Article 1. Scope of Regulation and Applicability
Article 1. This Decree guides the implementation of Resolution No. 49/2013/QH13 dated June 21, 2013 of the National Assembly on extending the term of land use for annual crop cultivation, aquaculture, and salt production land of households and individuals.
Article 2. The subjects to which this Decree applies include:
a) State management agencies responsible for land management and organizations and individuals related to land management;
b) Households and individuals directly engaged in agricultural production, aquaculture, salt production, and other organizations and individuals related to land use.
Article 3. Cases eligible for extension of land use period
1. Households and individuals currently using land for annual crop cultivation, aquaculture, and salt production that were allocated by the State pursuant to Decree No. 64/CP dated September 27, 1993 of the Government promulgating the Regulations on Allocation of Agricultural Land to Households and Individuals for Long-Term Stable Use for Agricultural Production Purposes; Decree No. 85/1999/NĐ-CP dated August 28, 1999 of the Government amending and supplementing certain provisions of the Regulations on Allocation of Agricultural Land to Households and Individuals for Long-Term Stable Use for Agricultural Production Purposes and adding the allocation of salt production land to households and individuals for long-term stable use; Decree No. 181/2004/NĐ-CP dated October 29, 2004 of the Government implementing the Land Law.
2. Households and individuals who fall under the category of agricultural land allocation as stipulated in Clause 1 of this Article and are currently using land for annual crop cultivation, aquaculture, and salt production that have been recognized as having land use rights within the allocated agricultural land limit; received through transfer, gift of land use rights within the limit of transferred agricultural land use rights from households and individuals; inherited land use rights according to the law.
Article 4. Implementation of rights by households and individuals whose land use period has been extended
1. Households and individuals using land for annual crop cultivation, aquaculture, and salt production whose land use period has been extended in accordance with this Decree shall implement their rights in accordance with the Land Law 2003.
2. Procedures and formalities for implementing the rights of conversion, transfer, lease, inheritance, gift of land use rights, mortgage, and capital contribution with land use rights according to current land laws.
Article 4. Effective date
Article 5. This Decree takes effect from October 15, 2013.
Article 6. The Ministers, Heads of ministerial-level agencies, Heads of agencies attached to the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
