Amending and supplementing the List of Narcotics and Precursors

issued together with Decree No. 82/2013/NĐ-CP dated July 19, 2013

of the Government on lists of narcotics and precursors

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Prevention and Control of Narcotics dated December 9, 2000 and the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics dated June 3, 2008;

Pursuant to the Law on Trade dated June 14, 2005;

Pursuant to the Drug Law dated June 14, 2005;

The Government issues this Decree amending and supplementing the list of narcotic substances and precursors promulgated together with Decree No. 57/2022/NĐ-CP dated August 25, 2022 of the Government stipulating the lists of narcotic substances and precursors.

At the proposal of the Minister of Public Security,

The Government promulgates this Decree amending and supplementing the List of Narcotics and Precursors issued together with Decree No. 82/2013/NĐ-CP dated July 19, 2013 of the Government on lists of narcotics and precursors.

Article 1. Amending and supplementing the List of Narcotics and Precursors issued together with Decree No. 82/2013/NĐ-CP dated July 19, 2013 of the Government on lists of narcotics and precursors as follows:

1. Adding substances to List II "Narcotics Used Restrictedly for Analysis, Testing, Scientific Research, Criminal Investigation, or in the Medical Field as Prescribed by Competent Authorities" as follows:

2. Adding substances to List IV "Precursors" as follows:

3. Amending the note under the lists of narcotics and precursors as follows:

a) Amending the note under List I, List II, and List III to read "This list includes all salts and derivatives that may exist of the substances mentioned above."

b) Amending the note under List IV to read "This list includes all salts that may exist of the substances mentioned above except hydrochloric acid salts and sulfuric acid salts; these salts are prescribed by the relevant ministry."

4. Renaming List III to "Narcotics Used for Analysis, Testing, Scientific Research, Criminal Investigation, or in the Medical Field as Prescribed by Competent Authorities."

Article 2. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree.

Article 3. Effectiveness

This Decree takes effect from February 1, 2016.

Article 4. Transitional Provisions

Organizations and individuals engaged in the business of APAAN and GBL precursors shall comply with the regulations on precursor management under this Decree and related documents from July 1, 2016./.
