together with this Circular shall take effect from March 1, 2022.
For fireworks and explosive fireworks products produced or imported before the effective date of these Technical Regulations, any remaining stock shall be subject to safety measures in business, storage, use, and disposal according to the provisions of these Technical Regulations upon their coming into effect.
1. The Director of the Administrative Police Management Department is responsible for guiding, inspecting, and urging the implementation of this Circular; based on practical needs, coordinating with relevant agencies and organizations to review and report to the Minister of Public Security for consideration and decision on amending and supplementing the list of fireworks and explosive fireworks; detailed list of HS code for fireworks and explosive fireworks.
Article 3. Responsibility for Implementation
2. Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Chief of Municipal Police Departments directly under the central government, and related organizations and individuals are responsible for implementing this Circular./.
2. The heads of units under the Ministry of Public Security, the Directors of Public Security for provinces and centrally governed cities, and related organizations and individuals shall be responsible for implementing this Circular./.
